1991/04/09 City Council MinutesRohnert Park City Council Minutes April 9, 1991 The Council of the City of Rohnert Park met this date in regular session commencing at 7:00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Eck presiding. CALL TO CRDER Mayor Eck called the regular session to order at approximately 7:16 p.m. and led the pledge of allegiance. Mayor Eck advised that a closed session commenced this evening at 6:30 p.m. to discuss personnel matters, real estate negotiations regarding a site on Redwood Drive, and two litigation matters, specifically, the Expressway Mall lawsuit and the mobile home rent control matter. He said no action was taken and there was nothing to report at this time. ROLL CALL Present: (4) Councilmembers Hollingsworth, Reilly, Spiro and Mayor Eck Absent: (1) Councilman Hopkins (Out of town attending a conference) Staff present for all or part of the meeting: City Manager Netter, City Attorney Flitner, Assistant to the City Manager Leivo, Planning Director Skanchy and City Engineer Brust. Approval of Minutes Upon motion by Councilmember Spiro, seconded by Councilman Hollingsworth, the minutes of March 26, 1991 were unanimously approved as submitted. Approval of Bills Upon motion by Councilman Hollingsworth, seconded by Councilman Reilly, and unanimously approved, the bills presented per the attached list in the amount of $1,195,187.50 were approved. Non- agendaed Mayor Eck queried if any Councilmember had any non- agendaed Matters items to add to the agenda. Mayor Eck said he would like to bring up a matter recently acted on by the Planning Commission under Matters from Council. Councilman Hollingsworth said he would like to share contents of a recent newspaper article regarding wireless cable under miscellaneous Matters from Council. Councilmember Spiro said she had items to add under Matters from Council regarding the Senior Commission and requesting Council's approval to be on other commissions of which she is specifically interested. Rohnert Park City Council Minutes (2) April 9, 1991 thschediled Public %yor Eck stated that in compliance with State Law (The Brown Appearances Act), anyone in the audience who wished to make a comment may do so at this time. In most cases under legislation of the new Brown Act, the Council cannot handle an item without agendizing. To ensure accurate recording, "Speaker Cards" are provided at the entrance of the Chamber and unscheduled public appearances are requested to fill out the cams and present to recording clerk after speaking. Donna Hecker Donna Hecker, 355 Bonnie Avenue, referenced tonight's agenda item regarding property abatement notice of building located at 7608 Blair Avenue and said there were three or four residents at tonight's meeting who would like to comment on this matter. Mayor Eck said time would be allowed for a few public comments at the time of review for this item. Ronald Shaw Ronald Shaw, 667 Bernice Avenue, requested Council support of Proposition 98 by resolution and distributed copies to Council of proposed resolution with attached sheet entitled Revenue Enhancements and shared the contents therein. He expressed concerns regarding the need to stabilize public school funding in California as well as funding for other after school activities and said we need to support our children as an investment in our future. Mayor Eck referenced the May 1st deadline to establish support of Proposition 98 and said there would be sufficient time for this item to be put on the next Council agenda. He said Council wants to support funding for schools, that he had read some conflicting information regarding the restriction of funds through this effort, and that it would be advisable to take the time necessary to check into the fiscal effects of Propostion 98. Council expressed appreciation to W. Cincera for the receipts from P. G. & E. George Horwedel George Horwedel, 7669 Camino Colegio, referenced AB 939 and proposed that the County buy some land for a conpost dump or pile where people could pick up conpost, when degraded, free or at a low cost. He also asked, because of the possible time change of the Council meetings, if time could be allotted after 7:30 for those arriving late and who might want the opportunity to speak. Mayor Eck said anyone could speak at the Unscheduled Public Appearance time at the end of Council meetings regarding any item on the agenda, and moving that allotted time from the end of the meeting to some other time slot on the agenda may be considered. Rohnert Park City Council Minutes (3) April 9, 1991 Ann Petty Ann Petty, 36 Francis Circle, referenced the traffic light at Country Club Drive and Southwest Blvd. near the school and said when the walk signal is pressed there is no left turn arrow for the turning traffic so drivers often continue to proceed on the turn when pedestrians are crossing on the walk signal. She said she was almost hit by a vehicle as she crossed this location today and it made her realize the danger to the many students daily crossing at that light. Director of Public Works Brust confirmed his department would take care of the matter. Rohnert Park City Council Minutes (4) April 9, 1991 Scheduled Public Appearances: AT&T Presentation Pamela Mazzola, representative for A T & T, said over the past several years A T & T has had the opportunity to assist the City of Rohnert Park with telephone systems. The City elected its current system a few years ago which was a new one with A T & T at the time, consequently, the phone company has used it as an exanple to respond to other customer questions. Ms. Nhzzola said A T & T elected the City of Rohnert Park as the model city for its showcase program and presented a plaque to the City of Rohnert Park to acknowledge appreciation and congratulations for the City's participation and cooperation in this program. Mayor Eck accepted the plague on behalf of the Council and expressed appreciation for the acknowledgment. Founders Days Tom Lukas, 1376 Jasmine Circle, and Lewis Kuehm, 1406 Gregory Court, Members of the Founders Days Committee distributed copies to Council of 1991 budget for Rohnert Park Founders Days. Mr. Lukas reviewed changes from previous years and said Founders Days were scheduled for September 21 and 22 this year. He requested funding of $5,000 with an advance for initial expenses to be applied against these budget funds in fiscal year 1991 -92. Discussion followed confirming appreciation for Founders Days and the efforts of the Committee. Council reviewed procedures of previous years in regard to advancing initial expenses in preparation of Founders Days events. A motion was made by Councilman Hollingsworth, seconded by Councilmember Spiro, and unanimously approved, to advance funds for initial expenses as requested by the 1991 Founders Days Committee in increments as needed up to $5,000. Crdinance No. 534 AN ORDINANCE AMMOING CHAPTER 2.08, CaJWIL PROCEDURAL RULES OF THE CITY OF ROHNERT PARK City Manager Netter explained that Ordinance No. 534 was intrucuu%au at the Council meeting in regard to changing the starting time of the regular scheduled Council meetings from 7:00 p.m. to 6:00 p.m. and changing adjournment time from 11:00 p.m. to 10:00 p.m. Amendment of Chapter 2.08 of the Rohnert Park M,inicipal Code is necessary to make this change. Mr. Netter reviewed a minor additional change as outlined in Section 2 of the ordinance directing the City Nhnager to deliver Council packets on Thursday preceding the Tuesday Council meetings instead of on Wednesday preceding Council meetings to allow an extra day to finalize agendas. He said a public hearing is scheduled at this time to solicit citizen input on this matter and that a news release and public notice had been published in the local newspaper regarding same. Rohnert Park City Council Minutes (5) April 9, 1991 Discussion followed during which Council agreed it would not be necessary to change the Council packet delivery date since leniency is always granted whenever necessary. Public Hearing Mayor Eck opened the public hearing at approximately 7:36 p.m. Linda Branscomb Linda Branscomb, 21 Anne, supported changing times to start an hour earlier and said she encourage citizen participation and allow more of interest to the public. Council meeting felt it would time for items There being no one further desiring to speak, Mayor Eck closed the public hearing at approximately 7:38 p.m. Upon motion by Councilman Hollingsworth, seconded by Councilmember Spiro, and unanimously approved, to leave packet delivery day on the Wednesday preceding Council meetings, Ordinance No. 534 was adopted. City Manager Netter said this ordinance becomes effective thirty (30) days after adoption and, therefore, the time change to begin Council meetings at 6:00 p.m. will start on May 14th, 1991. Mayor Eck received confirmation from City Attorney Flitner that during the thirty day interval for the new ordinance to be in effect, Council could still start the meetings at 6:30 p.m. by adjourning to the desired time. Mayor Eck said tonight's meeting would be adjourned to 6:30 p.m. for closed session on April 23rd with the regular session starting at the established time of 7:00 p.m. He confirmed to Council inquiry that the May 28th Council meeting would be held even though the previous day is a holiday. Ordinance No. 535 AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING TITLE 16 TO THE ROHNERT PARK MUNICIPAL CODE TO ADD CHAPTER 16.56 TO PROVIDE FOR INDEMNIFICATION TO THE CITY IN CERTAIN APPROVALS City Manager Netter explained the ordinance for introduction. Goverment Code Section 66474.9 authorizes a public agency to require a developer to indemnify a public agency for litigation challenging approval of tentative maps, parcel maps, or final subdivision maps. This ordinance would authorize the City to require the developer to indemnify the City should its approval be challenged in court. Upon motion by Councilman Hollingsworth, seconded by Councilman Reilly, and unanimously approved, Ordinance No. 535 was introduced. Parks & Recreation Ccandssion matters: i)R.P.Babe Ruth Bain- City Manager Netter referenced copies provided to Council of bino Baseball,Inc. letter dated March 26, 1991 from Marc Hayman, President of Rohnert Park Babe Ruth Bambino Baseball, Inc. thanking the Rohnert Park City Council Minutes (6) April 9, 1991 City for various improvements that have been completed or are in the process of being completed in the many fields throughout the community. Petitions signed by approximately 340 residents were also attached to the letter supporting the improvements as well as requesting lights and an outfield fence in the p 1 anned M section park which is current 1 y under design by the landscape architects. The nulti -use playing fields as approved by Council in Phase I included lighting, but because the fields would also have to be used for soccer, a permanent outfield fence would not be allowed. Recreation Director Pekkain has advised that installation of a portable fence could be a possibility but there would be no way to have a warning track that would work. Previous discussions with the City's insurance carrier, PZ,,ffF, established that warning tracks are a necessity in order to avoid injury to ball players prior to reaching the fence. A new portable fence that collapses avoiding injury is being researched. Mr. Netter explained that if a portable fence is allowed, staff recommends that RIIvEF prepare an evaluation regarding potential insurance risk. He requested Council's approval to forward this information by letter to Rohnert Park amino Baseball President Marc Hayman. Council concurred. 2)M.iltiple Sports City Manager Netter referenced copies provided to Council of Carplex /Proposed letter dated March 20, 1991 from Jay Potter, Chairmen of Parks and Recreation Commission regarding the formation of an ad hoc committee to discuss the feasibility of a multiple sports complex being built within the city limits. Mr. Netter referenced more complete details reviewed in tonight's Council Nbeting Nbmo and said Mr. Potter is requesting feedback on this matter prior to the next Parks and Recreation Commission meeting on April 15, 1991. He said this matter was previously discussed briefly by Council but concluded it was premature until such time as a funding program could be worked out. Mr. Netter said it is staff's recommendation to respond by letter to Chairman Potter that the proposed multiple sports complex is a good idea but the formation of an ad hoc committee is still premature. Discussion followed during which Council concurred that this type of project should be done as soon as feasible but financial status and other priorities need to be fully reviewed prior to recomwnding any proposed project. Golf Course Drive City Manager Netter referenced copies provided to Council of Sidewalk/Bikepath letter dated March 16, 1991 from Tom Murphy, 129 Francis Circle, requesting the construction of a walk /bikepath on the south side of Golf Gourse Drive. Several benefits of such a path were listed in Mr. Marphy's letter including the possibility of golf cart use. Mr. Netter said Council had discussed this location for a bikepath in the past but approval has not been made to date. Rohnert Park City Council Minutes (7) April 9, 1991 Discussion followed during which Council expressed concerns regarding the use of golf carts on the proposed path as well as the dangers of occasional golfball shots. Comments were made regarding the eventual proposed four lane road at this location that will make it necessary to install a sidewalk where the other road leaves off, resulting in Council suggestion that it would be advisable to leave it the way it is for now. Mayor Eck said a letter of response should be written to Mr. Mnphy regarding the above- mntioned comments as well as the fact that the City currently has a fairly substantial bikepath plan to conplete and that this project would be low priority, but the City would consider it in the future. Council agreed. Resolution No. A RESOLUTION OF THE CITY COLUCIL OF THE CITY OF ROHNERT PARK 91-81 IIWORSING THE CONCEPT OF FORMING A JOINT POWERS AUTHORITY TO IMPL94M ELEMIIV'1'S OF THE AB939 (SOLID WASTE REDUCTION) PLAN City Manager Netter explained the resolution. Upon motion by Councilman Hollingsworth, seconded by Councilmenber Spiro, and unanimously approved, reading of Resolution No. 91 -81 was waived and said resolution was adopted. C ununity Outreach on City Manager Netter said he would like to defer this item Youth & Families(ODYF)regarding Community Outreach on Youth & Families (COYF) until the Council Committee and staff has had time to finalize the report to be distributed to the full Council. Planning & Zoning: Planning Director Skanchy said copies were provided to Council File No. 1467 of Planning Staff Report dated March 28, 1991 regarding File No. 1467 and shared contents therein recommending that the Zoning Ordinance be amended to allow rehabilitation schools, instructional facilities for recovering substance abusers within the "C -G" (General Commercial District) as a Conditional Use. This would also require an amendment to the "ML" (Limited Industrial District) which would amend the M, (Limited Industrial District) to allow all uses permitted in the CG District, both under permitted and conditional uses. Planning Director Skanchy said at present, the Zoning Ordinance allows all permitted uses in the "CG" District within the "ML" District subject to a Conditional Use Permit. This was an oversight when the Ordinance was originally amended. In order to correct this omission, staff recom ended that the ML, District be amended to allow the conditional uses listed in the CG District and as a Conditional Use in the NL District. Also to amend the Zoning Ordinance to allow rehabilitation schools and instructional facilities for recovering substance abusers, subject to a Conditional Use Permit in the CG District. W. Skanchy said the Planning Commission adopted Resolution 91 -07 at its meeting of March Rohnert Park City Council Minutes (8) April 9, 1991 28, 1991 recommending the City Council hold the appropriate public hearing to amend the Zoning Ordinance to allow the above - mentioned modifications. He said copies were provided to Council of the ordinance for introduction and that a public hearing has been scheduled at this time regarding same. Discussion followed during which Mr. Skanchy responded to Council inquiry regarding restrictions on schools for substance abuse programs, that this was the type of program referred to, and the conclusion that it would be better to amend the ordinance than to stretch it. Public Hearing Nayor Eck opened the public hearing at approximately 7:50 p.m. There being no one desiring to speak, he closed the public hearing. Ordinance No. 536 AN ORDINANCE OF THE CITY OF ROHNERT PARK ANEMING THE ROHNERT PARK MINICIPAL CODE, TITLE 17.18.150 PARAGRAPH H TO READ "ALL USES" PERMITTED UNDER SECTION 17.16.160 AND SECTION 17.16.120 AND TO AMEND SECTION 17.16.120 BY ADDING PARAGRAPH W Upon nation by Councilmember Spiro, seconded by Councilman Reilly, and unanimously approved, reading of Ordinance No. 536 was waived and said ordinance was introduced. Step into the Future City Nbnager Netter referenced copies provided to Council of letter dated March 12, 1991 from Public Safety Director Dennett regarding a reception by the Department of Public Safety for the "STEP into the Future" program which offers adult and teen self - esteem programs on Friday, April 19th, 1991 at 5:30 p.m. at the Burton Avenue Recreation Center. He also informed Council that Congressman Frank Riggs and other officials would be attending. Mayor Eck said he had a conflict in his schedule and would be unable to attend this reception. Vice Mayor Spiro confirmed she would be able to attend. Abatement re. City Engineer Brust shared contents of above - referenced mew and said the Abatement Notices were posted on the property and mailed to the owner, Mr. Peter G. Kerston on February 27, 1991. The Notice and Order note that the building located at 7608 Blair Avenue is in a hazardous, dilapidated and deteriorated state and is an unsafe building. The building was ordered to be vacated immediately (the property is a rental property and no tenants reside at the property) and that repairs to the building to bring it up to code standards would cormmnce seven (7) days from the date of the Notice. W. Kerston spoke with City Engineer by phone and indicated he would clean up the property by March 22, 1991, however, no Rohnert Park City Council Minutes (9) April 9, 1991 activities have been performed on the property to this date. City Engineer Brust said W. Kerston phoned again today and advised that he was ill and would be unable to attend tonight's City Council meeting but a contractor has been hired to begin work on the referenced property tomorrow and would be at the Council meeting to confirm this. Joe Farrell Joe Farrell, Contractor, 445 Pheasant Lane, Santa Rosa, confirmed to Council that Peter Kerston had contacted him today regarding improvements on the building at 7608 Blair Avenue and said he would be able to begin work tomorrow. !Mayor Eck said the only action of Council regarding this matter would be to direct staff to proceed with the abatement process and that specifics would be worked out between the property owner and City Engineer. City Attorney Flitner said, if it is necessary to proceed with abatement process, it would be advisable to hold a public hearing regarding the matter even though the Lhiform Code does not specify such a requirement. He shared the example of complications involved with a recent similar case in Petaluma, acknowledged the residents at tonight's Council meeting desiring to express concerns regarding this particular matter, and said the property owner should be afforded the opportunity of a public hearing since he will be out the money for the improvements as well as the need for the City's protection to receive public input prior to proceeding. Mr. Flitner confirmed to Council inquiry that the two week interval between now and next Council meeting would be sufficient notice for the public hearing. Discussion followed during which Council agreed that a public hearing should be held regarding this matter as advised by the City Attorney. Council encouraged residents at tonight's meeting to hold documentation for presentation regarding this matter until the public hearing at the next Council meeting. Mayor Eck consented to allow a few responses from the residents regarding this property abatement notice. Donna E. Hecker Donna Hecker, 355 Bonnie Avenue, said this property is not an isolated instance of neglect by this property ocaner and he should not be trusted. She shared pictures with Council of two other houses in her neighborhood in the same or worse dilapidated condition owned by the same property owner located at 7512 Blair Avenue and 359 Bonnie Avenue. She urged Council to also look at these and recommended some- thing be done to prevent devaluation of the neighboring properties as well as protect the children in the neighborhood from potential dangers due to the hazardous conditions of the properties such as poisons and broken glass on the grounds. Rohnert Park City Council Minutes (10) April 9, 1991 Larry Harris Larry Harris, 7536 Blair Avenue, asked for clarification of the abatement proceedings. He said the neighboring properties have declined in value because of the deterioration of these properties mentioned tonight and that the owner needs to be under the gun even though he has secured a contractor to begin working tomorrow on the 7608 Blair Avenue building. Mayor Eck said the frustrations expressed tonight by residents are understandable. He said the chances are nuch greater of accomplishing what needs to be done without repercussions or unnecessary expense to taxpayers, such as potential court costs by taking an additional two weeks time for the scheduling of a public hearing to ensure proper and legal procedures. City Engineer Brust responded to inquiries regarding abate- ment procedures, scheduling of public hearings and printing of notices. Vicki Roberts Vicki Roberts, 394 Bonnie Avenue, said she is a neighborhood homeowner as well as a realtor, that tonight's referenced property owner is also a realtor with several properties in the County and Rohnert Park who charges exorbitant rents for properties she has entered herself and would not show to others because of the unfit living conditions, and that the concerns expressed tonight are asking what is going to prevent these properties from being in the same dilapidated state a year from now. Tom Biasotti Tom Biasotti, former tenant at 7512 Blair Avenue, said he had filed a lawsuit against tonight's referenced property owner regarding the Blair Avenue property he had to vacate, that the owner owns thirty -three other properties in Rohnert Park in deteriorated condition, and that Council should also investigate all of these properties. Discussion followed. RECESS NUyor Eck declared a recess at approximately 8:25 p.m. RFXXzaq dC Mayor Eck reconvened the Council meeting at approxi- mately 8:35 p.m. with all Councilmembers present except Councilman Hopkins. So.Co.Trans.Author. City Manager Netter referenced the recent Sonoma County Transportation Authority meeting attended by Councilman Hopkins and City Engineer Brust. He said discussion commenced on the possibility of hiring a part time Executive Director for the Authority. The Personnel Subcommittee is recomrLending this position and is now soliciting comments from City Rohnert Park City Council Minutes (11) April 9, 1991 Councils regarding approval or disapproval of this action. W. Netter said that staff feels it is premature to hire a part time Executive Director, that a County staff person is now handling the duties involved, and recommended a letter be written under the Mayor's signature to the Transportation Authority expressing this opinion with the statement that Rohnert Park will pay its fair share when the time does come to fill this position. Council concurred. Mayor Eck said the Highway 101 Corridor Committee meeting will be held tomorrow, April 10, 1991 and that he and Councilman Hollingsworth are the City's representatives on this committee. He said he would be able to attend the meting. Caltrans Draft Study City Manager Netter referenced map on display and said copies were provided to Council of letter dated February 27, 1991 from California Department of Transportation with attached Caltrans Draft Project Study Report (PSR) for widening Highway 101 to six (6) lanes from Highway 116 through the Wilfred Avenue Interchange. The report is very important for the City in the future when Caltrans is able to direct funding for the widening of U.S. 101 within the boundaries of the Rohnert Park city limits. City Engineer Brust reviewed basic development outline involving widening U.S. Highway 101 to six (6) lanes plus acquiring right of way for eventual eight (8) lanes, referenced map on display and shared contents within the above - referenced Caltrans report pointing out critical areas needing particular attention including the Expressway overpass, State Farm Drive crossing and ultimate inprovements at Wilfred Avenue which include the new construction of that crossing as well as a different configuration for on and off ramps to U. S. 101 Highway and Santa Rosa Avenue. Mr. Brust responded to various Council questions and confirmed that the purpose of the report is to receive input from the elected officials and staff for any recommended changes that may be necessary in the proposals afterwhich the draft document will be updated and become a working document. Discussion followed resulting in Council input as follows: Highway 116 develop north bound ramp through Windmill property rather than along Commerce Blvd.; retain Mitchell Building with a T intersection at Southwest Blvd. and Commmerce Blvd.; pedestrian overcrossing at Copeland Creek; ultimate improvements at Rohnert Park Expressway Interchange with second commter parking lot in the northeast corner; crossing at State Farm Drive and Business Park Drive; major change in alignment of Commrce Blvd. at Wilfred Interchange by moving Connerce to intersection with Roberts Lake Road; the ramps at Santa Rosa Avenue should be eliminated with a connection made from Santa Rosa Avenue to Millbrae Avenue with City Engineer's confirmation to leave the southbound ramp to U.S.101 south; Rohnert Park City Council Minutes (12) April 9, 1991 possible elimination of a portion of the comaa.ter ride lot was acknowledged due to Caltrans relocation considerations that would be approximately 100' west; and confirmation that ultimate traffic would go under freeway at Golf Course and Wilfred connection. Council concurred to have a letter sent to Caltrans with the City's recomrended changes. Council Commmittee Reports: la)Interim Housing Committee Members Eck and Reilly updated the Council on Task Force Aug. efforts regarding the Interim Housing Task Force. Mayor Eck referenced copies provided to Council of minutes from the first meeting of the Interim Housing Task Force held on April 2nd, 1991. He said Dawna Gallagher was appointed Chain and Catherine Crotty was appointed Vice Chairman. The committee decided to hold its meetings at 7:00 p.m. on the first and third Tuesdays of each month. Council Committee Nbmber Reilly reviewed concerns expressed regarding handicapped /special needs housing and suggested Dr. Barbara Heath of Santa Rosa serve as an ex- officio member. He said one of the assignments the committee has been asked to look into is the special needs housing. Discussion followed during which City Attorney Flitner responded to Council questions regarding possibilities for the upcoming appeal on the environmental illness housing request and confirmed this situation would be a legitimate moratorium until the issue is researched in more depth. Further consid- erations of Council concluded that rather than overturn the Planning Commission's decision regarding this item, it should at least be deferred until the Interim Housing Task Force Committee presents recommendations on special housing needs. City Manager Netter said this item will be scheduled at the next Council meeting. 1b) Appointment to Councilman Hollinggworth said he received word that his Interim Housing recommendation to the Interim Housing Task Force was not able Task Force to consider the appointment. He requested staff to advertise the opening and specify the interest of having someone with special needs on the committee. Council agreed. 1c) "Bring America City Manager Netter referenced copies distributed to Council H(Mes campaign of letter dated April 3, 1991 from t kited States Conference of Mayors urging participation in the "Bring America HOME" postcard canpaign which is the HONE program authorized in the Cranston - Gonzalez National Affordable Housing Act of 1990. He said the deadline for sending the postcards to the congressional members is April 24th for affordable housing Federal funding support. A motion was made by Councilman Hollingsworth, seconded by Councilmember Spiro, and unanimously approved, directing staff to respond by letter under the Mayor's signature to the U. S. Conference of Mayors signifying Council support of the "Bring America HOME" postcard canpaign for affordable housing. Rohnert Park City Council Minutes (13) April 9, 1991 2) Perf.Arts Center City Manager Netter said that he and Performing Arts Center Ltdate Comnittee Nbmbers corprised of Mayor Eck and Vice Mayor Spiro met to discuss items related to the Performing Arts Center including the Center's first year's operations and its 1991 -92 budget. He said more time is needed for the Council Committee to finalize discussions and review directions prior to submitting recommendations to the full Council. Council Committee agreed to meet next Tuesday, April 16, at 4:00 p.m. Coamaiications Communications per the attached outline were brought to the attention of the City Council. No action was taken unless specifically noted in these minutes. City Manager's Report:City Manager Netter referenced copies provided to Council of So.Co.Brd.of Super- Sonoma County Board of Supervisors Resolution No. 91 -4084 visors /Open Space appointing members to the Open Space Advisory Committee °Advisory Committee pointing out the appointments of Patti Hilligoss /2nd District, Ben Collins /4th District, and Ann Magnie /Fifth District. Mr. Netter said in addition to these appointments, a call was recently received from Supervisor Harberson informing that the Board of Supervisors has also increased the city representation from one (1) member to three (3) members to be selected by the Mayors' and Councilmembers' Association, that it is very crucial for a Rohnert Park representative or two be on the committee to ensure a voice being heard for the protection of open space and comtunity separator around the boundaries of Rohnert Park, and that Council needs to make selection(s) prior to this Thursday's Mayors' and Councilmembers' meeting. Nhyor Eck, Vice Mayor Spiro and Councilman Hollingsworth each signified interest to be a representative on the Open Space Advisory Committee depending on meeting times. Perf.Arts Catr.Tour City Manager Netter said Senator Mike Thompson and his staff by Senator Thcnpson toured the Performing Arts Center on Saturday, April 6th, during which compliments of approval were extended. Mr. Netter said he had the opportunity to discuss SB169 with Senator Thonpson and reviewed the Senator's reasons not to support this Senate Bill which included the Governor's previous allocation of funds. Mr. Netter is therefore not recommending that representatives of cities attend the upcoming briefing conference as previously suggested since Senator Thonpson will not budge on this item. City Logos City Manager Netter referenced examples for Council's observation and reviewed the three new street signs with sweet pea insignia located at the intersections of Commerce Blvd. /Avram, Enterprise Drive /State Farm Drive, and Enterprise Drive /Seed Farm Drive. Mr. Netter said staff is bringing this to Council's attention for recomrendations and input regarding the sweet pea design on the signs as well as consideration to eventually install the new signs with the sweet pea logo throughout the City. Rohnert Park City Council Minutes (14) April 9, 1991 Council agreed to observe the signs at the referenced locations and suggested it would also be appropriate to plant sweet peas in various locations of staff's choice throughout the City. Clean -up Week City Manager informed Council that representatives of Enpire Waste Management have confirmed yard waste bins will be provided during Clean -Up Week, April 5 through 14. He confirmed to Council inquiry that the Department of Public Works will be involved with this effort. In response to the possibility of extending the clean -up effort for another week, he said ten days are allocated to each city by the County for free dumping charges. The City maximizes these free days by using two weekends within the ten day period. Discussion followed. 1991 So.Co.Alliance City Manager Netter reference copies provided to Council of Annual Report & 1991 Sonoma County Alliance Annual Report and said it is very Supervisorial Dists. informative containing maps of the supervisorial, senatorial and assembly districts as well as a complete roster of all governmental agencies and other agencies throughout the county. Mr. Netter referred to map on display regarding the supervisorial districts for the City and a detailed map showing which supervisor is assigned to each section of the City. The City is represented by three (3) supervisors and the goal is for Rohnert Park to eventually be represented by one (1) supervisor. Discussion followed. A motion was made by Councilman Hollingsworth, seconded by Councilmember Spiro, and unanimously approved, to recommend including Rohnert Park in one district ( Rohnert Park being the largest City in the district) or at least having Rohnert Park in the third supervisorial district. Elderly Partnerships City Manager Netter referenced copies provided to Council of Myors Awards Program-letter dated March 15, 1991 from Lhited States Conference of Mayors regarding Partnerships With and For the Elderly/The Fourteenth Annual Mayors' Awards Program. He said in regard to the City's new Senior Center, it was premature for the City to make application to participate in this year's Mayors' Awards Program, but recommended putting a tickler on file to participate next year. Council agreed. Rohnert Park City Council Minutes (15) April 9, 1991 Public Safety Facility -City Manager Netter said the ground breaking dedication and Dedication & Dinner bond closing dinner is being planned for the new Public Safety Facility and that the preliminary date suggested for Council's consideration and /or approval is Thursday, April 18th at 5:00 p.m. A brief discussion followed regarding possibilities of a barbecue at the site instead of a formal indoor dinner with conclusion that the notice would be too short to consider such a change in plans. Council agreed to the April 18th plans as recommended. Rancho Verde Landlord City Manager Netter referenced copies provided to Council of Petition for Rent Notice of Continuance of Scheduled Hearing by the Rent Appeals In se Board for the Rancho Verde petition to April 25, 1991 at 9:00 a.m, in the City Council Chambers. SW B1vd.Shopping Ctr. -City Manager Netter advised that the owner of Crown Market is not interested is selling the Crown Market site at this time because of current discussions and possibilities with the Post Office. Mayor Eck said the Southwest B1vd.Shopping Center Committee plans to meet again soon regarding further considerations for the Shopping Center. Filming CaYpany City Manager Netter said he had been contacted by a film conpany doing Basic Instincts with Michael Douglas requesting use of Immediate Care Facility and Dr. Don Davis' office for brief filming site because of the rural nature of the area and scenery. Mr. Netter said the filming conpany needs to use the hospital site to park vehicles on April 18th, reviewed various fees of other areas, and recommended a fee of $250 to be put into an endowment fund. Discussion followed during which City Engineer Brust responded to Council inquiry that there would be very little cost to the City to conply with this request since the Irmediate Care Facility is on a dead end street and Public Works would handle security as usual for the area. Council concurred staff should solicit a contribution from the filming conpany for the Performing Arts Center Endowment Fund as consideration for use of the City's site. City Attorney's Report:City Attorney Flitner said he reported on the Mbbile Hone Park case in tonight's closed session which is still scheduled on the same trial base the end of May or f irst of June. With regard to the Price Club matter, there is no change and nothing further to report at this time. Wtters from Council: Mayor Eck reported on recent visit with Assemblymen Dan Hauser Visit with Assembly- attended by himself and Vice Mayor Spiro. He said the items man Den Hauser discussed were primarily based around the State's deficit. Apparently the Proposition 98 linkage does not necessarily and automatically provide for the needed educational funds, therefore the Prop 98 effects to the actual budget need to be checked out more thoroughly prior to supporting it since the Rohnert Park City Council Minutes (16) April 9, 1991 ultimate concern is to support education. Other issues discussed were wastewater piping possibilities, growth management, and mobile home rent control on a statewide basis which, basically, most state legislators say it won't happen. Natl Youth Svc.Day City Manager Netter referenced copies provided to Council of letter dated March 18, 1991 from National Youth Service Day regarding co- sponsorship by The U. S. Giants R.P. Day City Manager Netter said details are still being worked out regarding Giants Rohnert Park Day to promote Crane Melon Festival on August 8, 1991. Rohnert Park City Council Minutes (17) April 9, 1991 Jr.High School Gym Mayor Eck said the Jr. High School Gym Joint Dedication would Dedication be held on Thursday, April 11, 1991 at 7:30 p.m. He requested Vice Mayor Spiro to convey his regrets as he would be unable to attend the dedication and asked her to represent the City. Vice Mayor Spiro agreed. Bette Condiotti Mayor Eck said the Bette Condiotti Theatre Dedication is Theatre Dedication scheduled for Saturday, April 13th, 1991 at 6:00 p.m. Wireless Cable Councilman Hollingsworth referenced a recent newspaper article regarding wireless cable microwave. He said the possibility could give leverage to competition and recommended following UP on it. Miscellaneous Vice Mayor Spiro referenced a flag recently donated to the Senior Citizens to which City Manager Netter responded a flag pole was on order. Vice Mayor Spiro referenced information from California Elected Women's Association for Education and Research (CEWAER) and said she would like to join. Council concurred. Vice Mayor Spiro said she would also like to become a member of the Local Government Commission to which Mayor Eck said he is a member, encouraged Vice Mayor Spiro to participate, shared that the only difference as a member was to qualify for some cost breaks at the conferences, and said the recommendations of this commission have been very environmental regarding recycling and energy. Mayor Eck said he understood that Santa Rosa may be building its own analytical lab at the treatment plant to which City Engineer Brust explained that Santa Rosa's lab right now is very small and cramped and that the plans are to expand the lab but not go to full analytical ability. Mayor Eck requested staff to obtain a copy of Santa Rosa's plans regarding this lab expansion. Mayor Eck said the Cable TV Council Comnittee should meet regarding equipment purchase considerations for cable TV and requested staff to provide a report regarding the details, such as current budget provisions and /or anticipated expense. Mayor Eck asked if further consideration should be given at this time regarding Kathleen Burnham's appeal to which City Manager Netter responded that the appeal has not been filed yet so no action could be taken. City Manager Netter reminded Council of the Sonoma State Lhiversity pool naming ceremony in honor of Dr. Ed Rudloff. The ceremony is scheduled on Friday, April 19, 1991 at 3:00 p.m. at the poolside. Linda Hr'anscanb Linda Branscomb, 21 Anne, (Interim Housing Task Force bmmber) said she agreed with Vice Mayor Spiro that the Housing Task Force could devote some time to things like individual special needs. She asked if the issue regarding the referenced person with the environmental illness were put on hold, would she be allowed to remain at the existing location.
