1991/06/11 City Council MinutesRohnert Park City Council Minutes June 11, 1991 The Council of the City of Rohnert Park met this date in regular session commencing at 6:00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Eck presiding. CALL TO ORDER Mayor Eck called the reqular session to order at approximately 7:00 p.m. and led the pledge of allegiance. Mayor Eck advised that a closed session commenced this eveninq at 6:00 p.m. to discuss the mobile home rent control litiga- tion matter and personnel matters. He said no action was taken and there was nothing to report at this time. ROLL CALL Present: (5) Councilmembers Hollingsworth, Hopkins, Reilly, Spiro and Mayor Eck Absent: (0) None Staff present for all or part of the meeting: City Manager Netter, City Attorney Flitner, Assistant to the City Manager Leivo, City Engineer Brust and Finance Director Harrow Approval of Minutes Upon motion by Councilmman Hollinc_Tsworth, seconded by Councilman Hopkins, the minutes of May 24 & 28, 1991 were approved as submitted. Approval of Bills Upon motion by Councilman Hopkins, seconded by Councilman Hollingsworth, and unanimously approved, the bills presented per the attached list in the amount of $853,423.81 were approved. Non - agendaed Mayor Eck queried if any Councilmember had any non - agendaed Natters items to add to the agenda. Councilman Reilly said he had one miscellaneous item. Lhscheduled Public Mayor Eck stated that in compliance with State Law (The Brown Appearances Act), anyone in the audience who wished to make a comment may do so at this time. In most cases under legislation of the new Brown Act, the Council cannot handle an item without agendizing. To ensure accurate recording, "Speaker Cards" are provided at the entrance of the Chamber and unscheduled public appearances are requested to fill out the cards and present to recording clerk after speaking. Gregorian Paul P. Gregorian, 5739 Davis Circle, referenced copies Provided to Council of his letter dated May 24, 1991, and shared the contents therein requesting reconsideration of a Pooper Scooper Ordinance for both cats and dogs. Attached to his letter was recent Press Democrat article dated May 23, 1991 entitled "Santa Rosa leash law targets cats, too ". Mr. Gregorian shared various examples regarding the inconvenience, nuisance and unsanitary conditions created by negligent pet owners from pet droppings, and said the growth of Rohnert Park merits the necessity of such an ordinance. Rohnert Park City Council Minutes (3) June 11, 1991 Discussion followed during which City Manager Netter said copies were provided to Council of September 11 and October 9, 1990 Council meeting minutes and ordinance previously considered for introduction and tabled at that time. Concerns were expressed regarding the growing nuisance of pet droppings in the cormuinity. Council concluded, if consideration is given to re- introduce a pooper scooper ordinance, recommendations will be needed from the Public Safety Department regarding feasibility of enforcement, as well as give consideration to effective enforcement with the least amount of provocation. A motion was made Councilman Hopkins, seconded by Councilmember Spiro, and unanimously approved, to prepare Pooper Scooper Ordinance for introduction with public comments at the next Council meeting, then to be scheduled for public hearing through adoption stage, if decision is made to proceed. RECESS Mayor Eck declared a recess at approximately 7:15 p.m. in order to proceed with sche< M. ed Connuni t.y Deve 1 opment Agency meeting. REOONVENE Mayor Eck reconvened the Council meeting at approximately 8:00 p.m. with all Councilmembers present. KRCB -TV, Channel 22 City Manager Netter referenced copies provided to Council of letter dated May 23, 1991 from Nancy Dobbs, General Manager of KRCB -TV, Channel 22 requesting Council's consideration to sell the 1.2 acres currently leased by KRCB -TV from the City because it may be an opportune time to find a major donor to assist with the purchase. Discussion followed regarding pros and cons of the City retaining ownership of the land versus selling it, as well as reference to previous Council acknowledgment to KRCB -TV to give consideration to the possibility of selling with the major donor concept. As previously clarified by City Attorney Flitner statement, confirmation was given that such a proposal would have to be in line with current property values because the City cannot gift of public funds. Upon motion by Councilman Hopkins, seconded by Councilman Reilly, with friendly amendment by Councilman Hollingsworth for this matter to be worked in conjunction with staff report on projection of City owned land and potential purposes (lease vs. sale and best use of land), and unanimously approved, staff was directed to work out a proposal with Channel 22 in regard to selling the currently leased land. Rohnert Park City Council Minutes (4) June 11, 1991 Abatement /Action of City Attorney Flitner reported to Council's previous inquiry disrepair properties: regarding property abatements that a property owner can be 1) City Attny Report noticed for several properties at one time if he /she is the legal owner of all properies in question. 2) 7608 Blair Ave. City Manager Netter shared contents of copies provided to Council of memorandum dated June 7, 1991 from Director of Public Works Brust regarding Abatement 7608 Blair Avenue. Since the owner has started meaningful repairs on the property, staff recommends that abatement proceedings be delayed as long as the work continues. Discussion followed during which City Manager Netter and City Engineer Brust responded to various Council questions regarding abatement proceedures and confirming on -going time lines of same, the need for sensitivity to property owners, as well as the necessity of due process. Council concurred to delay abatement proceedings on 7608 Blair Avenue as long as the work continues. 3) 7711 Blair Ave. City Manager Netter said a public hearing has been scheduled at this time regarding abatement of 7711 Blair Avenue. He said copies were provided to Council of the Notice of !'ublic Hearing dated May 29, 1991. Public Hearing Mayor Eck opened the public hearing at approximately 8:19 p.m. City Attorney Flitner swore in all participants of the public hearings scheduled tonight for both abatements. Bill Clark Bill Clark, 7708 Blair Avenue, said the owner of this property has put a facing on the front of the house and has cut about- three-fourths of the grass but hasn't completed the other items. He asked about procedures to assure action on all the needed repairs in a reasonable and timely manner. There being no one further desiring to speak, Mayor Eck closed the public hearing at approximately 8:21 p.m. Discussion followed during which City Engineer Brust responded to Council questions and confirmed that. ha ui -! i +.,i +hc referenced property, that the owner has proceeded with vwork von the interior such as replacing broken windows and a sliding glass door and has completed all the roof work with the exception of installing rain gutters, and that in his opinion repair work has proceeded on this property. He said the Property owner was noticed on June 7th, that the thirty day time line of the abatement continues, and that the City can take necessary action if the repairs do not continue to progress. A motion was made by Councilman Hollingsworth, seconded by Councilman. Hopkins, and unanimously approved, directing staff to continue with the abatement procedures of the 7711 Blair Avenue property. Rohnert Park City Council Minutes (5) June 11, 1991 7512 Blair Ave. City Manager Netter said a public hearing has been scheduled at this time regarding abatement of 7512 Blair Avenue. He said copies were provided to Council of the Notice of Public Hearing dated May 29, 1991. City Engineer Brust said the same thirty day period is running for this property abatement as for the one just previously reviewed. He said the owner has partially removed the damaged area of the roof which was a major portion of it, interior repairs have not started, work has been done on the front lawn including removal of a damaged tree, and the owner says he will continue without delay. Public Hearing Mayor Eck opened the public hearing at approximately 8:24 p.m. Kelly Culver Kelly Culver, 351 Bonnie Avenue, expressed concern regardinq who is watching the construction progress since the owner told neighbors two weeks ago that he would begin repairs but did not start any work until two days ago just prior to this Council meeting. Mr. Culver said he wants the homes to look good for the benefit of the neighborhood and asked if building permits and licensed contractors are required to do the repairs. Bill Clark Bill Clark, 7708 Blair Avenue, asked if building permits and licensed contractors are required for these property repairs and expressed concern about the quality of work being done on the referenced property since he observed a woman and youth working on the project. John Hecker John Hecker, 355 Bonnie Avenue, said he has lived for two years in the vicinity of the referenced properties and expressed frustration toward "letting the system work ". He said he would like to know the time frame for fixing up these properties. Donna Hecker Donna Hecker, 355 Bonnie Avenue, said she agreed with the concerns expressed by her husband and that everyone's house belongs to the owner or their bank, but how it looks belongs to the neighbors. She said two homeowners in the neighborhood lost potential buyers because of the appearance of these neighboring houses. There being no one further desiring to speak, Mayor Eck closed the public hearing at approximately 8:45 p.m. Council responded to concerns expressed by participants of the public hearing confirming that the abatement notice grants thirty days from June 7th, 1991 to the owner to proceed with permits and repairs as outlined in the notice, that the impatience of the neighbors is understood but state law and the state constitution protects property rights, that tonight's action starts the clock ticking aril, therefore, by law, within thirty days action can be initiated, if necessary. Rohnert Park City Council Minutes (6) June 11, 1991 A motion was made by Councilman Hopkins, seconded by Councilmember Spiro, and unanimously approved, directing staff to continue with the abatement procedures of the 7512 Blair Avenue property. 700 Liberty Ave. City Manager Netter said the disrepair of 700 Liberty Avenue property has been brought to staff's attention. Staff is in the process of inspecting the property and this item will be placed on the next Council agenda for review. City Engineer Brust said he will inspect the property and, if necessary, post an abatement notice at that time, therefore, a public hearing could be scheduled anytime thereafter. Discussion followed during which Councilman Hollingsworth suggested that it could be beneficial to have a neighborhood housing work session to review rehab options available to people interested in upgrading their properties. RECESS Mayor Eck declared a recess at approximately 8:50 p.m. RECONVENE Mayor Eck reconvened the Council meeting at approximately 8:58 p.m. with all Councilmembers present. Scandia Fun Center City Manager Netter referenced copies provided to Council of letter dated June 6, 1991 from Scandia Family Fun Center regarding its payment of the 2% semi- annual fee on gross receipts and requesting a phase out program of same. W. Netter explained the background of this fee as outlined in the Council meeting memo. He said Scandia owners now oppose such a fee on gross revenues as no other business is charcred a similar fee. Discussion followed during which the logic as well as the legality of the verbal agreement regarding the 2% fee was reviewed. Cotati-R.P.Uaified City Manager Netter referenced copies provided to Council of School Dist. item: letter dated May 31, 1991 from Cotati - Rohnert Park Unified School District regarding request for water /sewer services and 1) Request for City fire /police protection for the proposed new intermediate Svcs /Snyder Lane school site outside the city limits on Snyder Lane at Keiser proposed site Road. He explained details of this item as outlined in the Council meeting memo and said the School District would like a formal approval from Council regarding this matter so that it Rohnert Park City Council Minutes (7) June 11, 1991 can become part of a complete application submitted to the County of Sonoma for approval. Mr. Netter said Adam Wolf, Assistant Superintendent of the School District was present at the meeting to respond to Council questions. Adam Wolf, Assistant Superintendent of the School District confirmed that he was available to answer Council questions regarding these School District matters. Discussion followed during which City Manager Netter responded to Council inquiry that the City has allowed other outside City service connections specifically to schools, Sonoma State Uhiversity and churches. However, there has never been any outside connections for residential homes or developments. A motion was made by Councilman Hopkins, seconded by Councilman Hollingsworth, and unanimously approved, to grant the City services requested by the School District via development of agreement with City staff outlining details to be presented for Council approval at a later date. 2) Crossing Ga=ds City Manager Netter referenced copies provided to Council of second letter from the School District dated ^e 7, 1991 regarding the next three items on tonight's agenda, specifically, a) Crossing Guards, b) Truancy Specialist, and c) Update on Purchase of "M" Site. He referenced map on the wall and shared contents from Council meeting memo outlining staff research regarding the four existing crossing guard locations, of which the City and the School District split costs, and reviewed proposal cost and location details of two additional locations. This proposal would add an expense of $3,500 to the City's budget, or a total of $10,500 for the current and proposed additional crossing guards program. He indicated that the crossing guard program was approved for one year only and that Council should consider the overall policy of the City providing funding for crossing guards. Discussion followed during which City Engineer Brust responded to various Council questions regarding this matter, reviewed existing bus routes via the map on display, and confirmed that crossing guard warrants are basically established by volume rather than through any type of actual safety reports or benefits to the children. Mr. Brust said a staff report could be prepared if Council desires to recommend modifying this program. Council concluded the need to review the upcoming budget prior to taking further action on any of the School District funding request items presented for Council consideration. 3) Truancy Program City Manager Netter said it is the School District's desire to continue the Truancy Program as outlined in the Council meeting memo. He confirmed $6,000 has been set aside in the proposed 1991 -92 budget. Rohnert Park City Council Minutes (8) June 11, 1991 4) M School Site City Manager Netter shared contents of Council meeting memo regarding update on purchase of "M" School site as referenced in the final item of the above- mentioned School District letter dated June 7, 1991. The City should receive the proceeds of this sale by July 26, 1991, however, if consummation of the sale is delayed any further, staff recomrends discussion with the School District for a possible adjustment for lost interest. Resolution No. A RESOLUTION OF THE COUNCIL OF THE CITY OF ROHNERT PARK 91 -113 AUTHORIZING AND APPROVING AGREEMENT WITH CODDING ENTERPRISES (RE. Sale of 2.31 Acre Parcel off Redwood Drive) City Manager Netter explained the resolution as outlined in detail in the Council meeting memo. Upon motion by Councilman Hopkins, seconded by Councilmember Spiro, and unanimously approved, reading of Resolution No. 91 -113 was waived and said resolution was adopted. Proposed B&get'91 -92 City Manager Netter referenced copies were provided to Council 1) Work Sessions of Proposed Budget for 1991 -92 and said Council should now set times and dates for budget work sessions. Council concurred to adjourn tonight's meeting for 1991 -92 Budget work sessions to next Nbnday, June 17th at 4:00 p.m. and then to the following Nbnday, June 24th at 3:00 p.m. City Manager Netter said consideration could be given to inviting special groups to review financial requests to the June 24th work session and that a budget public hearing could then be scheduled for the regular Council meeting on June 25th, 1991. 2) Review of Fees City Manager Netter recommended review of possible fee increases as listed on tonight's agenda for Council discussion and consideration at this time. He referenced copies of a report provided to Council for each fee regarding existing rates and the last date of increase. If Council desires to have staff pursue any of the increases, staff recommends setting public hearings for the June 25th meeting to receive public input regardingr Same which_ i_f anprover +hA -F=-- .. 1.4 be implemented in the early part of the 1991 -92 fiscal year. Council concurred it would be advisable to proceed with budget work session to get a thorough picture of the budget needs prior to reviewing the possible fee increases. Discussion followed during which City Manager Netter responded to Council inquiry that staff would check into State law regarding animal license fees for cats. 3.a)Water /Sewer rates City Manager Netter said the proposed 1991 -92 budget includes proposed rate increases for both sewer and water as explained in detail in the Council meeting memo which would basically increase the water rate $2.00 per month and the sewer rate Rohnert Park City Council Minutes (9) June 11, 1991 $6.00 per month with commercial accounts. hearing regarding this 25, 1991. comparable percentage increases for Staff recommends setting a public matter at the Council meeting of June A motion was made by Councilman Hollingsworth, seconded by Councilman Reilly, and unanimously approved, to set a public hearing for proposed water and sewer rate increases at the next Council meeting on June 25, 1991. 3.b)Water /Sewer Study -City Manager Netter referenced copies provided to Council of Proposal from letter dated June 5, 1991 from Deloitte & Touche regarding Deloitte & Touche proposal for Water and Sewer Study and shared detailed explanation as outlined in Council meeting memo. Mr. Netter said Council was also provided with copies of resolution for consideration approving letter agreement with Deloitte & Touche to perform Water and Sewer Study. Discussion followed during which the logic of whether or not the expense of an outside water /sewer study was necessary. It was concluded that staff provides this information for Council's review and that such a study would not be necessary at this time. Tax & Revenue Antici- City Manager Netter referenced copies provided to Council of portion Notes ( TRANs) program proposal dated May 29, 1991 from Sutro & Company regarding Tax and Revenue Anticipation Notes (TRANS) and explained details as outlined in tonight's Council meeting memo. He introduced Stephanie Lovette, representative of Sutro & Company who gave a brief presentation as outlined in the above - referenced program proposal and said she was available at tonight's meeting to respond to possible Council questions regarding this matter. Discussion followed during which Ms. Lovette responded to Council inquiry that this is a totally different financial vehicle than the one written about in a recent news article on Marx -Roos. Council presented various questions regarding use of other local agency bonds, length of terms, cash commitments, interest rates, charges of Sutro & Co., and what happens if one of the parties involved defaults. City Manager Netter said with Council's permission for staff to pursue this matter further, the proper documents and official agreements would be drafted and presented for Council's review and /or approval at the next Council meeting. Council showed interest in the concept and concurred to proceed as staff outlined. 1991 Annual Report City Manager Netter referenced Council's authorization at the Theme previous Council meeting to set aside $20,000 for the 1991 Annual Report and said time has been allotted at this time on tonight's agenda to consider theme recommendations. Council concurred that the them= should be "Youths of Our Community" as suggested at the previous Council meeting. Rohnert Park City Council Minutes (10) June 11, 1991 Seed Farm Drive City Engineer Brust referenced copies provided to Council of Project N0.1986 -25 his memo dated June 5, 1991 regarding Seed Farm Drive, Project No. 1986 -25 and shared contents therein proposing that the City look into the purchase of the small triangular area at the southeast corner of the State Farm Insurance Company property which adjoins the City's Corporation Yard on the north side and fronts on Seed Farm Drive. Mr. Brust reviewed the logic of this proposal as outlined in detail in his above - referenced memo and said it is staff's recommendation that the City move ahead with an appraisal of this property to establish an appropriate value and authorize the City Manager to negotiate with State Farm Insurance Company on the purchase of the property. Discussion followed regarding the need for the best waste facility possible because of inevitable recycling requirements. Confirmation was given by City Manager Netter that the appraisal cost would be approximately $1,500 and that this is a capital project which would be frunded from capital outlay funds or infrastructure revenue funds. City Engineer Brust said the costs may be applied against SB140 and SB300 funds. Councilmember Spiro said she questioned the use of prime property in the center of the City for trash handling activities to which City Engineer Brust responded that the area requested is needed for the Corp Yard expansion and being a central location is critical for the efficiency of the Corporation Yard functions. A motion was made by Councilman Hopkins, seconded by Councilman Hollingsworth, to proceed with the appraisal of the State Farm Property for the expansion of the Corp Yard as recommended by staff and approved by the following vote: AYES: (4) Councilmen Hollingsworth, Hopkins, Reilly and Mayor Eck NOES: (1) Councilmember Spiro ABSENT: (0) None Rent Appeals Board City Manager Netter explained the strategy for new Appointments appointments to the Rent Aooeals Board aG nittl;na,� in +►,,� Council meeting memo. He said all five Board Member terms expire as of December 31st, 1991 and none qualify to be appointed to another term since all will have served two full terms and, according to Ordinance No. 494, such terms of office shall not exceed a maximum of two full terms. Rent Appeals Board Chairman Jerry Kohler confirmed from the audience that two Board Members have signified interest to resign at this time which would allow needed comprehension and orientation time to new appointments prior to term expiration of the other three at the end of this year. He asked for Council's consideration to approve two such appointments. City Manager Netter indicated he would add to the Rent Appeals Board Agenda the volunteer resignation of two Rent Appeals Rohnert Park City Council Minutes (11) June 11, 1991 Board members to ensure continuity of the Rent Appeals Board. Council agreed to discuss this item further and commented further that the appointments should be staggered in relation to Council terms. Commmications Communications per the attached outline were brought to the attention of the City Council. No action was taken unless specifically noted in these minutes. City Manager's Report:City Manager Netter referenced copies provided to Council of letter received May 24, 1991 from Senior Citizens Advisory 1) Sunshine Bus Commission Chairman John D. Chase regarding request to replace the Sunshine Bus because of its worn out condition. Mr. Netter said this item is just being mentioned at this time for Council's awareness of the matter and would be reviewed at the upcoming 1991 -92 Budget work session. Discussion followed during which suggestion was made to repair the old bus and give it to the youth program and purchase a new one for the seniors. City Manager Netter said this bus would probably be the one terminated and confirmed the amo,..t of $15,000 set aside in the budget for the purchase of a new bus. 2) Senior Scheduler City Manager Netter said several letters have been received expressing concerns regarding the status of the Senior Scheduler of the Rohnert Park Senior Center because of the discontinuance County grant funds. Mr. Netter said funding for the Senior Scheduler are being considered in the 1991 -92 proposed budget. 3) U.S.Hwy 101 sign City Manager Netter said the City of Rohnert Park and the State has come to an agreement regarding the U.S.101 Highway sign and that the matter will be resolved by painting the border of the sign a dark blue. 4) Supervisorial City Manager Netter updated Council on the Supervisorial Redistricting Redistricting matter and said staff met with the subcommittee which has narrowed possibilities to two proposals. The first proposal would eliminate Rohnert Park from the 5th District (E.Carpenter) and would keep Rohnert Park in the 3rd (Tim Smith) and 2nd (Jim Harberson) Districts. The 2nd proposal would put Rohnert Park in one district, the 3rd (Tim Smith). The 3rd would be split about 50/50 with Santa Rosa, i.e., Tim Smith having about 36,000 votes in Rohnert Park and 36,000 votes in Santa Rosa. Staff will continue to keep the Council updated on this matter. Rohnert Park City Council Minutes (12) June 11, 1991 5) Triple Croon. Soft- City Manager Netter displayed plaque from recent Triple Crown bull Tournament Softball Tournament. He confirmed to Council inquiry that he Plaque will be reviewing the problems and complications of this tournament with Recreation Director Jim Pekkain. 6) Pimemtel Property City Manager Netter updated Council on the status of the Pimemtel property regarding the proposed west side golf course. 7) So- Co.Probation City Manager Netter referenced report from the Sonoma County Dept. / Graffitti Probation Department regarding graffitti for Council's inforrrat ion . 8) Hazardous Waste City Manager Netter commented on the City's Hazardous Cleanup Day held on June 8, 1991. A complete report will be provided to Council at a later date. City Attorney's Report:City Attorney Flitner referenced copies provided to Council of letter dated May 16, 1991 from the City of Moorpark regarding Amicus Brief on Sale of Surplus School Property to City (City of Moorpark v. Nborpark Unified School District) and said he thought it would be beneficial for the City of Rohnert Park to participate. A motion was made by Councilman Hollingsworth, seconded by Councilmember Spiro, and unanimously approved, to add the City's name to the above- referenced Amicus Brief. Natters from Council: Mayor Eck said the Sonoma County Wine Growers Association's 1) Viticulture Tour Viticulture Tour is scheduled for Wednesday, June 19, 1991. 2) Local Child Care Mayor Eck said copies were provided to Council of letter Planning Council dated May 30, 1991 from Office of County Adminsitrator regarding the Sonoma County Board of Supervisors in +r�roc+ in putting together a committee to look into child care vneeds in Sonoma County. Councilmember Spiro said she was interested in being on this committee and confirmed a letter would be written to the Chairman of the Mayors & Councilmembers Association expressing her interest. 3) Veterans Building City Manager Netter referenced copies provided to Council of letter dated May 23, 1991 from George Williams of the Veterans of Foreign Wars regarding a veterans building in Rohnert Park which was discussed at the previous Council meeting. Discussion followed during which Council confirmed previous direction to staff to look into this matter. Rohnert Park City Council Minutes (13) June 11, 1991 4) Miscellaneous Councilman Reilly invited Councilmembers to attend special PeeWee Baseball event regarding "Adopt a Coach" at A Park this Saturday, June 15th. Councilman Hollingsworth asked for an update on the plans for the Animal Shelter to which City Manager Netter responded that according to City Engineer Brust, the preliminary site plans are in hand and will be scheduled for Council consideration after staff's review.
