Rohnert Park City Council Minutes September 13, 1994 The Council of the City of Rohnert Park met this date in regular session commencing at 6:00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Reilly presiding. CALL TO ORDER-Mayor Reilly called the regular session to order at approximately 6:25 p.m. and led the pledge of allegiance. MAYOR'S REPORT ON CLOSED SESSION: Mayor Reilly advised a closed session commenced this evening at 6:00 p.m. to discuss litigation matters, as listed on the agenda attachment, regarding Hallock vs. City of Rohnert Park, Hillsboro Properties vs. City of Rohnert Park re. Nbbile Home Park rent control matters, and Lou Beary vs. City of Rohnert Park. The Mayor reported that the City Attorney would sunTnarize the results of these cases later on the agenda. ROLL CALL Present: (5) Councilmembers Eck, Gallagher, Hollingsworth, Spiro and Mayor Reilly Absent: (0) None Temporary Youth Committee present: (1) Representative Jennifer Mello Staff present for all or part of the meeting: City Manager Netter, City Attorney Flitner, Assistant City Manager Leivo, Director of Public Works /City Engineer Brust and Planning Director Skanchy. Senator Upon recognition by the Mayor, Senator Milton Narks expressed appre- Milton Narks ciation for schedules permitting his attendance at the Council meeting. He urged Councilmembers to call upon him whenever he could help in any way. Approval Upon motion by Councilman Hollingsworth, seconded by Councilman Eck, of Minutes the minutes of August 23, 1994 were unanimously approved as submitted. Approval Upon motion by Councilman Hollingsworth, seconded by Councilman Eck, of Bills including previously signified automatic no vote of Councilwoman Gallagher for payments to Sonoma County Wineries Association, City bills presented per the attached list in the amount of $1,004,326.58 were unanimously approved. Non- agendaed Mayor Reilly asked if any Councilmember had any items to add to the matters agenda. Councilwoman Gallagher and vice Mayor Eck each signified a miscellaneous item to add, Councilwoman Spiro signified three miscellaneous items and City Manager Netter signified tun items. Rohnert Park City Council Minutes (2) September 13, 1994 Unscheduled Mayor Reilly stated that in compliance with State Law (The Brown Act), Public citizens wishing to make a comment may do so at this time. Persons Appearances speaking under unscheduled public appearances are requested to submit completed cards to the recording clerk. Elaine Dechter, 584 Anson Avenue, reviewed concerns related to accessibility of assistance to the hearing impaired who need methods other than signing provisions to be able to understand the Council meetings. Dc�'iitcr respviLUCU thLLat a loop system wired for direct sound into hearing aides could be installed similar to provisions at the Petaluma Cinema and Luther Burbank Center. However, people like herself need a note taker. Transcripts captioned on the videos of the meetings would also be helpful. Jake Mackenzie, 1536 Gladstone Way, reviewed concerns related to continued problems of in -line skating and newly resurfaced tennis courts pointing out incompatible possibilities of the two activities. He requested the matter be referred to the Parks and Recreation Commission for further review and consideration. Tony Ponzo, 1394 Ludwig Avenue, reviewed recent success of Rohnert Park Softball team at Palm Springs. He inquired about the possibility of funding assistance for his team to proceed into the West Coast Nationals next Wednesday. City Manager Netter explained the City's policy and proce- dure for such funding requests to be submitted through the Parks and Recreation Department. Mayor Reilly confirmed the necessity of adhering to City policy and advised, due to the timing factor, such funding assistance, if available, would have to come after the fact. *************************************** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** C O N S E N T C A L E N D A R Mayor Reilly asked if any Councilmember had any questions regarding the matters on the Consent Calendar. AND THE CITY OF ROHNERT PARK TO 'PROVIDE JANITORIAL SERVICES AT THE DOROTHY ROHNERT SPRECKELS PERFORMING ARTS CENTER Upon motion by Councilman Hollingsworth, seconded by Councilwoman Spiro, with the exception of Resolution Nos. 94 -142 through 94 -145, the Consent Calendar as outlined on the meeting's agenda, was unanimously approved. Resolutions: No. 94 -142 A RESOLUTION APPROVING AN UPDATED JOB DESCRIPTION AND SETTING A PAY RATE AND RANGE FOR PUBLIC SAFETY RECORDS SUPERVISOR No. 94 -143 A RESOLUTION APPROVING A JOB DESCRIPTION AND SETTING A PAY RATE AND RANGE FOR STOREKEEPER /LOCKSMITH No. 94 -144 A RESOLUTION APPROVING AN UPDATED JOB DESCRIPTION AND SETTING A PAY RATE AND RANGE FOR CONSTRUCTION /BUILDING INSPECIOR No. 94 -145 A RESOL.LTTION APPROVING AN UPDATED JOB DESCRIPTION AND SETTING A PAY RATE AND RANGE FOR BUILDING INSPECTOR City Manager Netter responded to Council questions pertaining to the resolutions removed from the Consent Calendar. He confirmed that the referenced job descriptions would be in addition to the existing job descriptions, which would remain on the books as unfunded positions and could be utilized in the event of future needs. upon motion by Councilman Hollingsworth, seconded by Councilwoman Spiro, and unanimously approved, Resolution Nos. 94 -142 through 94 -145 were consecutively adopted. Nbbile Home Parks Rent Control Matters: 1) City Attorney's report on damages phase of Hillsboro lawsuit 2) Status of Rent Appeals Board in light of the recent court order 3) Rent Appeals Board appointment to fill vacancy left by William Combs, whose term expires December 31, 1994 (Councilman Hollingsworth's nominee) City Attorney Flitner referred to previous memorandum dated August 26, 1994 provided to the City Council and the Rent Appeals Board reporting on the damages phase of the Hillsboro lawsuit. He updated the Council on results of the recent status conference held on Friday, September 9, 1994 including unconstitutional ruling of Ordinance No. 494, review of the appeal process and confirming there is no judgment against the City. City Attorney explained reasons for his recommendation to temporarily suspend the Rent Appeals Board meetings until after the upcoming November election. Discussion concluded upon motion by Councilman Hollingsworth, seconded by Councilwoman Spiro, to follow the City Attorney's recommendation to temporarily suspend Mobile Home Park Rent Appeals Board meetings until after the November 1994 election, including postponement of the new appointment to the Rent Appeals Board, was unanimously approved. Rohnert Park City Council Minutes (4) September 13, 1994 4 ) Rent Stabilization Ordinance - City Manager Netter refer -red to the ordinance prepared for possible introduction to provide for a mobile home park space rent stabilization program. As signified in the previous City Attorney report, there is no formal challenge at this stage of procedures. City Attorney Flitner responded to Council inquiry related to the authority of the referenced ordinance proposal if still under Ordinance 494. To follow the process, if Ordinance 494 is rendered unconstitutional, then Council could adopt an ordinance in its place. Mr. Flitner confirmed an emergency item could be declared for such action, if Council deemed necessary. Vice Mayor Eck pointed out that he thought the Council has done what it ought to do so far, including back -up Preparation of the rent stabilization ordinance for consideration, if necessary. Parks and Recreation matter: North Bay Breakers use of Rohnert Park Stadium for soccer - City Manager Netter referenced fax letter of this date, September 13, 1994 from North Bay Breakers, expressing regrets and informing Recreation Director Pekkain that the North Bay Breakers are not able, at this time, to provide the necessary funds to proceed with meeting their commitment for the previously approved joint project for a new soccer field at the Rohnert Park Stadium. Maybe such plans can be pursued at some future date. Vice Mayor Eck recomrended sending a letter to Dr. David Whitten, Chief Executive Officer of the North Bay Breakers, expressing appreciation for his efforts toward these plans and that the City is interested in working with him later if he decides to prepare a new plan to consider. Council concurred. Hewlett - Packard Company re. Kaufman & Broad project sewer capacity proposal - City Manager Netter shared contents of letter dated August 22, 1994 from Hewlett - Packard Company regarding the above - referenced proposal for sewer allocations. He introduced Hewlett- Packard representatives, Marcel Cohen and Dan Condron available at this Council meeting to make comwnts and respond to Council questions. City Manager Netter, Director of Public Works /City Engineer Brust and City Attorney Flitner responded to various Council questions. Dan Condron, Public Affairs Representative of Hewlett- Packard Company, responded to Council concern expressed about the interest rate with explanation that the percentage amount was not relevant as far as Hewlett- Packard was concerned, but that the same percentage should be signified for both the City and Hewlett - Packard. It would be fine with Hewlett - Packard if Council concurred that the interest rate should be 0% rather than 9%. Mr. Condron confirmed agreement with previous City Manager Netter's comments that the only intention is to make whole when transferring back sewer allocations. Council concerns expressed related to the legalities of paragraph 2(a) in the referenced Hewlett - Packard letter pertaining to the Cannon Manor Area exception, is not an issue with Hewlett - Packard, but only resulted from a meeting with City staff. Mr. Condron said Hewlett- Packard representatives would be happy to meet in a work session with City Council, City staff, etc. to resolve the issue. Discussion concluded upon motion by Councilman Hollingsworth, seconded by Councilman Eck, and unanimously approved, to accept the above- reviewed Hewlett - Packard proposal in concept with amended language to be added by City Attorney on the zero interest, and not restricting the City's authority on sewer allocation decisions. Rohnert Park City Council Minutes (5) September 13, 1994 RECESS Mayor Reilly declared a recess at approximately 7:15 p.m. RECONVENE Mayor Reilly reconvened the Council meeting at approximately 7:24 p.m. with all Councilmembers present with the exception of Councilwoman Spiro arriving late at 7:25 p.m. and Councilwoman Gallagher arriving late at 7:26 p.m. during discussion of the following agenda item. Planning and Zoning matter: File No. 1649 - Winston Tires: Lombard & Associates, Inc. appeal of Planning Commission approval of a use permit for a Winston Tire site at 5050 Commerce Boulevard. Mayor Reilly advised that Lombard & Associates has requested this matter be continued to the Council meeting of September 27, 1994 because of a conflict with schedules. Discussion included City Attorney Flitner confirmation that Council direction on this matter is discretionary as outlined in the Council Meeting Memo. Council referenced commmications from representatives of Winston Tires and acknowledged substantial funds involved for this project and the desire to accomplish earth moving work prior to the rainy season. It was also pointed out that representatives of both sides of the issue were present at this Council meeting and even though all the owners of the opponents requesting the matter to be continued to September 27 were unable to be present, the written comnmications provided to Council adequately explained the reasoning for the opposition. Planning Director Skanchy referenced plans on display, reviewed staff report and responded to Council questions. Letters in support of the Winston Tire Store and responding to questions raised during the Planning Commission meeting of August 25, 1994 were received from Paul E. Carlton, Owner- Lessor; Jacques T. L. Hunter, Senior Vice President; and Sandy Swallow. Letter appealing the Planning Commission approval, as signified, and requesting continuation of the matter to the September 27 Council meeting was received from Lombard & Associates, Inc., dba Triple "S" Tire Centers. Director of Public Works /City Engineer Brust responded to Council questions related to traffic impacts signifying that the minimal amount of traffic anticipated for Winston Tires makes the most viable use of the referenced site. Mr. Brust confirmed communications with Winston Tire representatives regarding awareness of changes by Caltrans in the future that could eliminate the site. Jacques Hunter, Senior Vice President of Winston Tire Company, urged agreement with previous Planning Commission approval. He agreed with comments during above discussion that it might be necessary for customers leaving the Winston Tire Store to make a right hand turn at busier traffic times of the day but, related to the competition of doing a good job, thought, if necessary, the customers would go along with it. In response to the question regarding Caltrans' plans and future possibilities of eliminating the site, Mr. Hunter said the 10 to 15 year estimated timeframe before that happens would be sufficient to let them operate for that length of time and provide the new business to the City of Rohnert Park. Rohnert Park City Council Minutes (6) September 13, 1994 W. L. N. Lombard of Lombard & Associates, Inc., dba Triple "S" Tire Centers, referenced above- reviewed letter requesting this item be continued to the next City Council meeting of September 27 and shared that he was not fully prepared to review the matter at tonight's meeting. He questioned the number of 20 daily vehicles estimated for the new tire store compared to their business with approximately 60 to 100 vehicles per day and did not see how a business could succeed at the lesser number. Numerous individuals had signed the petition letter with expectations to receive as many as 1,000 signatures over the next couple of weeks. Mr. Lombard explained that he was also a property owner and did not want to run across property rights, however, he did not think a two week extension of time for Council to make a decision was too mach to ask, as they were in the process of seeking additional information including going to Caltrans. Steve- Trolio, 9700 Fair Oaks Blvd., Sacramento, Ca., Real Estate representative for Winston Tires, reviewed his experience working in real estate throughout the State of California, north of San Gabriel, and found it strange that out of 170 stores in the surrounding area of the site for Winston Tires, only the Triple "S" Tire representatives have expressed concerns about gauging the traffic. He did not think that was proper and thought they were objecting to the competition. He questioned the traffic related concerns expressed in the petition letter compared to his observations of traffic flows of the particular intersection at various times of the day, and did not think the anticipated number of 20 daily cars at Winston Tire would make much difference. W. Trolio further reviewed real estate procedures for matching potential buyers with property location and conditions and thought Winston Tires was one of the best considerations for this particular site. Dino D'Argenzio, 1355 N. Dutton Ave., Santa Rosa, Ca., reviewed efforts toward procuring a buyer for the owner of the referenced property signifying that the majority of interest had much more intensive uses for the site that were allowable within the zoning codes, such as 5 to 20 times the traffic estimation of Winston Tires with its anticipation of 20 cars per day. He also found it strange that the only objection is from a competitor down the block. Mayor Reilly signified that he had received a call earlier today from one of the non - competition neighbors of the referenced site expressing traffic congestion concerns to clarify that there were others besides the competition who have warranted concerns about the traffic impacts. From comments expressed tonight, the Mayor said he would probably vote for Winston Tires but thought it would be reasonable to wait two weeks for Council action to allow time for everyone to have their say. The traffic conditions at this intersection are well known and whether or not it is a competitor expressing concerns about the traffic impacts, is inconsequential. Annual Report/Review of options: City Manager Netter shared contents of staff report pertaining to options for an Annual Report, as previously requested by Council during budget deliberations when $8,000 were set aside for an annual report. The options include consideration of proposals from the following three firms: North Coast Productions' It's Reba; and Patterson & Hall. City Manager Netter also reviewed separate staff report regarding a fourth alternative to coordinate the City's Annual Report with the Chamber of Commerce's publicity packet. Representatives reviewed above- referenced proposals and responded to Council questions as follows: Suzanne Martens of North Coast Productions; and Reba Roberts of It's Reba Discussion concluded with compliments of the successful track record of Reba Roberts. The advantages of her familiarity with the many factors of the City were acknowledgment. Upon motion by Councilman Hollingsworth, seconded by Councilwomen Spiro, with Councilwoman Gallagher dissenting due to the desire for a new perspective, Reba Roberts' proposal for the City's Annual Report in the amount of $8,000, was approved. Vice Mayor Eck requested that the record acknowledge discussion comments that he would not be adverse to a cost sharing effort with the Chamber of Commerce and that sometimes change is beneficial, but he could remember times in the past when the annual report was put together on a shoe string budget and those efforts should be acknowledged. Even so, and because of budget constraints, it might be well to consider the idea of cost sharing with the Chamber. However, with Councilwoman Gallagher's response that she was going to vote no on the motion no matter what, but would rather have the annual report done by Reba than have a joint effort with the Chamber because of partiality, Vice Mayor Eck signified his yes vote on the motion. School District /Cities Coordinating Committee meeting - Assistant City Manager Leivo summarized the items discussed at the School District /Cities Coordinating Committee meeting held on August 25, 1994 including uniforms; B Park landscaping; resolution presented by Councilwoman Gallagher urging federal government toward available financing to local governments which will be taken back to the full Board of the School District; and School District indication of no funds available for the library project proposal. Rohnert Park City Council Minutes (8) September 13, 1994 Councilman Hollingsworth- Councilman Hollingsworth left the Chamber during this discussion at leaves approximately 8:34 p.m. and returned at approximately 8:36 p.m. & returns Councilwoman. Gallagher acknowledged intent to provide to Council the above - referenced financial packet related to federal government interest -free loans. General Plan Update - Discussion ensued pertaining to the progress of the General Plan Update. "M" section neighborhood meeting - Council concurred to schedule this meeting at the Nbnte Vista School, 7:00 to 8:30 p.m., Tuesday, October 18th, 1994. Communications- Communications per the attached outline were brought to the attention of the City Council. No action was taken unless specifically noted in these minutes. Vice Mayor Eck referred to cocmunications like Greenbelt Alliance arguments and political campaign issues and recommended staff save reproduction costs of such items since Council usually receives the information individually addressed. Councilwoman Gallagher referenced Proposition 187 items listed on comninications, as well as additional information she had received on the issue regarding resolutions adopted by Los Angeles and Santa Barbara expressing opposition to Proposition 187, Ms. Gallagher requested consideration of a resolution opposing Proposition 187 be placed on the next Council agenda. City Manager's report: 1. Provision of compost for Community Garden site - City Manager Netter shared contents of staff report dated September 12, 1994 regarding this item for informational purposes. 2. Installation of recycling containers at Community Center site - City Manager Netter shared contents of staff report dated September 12, 1994 regarding this item for informational purposes. Vice Mayor Eck referred to previous recomnendation of trash bins on the bike path and recommended additional provision of ash trays even with non - smoking good efforts of City ordinances, etc. 3. Beat Health Issues, Boats and Trailers - City Manager Netter shared contents of this staff report dated September 12, 1994 and responded to Council questions. The Department of Public Safety recommends instituting the policy, as reviewed in the referenced staff report, to greatly enhance its ability to remove boats and trailers (odcmeterless vehicles) from City streets. 'This would include proceeding with Press Releases, accordingly. Council concurred. 4. Public Safety Community Policing Grant Reconsideration - City Manager Netter referred to a letter received today regarding this item and updated the City Council. Rohnert Park City Council Minutes (9) September 13, 1994 S. Exxon Station landscaping arrangements with City - City Manager Netter reviewed staff communications with representatives of the Exxon Service Station at the Rohnert Park Expressway /Commerce Blvd. intersection regarding property improvements including Caltrans approval to bring a right hand turn into the station. Mr. Netter referred to plans on display and explained discussions with Exxon representations regarding new landscaping arrangement possibilities with the City. Council agreed the item should be placed on the next meeting agenda for further review and consideration. City Attorney's report: 1. Hallock vs. City of Rohnert Park - City Attorney Flitner advised there is nothing further to do on this case. To date, the attorney has asked to be relieved as Mr. Hallock's attorney and Mr. Hallock has asked for a 30-day continuance to find other counsel. The City resists any further application and the O'Donnell Firm has already written a letter opposing the request for continuance. 2. Hillsboro Properties vs. City of Rohnert Park re. Wbile Home Park rent control - City Attorney Flitner advised this issue was handled at the beginning of tonight's agenda. 3. Lou Beary vs. City of Rohnert Park - City Attorney Flitner reviewed court proce- dures requesting each party to submit final comments and advised that this case has been formally dismissed. Matters from/for Council: 1. 32nd Annual Founders Days festivities, Saturday & Sunday, September 17 & 18, 1994 - Mayor Reilly announced the scheduling of this event. 2. Mayors and Councilmembers Discussion Group meeting, Thursday, September, 22, 1994, 7:00 p.m., Santa Rosa City Hall - The Mayor confirmed this meeting. 3. Door locks at City Hall - Vice Mayor Eck requested a type of coded lock be installed on the interior City Hall door between the reception area and administrative offices, if continued locking of the doors is deemed necessary. This would be more convenient and would save valuable staff time from having to constantly unlock the doors. 4. SSU student housing - Vice Mayor Eck reported some concerns have been expressed regarding students not being able to rent houses in the neighborhood. He suggested there might be a need to have a student housing representative and recommended Fred Jorgenson from SSU and maybe the Mayor have a preliminary meeting to review the matter. Mayor Reilly responded it would be necessary to schedule the meeting around his existing plans to represent the City in Japan from September 14 to 20 and to be in Pueblo, Colorado from September 25th through 30th. 5. Public Safety - City Manager Netter responded to Councilwoman Gallagher's inquiry regarding progress of automatic aid agreements with neighbors to the south, that he is currently working with Director of Public Safety Rooney to see what can be worked out over a period of time. There will be a meeting with Rancho Adobe to see if they would accept an agreement with limited hours of non - coverage. Staff is also working on that time gap and as soon as new staff is hired, there will be coverage around the clock. Rohnert Park City Council Minutes (10) September 13, 1994 6. Employee recognition - Councilwoman Spiro referred to recent monthly sales report and revenue reports on the Tea Dances from Evelyn Kim, Manager of Rohnert Park Seniors' Craft Shoppe. Ms. Spiro recommended a proclamation from the Mayor recognizing Vickie Wilkerson's efforts for the success of the Tea Dances. She felt Ms. Wilkerson has done a job above and beyond the regular call of duty to accomplish this success. Vice Mayor Eck expressed preference for further review of the matter on the next Council agenda, if pursued, as employees are supposed to do a good job. Unless Council desires to have something like "employee of the month ", individual recognition would not seem advisable. He recommended an alternative approach, as he has done in the past, like simply writing a note on the designated report and extend a compliment for doing a good job. 7. Neon signs - Councilwoman Spiro said a citizen had expressed concern to her about a neon sign in the window of a particular business. Ms. Spiro asked if she was correct in advising the citizen that she did not think there was anything that could be done to discourage the sign as long as it was inside the window. City Manager Netter confirmed Council comment that a business is allowed a certain number of signs per square foot and that he would check into the matter. 8. Wal -Mart Parking Lot use - Councilwoman Spiro questioned the use of numerous prime parking spaces at Wal -Mart for uses other than individual parking spaces for shoppers. She noted 37 spaces being used for Wal- -Mart gardening items and had also previously observed 34 parking spaces taken up by 5 semi - trucks parked sideways. 9. Emergency response recognition - Mayor Reilly referred to recent incident at City Hall requiring emergency action for a job applicant who apparently suffered from a stroke. The Mayor said he would like to take this opportunity to publicly commend Theresa Smith in the Personnel Department handling the interview for her quick action and calm composure during the incident. He also commended the Public Safety Department response time to the 911 call which was less than 2 minutes with rescue services accomplished within 5 minutes. Mayor Reilly requested his comments be passed on both to the Public Safety Department and to Theresa Smith who was doing the interviewing. Unscheduled Public Mayor Reilly asked if anyone in the audience wished to make an Appearances appearance at this time. Katherine Collins, 828 Lilac Way, referred to approval of the annual report earlier on the agenda and said she thought Council had lost sight of the purpose of the annual report. It is to let citizens know the City's business and not to advertise for others. She thought Council should let the Chamber publicize and the City should provide a report letting the citizens of Rohnert Park know how much was spent for projects, etc. Secondly, Ms. Collins questioned access for compostable green waste provisions to commercial places like hers, similar to residential provisions. She reviewed the excessive amount of such green waste she has had to discard because of no compostable access provisions. Rohnert Park City Council Minutes (11) September 13, 1994 John Hudson, 399 Bonnie Avenue, referred to previous Conmmity Development Agency action passing a resolution pertaining to Article 34 and the authorization of funds for low income housing. He reviewed reasons for concerns related to Article 34 requiring a vote of the people prior to such action and requested Council to rescind that vote. City Attorney Flitner responded that there are certain exceptions to the provision as well. Adoption of the resolution is not in violation, however, there is a statute applying to that. City Manager Netter commented that the funds would not be distributed until after the November election. In response to Council inquiry, City Attorney Flitner explained further that the law provides for the above Agency action which is not authorizing public funds to be spent prior to the election. City Attorney Flitner reviewed his opinion that this is not a violation of constitutional provisions, but if W. Hudson thinks so, he has that right. Marie Vinsick, 38 Estrella Drive, requested response at a later date on questions raised about the effects of Ordinance 494 and feedback on the possible sales of mobilehome parks including procedures with residents and problems for residents not on leases.
