The Council of the City of Rohnert Park met this date in regular
session commencing at 6:00 p.m. in the City Offices, 6750 Commerce
Boulevard, Rohnert Park, with Mayor Reilly presiding.
CALL TO ORDER-Mayor Reilly called the regular session to order at approximately
6 :17 p.m. and led the pledge of allegiance.
ROLL CALL Present: (5) Councilmembers Eck, Gallagher, Hollingsworth, Spiro
and Mayor Reilly
Absent: (0) None
Temporary Youth Committee present: Representative Jennifer Mello
Staff present for all or part of the meeting: City Manager Netter,
City Attorney Flitner, Assistant City Manager Leivo, and Director of
Public Works /City Engineer Brust.
U. S. Department of Justice Grant Approval for Department of Public Safety:
Mayor Reilly introduced Congresswoman Lynn Woolsey to comment on this
item. Congresswoman Woolsey expressed appreciation for being invited
to speak and extended congratulations for the grant approval. She had
solicited support for the grant which was previously submitted by the
City of Rohnert Park. On behalf of the City Council, Mayor Reilly
expressed appreciation to Congresswoman Woolsey for her efforts toward
the grant approval. The Mayor advised he would be leaving the Council
meeting early to fly to the White House to participate in the ceremony
with Director of Public Safety Rooney to officially receive the
awarding of the grant from President Clinton. Mayor Reilly also
expressed appreciation to staff for the extensive efforts involved in
the application process.
City Manager Netter reviewed further details of the grant application
process resulting in the approval of $311,648 over three years making
funding possible for an additional Public Safety Officer.
Acknowledgment was made of the huge team effort involved including the
Assistant City Manager and Department of Public Safety staff.
Also, City Manager personally thanked Congresswoman Woolsey and her
staff aide Jim Chaaban.
Closed Mayor Reilly advised that a closed session commenced this evening at
Session 6:00 p.m. to discuss litigation and real estate matters as listed on
the agenda attachment. The pending litigation matters were regarding
Hillsboro Properties, Inc. vs. City of Rohnert Park and Hallock vs.
City of Rohnert Park. The real estate item would be reviewed later on
the agenda. He said no action was taken and there was nothing further
to report at this time.
Mayor's Report on trip to Hashimoto City, Japan & presentation of gift -
Mayor Reilly reviewed highlights of this trip recently enjoyed with
the presence of his wife and members of the Rohnert Park Sister Cities
Relations Committee. The Rohnert Park Sister Cities Committee has
extended an invitation to the City Council to attend a slide show for
• more complete review of the trip. Mayor Reilly officially presented
• gift of a ceramic vase and stand to the City of Rohnert Park which
was sent home with him from Hashimoto City.

Approval Counci lworren_ Spiro referred to page 5, second item of September 27th
of minutes regarding Proposition 186. The comment signifying a brief
Minutes discussion should be deleted as the proposition was not discussed.
Upon motion by Councilwoman Spiro, seconded by Councilman Eck, with
abstention by Mayor Reilly on September 27 minutes due to absence from
the meeting, the minutes of September 6, 1994 as submitted, and
September 27, 1994 as amended, were otherwise unanimously approved.

Non - agendaed Mayor Reilly asked if any Councilmember had any items to add to the
matters agenda. Counc i lmmembers Gallagher, Spiro and Eck each signified
miscellaneous items.
Unscheduled Mayor Reilly stated that in compliance with State Law (The Brown Act),
Public citizens wishing to make a comment may do so at this time. Persons
Appearances speaking under unscheduled public appearances are requested to submit
completed cards to the recording clerk.
Ben Friedman., 655 Enterprise Drive, expressed concerns related to the City's
recently instituted ordinance for interest on security deposits. He
urged stronger enforcement measures. Responding comments from Council
included explanation that the communities with enforcement abilities
have rent control. Rohnert Park does not have that leverage.
Residents shared various reasons for urging consideration of keeping Honeybee Pool
open during winter months for lap swimmers as follows:

Discussion concluded in Council concurrence for staff to review the
budgetary factors related to keeping H Pool open during the winter
months and to place the item on the next regular Council meting
agenda for further consideration.

Upon motion by Councilman Hollingsworth, seconded by Councilwoman
Gallagher, the Consent Calendar as outlined on the meeting's agenda,

Temporary Youth Committee matters:
1. City Council appointment of Sheree Rico - City Nbmger Netter referred to the
Fact Sheet application from Sheree Rico, a student at Mountain Shadows
Middle School, requesting this appointment.
Upon motion by Councilman Hollingsworth, seconded by Councilwoman
Spiro, appointment of Sheree Rico to the Temporary Youth Committee,
was unanimously approved.
2. Youth Committee report - Representative Jennifer Mello referenced Youth Committee
Agenda of October 11, 1994 with attached September 26, 1994 meeting
minutes provided to Council. Ms. Mello reviewed highlights of
contents therein.
Presentation of Proclamation to Reverend Samuel Tharpe of T's Academy -
Mhyor Reilly shared contents of this proclamation expressing apprecia-
tion and recognition to Reverend Sam Tharpe of T's Academy for
successful efforts of the Annual Thanksgiving Dinner Event for the
needy and elderly of our community and county. The Mayor presented
the proclamation to Reverend Tharpe on behalf of the entire Council.
Mayor Reilly encouraged volunteers to contact Reverend Tharpe
regarding participation in this worthwhile effort. Reverend Tharpe
expressed appreciation for the recognition and for the voluntary
efforts of those who have helped with the event for more than 5 years.
Sonoma County Convention & Visitors Bureau -
Introduction of new Director Estelle Miller - City Manager Netter
acknowledged that Ms. Miller was unable to attend this Council meeting.

City Manager Netter explained the resolution coinciding with
previously approved Comnmity Development Agency agenda item.
Upon motion by Councilwoman Spiro, seconded by Councilman
Hollingsworth, and unanimously approved with absence of Mayor Reilly
and Councilwoman Gallagher, reading of Resolution No. 94 -160 was
waived and said resolution was adopted with same-conditions of
coinciding CDA item to be modified subject to half of the designated
limit and City Attorney review of real estate and banking requirements.

Lew Kuehm, 1406 Gregory Court, representative of Founders Day Association, explained
the Youth of the Year Program with the purpose of encouraging
leadership and community service both on campus and in the cone nlity.
Mr. Kuehm introduced the 1994 -95 Youth of the Year representatives.
The two young men present for introduction at the Council meeting were
Seamus Giffen and Chiung -Fu Shih. The two young ladies unable to
attend the Council meeting were Hollie Scharfe and My Tran. All four
1994 -95 Youth of the Year representatives are Seniors at Rancho Cotate
High-School.
Councilwoman
Gallagher Councilwoman Gallagher returned to the Chamber for the remainder of

City Manager Netter explained the resolution. He and City Attorney
Flitner responded to related Council questions.
Debra Hales, 825 Liana Court, asked if there were a way to legally include in the
agreement a limit on the profit margin pertaining to future sale of
the property for possible roadway expansion uses because of the cost
to residents through taxes.
A motion was made by Councilman Hollingsworth, seconded by
Councilwoman Spiro, including Cost of Living Adjustment (COLA)
provisions and amendment by Mayor Pro Tempore Eck for traffic i s 1 and
regulation system requirement, reading of Resolution No. 94 -161 was
waived and said resolution was adopted by the following vote:

Ordinance AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING CHAPTER 2.60 OF THE

City Attorney Flitner explained the ordinance and responded to
Council questions.
Upon motion by Councilman Hollingsworth, seconded by Councilwoman
Spiro, and unanimously approved with Mayor Reilly absent, including
direction for City Attorney to review "governmental decision
consultant" language, reading of Ordinance No. 593 was waived and said
ordinance was introduced.
Matters from/for Council:
1. Proposition 187 re. "Save Our State" initiative (Gallagher)
A motion was made by Councilwoman Spiro to disperse with discussion on
Proposition 187. Said motion died for lack of a second.
Councilwoman Gallagher shared contents of resolution she prepared for
Council's consideration opposing Proposition 187 on the upcoming
November 8th ballot. She made a motion to adopt the resolution.
Mayor Pro Tempore Eck confirmed reasoning expressed at the previous
Council meeting regarding advisability of Council taking stands on any
of the propositions. He said anyone was welcome to ask him personally
about his stand on any of the issues. He pointed out it was obvious
the motion would fail by a two to two vote even if he were to second
it and, therefore, declared the motion died for lack of a second.
2. Other Propositions 181 through 191 (Spiro)
For consistency with above conclusion, Councilwoman Spiro signified
there was no need to review the other propositions. However, she
pointed out one exception was about the tobacco /smoking issue whereby
the City has an ordinance in place with designated smoking restric-
tions. City Manager indicated an ordinance was previously approved
regarding this item.
3. "M" Section Neighborhood meeting @ Hewlett - Packard Facility, Building No. 1,
Auditorium, 1212 Valley House Drive, Rohnert Park, 7:00 - 8:30 p.m.,
Tuesday, October 18, 1994 - City Manager Netter confirmed
arrangements for this neighborhood meeting. He further advised that
the previously scheduled General Plan Update meeting of the same date
would also be held at this location starting at 5:30 p.m.
4. League of California Cities Annual Conference, Long Beach, Ca., October 23 - 25,
1994 - City Manager Netter confirmed the scheduling of this conference.

5. City Population Sign - Councilwoman Spiro referred to the Caltrans sign
signifying the City's population at 31,000 and asked when it would be
updated. She shared resident concerns expressed to her about the
City's population. City Manager Netter confirmed staff has a request
into Caltrans and they are in the process of updating the sign.

Hollingsworth- Councilman Hollingsworth left the Chamber at approximately 8:20 p.m.

additional efforts would be made regarding notification to residents
of the City's current population.
6. United Way funds - Councilwoman Spiro referred to previous meeting comments about
dispersement of United Way funds by the next Friday. F.A.I.R.E. has
signified not yet receiving its portion. Mayor Pro Tempore Eck
suggested Councilwoman Spiro contact the United Way representative and
ask them to comply as previously stated.
7. State candidate sign -Mayor Pro Tempore Eck said the high location of a particular
State candidate campaign sign was in violation of city codes and
requested staff to check into the matter and inform them of the code
violation. He complimented local candidates for campaign sign compli-
ance with codes.
Councilman
Hollingsworth- Councilman Hollingsworth returned to the Chamber at approximately

8. SSU Fall Festival - Mayor Pro Tempore Eck advised that Sonoma State University is
having its Fall Festival all day on Saturday, October 15th, at the
Red Lion Inn, and will include folk games, football, fundraisers, a
hypnotist, etc. He invited people to attend.
9. Boys & Girls Club/3rd Annual Golf Tournament - Councilwoman Spiro announced this
this upcoming event and that Councilman Hollingsworth was going to be
honored by the Boys & Girls Club at Mountain Shadows Resort on Friday,
October 14, 1994.
Public Safety matter:
Enforcement of violations to alcoholic beverage sales to minors -
City Manager Netter reviewed contents of staff report dated October 6,
1994 pertaining to the referenced item with attached bulletin issued
by the California Alcohol Beverage Control Bureau announcing the State
Supreme Court's decision upholding the constitutionality of the
use of underage decoys by law enforcement agencies. Based on this
report, staff recommends Counci 1 ' s support in the implementation of
this program.
A motion was made by Councilman Hollingsworth, seconded by
Councilwoman Spiro with Mayor Reilly absent, supporting implementation
of the above- reviewed program regarding enforcement of violations to
alcoholic beverage sales to minors, was unanimously approved.

Bicycle Master Plan -
Recommendations from Planning Commission /Parks & Recreation Commission
City Manager Netter advised that the previously submitted Bicycle
Master Plan from the Bicycle Advisory Committee was presented to the
referenced Commissions for review. Recommendations from both
Commissions have now been submitted to Council for review.
Council concurred with staff recommendation to submit the plan for
comment to Sonoma State University (SSU), City of Cotati and the
Sonoma Countywide Bicycle Advisory Committee. Bicycle Advisory
Committee Chairman. Jake Mackenzie asked that final approval be held
until after November 21, 1994 in order to allow time for the Bicycle
Advisory Committee to review the responses. Council concurred.
Open Space District Competitive Matching Grant Program - City Manager Netter shared
contents of letter dated September 23, 1994 from the Open Space
District regarding the Competitive Matching Grant Program. November
15, 1994 is the deadline proposals mast be submitted. Staff is in the
process of surveying particular areas, such as the lot in front of the
Community Center, and will check with the Open Space District for
compliance with specs prior to submitting a proposal. -
Transportation matters:
1. Sonoma County Transportation Authority (SCTA) Citizens Advisory Committee (CAC)
Countywide Transportation Plan Proposal -City Manager Netter referenced
memorandum dated September 27, 1994 from Vice Mayor Eck with
recommendations responding to this item. Vice Mayor Eck reviewed
contents therein and responded to questions.
2. Metropolitan Transportation Commission (MTC) - Public Hearing - re. unmet transit
needs, Chambers /County Board of Supervisors at 5:00 p.m., Mbnday,
October 24, 1994 - Director of Public Works /City Engineer Brust
reminded Council, for its information, of the rescheduling of this
public hearing to the designated time and date. He commented that
these unmet needs only relate to those that use TDA funds. There are
only'about three cities that use TDA funds which include Rohnert Park.
3. SCTA meeting, Oct. 3, 1994 - Report - Director of Public Works /City Engineer Brust
referred to the agenda for this meeting with handwritten actions as
signified. He and Vice Mayor Eck responded to questions including
informational item VI regarding the SCTA /MCPA Joint Executive
Committee Meeting report on a $400,000 State grant and the State now
requesting $80,000 local matching funds. There were comments about
various types of funding anticipated to be in short supply after the
election so discussions are proceeding about possible mandates.
Communications- Communications per the attached outline were brought to the
attention of the City Council. No action was taken unless
specifically noted in these minutes.
1. Emergency Medical Van recommendation by Senior Citizens Advisory Commission -
Councilwoman. Spiro referred to #4 on the ComiTunications list regarding
this item. She said it should be given consideration and requested
staff to look into the matter for emergency preparedness. City
Manager Netter responded that staff has reviewed possibilities which
have proven to be very expensive. There is an ambulance stationed
here and staff will check further into the medical van possibilities.

2. Underground Tanks /Passage of SB 1764 - City Manager Netter referred to item #7
listed on Com ninications regarding this item which was worked on by
Director of Public Works /City Engineer Brust. The bill was signed by
the Governor signifying effective results of combined efforts.
Vice Mayor Eck recommended drafting a responding letter for approval
by the full Council on the next agenda expressing appreciation to
the Governor for signing the bill and to Senator Mike Thompson
for his efforts.
City 1v1anager Netter reported on a recent incident pertaining to a
broken valve on a diesel tank causing a spill in a specified area in
the gravel around the tank and some leakage into the storm drain.
This has been cleaned up and the responsible party is currently
looking into replacement of the tank.
City Manager's report:
1. Automatic Aid with Rancho Adobe -City Manager Netter gave an update on this item.
The Rancho Adobe board meeting is scheduled for October 18, 1994.
Director of Public Safety Rooney has indicated that the automatic aid
decision with Rancho Adobe will not be made until after that meeting.
City Manager Netter responded to Council questions.
2. Nbbile Home Park Purchase Program - City Manager Netter updated the City Council
on the Mobile Home Park Purchase Program. He confirmed that Bond
Consultants were hired by Council approval several months ago and that
up to $15,000 has been authorized for this project. He indicated that
Phil Hoon from Sutro & Cody has recently hired an appraiser from
the firm of Palmer, Groth and Pietka which are registered MIA
appraisers and they are beginning to do the appraisal work on Las
Casitas and Rancho Feliz Mobile Home Parks. In addition, an
independent Park Resident Liaison Consultant has been hired by the
name of John DuPriest. He will act as the contact with mobile home
park residents in explaining the details and negotiating contracts.
W. Netter said Phil Hoon indicated that the appraisal work should be
completed by the first part of November 1994.
City Manager Netter also reported on Valley Village Nbbile Home Park
and a meeting held with CB Commercial and the Bond firm of Stone &
Youngberg. The owner, W. Heath, has insisted on using the Broker CB
Commercial in conjunction with Stone & Youngberg as underwriters in
the bonds for the Valley Village Nbbile Purchase Program.
City Manager Netter then explained the possible bonding structure
through the Conmmity Development Agency Housing Set -Aside Funds and
indicated that the 1994 -95 CDA budget provides for a set -aside of $1.3
million for the Mobile Home Park Purchase Program. A copy of the CDA
budget was distributed to the City Council. City Manager Netter also
indicated that these funds would be used as Credit Enhancements in the
Bond Program to secure a AAA rating and lower interest costs. He also
indicated that the question of bonding capacity through the CDA is not
a yes or no answer but "it depends" on the bond program structure.
The major factor includes the purchase price of the park, interest
rate, net revenues generated by the parks and available funds as a

pledge from the CDA as a Credit Enhancement. He indicated that Bond
Consultants have mentioned the possibility of pledging General Funds
to assist in the program. City Council had previously indicated it
would not look favorably on pledging General Fund monies. City

3. Willis Avenue abandonment issue - Director of Public Works /City Engineer Brust
updated the Council on this item per road diagram/map on display. The
area of concern expressed at the previous Council meeting was related
to the Levitz construction site. They are working on making things
right with the adjoining property owner and the contractor is willing
to work with the owner on property access.
4. PAL building /Status of property - In response to Council inquiry at the previous
meeting, City Manager Netter reported that the PAL building has not
been sold. The real estate signs have been taken down because PAL is
in the process of changing real estate brokers. Comments included
reference to previously discussed improvements of the gravel parking
lot and that such improvements will depend on new user needs.
5. 1995 Underground Project re. College View to Bruce on Adrian $400,000 -
City Manager Netter updated the Council on the progress of this
project anticipated to commence in the spring of 1995.
6. Expressway Overpass Public Safety Signal Control Devices - City Manager Netter
gave an update on this item referencing staff report dated September
15, 1994 from the Department of Public Safety. Director of Public
Works /City Engineer Brust recommends installation of the signal
control devices be deferred until Expressway overpass improvements are
started next spring.
7. Rohnert Park Symphony Change - City Manager Netter said the recent newspaper
article on this item already provided a sufficient update to Council.
The Symphony Board has decided not to renew Karla Lemon's contract and
is in the process of discussing an alternative conductor. In the
interim, Asher Raboy has been hired for the first concert and other

9. Shopping Carts - City Manager Netter reviewed current procedures to alleviate
the shopping cart problem throughout the community and solicited
Council's direction toward more effective results. Comparisons were
made between abandoned vehicles and carts. Council agreed staff
should review the matter further giving consideration to an ordinance
or some other plan that might work better.
10. Proposed County Refuse Disposal Fee Schedule - City Manager Netter reported that
the County is recommending raising the tipping fees at the Sonoma

the garbage rates and would report the results after meeting with
Empire Waste Management as the City is now tied to a formula based on
tipping fees increases and CPI.
11. Avenue of the Flags Ceremony - City Manager Netter advised that in a discussion
with George Williams, who has been very active in the Memorial Day
events at the Community Center, has recommended holding off the Avenue
of Flags Ceremony until Memorial Day 1995. Vice Mayor Eck suggested
inviting Jim Chaaban of Lynn Woolsey's office. Council concurred.
12. Performing Arts Center /1940's Radio program - City Manager Netter announced the
scheduling of this radio program on Friday evening, April 21st, 1994.
13. Employee Appreciation Affair - City Manager Netter reviewed previous efforts for
this event and asked about Council's desires for the next one.
Council comments included concerns that last year's stage setting was
too formal and restricted mingling. Suggestion was made to consider
something in between last year's event and previous years' events at
the Red Lion, keeping economical factors in mind, such as PAC lobby or
the Community Center. City Manager confirmed he would bring the
matter up at the next staff meeting.
14. Golf Course matters - City Manager Netter reviewed meeting with Mark Flowers,
General Manager of Mountain Shadows Golf Course, regarding the
installation of the new speaker system at the golf course within the
next couple of weeks. Letters will be sent to vendors not to deliver
supplies before 6:00 a.m.
Al Barr requested from the audience that the vendor delivery time be
changed to 7:00 a.m. Council agreed.
Councilwoman. Spiro said the last two Golf Course Council Committee
meetings were canceled by the Golf Course representatives for
different reasons and requested staff to check into rescheduling.
15. November 8th City Council Meeting - City Manager Netter pointed out that the
first Council meeting in November falls on election night and asked if
Council preferred to schedule the meeting on a different date.
Council concurred retention of November 8th for the Council meeting
but with preference to a light agenda.

City Attorney's report:
1. Any items reported in Closed Session - City Attorney Flitner reported there has
been no action regarding either the Hallock or the Hillsboro cases.
It is expected that the judge will change the Hallock action and as
soon as that direction is known, the process of appeal can start.
2. Misdemeanor prosecutions - City Attorney Flitner reviewed contents of his
memorandum dated September 26, 1994 with attached copy of the
agreement between the Sonoma County District Attorney and the City of
Santa Rosa for law clerk services. This was provided to Council for
informational purposes.
3. Water Quality Association vs. City of Escondido, et al, - City Attorney Flitner
reviewed the referenced letter dated September 28, 1994 regarding a
request for amicus support. He recommended support. Council concurred.
4. City of Huntington Beach re. settlement against large oil corporations -
City Attorney Flitner reviewed letter he received requesting amicus
support pertaining to the referenced item involving inclusion of
municipalities in dispersement of $81 million settlement.
A motion was made by Councilwoman Spiro, seconded by Councilman
Hollingsworth, and unanimously approved, declaring this an emergency
item.

amicus brief and signify the desire for Rohnert Park to obtain its
fair share with comparison to large percent of related purchases in
this area.
5. Sim I vs. City of Rohnert Park - City Attorney Flitner said he called today to
inquire about the Sim I Greenbook case and was told it was set to
argue on November 16 or 17. This should be confirmed by next week.

Public Mayor Pro Tempore Eck opened the public hearing at approximately
Hearing 9:42 p.m. There being no one desiring to speak, the public hearing
was closed.
Due to the lateness of the hour, Council concurred to defer this item
to the next scheduled General Plan meeting at 5:30 p.m. on Tuesday,
October 18, 1994 at the Hewlett Packard Facility located at 1212
Valley House Drive, Building One - Auditorium.

Al Barr, 5746 Dexter Circle, expressed appreciation for Council concurrence to
change the vendor delivery time at the golf course from 6 to 7:00 p.m.
He recommended such time be 8:00 a.m. on weekends and holidays.
Council agreed.
Julie Wood, 7292 Calcutta Court, referred to the grant application for the new
officers and thought proper recognition should be given to
Councilwoman Gallagher for inviting Congresswoman Woolsey into their
neighborhood as she only knew of their Neighborhood Watch efforts.
Adjournment Mayor Pro Tempore Eck adjourned the meeting at approximately 9:45 p.m.
