1994/10/25 City Council MinutesRohnert Park City Council Minutes October 25, 1994 The Council of the City of Rohnert Park met this date in regular session commencing at 6:00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Reilly presiding. CALL TO ORDER -Mayor Reilly called the regular session to order at approximately 6:20 p.m. and led the pledge of allegiance. ROLL CALL Present: (5) Councilmembers Eck, Gallagher, Hollingsworth, Spiro and Mayor Reilly Absent: (0) None Temporary Youth Committee present: Representative Jennifer Mello Staff present for all or part of the meeting: City Manager Netter, City Attorney Flitner, Assistant City Manager Leivo, Director of Public Works /City Engineer Brust and Planning Director Skanchy Mayor Reilly advised that a closed session commenced this evening at 6:00 p.m. to discuss litigation matters as listed on the agenda attachment. The pending litigation matters were regarding Hillsboro vs. City of Rohnert Park and Sim I vs. City of Rohnert park. City Council has directed the City Attorney to continue with appeals on both cases. The City Attorney will review these items further later as signified on the meeting agenda. In addition, a personnel matter was discussed. The Mayor said no action was taken and there was nothing further to report at this time. Approval Councilwoman Gallagher referred to page 9 of the October 11 minutes of regarding Housing Set -Aside Funds and said the City Manager's Minutes explanation should be added that equates the bonding capacity. City Manager Netter indicated that it would be approximately $4 to $5 million based solely on the annual CDA tax increment. She also requested that the reference to her leaving the chamber "due to a conflict of interest" be changed to "to avoid a conflict of interest" (page 4 of October 11 minutes). Mayor Reilly said the invitation to unscheduled public appearances on page 12 of the October 11 minutes should be changed from Mayor Reilly to Mayor Pro Tempore Eck. Upon motion by Councilman Hollingsworth, seconded by Councilman Eck, the minutes of October 4 and 11, 1994 with above - reviewed corrections, were unanimously approved as amended. Approval City Manager Netter responded to Council questions related to the of bills presented for approval. Bills Upon motion by Councilman Hollingsworth, seconded by Councilwoman Gallagher with previously signified no vote by Councilwoman Gallagher on $10,000 payment to the Sonoma County Wineries Assn., City bills presented per the attached list in the amount of $1,273.311.46 were unanimously approved. Rohnert Park City Council Minutes (2) October 25, 1994 Non- agendaed Mayor Reilly asked if any Councilmember had any items to add to the matters agenda. Vice Mayor Eck signified two miscellaneous items. Council- woman Spiro said she might have miscellaneous items. Councilwoman. Gallagher signified two miscellaneous items. Unscheduled Mayor Reilly stated that in compliance with State Law (The Brown Act), Public citizens wishing to make a comment may do so at this time. Persons Appearances speaking under unscheduled public appearances are requested to submit completed cards to the recording clerk. Gary Holmes & Brendan Tracey, New Zealand Youth Representatives, explained reasons for attending this Council meeting, and other such meetings in surrounding comm.mities, to compare municipal procedures of America with those of New Zealand for their particular study in process. They reviewed youth related concerns and urged the City Council to permit youth to participate in Council meetings and be allowed to take an active part in responsibilities. Efforts were encouraged toward the need of keeping young people active with positive energy. Council invited the young men to leave a phone number with the Mayor to enable staff to make arrangements for a tour of City Hall for a first hand view of City facilities and processes. Patricia Burns, 936 Helene Court, explained the benefits of the "H" Pool Senior Aqua -Cise program and urged the Council to keep the Honeybee Pool open during the winter season. Youth Committee report - Representative Jennifer Mello reviewed highlights of Youth Committee Agenda of October 24, 1994 with attached October 11, 1994 meeting minutes provided to Council. Ms. Mello also referred to Fact Sheet application from Judy Rico, a student at Nbuntain Shadows Middle School, signifying interest in appointment to the Youth Committee. Upon motion by Councilman Hollingsworth, seconded by Councilwoman. Spiro, appointment of Judy Rico to the Temporary Youth Committee, was unanimously approved. Council comments included explanation that the temporary status of the Youth Committee was only until such time as necessary ground work efforts are accomplished, afterwhich the Temporary Youth Committee will make recommendations to the City Council for the on -going establishment of the Youth Committee. Council extended compliments for the effective progress of the efforts of the Youth Committee, especially noting the wisdom of setting hard and fast rules of attendance as a requirement for membership. Scheduled Public Appearances: 1. Friends of the Animals in the Redwood Empire (F.A.I.R.E.) presentation of $15,000 contribution to the new Animal Shelter - Holly Blue, President, introduced FAIRE representatives as follows: Meg Crumley, Shelter Manager /City; Carol Haggerty, Treasurer /Board Member; Al Haggerty, Board Advisor; Ann Strom, Secretary /Board Nbmber; Gloria Menchini, Board Member; Denise Hill, Vice President /Board Member and part -time Volunteer Coordinator for the City; Vesta Jelte, Board Advisor; and Paul Hock, Assistant Treasurer /Board Member. Nis. Blue updated the City Council on the progress of the new Animal Shelter. Fundraising efforts produced a little over $20,000 of which $15,000 is being contributed to the City to assist with the purchase of the steel animal cages, leaving a little over $5,000 to be spent as needed at the Animal Shelter. FAIRE President Holly Blue and Assistant Treasurer /Board Member Paul Hock presented the $15,000 contribution to Mayor Reilly who received it on behalf of the full Council for the purchase of the animal cages at the Animal Shelter. Lew Kuehm of Rohnert Park Association for the Arts, distributed communications to the Council regarding up- coming activities and reviewed contents therein (copy attached to original set of these minutes). He recognized the efforts of Mark Luca who has been tending to the rotation of art exhibits in five locations in the comnmity. Rohnert Park City Council Minutes (4) October 25, 1994 Sonoma County Convention & Visitors Bureau - Introduction of Director Mayor Reilly introduced Estelle Miller as the new Executive Director of the Sonoma County Convention & Visitors Bureau. Ms. Miller expressed appreciation for the opportunity to meet the City Council. She reviewed her background bringing her to this new position and shared her hopes for a strong united front with the different visions of each region in working together toward building successful tourism opportunities in the area. She extended an invitation to the Council to call on her for any related questions they might have and expressed willingness to work with them on recommended projects. Ms. Miller invited the Council to visit their office anytime to get acquainted. Founders' Day Committee letter request for use of parking facilities - City Manager Netter acknowledged the presence of Patty Coe, Parade Chairperson at the Council meeting. He shared contents of her letter requesting use of the parking lot facilities at the Rohnert Park Comn,inity Center on September 15, 1995 from approximately 7:00 a.m, to 1:00 p.m. for the hosting of the 1995 California State Horsemen Association's National Event. Mr. Netter advised checking with the the Recreation Department and the Performing Arts Center and both Director's have indicated there should be no problem with this request. The letter also includes requesting the City's support for Patty Coe to ask the Soccer Leagues and the Pop Warner Football, or any other conflicting events, not to schedule games until after 1:00 p.m. on September 15, 1995 so more children will be able to participate in the Founder's Day Parade Day. City Manager Netter responded to questions. Upon motion by Councilman Hollingsworth, seconded by Vice Mayor Eck, the above- reviewed request of the Founder's Day Association for use of parking facilities at the Comnmity Center on September 15, 1995, including the City encouraging the Soccer Leagues and Pop Warner Football to hold off games on the parade morning and becoming a part of the event, was unanimously approved. Resolution A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK APPROVING No. 94 -168 AGREEMENT WITH OLD ADOBE DEVELOPMENT SERVICES, INC. City Manager Netter explained the resolution. Mayor Reilly expressed appreciation for the organization and further explained that OADS encourages the hiring of individuals with developmental disabilities and provides proper supervision for overseeing the workers. Upon motion by Councilman Hollingsworth, seconded by Councilwoman Gallagher, and unanimously approved, reading of Resolution No. 94 -168 was waived and said resolution was adopted. Ordinance AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING CHAPTER 2.60 OF THE No. 593 ROHNERT PARK "ICIPAL CODE (CONFLICT OF INTEREST) TO PROVIDE FOR DISCLOSURE CATEGORIES FOR CITY OFFICERS, EMPLOYEES AND CONSULTANTS AND OTHER DEFINED PERSONS City Manager Netter explained the ordinance which was introduced at the previous Council meeting. City Attorney Flitner reviewed the revised definitions recommended at the previous Council meeting. Upon motion by Councilman Hollingsworth, seconded by Councilwoman. Spiro, and unanimously approved, with revised definitions by City Attorney to add earnings and consultant language to comply with the broader language of State law, reading of Ordinance No. 593 was waived and said ordinance was adopted. Rohnert Park City Council Minutes (5) October 25, 1994 Parks and Recreation matter: Honeybee Pool - Request by Lap Swimrers to keep pool open for winter - City Manager Netter referred to staff reports for this item dated September 30, 1994 and October 17 & 19, 1994 regarding review of costs, financial information and possible alternatives to consider. Additional letters, along with those presented at the previous Council meeting, were received from Candice Dahlstet, William Conner and Linda Eccles requesting H Pool be kept open during the winter months. Discussion concluded upon motion by Councilman Hollingsworth, seconded by Councilwoman Spiro, and unanimously approved, to keep Honeybee Pool open during the winter season with no rate increase for this year, that the item would be reviewed during next year's budget sessions, and with direction for the Parks and Recreation Commission and staff to work on creative ways to decrease the deficit, including active participation of the lap swimmers in providing solutions for future years. In response to Council comment, for the record, City Manager Netter said the Council did not previously approve the budget for the pool to be open year round but did approve opening the pool in February for the High School swimming program. RECESS Mayor Reilly declared a recess at approximately 7:15 p.m. RECONVENE Mayor Reilly reconvened the Council meeting at approximately 7:26 p.m. with all Councilmembers present. Public Safety matter: DUI -Check Point Program in conjunction with California Highway Patrol - City Manager Netter reviewed staff report dated September 18, 1994. He responded to Council questions confirming that the Sobriety Check- point Program has been instituted in surrounding conTamities and, with the California Highway Patrol located in Rohnert Park, it desires to work in partnership with the City to implement this promotional and informational program, including distribution of flyers. This should be a beneficial effort because of the upcoming holidays. Discussion concluded upon motion by Councilman Hollingsworth, seconded by Councilwoman Spiro, and unanimously approved, for implementation of the above - reviewed DUI Checkpoint Program in conjunction with the California Highway Patrol. Council requested to receive all printed materials and dates and times of when the check points would be held with proper notice to the public being made. Planning and Zoning matters: File No. 0458 - State Farm Insurance - Site Plan & Architectural review of a security fence to be placed around the perimeter of the Northern California Regional Insurance facility. Subject property is located at 6400 State Farm Drive in the PA:PD District - Planning Director Skanchy referred to plans on display and shared contents of staff report dated October 19, 1994 pertaining to this item. He displayed a sample of the proposed security fence and responded to questions. Upon motion by Councilman Hollingsworth, seconded by Councilwoman Gallagher, including direction to work with staff to move the fence into the trees closer to the parking area, File No. 0458 for the State Farm Insurance security fence, was unanimously approved. Rohnert Park City Council Minutes (6) October 25, 1994 File No. 1650 - Caffino's Drive Thru Espresso - Variance, Use Permit, Site Plan & Architectural review for a drive - through espresso bar. Subject property is located at 6325 Commerce Blvd. in the Northbay Shopping Center contiguous to Pay Less Drug in the CR:PD District - Planning Director Skanchy referred to plans on display, shared contents of staff report dated October 19, 1994 pertaining to this item and responded to Council questions. Discussion included Council concerns about the possibility of overuse of variance use permits which may reveal a need to change the City's Upon motion by Vice Mayor Eck, seconded by Councilwoman Gallagher, to deny the request of File No. 1650 without prejudice pending staff review of parking requirements, was approved by the following vote: AYES: (4) Councilmeniers Eck, Gallagher, Spiro, and Mayor Reilly NOES: (1) Councilman Hollingsworth preferring continuance rather than denial without prejudice ABSENT: (0) None Shopping Carts - City Manager Netter shared contents of staff report updating the Council on the status of the abandoned shopping carts issue which has been reviewed with Council over the past several months. Katherine Collins, 828 Lilac Way, said she does not allow people to take their shopping carts. Business owners should not be held accountable for theft. When the carts are missing or removed from her property, she reports them as stolen. Discussion concluded upon motion by Councilman. Hollingsworth, seconded by Councilwoman Spiro, to proceed with drafting an ordinance for Council's consideration regarding the abandoned shopping carts, as recommended by staff, was unanimously approved. City Council Committee Reports: 1. Mobile Home Park Purchase Program -The Council Committee comprised of Mayor Reilly and Vice Mayor Eck, along with City Manager Netter, reported on results of most recent meeting held last Wednesday morning updating the City Council on the progress of this program. The report included status of appraisals on Rancho Feliz and Las Casitas mobile home parks; John DuPriest, the independent Park Resident Liaison Consultant recently hired by Sutro & Cody, has been working on the two parks. Valley Village Mobile Home Park, which was also thought to be part of the Sutro program, changed and began discussions with the Stone & Youngberg bond house. There is some indication that Valley Village may be interested in using Sutro under its program. There, the three mobile home parks are being considered with the first two a little farther along than Valley Village. Valley Village owner, Joel Heath, is scheduled to meet with Sutro over the next two weeks. Following the park owner's discussion with Sutro, a decision will be made on whether the Sutro or Stone & Youngberg program is pursued. The Council Committee may want to meet with CB Financial and Stone & Youngberg if the owner chooses this program, to learn more about its program. Rohnert Park City Council Minutes (7) October 25, 1994 Council Committee and City Manager responded to Council questions including confirmation of the need to be very sensitive not to jeopardize the pending mobile home rent control lawsuit which was the reason for hiring John DuPriest, the independent liaison consultant. Vice Mayor Eck reviewed background history of the Nbbile Home Park Purchase Program and distributed to Council a calendar time table that he put together from past City records, specifically noting that he did not utilize staff time, but prepared it himself. This effort may have been pushed back a bit because of problems related to obtaining companies with the expertise and competence to work out the many complexities of such a purchase program, such as how to do the books because of current laws up to the current dealings with W. DuPriest. Vice Mayor Eck said he put forth this effort because of concerns about hearing people say nothing is being done and, especially, the indications from certain misleading campaign comments that the City has done nothing. Charles Kitchen, 4945 Fern Place, asked if any composites by the Grumbley /Flores plan had been received for estimated cost comparisons. Vice Mayor Eck responded that the City has not been working with them, but it is good to see they are supporting the City's plan since seven out of their nine steps were approximately the same. 2. Golf Course Committee - Council Committee comprised of Councilman Hollingsworth and Councilwoman Spiro updated Council on recent meeting with American Golf representatives, Dan Ross and Kevin Roberts. Discussion included 11 review of the existing 40 year contract negotiated when the rates -'CORRECTION from were set.P�'Response was given by the Council Committee that the City 11/8/94 Council would be more than happy to re- negotiate the contract but at this meeting: point in time left them with the idea that American Golf needs to look Per Councilwoman at several things needing attention at the golf course. City Manager Spiro with con- Netter updated Council on recent communications with Mark Flowers, firmation by City General Manager of Mountain Shadows, regarding installation of Manager Netter speakers at the golf course expected by Thursday. Rohnert Park City Council Minutes (8) October 25, 1994 Communications (cont'd): 2. Mayors' & Councilmembers Association meeting at Santa Rosa Citv Hall, 7:00 p.m., Thursday, October 27, 1994 - City Manager Netter brought Council's attention to item #13 on Communications regarding the referenced meeting agenda notice. City Manager's report: 1. The same formula adopted in 1992 -93 for calculating both refunds is recommended for approving the 1993 -94 refunds. This represents a refund of $228,192 to Rohnert Park for the Liability Fund and a similar amount for the Workers' Compensation Fund. 2. New West Chamber Orchestra - name change to Rohnert Park Chamber Orchestra - City Manager Netter advised the Council of this name change which was probably part of the results of recent decision related to changing conductors. Council agreed a letter of appreciation over the Mayor's signature should be sent to Karla Lemon for her efforts and past performance as the conductor. Vice Mayor Eck extended a reminder that the Orchestra would be playing this weekend with the informal introduction on Friday evening prior to the performance. 3. Public Safety policies - City Manager Netter responded to questions raised at the previous Council meeting regarding Public Safety policies as follows: (1) Responding to the inquiry of Councilwoman. Gallagher on the policy of citing emergency vehicles of other agencies, City Manager referred to a discussion he had with Director of Public Safety Rooney. He said speculation is that this involves Rancho Adobe Fire District as Director Rooney observed a speeding vehicle (Rancho Adobe) going through the City, which he originally thought was a Rohnert Park unit. When he found out it was Rancho Adobe's, he made a professional courtesy call to the Rancho Adobe Chief. No citations were issued, nor was the vehicle even stopped. The department is concerned about traffic safety, as there is potential liability and the city must be concerned about residents and children who may be in those residential areas. (2) Responding to the question from Councilwoman Gallagher about a Rohnert Park Public Safety vehicle driving on a person's lawn to inspect someone's back yard, more specific details are needed to identify the incident. City Manager said the department has policies to respect an individuals personal property and privacy rights. (3) Lastly, responding to Councilwoman Gallagher's comments about a Public Works vehicle carrying an Empire Waste Management can in the back of the truck (inferring that City employees are working for Empire Waste Management), City Manager Netter said he checked into the matter and whenever the Utility Department employee sees a garbage can across the sidewalk or in the street that may be a potential hazard, and the home where it belongs cannot be identified, the City employee will remove the potential hazard. Empire Waste Management is then notified. Rohnert Park City Council Minutes (9) October 25, 1994 Vice Mayor Eck referred to the City's organizational flow chart and said these types of miscellaneous concerns should be presented directly to the City Manager and better handled privately. Further Council comments signified that it is not the job of individual Councilmembers to micro- manage the staff. If a particular Council- person does not feel responses to concerns are adequate, a list could be made for the City Manager to review and specifically say why support is possible or not, or what efforts are being made toward finding solutions. Councilwoman Gallagher signified reasons for asking such questions at Council meetings was that she also wanted some of these things on the record. 4. Tower Apartments Dedication of Public Art, Tuesday, November 1, 1994, 12:30 p.m. City Manager Netter announced this dedication related to a federal grant obtained by Burbank Housing for production of public art at the Tower Apartments. Congresswoman. Lynn Woolsey is scheduled to attend. 5. Rancho Adobe Automatic Aid - City Manager Netter shared results of a meeting held on October 18, 1994 regarding this item. Rancho Adobe prefers to wait until full 24 hour coverage is available before proceeding with an agreement. City Manager and Public Safety Director Rooney are in the process of discussing how the full coverage can be managed. 6. Hewlett - Packard sewer agreement - City Manager Netter advised he is working with the City Attorney on a second letter to Hewlett - Packard regarding the sewer allocation in reference to the existing Utility Agreement. A letter has been sent to Hewlett - Packard directing the first letter to be voided and, therefore, additional discussions with Hewlett - Packard are necessary. City Attorney's report: 1. Hillsboro vs. City of Rohnert Park - City Attorney reviewed contents of his memorandum dated October 25, 1994 regarding proceedings in the Hillsboro Case. The Federal Court stayed proceedings pending the appeal of its decision declaring Ordinance No. 494 unconstitutional, which means the court will not allow Hillsboro to try to impose the capital improvement pass - through until the appeal is decided. City Attorney confirmed the decision would be appealed as previously indicated by Council. 2. Sim vs. City of Rohnert Park - City Attorney Flitner explained this is the Greenbook case and is under appeal. It should be argued sometime in November, 1994. 3. Mobile Home Rent Appeals Board meeting - City Attorney Flitner reviewed previous reasoning for discontinuing these Board meetings until after results of pending litigations involving the Hillsboro case. It may be neces- sary to change that status because of the need to give attention to Rent Appeals Board budgets, CPI rent increase notice requirements, etc. W. Flitner recommended the Rent Appeals Board reconvene its meeting in November to deal with the matter. Council discussion concluded that the City Attorney should make that decision to assure the irrpartiality of the City Council. Rohnert Park City Council Minutes (10) October 25, 1994 3. 1st Time Home Buyer Program — City Attorney Flitner shared contents of his mmo- randum dated October 19, 1994 regarding his review of this item as requested at the previous Council meeting. The arrangement with First Security Loan Corporation to administer the first time buyer program does not violate the public bidding requirements under the Public Contracts Code because the subject matter of the contract is not a public work. Thanksgiving week - November 22nd, 1994 City Council meeting - Council agreed the decision regarding the scheduling or cancellation of this meting should be deferred to the next Council meting. 3. Codding Enterprises /Laguna Apartments Project - Vice Mayor Eck referenced letter from Codding Enterprises regarding variance changes, etc. that is before the Planning Commission for consideration. He requested this item be placed on the next Council agenda as he would like to bring up some questions related to the matter. Councilman Hollingsworth- Councilman Hollingsworth left the chamber at approximately 8:50 p.m. leaves 4. Sonoma Valley Bagel - Ribbon Cutting Ceremony, 9:30 a.m., Wed., October 26, 1994 Nkyor Reilly announced this ceremony and that he would be unable to attend due to conflicting schedules. Vice Mayor Eck confirmed his previous consent to attend the ribbon cutting for Sonoma Valley Bagel. Rohnert Park City Council Minutes (11) October 25, 1994 RECESS Mayor Reilly declared a recess at approximately 8:51 p.m. in order to proceed with the Community Development Agency meeting scheduled later on the agenda. RECONVENE Mayor Reilly reconvened the Council meeting at approximately 9:07 p.m. with all Councilmembers present except for Vice Mayor Eck arriving late during opening comments at approximately 9:09 p.m. General Plan Update Work Session - Land Use element Council discussion of the referenced portion of the Second Draft General Plan dated June 30, 1994 included the following directives: Page 2:17 - Retain the new Civic Center as conceptual proposal but signify a higher priority to the new Library proposal referenced on page 2:21. Page 2:19 - Add a section preceding the section on Roberts Lake for the completed Community Center Complex including the new swimming pool with a drawing like Figure 2.14 for the Wine Center. Page 2:19 - Change wording in Sonoma County Wine and Visitors Center section from "was built by" to "through the efforts of" the Sonoma County Wineries Association. Page 2:19 - Revise the new Animal Shelter section as development has been accomplished. Page 2:21 - Change wording in Codding Center section continued in first paragraph on this page referring to the remodeled building for a senior citizens center, a youth center,etc.,change "youth center" to City Hall Annex ". Page 2:21 - Consideration was given to include in the Summary "and other sections" after neighborhood centers in "G" and "M" sections, with comments that recreation centers may not be necessary in every park, and with conclusion this should be re- addressed in the Master Plan. Page 2:21 - Remove the final reference in the Summary to "a new animal shelter ", as previously mentioned, because this has been accomplished. Page 2:21 - Since the Land Fill section was prepared by the Planning Commission prior to completion of the Integrated Waste Management Plan and Siting Element, reference the Siting Element instead of existing text. Page 2:21 - Suggestion was made to update the Rohnert Park - Cotati Regional Library section as it was not certain all three entities referenced were still involved in pursuing the combined new library and learning center. The question was raised about the possibility of the School District pulling out of the effort. Rohnert Park City Council Minutes (12) October 25, 1994 Page 2:21 - Statistical numbers and dates under the Public Improvement Financing section were referenced with discussion related to additional staff time and effort involved to update the entire document to current numbers and dates. A motion was made by Vice Mayor Eck, seconded by Councilwoman Gallagher, and unanimously approved, to update the General Plan document to June 30, 1994 representing the most recent fiscal year end. Page 2:22 - Change the lined out hospital need on same Figure 2.15 to signify the need or goal of having a 24 -hour emergency care facility. Page 2:23 - The Open Space Buffer section should be consistent with the County General Plan. This section contains a definition and is not a policy statement. Question was raised about the general order of the General Plan elements. Assistant City Manager Leivo noted that citizens and the Planning Commission had all the elements before them during discussions. It should be considered as one integrated document. Council concluded it could decide the actual order of the elements after review of the entire document. Page 2:26 - Clarify in section 1 under Principles the reason for lining out the work "residential" describing any future development in that villages are commercial and industrial with housing and shopping combined. Page 2:26 - Remove section 3 under Principles referring to discouragement of strip type commercial development since it is a concept that does not apply in Rohnert Park. Page 2:26 - Change the reference to population of approximately 40,000 in section 1 under Policies to be consistent with current figure. Page 2:26 - The lined out section 2 under Policies should be restored to supporting the general concept of the Sonoma County Land Use designations until such time as the Council completes its review of the elements, i.e. support in concept in the General Plan. Page 2:26 - In item 3 under Policies which encourages Open Space District and other entities to implement community separator policies in the Sonoma County General Plan, add a reference to the Open Space Acquisition Plan as some open space areas that should be preserved are not within a community separator. Rohnert Park City Council Minutes (13) October 25, 1994 Page 2:26 - Council discussed differing opinions related to various factors of item 4 under Policies that the City shall assure proper maintenance of the comnanity through code enforcement programs, public relations, grants and loans. Council concluded to retain this section. Public Mayor Reilly continued the public hearing from the October 18, 1994 Hearing General Plan Update meeting at approximately 9:55 p.m. Public comments related to this matter were submitted on speaker cards or other written and /or verbal commmications by citizens as follows: Dave Mochel, 4405 Hollingsworth Circle, limited his comments to sections reviewed by Council during this meeting. Page 2:19 regarding Golf Courses is an incomplete discussion. If there are plans for golf courses, the citizens should hear about them and proposals ought to be in the General Plan. Residents stated that this would be their last priority. Page 2:26, item 1 under Policies referring to the City will plan for reasonable growth within the existing city limits. It is known that the City is going over the 40,000 population designated in this section which is a violation in the current General Plan. Councilman Hollingsworth responded that Council previously signified the need to correct the population figure to approximately 45,000. Mr. Nbche1 said the reason citizens want a policy like this is to limit the growth of Rohnert Park. Nothing stops annexing land and growing to 60,000. He recommended changing the definition to "the city's planning area" as that would satisfy what the citizens are requesting. Page 2:26 needs inclusion of the desire for urban growth boundaries within the sections for Objectives, Principles and Policies in the Land Use Element. If this were placed on the ballot, W. Mochel was certain it would receive a two - thirds vote of support. Councilman Hollingsworth- Councilman Hollingsworth left the chamber at approximately 10:00 p.m. leaves The remaining Councilmembers signified agreement to hear minimal public comments for a few minutes past the regular adjournment time of 10:00 P.M. Linda Branscomb, 6585 Commerce Blvd., signified she agreed with previous comments for (1) no new civic center; (2) a new golf course was lowest priority in the citizen survey; and the need for inclusion of urban growth boundaries on page 2:26 within the Land Use Element sections for Objectives, Principles and Policies. Heidi Weil, 193 Fescue Way, expressed agreement with Land Use /Standards as follows: item 16 regarding one elementary school carpus for each 5,000; item 18 regarding a neighborhood park of approximately five acres for each 5,000 residents located within a mile of those residences; item 19 regarding a swimming pool for each 10,000 residents. Rohnert Park City Council Minutes (14) October 25, 1994 Debra Hales, 825 Liana Court, expressed support of code enforcement efforts. Before the city does any more building of new homes, she urged attention to the old homes. Ms. Hales also expressed concern about the Open Space District possibilities of purchasing land for golf courses. Vice Mayor Eck responded that the Open Space District has a standing policy not to include golf courses as an option for open space purchases. The District has turned down every city that has presented the idea. The Open Space District might purchase certain lands with an option for a city to re- purchase it back, but no city has ever There being no one further desiring to speak, Mayor Reilly closed this meeting's portion of the General Plan public hearing at approximately 10:08 p.m. to be continued at the next work session for the General Plan Update. Council expressed preference to schedule future work sessions for the General Plan separate from regular Council meetings. Council agreed to tentatively schedule the next General Plan Update Work Session on Tuesday evening, November 15, 1994 with confirmation to be signified at the next City Council meeting of November 8, 1994.
