1995/01/24 City Council MinutesRohnert Park City Council Minutes January 24, 1995 The Council of the City of Rohnert Park met this date in regular session commencing at 6:00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Eck presiding. CALL TO ORDER Mayor Eck called the regular session to order at approximately 6:25 p.m. and led the pledge of allegiance. Mayor Eck advised that a closed session commenced this evening at 6:00 p.m. to discuss items as listed on the agenda attachment as follows: two litigation matters regarding Kuhn and Presswood vs. City of Rohnert Park and Hallock vs. City of Rohnert Park; real estate negotiations regarding Las Casitas Mobile Home Park/Park Purchase; and a City Administrative personnel matter. One of the litigation matters may be reviewed later during the City Attorney's report. The Mayor said no action was taken and there was nothing further to report at this time. ROLL CALL Present: (5) Councilmembers Flores, Gallagher, Reilly, Spiro and Mayor Eck Absent: (0) None Temporary Youth Committee present: Jennifer Mello Staff present for all or part of the meeting: City Manager Netter, City Attorney Flitner, Assistant City Manager Leivo, Director of Public Works /City Engineer Brust, Finance Director Harrow, Fire Commander Shields and Director of Recreation Director Pekkain. Approval of Minutes: Upon motion by Councilwoman Gallagher, seconded by Councilman Flores, the minutes of January 10, 1994 were unanimously approved as submitted. Approval of Bills: City Manager Netter responded to Council questions related to the bills. Upon motion by Councilman Reilly, seconded by Councilwoman Spiro, City bills presented per the attached list in the amount of $739,136.82 were unanimously approved. Non - agendaed matters: Mayor Eck queried if any Councilmember had any non - agendaed items to add to the agenda. If time permitted, miscellaneous items were signified by Councilmembers Flores, Spiro and Gallagher. City Manager Netter also signified a few miscellaneous items. Unscheduled Public Appearances: Mayor Eck stated that in compliance with State Law (The Brown Act), citizens wishing to make a comment may do so at this time. Under legislation of the Brown Act, in most cases, the Council cannot handle an item without agendizing. To ensure accurate recording, "Speaker Cards" are provided at the entrance of the Chamber and persons speaking under unscheduled public appearances are requested to submit completed cards to the recording clerk. Rohnert Park City Council Minutes (2) January 24, 1995 Unscheduled Public Appearances: (cont'd) Bill Kor tum, 180 Ely Rd., Petaluma, Ca., representing Sonoma County Transportation Land Use Conference, reviewed details of this conference scheduled on Saturday, February 11, 1995 per informational material previously distributed to Council. He explained the request for co- sponsors on promotional literature and requested Council's support and participation. Discussion included acknowledgment of the City Manager's recent response letter signifying support of this effort. Emergency Item declared: Discussion concluded upon motion by Councilwoman Gallagher, seconded by Councilman Flores, and unanimously approved, declaring the above request an emergency Council action item. Upon motion by Councilwoman Gallagher, seconded by Councilman Flores, a $100 contribution for co- sponsorship and participation in the above - reviewed Transportation Land Use Conference, was unanimously approved. Bud Myrick, P.O.Box 175, Santa Rosa, Calif. 95402, from the Church of the New Birth, Sonoma County, expanded on his material versus spiritual views expressed at the previous Council meeting. His comments concluded in continued support of not having a prayer or blessing at Council meetings. CONSENT CALENDAR Mayor Eck asked if anyone had any questions regarding the matters on the Consent Calendar which were explained in the City Manager's Council Meeting Memo. Acknowledging the City Manager /Clerk's report on the posting of the agenda. Resolutions: No. 95 -07 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK COMMENDING REVAN A. F. TRANTER ON THE OCCASION OF HIS RETIREMENT AS EXECUTIVE DIRECTOR OF THE ASSOCIATION OF BAY AREA GOVERNMENTS No. 95 -08 RESOLUTION OF THE COUNCIL OF THE CITY OF ROHNERT PARK APPROVING A LEASE PURCHASE AGREEMENT BETWEEN BANC ONE LEASING CORPORATION AND THE CITY OF ROHNERT PARK No. 95-09 RESOLUTION DECLARING OFFICIAL INTENT OF THE CITY OF ROHNERT PARK TO BE REIMBURSED CERTAIN CAPITAL EXPENDI- TURES FROM PROCEEDS OF LEASE PURCHASE AGREEMENT WITH BANC ONE LEASING Upon motion by Councilman Flores, seconded by Councilwoman Gallagher, the Consent Calendar as outlined on the meeting's agenda, was unanimously approved. Rohnert Park City Council Minutes (3) January 24, 1995 Temporary Youth Committee report: Representative Jennifer Mello, reported on the Youth Committee meeting held on Monday, January 23rd, 1995. The Youth Committee will not be meeting in February because of low attendance but, instead, extensive efforts will be made toward recruitment and building interest in the establishment of the Rohnert Park Youth Committee. Council offered encouragement and made several suggestions toward this effort. Scheduled Public Appearance: Leadership Rohnert Park -Class IV re. visions for the City - Representative Tim Coxon introduced Leadership Rohnert Park - Class IV members present at the Council meeting. He reviewed the "banner of vision" on display showing results of this year's efforts and Leadership Rohnert Park Class IV's vision for the City. This class concluded with a three -day retreat in Healdsburg when the banner was made signifying the hopes of bringing shared goals into reality. Senior citizens proposal for "Destination Rohnert Park" - Presentation by Florence Jennis Flo Jennis reviewed this proposal per Recreation Department staff report dated December 28, 1994, and responded to Council questions. The proposal encourages tour groups to come to Rohnert Park and enjoy the many amenities of the City in conjunction with wine tours, etc. and tours of other parts of Sonoma County. The proposal includes encouraging discount arrangements for such groups with local hotels and restaurants and various other promotional ideas involving the Chamber of Commerce and local businesses. Discussion concluded upon motion by Councilwoman Spiro, seconded by Councilman Flores, to support in concept the above - reviewed proposal for "Destination Rohnert Park ", was unanimously approved. Residential Fire Sprinklers: Fire Commander Shields shared contents of staff report dated January 19, 1995 reviewing fire sprinkler systems and approximate cost comparisons for an average 1700 sq. ft. home for the following: HOT SPOT SYSTEM (City of Petaluma) at $400 -$600; PROPOSED /EXPANDED HOT SPOT SYSTEM (Following NFPA 13D Construction Standards) at $2,125; and PROPOSED FULL SPRINKLER SYSTEM (Following NFPA 13D Construction Standards) at $2,975. City Manager Netter and Fire Commander Shields responded to Council questions related to above - reviewed comparisons. As previously directed by Council, a second public hearing for this item was duly noticed and scheduled for this Council meeting agenda because of the revised cost estimates presented in the updated figures. Smoke detectors /fire alarms are more effective in waking people up and saving lives. Peter Benson of Kaufman & Broad, Santa Rosa, Ca. - Uniform Building Codes are sufficient. Smoke alarms warn occupants before sprinklers activate. Additional expense of other systems not merited. Charlie Carson of Building Industry Assoc. (BIA) - Agreed Uniform Building Codes are guide for most developers. City of Vallejo litigations have proceeded to state level working toward smoke alarms in sleeping areas. There is no reference in the UBC to fire sprinklers, only to smoke alarms with proven point of saving lives. Smoke alarms would need to be tied into sprinkler systems. Insurance breaks (5 % to 7 % of property valuation) only come with the full NFPA 13D sprinkler system which would not make much of a difference with the break for an average home amounting to about $24 per month. There being no one further desiring to speak, Mayor Eck closed the public hearing at approximately 7:26 p.m. Ordinance No. 598 AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING CHAPTER 15.28 SMOKE DETECTORS AND AUTOMATIC SPRINKLER SYSTEMS BY ADDING CERTAIN SECTIONS Discussion included a motion by Councilman Reilly, seconded by Council- woman Spiro, to adopt the ordinance with the full sprinkler system, and failed by a roll call vote with dissenting votes by Councilman Flores, Councilwoman Gallagher and Mayor Eck. Discussion concluded upon motion by Councilman Flores, seconded by Councilwoman Spiro, as amended with revisions for the expanded hot spot system per second proposal of above - reviewed staff report and adding findings in the ordinance, reading of Ordinance No. 598 was waived and said ordinance was adopted by the following roll call vote: AYES: (3) Councilmembers Flores, Reilly and Spiro NOES: (2) Councilwoman Gallagher (signifying disapproval of added con- struction costs and that the second hot spot system does not meet requirements for the insurance break), and Mayor Eck (signifying preference to the first/minimum hot spot system as an initial step for fire safety protection) Rohnert Park City Council Minutes (5) January 24, 1995 Extending Appointment of Richard Brody to Mobile Home Parks Rent Appeals Board: Mayor Eck explained Mr. Brody's desire to continue on this Board. Upon motion by Mayor Eck, seconded by Councilwoman Spiro, and unanimously approved, Richard Brody's appointment was extended to the Mobile Home Parks Rent Appeals Board. Bicycle Advisory Committee appointment (a two year term to expire 12/31/96) - Vacancy left by Andrew Hutchins - Councilman Reilly acknowledged this opening was his nomination and that he had not had an opportunity to visit with the applicant interested in the appointment. Council agreed to defer this item to the next Council meeting. RECESS Mayor Eck declared a recess at approximately 7:50 p.m. RECONVENE Mayor Eck reconvened the Council meeting at approximately 8:00 p.m. with all Councilmembers present. In respect of legal counsel present at this meeting, Mayor Eck advised that the following item listed later on the agenda would be reviewed at this time. Annexation Fees /Public Facility Financing: Legal Counsel Margaret Sohagi referenced her letter dated January 17, 1994 per- taining to proposed ordinance amending the Rohnert Park Municipal Code by repealing Chapter 3.28, Annexation Fees in its entirety, and by adding a new Chapter 3.28 to be titled "Public Facility Financing in Areas to be Annexed ". She reviewed contents therein and responded to Council questions. Discussion concluded upon motion by Councilwoman Spiro, seconded by Councilman Flores, to agendize this ordinance for introduction on the next Council agenda, was unanimously approved. Community Development Block Grant (CDBG) Program - Programs /Projects proposed for Rohnert Park: City Manager Netter reported on this item, as reviewed in the Council Meeting Memo, regarding the four Rohnert Park projects for consideration as follows: 1) Homeless Prevention Group of Cotati /Rohnert Park/Penngrove for $10,000; 2) Rohnert Park Boys & Girls Club for $11,000; 3) City program - Job Creation Revolving Loan Program for $140,000; and 4) City program - Mobile Home Earthquake Resistant Bracing System Program (Rancho Grande and Valley Village) for $200,000. City Manager Netter and Assistant City Manager Leivo responded to various Council questions pertaining to this program and projects listed. It was confirmed that Jennifer Brumley, Special Projects Coordinator of the Sonoma County Community Development Commission was present to respond to questions related to the County -wide Job Creation Revolving Loan Program. A public hearing was duly noticed and scheduled at this time. PUBLIC HEARING: Mayor Eck opened the public hearing at approximately 8:25 p.m. Public comments related to this item were submitted on speaker cards or other written and/or verbal communications by citizens as follows: Ralph Jones, 5309 Country Club Drive, reviewed the merits of the Homeless Prevention program and responded to Council questions related to the application. Rohnert Park City Council Minutes (6) January 24, 1995 Bob Butler, 826 Jewell Avenue, Sebastopol, expressed support of the Boys & Girls Club applica- tion for CDBG funds and responded to Council questions. Jennifer Christie, 8393 Lakewood Avenue, Cotati, also supported the Boys & Girls Club applica- tion for CDBG funds and urged consideration of top priority. She supported City staff recommendations of the projects for the CDBG Program. There being no one further desiring to speak, Mayor Eck closed the public hearing at approximately 8:42 p.m. Discussion included City Attorney Flitner's response to Councilwoman Spiro's inquiry, that there is no conflict of interest as long as a member of a board has no material benefit from a board membership. Ms. Spiro confirmed she had no material benefit related to being a Board Member of the Boys & Girls Club. Discussion concluded upon motion by Councilwoman Spiro, seconded by Councilman Flores, and unanimously approved, to rank the proposed CDBG projects according to the order proposed by staff as follows: 1) Homeless Prevention, Homeless Prevention Group of Cotati, Rohnert Park, & Penngrove ($10,000) 2) Intervention Project for Lower Income Youth, Boys and Girls Club of Rohnert Park ($11,000) 3) Job Creation Revolving Loan Program, City of Rohnert Park ($140,000) 4) Mobile Home Earthquake Resistant Bracing System Program, City of Rohnert Park ($200,000) and, if necessary to provide sufficient funding for housing projects, to authorize the City's representative on the Technical Advisory Committee the flexibility to seek funding for the Mobile Home Program in preference to the Job Creation Program. Bicycle Master Plan: Director of Public Works /City Engineer Brust commented on reports provided to Council related to the Bicycle Master Plan, as reviewed in the Council Meeting Memo. He introduced Jake Mackenzie, Chairman of the Bicycle Advisory Committee, who introduced other Committee Members Rick Luttman, Linda Debolt and Vern Shuck present at the Council meeting. Chairman Mackenzie reviewed background efforts and goals of the Bicycle Advisory Committee. Vice Chairman Luttman gave the formal presentation and updated the City Council on the Rohnert Park Bicycle Plan and shared the Bicycle Advisory Committee's recommendations. A public hearing was scheduled at this time. Rohnert Park City Council Minutes (7) January 24, 1995 Bicycle Master Plan: (cont'd) PUBLIC HEARING: Mayor Eck opened the public hearing at approximately 9:05 p.m. Director of Public Works /City Engineer Brust referred to written communications submitted for the record expressing support and making recommendations for the Rohnert Park Bicycle Master Plan as follows: Rohnert Park Bicycle Advisory Committee City of Rohnert Park Staff comments City Council of the City of Cotati, 201 West Sierra Ave., Cotati, Ca. 94931 Sonoma County Transportation Authority (SCTA)- 2 letters, 575 Administration Dr., Room 105A, Santa Rosa, Ca. 95403 Sonoma State University, 1801 E. Cotati Ave., Rohnert Park, Ca.94928 City Manager Netter responded to inquiry that recent holidays prevented full and adequate advertisement of this public hearing, i.e. the legal requirement of ten days prior to a public hearing. There being no one further desiring to speak, Mayor Eck continued the public hearing at approximately 9:07 p.m. to the next City Council meeting of February 14th, 1995. Mobile Home Parks matters: 1. Amendments to Ordinance No. 494 - City Manager Netter advised a public hearing was duly noticed and scheduled at this time for consideration of the final adoption of Ordinance No. 599 amending Chapter 9.70 of the Rohnert Park Municipal Code to provide for capital improvement pass - through, other changes, and declaring an emergency. PUBLIC HEARING: Mayor Eck opened the public hearing at approximately 9:12 p.m. Public comments related to this item were submitted on speaker cards or other written and /or verbal communications expressing support or opposition by citizens as follows: Lorna Blanc, 43 Verde Circle - SUPPORT - Due to findings of Hillsboro case. There being no one further desiring to speak, Mayor Eck continued the public hearing at approximately 9:14 p.m. Ordinance No. 599 AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING CHAPTER 9.70 OF THE ROHNERT PARK MUNICIPAL CODE (MOBILEHOME ORDINANCE) TO PROVIDE FOR A CAPITAL IMPROVEMENT PASS- THROUGH, OTHER CHANGES, AND DECLAR- ING AN EMERGENCY City Attorney Flitner responded to questions further explaining the ordinance. Upon motion by Councilman Flores, seconded by Councilwoman Gallagher, and unanimously approved, reading of Ordinance No. 599 was waived and said emergency ordinance was adopted. Rohnert Park City Council Minutes (8) January 24, 1995 Mobile Home Park matters: (cont'd) 2. Mobile Home Park Purchase Program: City Manager Netter updated the Council on the progress of this program, as reviewed in the Council Meeting Memo. He responded to Council questions explaining the purpose of the ordinance declaring the need for a Community Development Commission and that it is the structure recommended by the Bond Counsel. Also, City Attorney is in the process of addressing the mobile home park resident letters presented at the previous Council meeting. Katherine Collins, 828 Lilac Way, questioned the logic of recent visit of Councilman Flores to X alley village mumle riuifie rack. Counciirnan Flores responded that it is important for those elected to public office to attend functions to which they are invited, and then to share their particular impressions and perceptions. Mayor Eck further responded that he had been invited to the previous meeting at Valley Village and this time Councilman Flores was invited to attend. Vera Green, President of Valley Village Association, expressed appreciation to Councilman Flores for accepting their invitation to the above - mentioned meeting and for addressing concerns expressed by the mobile home park residents. Ordinance No. 600 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK DECLARING THE NEED FOR THE FUNCTIONING OF THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF ROHNERT PARK Upon motion by Councilman Flores, seconded by Councilwoman Spiro, and unanimously approved, reading of Ordinance No. 600 was waived and said ordinance was adopted. In respect of G Section residents present at this meeting, Mayor Eck advised the agenda item listed later would be moved forward for review at this time. Parks and Recreation matters: 1. G Park baseball field lighting - City Manager Netter reviewed background of this item which Councilman Flores requested to be revisited at the previous Council meeting. Rohnert Park City Council Minutes (9) January 24, 1995 Parks and Recreation matters: (cons' d) 2. G Park softball field improvements - City Manager Netter explained this staff report as reviewed in the Council Meeting Memo. Discussion concluded upon motion by Councilwoman Spiro, seconded by Councilwoman Gallagher, improvements to the Golis Park softball field for girls softball, as recommended by the Parks and Recreation Commission, were unanimously approved. 3. Magnolia Park Master Plan - Due to the lateness of the hour, this item was deferred to the next City Council meeting. 4. Sports Center membership rate special - City Manager Netter explained this staff report as reviewed in the Council Meeting Memo. Recreation Director Pekkain responded to Council questions. Council discussion included concerns expressed by Councilwoman Spiro about the possibility of a negative impact on existing members and potential result of subsidizing with tax dollars. She could support development of some kind of promotion of the off hours but had problem with the overall picture of promoting special discounts for the regular memberships since the City is not an independent company providing a competitive service. Councilwoman Gallagher signified preference to more people at a lower price versus fewer people at a higher price. Council concurred to refer this item back to staff for re- evaluation. City Council Committee /Liaison reports: 1. League of California Cities Revenue and Taxation Committee meeting - Councilwoman Spiro shared highlights of her recent participation in this meeting referencing a discussion paper dated January 1994 by the League of California Cities entitled "Making California's Governments Work ". Ms. Spiro brought specific attention to pages 22 and 23 of the discussion paper and shared contents therein pertaining to the section entitled "Revise Reorganization Laws" regarding impediments to annexation of pockets containing housing and /or manufacturing that should be removed and restraints of LAFCO power to disapprove annexations of territory surrounded by a city. She made comparisons with Rohnert Park's situation and, according to what is happening elsewhere in the state, which is not unique to Rohnert Park. Councilwoman Spiro reviewed concerns that if Rohnert Park, or any city, has an absolutely no growth policy, then there will be no opportunity with a very minimal provision for housing and jobs. She recommended revisiting the open space map for further review of the designated areas surrounding Rohnert Park. Discussion concluded in confirmation that there would be opportunity to review the matter more extensively during General Plan Update work sessions in progress. 2. Performing Arts Center Committee - Mayor Eck reported on this Council Committee meeting held on January 18, 1995 comprised of himself, Councilwoman Spiro, City Manger Netter and Arts Center Director Grice, per staff report provided to the full Council. The report represented working arrangement recommenda- tions of the Council Committee and staff for a 5th Anniversary celebration of the Spreckels Performing Arts Center, mid - fiscal year financial review, the Center's 1995 -96 season, and other miscellaneous matters. Upon motion by Councilman Flores, seconded by Councilwoman Gallagher, the above- reviewed recommendations of the Council Committee and staff for the Spreckels Performing Arts Center, were unanimously approved. Rohnert Park City Council Minutes (10) January 24, 1995 Response to Audit Management Letter - Due to the lateness of the hour, this item was deferred to the next City Council meeting. Review of 6 Month Revenues & Expenditures Report for Fiscal Year 1994 -95 - Due to the lateness of the hour, this item was deferred to the next City Council meeting. Santa Rosa Subregional Sewerage System /Rohnert Park Pipeline - Bid results: Director of Public Works /City Engineer Brust updated Council on this project. Nine (9) bids were received of which results were provided to Council from the Santa Rosa Subregional operation. A motion was made by Councilman Flores, seconded by Councilwoman Gallagher, and unanimously approved, in agreement with Santa Rosa's recommendation to proceed with awarding the contract to the low bidder, Argonaut, for the bid price of $5,848,661 for the Rohnert Park Pipeline /Water Reuse Project of the Santa Rosa Subregional Sewerage System. EXTEND COUNCIL MEETING - At approximately 10:00 p.m., Councilwoman Gallagher recommended extending the Council meeting sufficiently to complete necessary agenda items. Council concurred. Empire Waste Management matters: 1. Request for garbage rate increase - City Manager Netter explained this item per staff report dated January 20, 1994. A public hearing will be scheduled for February 14, 1995 to receive public input on the matter. 2. Request for increase in debris box fees - City Manager Netter explained the letter dated January 11, 1995 from Empire Waste Management submitting financial information and requesting the 1995 increase in disposal rates. Discussion concluded upon motion by Councilwoman Spiro, seconded by Councilman Flores, and approved with Councilwoman Gallagher dissenting, to proceed with the formula presented for the above - reviewed increase in 1995 debris box fees for inclusion in the publication of the public hearing notice for garbage rates. Review of policy on expenses incurred on city business, i.e. conferences, seminars, meetings, etc. - Due to the lateness of the hour, this item was deferred to the next City Council meeting. City & County Working Group /Discussion Group - City Manager Netter explained the draft Mission Statement provided to Council for its review and discussion of this item. Council has also been requested to contribute a $400 share to pay for the facilitator of this Discussion Group. Rohnert Park City Council Minutes 01) January 24, 1995 Sonoma County Grand Jury Report, 1994 - City Manager Netter confirmed receipt of this item submitted to the City Council for its review and /or comments. None of the items in this Grand Jury Report were directly related to the City of Rohnert Park, therefore, Council comments are not necessary this year. The report will be officially received and filed. Communications: Communications per the attached outline were brought to the attention of the City Council. No action was taken unless specifically noted in these minutes. Councilwoman Spiro referenced communications from citizen expressing concern about flight patterns. City Manager Netter responded he would check with the FAA regarding the helicopters and jet traffic concerns. City Manager Netter referred to items 6 and 7 on Communications from the Board of Supervisors regarding the City Selection Committee meeting on Thursday, February 9, 1995. He advised that the Metropolitan Transportation Commission (MTC) appointment requires three names to be submitted to the County Board of Supervisors for its consideration. City Manager's report: 1. Japanese Garden Lamp - City Manager Netter advised that the City will be receiving a large lamp for the Japanese Garden sometime next week as a gift from Sister City Hashimoto City, Japan. 2. DARE Graduation - City Manager Netter confirmed the DARE Graduation on Thursday at the Performing Arts Center and reviewed the request for Auto Dealer sponsor /advertisement for the DARE Program. 3. Storm Cost Summary - City Manager Netter referred to the Flood Damage Report with Storm Cost Summary for January 8-9, 1995 provided to Council for informational purposes. The report is being submitted to FEMA for reimbursement. 4. Boundaries research - City Manager Netter advised that staff has been researching the School District boundaries issue. A School District lobbyist is willing to work with the City to write Legislation, if necessary. Council concurred with the idea but the issue should be represented by speakers from our local School District. 5. Rotary Club donation to DARE Program - Councilwoman Spiro shared information regarding a donation to the DARE Program from the local Rotary Club in the amount of $3,000 that was not acknowledged in the City's Annual Report. She recommended a letter over the Mayor's signature expressing appreciation for the contribution. City Attorney's report: Article XXXIV /The Gardens project - City Attorney Flitner reviewed his memorandum dated December 23, 1994 pertaining to this item. He said the City basically has to follow the stipulations for 51 % related to funding requirements for the development, construction and acquisition of low -rent housing projects, etc. Some projects can be funded if in the 50% category, however, there must be strict compliance with the law. City Manager Netter and Director of Public Works /City Engineer Brust confirmed speed trailers are a good incentive for slowing traffic down and that one could be placed in the referenced area right away. 6. Sphere of Influence /Annexation concerns - Councilwoman Spiro referred to previous request to have City Attorney research legalities of people assuming annexation, especially related to properties in the City's sphere of influence. Council agreed to have the City Attorney research this as a precautionary measure. Flores, Councilman January 24, 1995 The aspect of limiting Babe Ruth League games to seven innings or two hours is reasonable and allows two games per scheduled evening. In reviewing all considerations, it is important to focus on the needs of the players and league and the viewpoints of residents. Unlike Magnolia Park, the homes are closer to the baseball field and the potential for noise is a factor. To respect the concerns of both parties is in the best interests of the children and the city. On this basis, I propose the following program which I believe is feasible and incorporates elements of the recommendation of the Parks and Recreation Commission. It also addresses aspects of residents and baseball league representatives. A. Baseball Program For April - August 31 Game 1, 5:30 P.M 7:30 P.M. Game 2,7:45 P.M. - 9:45 P.M. 1. Field lights are turned off at 9:45 P.M. 2. Flood lights for closing activities are turned off at 10:30 P.M. B. Baseball Program For September I - November 30 Game 1, 5:15 P.M.'- 7:15 P.M. Game 2,7:30 P.M. - 9:30 P.M. I. Field lights are turned off at 9:30 P.M. 2. Flood lights for closing activities are turned off at 10:15 P.M. C. Lighting 1. Full field lights flood the field for game conditions. 2. Flood lights provide minimal fighting for closing . Light is provided for completing snack bar operations and field preparation.
