1995/05/09 City Council MinutesRohnert Park City Council Minutes May 9, 1995 {. The Council of the City of Rohnert Park met this date in regular session commencing at 6:00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Eck presiding. CALL TO ORDER: Mayor Eck called the regular session to order at approximately 7:12 p.m. and led the pledge of allegiance. Mayor Eck advised that a closed session commenced this evening at 6:00 to discuss litigation matters, real estate negotiations and personnel matters as listed on the agenda attachment. No action was taken and there was nothing further to report at this time. ROLL CALL Present: (5) Councilmembers Flores, Gallagher, Reilly, Spiro and Mayor Eck Absent: (0) None Staff present for all or part of the meeting: City Manager Netter, City Attorney Flitner, Assistant City Manager Leivo and Director of Public Works /City Engineer Brust . APPROVAL OF MINUTES: Councilwoman Gallagher referenced page 10, last sentence and asked it be eliminated and stated that the video tape would indicate that she supported the residents and their concerns. Vice -Mayor Spiro referenced item 4 on page 10 and stated that she requested the contributions made by the senior citizens be set out to be shown; on page 11, Open Space, Vice -Mayor Spiro stated the meeting was initiated by the residents with invited council members. Councilwoman Gallagher stated that on page 12, item 2, weed removal, and inquired as to why Mr. Jimmy Rogers' weeds were mowed with taxpayer's money when he can well afford to remove them himself. She stated Mr. Rogers' properties were also mowed last year for a minimal fee. City Manager Netter advised her that the properties were cleared under the weed abatement program. Councilwoman Gallagher stated she wanted her concerns in the Minutes that Mr. Rogers received this service very cheap at taxpayer's expense and he got a great deal. Mayor Eck asked if she wanted that statement in quotes and asked her to come back with a square foot charge for weed abatement. City Manager Netter advised this item will be an agenda item on the May 23rd, 1995 City Council meeting. Upon motion by Councilman Flores, seconded by Mayor Eck, with above reviewed amendments, the Minutes of April 25, 1995 were otherwise unanimously approved as submitted. Rohnert Park City Council Minutes (2) May 9, 1995 APPROVAL. OF BILLS": Upon motion by Councilwoman Gallagher, seconded by Mayor Eck, City bills presented per the attached list in the amount of $1,266,369.37 were unanimously approved. NON- AGENDAED MATTERS': Mayor Eck asked if Councilmembers had any non- agendaed items to add to the agenda. Vice Mayor Spiro stated she had a miscellaneous item to add under Matters from Council. UNSCHEDULED PUBLIC APPEARANCES. Mayor Eck stated that in compliance with State Law (The Brown Act), citizens wishing to make a comment may do so at this time. Under legislation of the Brown Act, in most cases, the Council cannot handle an item without agendizing. To ensure accurate, recording, "Speaker Cards" are provided at the entrance of the Chamber and persons speaking under unscheduled public appearances are requested to submit completed cards to the recording clerk. No one wished to speak. CONSENT CALENDAR Mayor Eck asked if Councilmembers had any questions regarding the matters on the Consent Calendar which were explained in the City Manager's Council Meeting Memo V Acknowledging the City Manager /Clerk's report on the posting of the agenda. Upon motion by Vice Mayor Linda Spiro, seconded by Councilman Flores, the Consent Calendar as outlined on the meeting's agenda, was unanimously approved. Resolution No. 95 -72 A RESOLUTION APPROVING A JOB DESCRIPTION AND JOB TITLE FOR "PERSONNEL MANAGER" POSITION, SETTING A PAY RATE AND RANGE, AND AUTHORIZING THIS POSITION TO BE CLASSIFIED AS A KEY MANAGEMENT POSITION. City Manager Netter, advised that the job description has been upgraded to include management benefits to attempt to recruit an experienced Human Resources person with the appropriate degrees, etc. However, the pay rate has been continued at classification 83X ($3,709 to $4,508) and not increased to the classification of 90M as requested. Mr. Netter explained the City would attempt to recruit at the lower salary range and if not successful in filling the position, staff would bring the request back to City Council for further consideration. Upon motion by Councilman Flores, seconded by Vice Mayor Linda Spiro, and unanimously approved, reading of Resolution No. 95 -72 was waived and said resolution was adopted. Rohnert Park City Council Minutes ( t) May 9, 1995 Ordinance No. 605 AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING CHAPTER 17 OF THE ROHNERT PARK MUNICIPAL CODE TO REZONE THE PROPERTY DESCRIBED IN THIS ORDINANCE FROM THE R1:40,000 (SINGLE FAMILY RESIDENTIAL) DISTRICT 40,000 SQ. FT. LOT MINA4UM TO RI (SINGLE FAMILY RESIDENTIAL) DISTRICT 7,500 SQ. FT. LOT MINEVIUM (File No. 1666 - L. Dale Tatman) City Manager Netter reviewed this Ordinance which was approved for introduction by the City Council at its meeting of April 25, 1995 as well as having been approved by the Planning Commission at its meeting of April 13, 1995. This project is the rezoning of the approximately 4 acre parcel adjacent to the St. Elizabeth Seton Catholic Church located on Snyder Lane. Ordinance No. 605 is up for final adoption which amends Chapter 17 of the Rohnert Park Municipal Code to rezone the property described from RI: 40,000 (Single Family Residential) District 40,000 square foot lot minimum to R1 (Single Family Residential) District 7,500 square foot lot minimum (File No. 1666 - L. Dale Tatman). Upon motion by Councilwoman Gallagher, seconded by Councilman Flores, and approved by a roll call vote of 4 in favor with Councilman Reilly dissenting, reading of Ordinance No. 605 was waived and said ordinance was adopted. .SCHEDULED PUBLIC APPEARANCES: 1. Jane Boyte, Secretary to the Rohnert Park Community Garden and Leo Walker, representing the Rohnert Park Community Garden nroiect were reconni ed Ms. Boyte stated she was present to express her concern and seek continued support from the city for the community garden and introduced Mr. Leo Walker. Mr. Walker stated that the garden's produce is not just consumed by the volunteers who run it but the garden provides food to those in need throughout the community, mainly senior citizens. He stated that he has always been proud of Rohnert Park and its support of the community garden, however, at this time he would like to see someone in the city stand firm behind their commitment to continue the garden at the new location and was distressed as to the contents of Mr. James P. Pekkain's letter of April 27, 1995 wherein the city states it would not be able to provide the garden with the 8 ft. fencing or water outlets into the site. Mr. Walker stated that the city promised they would make these contributions at the time the new site was offered and are now stating that due to financial constraints cannot provide these necessities. Mr. Walker stated that the garden provides a recreational outlet to many who volunteer there besides providing a service to the community, and many senior citizens who take pride in it. He stated that the discussions regarding the new site have been going on for Rohnert Park City Council Minutes ( 5 ) May 9, 1995 over a year now and he would like to have a resolution soon and not have to wait any longer. Mr. Walker stated they have already missed the Spring planting deadline and would like to have a Fall planting schedule. Mr. Walker also stated that he was told by the Engineering Department they would be given two acres. Mayor Eck stated that the city did agree to provide an area for a new community garden and at this time the city needs to make sure that it is done. City Manager Netter stated the agreement was with the School District and did not indicate type or height of fence. He stated an 8 ft. fence would cost the city approximately $25,000 and the city agreed to provide water to the garden, but not necessarily to each garden plot. He said the City also agreed to provide access to, the site with a graveled driveway and small parking area. Councilman Reilly, reading from the Municipal Services Agreement between the City with Cotati - Rohnert Park Unified School District, item 3B, stated the City will install a fence around the garden. Mayor Eck stated that the City has created a mess with this situation and should have just kept the site on Santa Alicia. He stated the City needs to budget the money to honor the agreement that was made and that gardening should be considered the same as any other recreational activity the City would support. City Manager Netter stated he would cycle the costs into the budget for Council consideration during 1995 -96 budget work sessions. Vice -Mayor Spiro recommended they lay the PVC pipe down on top of the ground to provide the water access. Councilwoman Gallagher stated that would not work because they wouldn't be able to rototill the property. Councilman Flores stated the City Council, in good faith, should make the allocations for the project as promised. Upon motion by Councilman Reilly, seconded by Vice -Mayor Spiro, to provide as quickly as possible the budget and time table for this project as promised in the original agreement. Director of Public Works /City Engineer Brust stated there is no water available to the site at this time and is subject to the School's construction schedule. Discussion continued on the handicapped accessibility and width of aisles. Discussion ended and the motion was unanimously carried. Mr. Robert Fletcher, representing the Sonoma County Crushers was recognized and stated opening night is sold out. Mr. Fletcher thanked the City for its support and invited each of the Councilmembers along with a guest to the May 19, 1995, opening night. City Manager Netter stated he will look into that request. BICYCLE ADVISORY COMMITTEE MATTER: Vice Mayor Spiro stated the individual she hoped to appoint to the Bicycle Advisory Committee has been unavailable. She asked that this item be put off until the first regularly scheduled City Council meeting in June as she will be on vacation during the May 23rd Council meeting. MOBILE HOME PARK MATTEM: I. Public Notice Seeking an Appointee to the Mobile Home Parks Rent Appeals Board Mayor Eck accepted the resignation of Richard A. Brody, letter dated May 3, 1995 and effective May 19, 1995. Mayor Eck stated he would like to appoint someone to this Board who has already served and he has two individuals in mind for the position, but is holding off his recommendations until the term limits can be clarified. City Attorney Flitner stated he is checking into that and will get back to Mayor Eck.. 2. Mobile Home Park Purchase Program: City Manager Netter stated that negotiations with Rancho Feliz, Las Casitas, and Valley Village Mobile Home Parks have continued. Las Casitas has offered a revised purchase price; there is an offer letter for Rancho Feliz and Valley Village is still in negotiations. Mayor Eck asked how close is the offer on Rancho Feliz, Assistant City Manager Leivo stated that Mr. DuPriest is meeting with the park's residents and conducting a survey. Mr. Leivo asked that this study be ready by the end of May. Councilman Flores stated that at the invitation of Valley Village Mobile Home Park residents, he toured the park and as per the HCD inspection report, the repair work will not be considered satisfactory without a complete overlay and a quick decision needs to be considered. Mayor Eck agreed. Rohnert Park City Council Minutes ( 7 ) May 9, 199.5 MOBILE HOME PARK MATTERS: (cont'd) 3. Sonoma Grove Mobile Home Purchase Program: City Manager Netter distributed a memorandum stating Sonoma Grove would qualify for the Mobile Home Purchase Program with the use of bonds but he felt it was feasible with greater participation from the city. Mayor Eck asked how the zoning would be effected as Sonoma Grove is not zoned a Mobile Home Park and, therefore, not set at the same standards. Assistant City Manager Leivo responded that this is an important issue in asking for bonding and it would have to be treated as a separate project. For that reason, the City is going to have to provide greater security for the bond holder. Councilman Flores stated that when the park was approved it was considered alternative housing for students at SSU. Mr. Leivo stated there is a Special Use Permit for Sonoma Grove. A proposal for the residents to purchase their site is a consideration and as yet, we have not spoken with the owner of the park. Mayor Eck stated he would like to explore the various options and would like to approach Alexis Tellis, the owner. Nancy E. Crawford, 394 Circle La Cruz, Rohnert Park, has written a letter to the City dated April 22, 1995 to eliminate the use of the word "tenant" as it appears in the original ordinance to that of "homeowner" bringing the language into conformity with the California Civil Code mobile home Residency Law, Article 1, Section 798.9. City Attorney Flitner agreed to make the recommendation. Council unanimously agreed to forward this matter to the Mobile Home Park Rent Appeals Board for consideration. RESOL UTION NO. 94 -1861 STOP SIGN A T 1521 MADISON A VE: City Manager Netter advised this item required a six month review in order to evaluate the necessity for the stop sign. Director of Public Works /City Engineer Brust advised that one letter of complaint had been received from Mr. Robert Meyers, no address. Councilwoman Gallagher supported the stop sign and stated that it slowed cars down in the area, which is the intent. Upon motion by Councilman Flores, seconded by Vice -Mayor Spiro, and unanimously approved to keep the stop sign as permanent. ttohnert Park City Council Minutes (8 ) May 9, 1995 CONSTRUCTION /BUILDING REVIEW COMMITTEE: City Manager Netter advised that a press release went out to the Community Voice announcing that the deadline for complaints to be reviewed by the City will be May 31, 1995. Councilwoman Gallagher stated that staff should start looking at a few of these homes now. Councilman Reilly agreed and stated the need for trained eyes, such as a Building Inspector to start making these inspections and he will discuss a schedule with Councilwoman Gallagher. Paul D. Stutrud 712 Hudis Street, requested permission to speak before the Council. Mr. Stutrud stated he has observed that some of the new traffic signals being installed are below grade standards. He stated he has been an electrical contractor for many years and recognizes work that is below grade. Mr. Stutrud also stated that a notice should be sent out with the utility bills regarding the May 31, 1995 deadline for construction defect complaints and cited the possibility that many of these homeowners with defective construction may be unable to acquire earthquake insurance and the city should make every effort to advise all homeowners of this construction review procedure. Mr. Stutrud also stated that he has observed that the bleacher pads at Golis Park have no steel reinforcements in them and pose a danger to the public. Councilwoman Gallagher asked City Attorney Flitner to provide her with information regarding the city's legal obligations to resolve these problems. City Attorney Flitner stated he issued a written statement on this subject and provided Council with same. He stated the law is that the city is not liable and the recourse is against the builder by the homeowner. The city could be inundated with complaints if this were not the case. Mr. Flitner stated that the city has an obligation to provide for building inspections and the City is immune if the inspector happens to miss something in an inspection. The City would only be held responsible if it can be proven beyond a reasonable doubt that the City was corrupt and grossly negligent and even in those cases, the City has been found to be inirni ne, therefore, the City has no iiabiiiiy. Rohnert Park Citv Council Minutes (9) May 9, 1995 Councilman Reilly stated that the City Manager and the City Council should set a standard that is higher than what is nominally standard. If that means the City needs to hire more Building Inspectors, then we should do that. He stated that the City Council should serve as a steward over the citizens of the community. He agreed with the recommendation that a notice go out in the utility bills but that would not be feasible at this time. He stated that him and Councilwoman Gallagher would be reviewing different ways of getting the information out to the residents and asked the assistance of Mr. Netter and Mr. Brust in this endeavor. Discussion continued. Mayor Eck asked how many complaints have been received. City Engineer Brust stated there are 63 complaints. Discussion continued. Cindy Walsh, 44 Glacier Court, was recognized and exhibited a copy of the Building Permit issued for her home wherein she states that nothing was inspected as it was being built and asked if you have code violations, how would anyone know when nothing was inspected. It appears the Building Inspector just signed the permit off after the house was built. Ms. Walsh stated that she has asked for a City Inspector to come out and inspect and was told because her home is involved in litigation, the city cannot provide her with that service. Ms. Walsh stated that as far as she is concerned, the City of Rohnert Park signed the Building Permit and none of it is accurate and asked why she is now being ignored by City staff? Councilman Flores advised Ms. Walsh to advise the City as to the resolution of the builder and her attorneys. Ms. Walsh stated there are State laws that have not been complied with and the City's Building Inspector didn't even make these inspection as required. Discussion continued. Councilman Reilly asked City Manager, Netter, to check into the complaint that the Golis Park bleacher pads do not have re -bar and of the other complaint about below grade street light poles. Rohnert Park City Council Minutes ( 10 ) May 9, 1995 PUBLIC FACILITIES FINANCING PROGR L41. City Manager Netter reviewed a letter received from Margaret Moore Sohagi of Freilich, Kaufman, Fox & Sohagi referring to Implementation of Public Facilities Financing Act Ordinance. City Manager Netter recommended consideration of two specific plan areas that are currently in the City's sphere of influence, that is the 22 acres on the west side and Cannon Manor. These two areas would be identified for future consideration and development of the annexation fee ordinance. This process would initialize the new annexation fee ordinance and set up a program of contingent and non - contingent assessment fees. Councilwoman Gallagher stated she was against any changes at this time because the City is too close to starting the 20 General Plan update. Councilman Flores asked staff to prepare a Resolution for a potential annexation for Canon Manor or have that request tied to the 20 year study and he did not see where it would impede the process at this time. Mayor Eck stated it would be unwise to include Canon Manor and that LAFCO is going to force the City to do that anyway. Mayor Eck stated that LAFCO has two very different policies - one is to establish an Urban Growth Boundary and the other is a Community Separator policy and they don't know which one they are enforcing and when they resolve this problem, the City should become involved. Councilman Reilly referred to the last sentence on page 3 of the letter and asked what the City would be legally impeding? Is there a possibility the City could be sued or we are giving these property owners a case against us? City Attorney Flitner stated that we can always be sued and the City has an obligation to the people around it as well as the residents to let them know where the Urban Growth Boundary is designated. City Manager Netter stated in his opinion that what Margaret Sohagi meant was that the process would be established before consideration of annexations to avoid the relation of annexation appraisal with fee collection. Assistant City Manager Leivo stated that he felt the Council did not understand the intent of this letter and gave the example of a homeowner from Canon Manor approached the city for annexation and the City put him on hold which would legally impede him. Vice Mayor Spiro asked what the word "expeditiously" meant in this situation? Rohnert Park City Council Minutes ( 11 ) May 9, 1995 City Manager Netter replied that, due to the fact we do not have an Annexation Ordinance in place, we need to have our process on the books and not do it in tandem. In other words, finalize the process that was established in Ordinance 604 as there is not an active annexation fee ordinance on the books. Discussion continued with no action being taken. PLANNING AND ZONING - BILE NO. 1670 1,9handonment of Pathway Connecting Lied Court with Lilac Way Mini Park City Manager Netter reviewed the request by several homeowners in the Lilac Way/Lydia Court area with Council's approval to eliminate the pathway connecting Lydia Court with Lilac Way. A resolution has been prepared formally abandoning this pathway and transferring ownership to an adjacent property owner who has expressed interest in purchasing it. Resolution No. 95 -73 A RESOLUTION OF TIIE CITY COUNCIL OF THE CITY OF ROHNERT PARK ABANDONING AND VACATING A 15 FT. WIDE BY 88 FT. LONG PATHWAY LEADING FROM THE NORTH END OF THE LYDIA COURT (NORTH) TO LILAC WAY MINI PARK WITHIN THE HOLIDAY PARK SUBDIVISION (A PORTION OF ASSESSOR'S PARCEL NO. 046 - 540 -74) FILE NO 1670 Upon motion by Councilwoman Gallagher, seconded by Councilman Flores, and unanimously approved, reading of Resolution No. 95 -73 was waived and said resolution was adopted. TRANSPORTATIONMATTERS: U.S. 1011EXPRESSWAY OVERPASS PROJECT City Manager Netter reviewed Council Meeting Memo on this item which was brought back from the previous City Council meeting. Staff was directed to research a funding program to allow for both the bridge widening as well as the northbound loop to be completed as one project. Staff was directed to look into the possibility of using gas tax and TDA funding over a two to four year period to reimburse the Sewer Service Connection fee account that the City would have to borrow from. Director of Public Works /City Engineer Brust doesn't believe this is a solution with the City using TDA money before the fact in the amount of $200,00 to $300,000 going towards the project and then reimburse the Sewer Service Connection fee account City Manager Netter stated that the current year's TDA funds have been used up with all the overlays the City has done. Mr. Netter asked if Capital Outlay funds are a possibility. Rohnert Park City Council Minutes ( 12) May 9, 1995 Vice Mayor Spiro suggested the project be spread over 3 fiscal years to cover the cost and that would give the City up to $400,000.00. City Engineer Brust felt that could be a possibility. Mayor Eck felt such an action would delay the project. Councilwoman Gallagher agreed that such a delay would increase the costs of the nr oil Qcr Councilman Reilly stated he felt the widening on Commerce and Rohnert Park Expressway should be a priority and then use the State money to reimburse the City. Mayor Eck stated that the City's budget is not unlimited and there is no trickle down theory and recommended the city begin with the widening and end the project with the loop. City Engineer Brust stated the City could use 1STEA money to fund the loop. Councilman Flores asked to see an analysis of the projections up to and including the second phase. City Engineer Brust advised that the project will go out to bid this summer and be awarded by the end of summer. Mayor Eck advised City Engineer Brust he had the Council's approval to proceed as previously directed. Staff will continue to pursue funding alternatives for the north bound loop. COMMUNICATIONS: Communications per the attached outline were brought to the attention of the City Council. No action was taken unless specifically noted in these minutes. MATTERS FROM /FOR COUNCIL: Councilman Reillv stated he was on Highway 37, Tuesday a.m. and observed the accident that involved two fatalities that closed the Highway most of the morning. He directed staff to obtain a copy of a bill that State Senator Mike Thompson is trying to get passed in order to make that stretch of highway safer as it has been the site of many serious accidents over the years. Rohnert Park City Council Minutes ( 13 ) May 9, 1995 2. Vice -Mayor Spiro stated that the directional markers on Golf Course eastbound for a right turn only to Country Club Drive are being ignored and the way they are displayed, you have to go right and you can't go straight ahead and it is very unclear. City Engineer Brust stated he would look into it. 3. Manor Eck referenced the Transportation Authority Gas Tax proposal and expressed interest in having local control over the funds as was voted on in Measure B. 4. Vice -Mayor Spiro wishes to support Senate Bill No. 856 (SB 856) as supported by Town of Windsor wherein any person released on parole be required to report to their assigned parole officer within 48 hours of release from State Prison and directs staff to send a letter to Senator Mike Thompson. Councilman Reilly stated he would like to review the Bill before making a recommendation. 5. Mayor Eck reminded the Councilmembers and all present of the scheduled Memorial Day dedication of Rohnert Park Avenue of the Flags at 10 a.m. on Monday, May 29, 1995 and encouraged everyone to attend the Rohnert Park Chamber Orchestra's presentation of the All American Pops Concert, featuring our new Conductor, Nan Washburn on May 26, 27 and 28 at the Spreckels Performing Arts Center. 6. Cijy Manager Netter advised that according to the latest State Department of Finance statistics, Rohnert Park had the second lowest increase in population in Sonoma County, increasing only 0.3% from 39,090 to 39,214. 7. The Mayor's and Councilmember's Association general membership meeting is scheduled for Thursday, May 11, 1995 at 6:30 p.m. in the City of Cloverdale at which time a vote will be taken for a new LAFCO seat and LAFCO alternate seat as well as other appointments. Councilwoman Gallagher supports Councilman Richard M. Cullinen, Jr. from the City of Cotati for the new LAFCO seat and Allan M. Rawland, Mayor of Windsor as the alternate seat. Mayor Eck and Councilman Flores supported Councilmember Louie Ramponi for the seat on LAFCO. 9. Vice -Mayor Spiro asked that the Councilmembers review the pamphlet received from the Character Counts Coalition and asked that the City request a proclamation commemorating the first annual "Character Counts! Councilwoman Gallagher noted that the Golf Course Committee Meeting was scheduled for May 11, 1995. She also requested an update on the Consultant doing the EIR on the General Plan. CITY]VANAGER'S REPORT.• 1. .budget Hearing Calendar - City Manager Netter asked the Council to designate a time and date to hold its first budget hearings. The Council agreed to Monday, June 12, at 6:00 p.m 2. Remif Health Plan - City Manager Netter reviewed the packet of information distributed to all Councilmembers of the Group Insurance Review prepared by James T. West, CEBS, CLU. Remif has discontinued the self - funded health plan and is recommending all members go with Health Plan of the Redhxrnnrio ,>,a „aa v vvwwt a and add chiropractic care and in- patient mental health coverage and the premiums will remain almost the same. City Manager Netter stated Blue Shield provided him with a copy of their health plan which is based on age and he has also met with the representatives of the PERS Health Care Plan which provides a multitude of options. Vice -Mayor Spiro asked if any PPO (Preferred Provider Organization) Plans have been reviewed or just HMO's. She stated she wishes to make sure a negative financial impact on our local health care provider is avoided. City Manager Netter stated both PPO's and HMO's. Councilman Flores asked how the change in coverage would effect the retired employees now living out of state. City Manager Netter stated their coverage would not be effected as HPR has offered an alternative. Also, the PERS health care plan offers an indemnity plan similar to the old REMIF plan. Hospital Site Options /Proposal - City Manager Netter advised the Council he is compiling information as to a proposed hospital site and the city's options and should have it ready by June 1, 1995 and at that time will ask the Council to set aside time to work together in developing a proposal. Mr. Netter stated he has been contacted by the CEO of Palm Drive Hospital, Healdsburg Hospital and Petaluma Valley Hospital. He stated he will be consulting with the City Attorney as to procedural and legal issues that may arise due to multiple parties' interest in the site. Councilwoman Gallagher asked why the Council were not informed or included in any of these discussions? City Manager Netter stated they were not planned meetings but phone calls and CEO Neil Martin of Petaluma Valley Hospital invited the City Manager to a lunch meeting. Councilman Reilly stated he had some major problems with Petaluma Valley Hospital and would like his comments to be noted. Vice Mayor Spiro stated she received a call from Memorial Hospital and is meeting with them on Thursday, May 11, 1995 in Rohnert Park to discuss their services. 4. Cable Television Franchise Renewal - City Manager Netter advised the Council that study sessions on cable TV and the Franchise Agreement need to be conducted. Several proposals are being submitted and staff will review these matters with Council to develop a process at a work session. Mayor Eck asked if the study session can be scheduled before a regularly scheduled City Council meeting? City Manager agreed to schedule the study session for 5 p.m. on May 23, 1995, 5. Letter of Support for AB563 (Harvey) - City Manager Netter drafted a letter in support of AB563, for the Mayor's signature, to exclude local entities from liability regarding the discharge of hazardous materials on property that the City must take as a right -of -way. Miscellaneous Matters: City Manager, Netter, advised the Council of the Health Fair at the Community Center on May U, 1995. The Automatic /Mutual Aid agreement to protect the southern portions of our city, such as "L" Section with the Rancho Adobe Fire District has been signed. Vice -Mayor Spiro stated she would like to commend Public Safety for their quick response to a fire at Self Service Furniture when she and Colleen Militello were there and called 911. CITY ATTORNEY'S REPORT.- 1. Hallock vs. City of Rohnert Park et at - City Attorney Flitner stated there should be a decision on the motion submitted by the end of the month. 2. Kuhn, et al. vs. City of Rohnert Park et al - City Attorney Flitner commented that this case is still in litigation. UNSCHEDULED PUBLIC APPEARANCES: Mayor Eck asked if there were any additional unscheduled public appearances at this time. Linda Branscomb, 6586 Commerce Blvd., #188, referred to the City's review process for a hospital facility to be located in Rohnert Park and recommended that Palm Drive Hospital and Petaluma Valley Hospital be reviewed carefully as there are various unspecified policy charges against.
