2000/10/05 Mobile Home Park Rent Appeals Board ResolutionRESOLUTION NO. 2000-02 A RESOLUTION OF THE ROHNERT PARK RENT APPEALS BOARD AMENDING SECTION 4.01, GENERAL ADJUSTMENT, AND THE CONSMER PRICE INDEX DEFINITION OF THE RULES AND REGULATIONS OF CHAPTER 9.70, MOBILEHOME ORDINANCE. WHEREAS, on December 8, 1987, the voters of the City of Rohnert Park adopted Ordinance No. 494, the Rohnert Park Mobile Home Ordinance; and WHEREAS, in 1996, the voters of the City of Rohnert Park approved the addition of Section 9.70.132, Amendment, which provides that the Mobile Home Ordinance may be amended by the City Council after a public hearing before the Rent Appeals Board; and WHEREAS, on August 22, 2000, the City Council of the City of Rohnert Park approved Ordinance No. 658 amending the Rohnert Park Municipal Code Chapter 9.70, and providing that the Annual General Adjustment index shall be the Consumer Price Index for Urban Wage Earners and Clerical Workers in the United States (CPI) and that the Annual General Adjustment shall not exceed one half of one percent (1/2 %) less than one hundred percent (100 %) of the increase in the CPI; and WHEREAS, portions of the Rules and Regulations are not consistent with Ordinance No. 658 and City staff has drafted proposed changes to Section 4.01, General Adjustment, and the Consumer Price Index definition of the Rules and Regulations consistent with Ordinance No. 658; and WHEREAS, the proposed amendments to the Rules and Regulations were published in a newspaper in general circulation in the City of Rohnert Park. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Rohnert Park Rent Appeals Board that the following amendments to the Rules and Regulations for Chapter 9.70, Mobilehome Ordinance, are hereby approved and authorized: Section 1. Paragraph A.1. of Section 4.01, General Adjustment, is amended to read as follows: A. 1. On or before November 1St of each year, the Board shall direct Board /City staff to determine the percentage increase between the Consumer Price Index -Urban Wage Earners and Clerical Workers, U.S. city average (CPI) reported as of September of the prior year and the month of September of the current year. Section 2. Paragraph B.1. of Section 4.01, General Adjustment, is amended to read as follows: Resolution 2000- page 2 B. 1. The Board shall calculate the permissible maximum amount of the annual general adjustment at one half of one percent (1/2 %) less than one hundred percent (1.00%) of the percentage increase in the CPI determined in Section A above. The amount of the permitted increase shall be rounded to the nearest one -tenth of one- percent (0.10 %). Section 3. The definition of Consumer Price Index in Chapter 9 - Definitions is amended to read as follows: CONSUMER PRICE INDEX: The Consumer Price Index = the Consumer Price Index for Urban Wage Earners and Clerical Workers, U.S. city average as published by the federal Bureau of Labor Statistics.
