1973/06/04 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES .June 4, 1973 The Council of the. -City of Rohnert Park mat this date in regular session commencing at 7 :�33 p,m, in the City Offices 6750 Commerce: Boulevard, Rohnert P ark, with Mayor Flores presiding. The regular session was preceded by an execu- tive session which commenced at 7 :00 p.m. and at which all Councilmen and City Manager Callinan were present and which was held.to discuss labor relations negotiations and personnel matters. Call to Ordor Mayor, Flores called the meeting of the regular session to order at approximately 7 :33 p.m. and led the pledge of allegiance. Roll Call PRESENT: (5) Councilmen Beary, Hopkins, Roberts Smith, and Flores ABSENT: (0) None Staff present for all or part of the meeting: City.Manager Callinan, City Attorney Maxwell and Planning Director Skanchy Executive Session Mayor Flores announced that an executive session had been held prior to the regular meeting to discuss labor rela- tions negotiations and personnel matters. Minutes Mayor Flores advised that the minutes for the May 21 and 29 meetings were not yet ready. Approval of Bills Upon motion of Councilman Hopkins, seconded by Councilman Beary.and. unanimously approved, the bills presented per the attached list in the amount of $11,987.26 were approved. Communications Communications per the attached outline were brought to the attention of the Council. No action was taken on any communication- except as noted specifically in these minutes. Green'Belt Land Councilman Smith initiated a brief discussion concerning the response from Group 5 Realty regarding purchase of the Faraudo land on Snyder Lane for green belt land. It was requested tha t the matter be an agenda item at the next regular meeting. Mosquito Abatement Discussion was held on a letter received from Supervisor Joerger concerning jossible annexation to the Marin County and /or Sonoma Mosquito Abatement Districts. Upon motion of Councilman Beary, seconded by Councilman Hopkins, and unanimously approved, the Council indicated approval in concept for joining the Marin County and /or Sonoma Mosquito Abatement Districts. Page 2. June 4, 1973 Ordinance No. 199 ORDINANCE RE THE OPERATION OF MOTORCYCLES AND MOTOR DRIVEN CYCLES Mayor Flores declared the scheduled public hearing open on Ordinance No. 199. City Attorney Maxwell explained the ordinance. City Manager Callinan read a letter from Thomas L. Harrocks Jr. dated May 30, 1.973 which expressed support for adoption of the said ordinance. Discussion followed. Upon motion of Councilman Hopkins, seconded by Councilman Smith, and unanimously approved, the public hearing on Ordinance No. 199 was continued to the next regular meeting in the hope of getting more citizen participation in said hearing. Ordinance No. 200 AN ORDINANCE AMENDING ORDINANCE NO. 63 (Zoning Map Change, Harris & Rathke, File No. 0289) City Manager Callinan explained the ordinance. Upon motion of Councilman Smith, seconded by Councilman Beary, and unanimously approved by the following roll call vote, the reading of Ordinance No. 200 was waived and said ordinance was adopted: AYES: (5) Councilmen Beary, Hopkins, Roberts Smith, and Flores. NOES. (0) None Planning Direct6i, Skanchy noted that the Planning Comm- ission, at its May 24th meeting, had discussed additional conditions for the proposed project recommended by the City Council and said conditions were attached to architectural approval and are on file. A brief discussion followed with Mr. Bob Harris participating. Ordinance No. 201 AN ORDINANCE LICENSING THE TRANSACTION AND CARRYING ON OF CERTAIN BUSINESSES, TRADES, PROFESSIONS, CALLINGS AND OCCUPATIONS IN THE CITY OF ROHNERT PARK FOR THE PURPOSE OF RAISING MUNICIPAL.REVENUE AND PROVIDING A PENALTY FOR THE VIOLATION THEREOF City Attorney Maxwell reviewed the ordinance. June 4, 1973 Councilman Smith stated for the record he abstained because he had not participated in the initial discussion on the ordinance, File No. 0297 Planning Director Skanchy explained and reviewed the Proposed Amendment proposed amendment to the Zoning Ordinance concerning to Zoning Ordinance off-street parking facilities as recommended by the Concerning Off- Planning Commission. Discussion followed. Street Parking Facilities Mayor Flores declared the public hearing open on the proposed amendment to the Zoning Ordinance concerning off-street parking facilities. Mr. Pat Taylor, 488 Alta Avenue, was recognized. He passed out copies of material to Planning Director Skanchy and the Council regarding a survey of apartments either owned, controlled or managed by Taylor and Associates. He apologized for not providing the information contained in the survey to Planning Director Skanchy prior to his pre- paration of the proposed amendment to the ordinance, but advised he had not been aware of such preparation. He briefly reviewed the material provided and commented Taylor and Associates does not have any problems at their apart- ments which are not student oriented. lie agreed there were problems with parking in Rohnert Park, but stated. they seemed to be mostly at student oriented apartments where there are more cars generated per unit. He asked permission for Taylor and Associates to work with Planning Director Skanchy on revising the ordinance. Mr. Olaf Gross, owner of Tivoli Apartments, was recognized. He advised that if two parking spaces were required for each multiple unit, rents would have to be raised which would work a hardship on new tenants. Mre Bob Harris, 5244 Carriage Lane, Santa Rosa, and owner of apartments in Rohnert Park, was recognized. He advised he was one of those responsible for the situation at Jung Haus apartments, acknowledged there was a problem, and apologized for the poor parking situation. He commented that there should be a differentiation in parking require- ments for student oriented apartments and family apartments. There being no one further desiring to be heard, Mayor Flores declared the public hearing closed. Discussion followed regarding possible legal problems in differentia- ting between student housing and family housing. Upon motion of Councilman Roberts, seconded by Councilman Beary, and unanimously approved, the proposed amendment to the Zoning Ordinance concerning off-street parking facilit- ies was referred back to the Planning Commission for fur- ther study with particular attention to be paid to the requirements for multiple housing. June 4, 1973 Resolution No. 73 -75 RESOLUTION AMENDING RESOLUTION NO. 72-150 ESTABLISHING PLANNING, ZONING, SUBDIVISION AND RELATED MATTERS FEES (AS RELATED TO ARCHITECTURAL REVIEW AND TEMPORARY USE PERMITS) City Manager Callinan explained the resolution. Upon motion of Councilman Hopkins, seconded by Councilman. Smith, and unanimously approved, the reading of Resolution No. 73 -75 was waived and said resolution was adopted. Resolution No. 73 -76 RESOLUTION OF THE CITY COUNCIL, CITY OF ROHNERT PARK, APPROVING THE APPLICATION FOR LAND AND WATER CONSERVATION FUNDS, RAPOZO RANCH PROJECT. City Manager Callinan explained the resolution. Upon motion of Councilman Hopkins, seconded by Councilman Roberts, and unanimously approved, the reading of Resolution No. 73 -76 was waived and said resolution was adopted. Resolution No. 73 -77 RESOLUTION CREATING AD HOC COMMITTEE ON OPEN SPACE City Attorney Maxwell explained the resolution. City Manager Callinan noted that Mrs. H. C. Simpson was in the audiences owned property designated as open space on the Spheres of Influence map, and would be speaking on that subject later in the meeting. Upon motion of Councilman Beary, seconded by Councilman Hopkins, and unanimously approved, the reading of Resolution No. 73• -77 was waived and said resolution was adopted. Amendments to City Manager Callinan noted that City Attorney Maxwell General Plan had explained to him that the changes to the General Plan as discussed at the last Council meeting must be referred back to the Planning Commision.for comment before adoption of a resolution by the Council approving same. Resolution No. 73 -78 A RESOLUTION DIRECTING FILING OF AMENDED ASSESSMENT DIAGRAM (Hinebaugh Creek et al Improvement Project No. 1972 --3) City Manager Callinan explained the resolution. Upon motion of Councilman Roberts, seconded by Councilman Hopkins, and unanimously approved, the reading of Reso- lution No. 13 -78 was waived and said resolution was adopted. Resolution No. 73-76 RESOLUTION ACCEPTING GRANT DEED (Southwest Blvd Right of Way,Camino Colegio East) City Manager Callinan explained the resolution. Upon motion of Councilman Hopkins, seconded by Councilman Abco Cab Co. Request for Increase in Taxi Cab Fares Project No. 19737 Waste Water Treatment Plant Interim Improvements Development of Bike Paths in Subdivision Appointments to Commissions Council Meetings Page 5. Roberts, and unanimously approved, Resolution No. 73-79 was waived and adopted. June 4, 1973 the reading of said resolution was Mr. Gary Sterner, owner of ABCO Cab Co., appeared and discussed with the Council his request for an increase in taxi cab fares. City Attorney Maxwell advised that upon checking the applicable ordinance he had determined that a public hearing must be held on the application for .increase in rates., . Upon motion of Councilman Hopkins, seconded by Councilman Roberts, and unanimously approved,the application of ABCO Cab Co. for an increase in taxi cab rates will be set for public hearing. City Manager Callinan noted that the Engineer's estimate on the interim improvements for the waste water treatment plant due to revisions made in the specifications was high, reviewed the bids received on the work from J. R. Peters, and Argonaut Constructors, and advised that he and Supt. of Public Works Wiggins still hope just moving the outfall of.the plant will solve the problem. He noted that he and Supt. of Public Works Wiggins had toured the area in the vicinity of the sewer plant earlier in the day and not detected any odor. He requested that the bids be kept under advisement until consultation had been held with staff representatives of the Water Quality Control Board. Council. concurred. City Manager Callinan reviewed his memo to the Council dated March 30, 1973 and his analysis of anticipated recreation fees dated June 4, 1973. City Manager Callinan advised that appointments to the Cultural Arts and Parks and Recreation Commission did not have to be made until the next regular meeting but wanted to alert the Council to same so thought could be given to the matter. A brief discussion followed during which it was decided to schedule an executive session at the next regular meeting to consider appointments to commissions. The Council noted there was at least one opening on the Parks and Recreation Commission and solicited residents interested in serving on said commission to submit letters. Councilman Hopkins initiated a discussion concerning hold- ing some Council meetings at an earlier hour. Upon motion of Councilman Hopkins, seconded by Councilman .Bear-j, and approved by the following voice vote, City Attorney Maxwell was directed to prepare an amendment to the ordinance to provide that the second meeting in every Page 6. June 4, 1973 other month be scheduled at 4 :00 p.m. AYES: (3) Councilman Beary,Hopkins, and Floras NOES: (2)'' Councilmen Roberts and Smith Park Plaza Shopping Councilman Beary initiated a brief discussion concerning Center Trash Cans the trash cans that were to have been installed at the Park Plaza Shopping Center and whether or not they had been installed. City Manager Callinan stated he would follow -up on the matter with the manager of the shopping canter. Proposed Ordinance Councilman Beary noted that Mr. Tom Johnson was present, re Motor Cycles had missed the discussion held earlier on the proposed SB 460 ordinance concerning motorcycles and requested that he be allowed to speak on the matter. Mr. Tom Johnson was recognized. He stated he had been a resident of Rohnert Park for approximately eight years and expressed opposition to the proposed ordinance concerning motorcycles, commenting that only a few individuals have created problems with motorcycles and it seemed unfair to penalize all those conscientious citizens who enjoyed riding motorcycles and /or bikes. A brief discussion followed during which Mr. Johnson was advised that the public hearing on the matter had been continued to the next regular meeting and interested citizens should be encour- aged to attend. Councilman Smith briefly reviewed SB 460 which would man- date the CHP retirement formula for policemen and firemen and would also place city managers in the "local safety member`' classification for P.E.R.S. purposes. Discussion followed. Upon motion of Councilman Smith, seconded by Councilman Beary, and approved by the following voice vote, the Coun- cil went on record in opposition to SB 460 on the basis that the bill provides for retirement funds over which the City Council would have no control and also that the position of city manager is one of management and should not be included in the "local safety member" classifica- tion: AYES: (4) Councilmen Beary, Roberts, Smith and Flores NOES: (0) None ABSTAIN: (1) Councilman Hopkins Councilman Hopkins stated he abstained because he was not sure about the effect on Public Safety personnel but did agree with excluding the city manager from the program. Page 7. June 4, 1973 SB 981 Councilman Smith brought to the attention of the Council SB 981 which concerns new construction taxes. Staff was requested to obtain a copy of SB 981. SB 629 Councilman Smith briefly reviewed SB 629 which would prohibit joint powers financing and lease purchase agree- ments without approval by a majority of the voters of the local agency. Discussion followed. Upon motion of Councilman Roberts, seconded by Councilman Hopkins, and unanimously approved; the Council went on record in opposition to SB 629. SB 546 Councilman Smith reported that SB546, which would make the governing body of the Bay. Area Pollution Control District directly elected, had been approved in committee. 'AB 1088 Councilman Smith reported that AB 1088 which would prohibit the use of lie detector tests in connection with public employment, had been amended to permit use of same with respect to applicants for employment as policemen. Mayors and Councilmen's Mayor Roberts brought to the attention of the Council that Assns the next agenda meeting of the Mayors and Councilmen's Association would be June 14 and requested any Councilmen interested in serving as an officer to let him know. Phones'at Park Mayor Flores briefly reviewed the memo from Parks and Concession Stands Recreation Director Pekkain to City Manager Callinan concerning installation of phones at the Alicia and Benecia Park concession stands. * Discusion followed with Mr. Dick Brown of Pacific Telephone and Telegraph Company participating. Upon motion of Councilman Smith, seconded by Councilman Roberts, and unanimously approved, the installation of semi- public phones at the Alicia and Benecia Park concess- ion stands was approved. Parking of City Manager Callinan advised that a resident had contacted Recreational him regarding a trailer parked in the driveway next door Vehicles which blocked the view, the resident had pointed out there is an ordinance on the books to prohibit such parking but was not being enforced at the direction of the City Council. He further advised that the resident had requested the matter be discussed again with the Council and the ordinance either enforced or removed from the books. Discussion followed and staff was directed to look into possible locations and costs for a storage area for recreational vehicles and the Planning Commission was directed to study the matter and schedule a public hearing on same. Mrs. David C. Bliese, 7584 Beth Ct., was recognized. She indicated she was not satisfied with the Council action on the matter and felt the ordinance should be enforced, starting the next day. Discussion followed. Page 8. June 4, 1973 Mr. Tom Johnson was recognized and expressed support for - allowing recreational vehicles to be parked on residential proper ty. Mr. David C. Bliese was recognized and indicated he felt the ordinance should be enforced. Discussion followed during which it was pointed out that many residents in the past had expressed opposition to not being allowed to park recrea- tional vehicles on their properties. The Council indicated the ordinance regarding parking of recreational vehicles on residential property will not be enforced during the period prior to the public hearing on same. Transit Study City Manager Callinan advised the Council that a Transit Needs Study committee meeting had been held earlier in the day with representatives from the Golden Gate Bridge District present and that a revised draft of an agreement for the study had been worked out and will be referred to the Bridge District's attorney for review., Open Space Mrs. H. C. Simpson, 3468 Stony Point Road, Santa Rosa, was recognized. She made a lengthy presentation regarding the lands on the northern boundary of Rohnert Park being design- ated as."Permanent Open Space" on the Spheres of Influence Map and requested that said designation be removed or the land annexed to the City. Mr. M. E. Kalin, 516,Mt. View, Santa Rosa, was recognized. He exprecsed opposition to his lands being placed in the permanent Open Space" area and indicated he would consider annexation to City. A lengthy discussion followed. Planning Director Skanchy explained the Spheres of Influence map and how boundaries were determined using natural bound- aries such as drainage channels, roads, etc. Mrs. Mark Rose appeared before the Council and asked if any thought had been given to homes being planned next door to their property where fertilizer and insecticides are applied by airplane. A brief discussion followed with Mr. Simpson also making some comments. Mr. Kalin again appeared and indicated he would prefer annex- ation to the City. Mr. Mark Rose appeared and spoke in opposition to his land being included in the "Permanent Open Space" area and asked that it be removed from same. Discussion followed during which it was noted that the committee to be appointed to dis- cuss acquisition of open space would be considering various areas to be acquired, methods of financing, etc. Adjournment There being no further business, Mayor Flores adjourned the meeting at 10:50 p.
