File No. 0234 City Manager Callinan reviewed the proposed Amendment to Amendment to the the Zoning Ordinance which would provide that the actions Zoning Ordinance of the Planning Commission,upon disapproving m applica- tion, would not automatically come to the Council. He advised that an.appeal could be filed to reconsider a posim .;tive or negative decision, that the proposed amendment was favorably considered by the Planning Commission, and that Notice of Public Hearing had been published in the local newspaper.. July 3, 1972 The Council of the City of Rohnert Park met this date in regular,session ; commenci.ng at 7:17 p.m. in the City Offices, 435 Southwest Boulevard,``1phnert Park, with Mayor Roberts presiding. -,'the regular s.essign was preceded by an execu- tive session which commenced 'At 7 :00 p.m. and at which City Manager Callinan and ail Councilmen were present, and which was held to discuss a. possible appointment to the .Planning Commission and personnel matters. Call''to Order Mayor Roberts called the.meeting of the regular session to order :at, approximately 7;17 p.m. and led 'the pledge of allegiance. M. Hahn A moment of silence was observed for Margurite Hahn who passed away. Roll Call Present: (5) Councilmen Beary, Flores, Hopkins, Smith and Roberts ' Absent: (0) None Staff Present for all or part of the meeting: City Manager Callinan . Communications Communications per the attached outline were brought to the attention'of the Council. No action was taken on any communication except as noted specifically in these minutes. 'ABAG. Mayor`Roberts reported on recent developments in relation to membership in ABAG and inquired if the Council wished to stand by previous Council policy in that the City of Rohnert Park would remain in ABAG until such time as an- other organization arises to better serve Rohnert Park's needs. Page -2- July 3, 1972 May Roberts declared the public hearing open on the proposed amendment to the Zoning Ordinance regarding processing rezoning applications and appeals. City Manager Callinan nformed.that there were no communi- cations received regarding the proposed amendment, other than the4Plann'ing Commission's recommendation in favor. There being no one desiring to'be heard, Mayor Roberts declared the public hearing closed. Ordinance No. 179 AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING ORDINANCE NO. 63 (Changes text of ordinance; rezonings; appeals) City Manager Callinan explained the ordinance. Upon motion of Councilman Flores, seconded by Councilman Smith, and unanimously approved, the reading of Ordinance No. 179 was waived and said ordinance was introduced. Ordinance No. 177 AN ORDINANCE AMENDING ORDINANCE NO. 63, ZONING ORDINANCE (Zoning Map Change -- Forhim Corporation) City Manager Callinan explained the ordinance. Discussion followed regarding recreational fees, review of the plan by the Parks, and Recreation Commission and application of minimum lot size. Upon motion of Councilman Hopkins, seconded by Councilman Flores and approved by the following roll call vote, read- ing of Ordinance.No. 177 was waived and said ordinance adopted: AYES: (3) Councilman Flores, Hopkins and Mayor Roberts NOES: (2) Councilman Beary and Smith ABSENT: (0) None Ordinance No. 278 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE CITY OF ROHNERT PARK AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT .SYSTEM City Manager Callinan explained the ordinance. Upon motion of Councilman Flores, seconded by Councilman Hopkins, and approved'by the following roll call vote, reading of Ordinance No. 178 was waived and said ordinance adopted: AYES: (5) Councilmen Beary, Flores, Hopkins, Smith and Mayor- Roberts NOES i.0) None ABSENT:` (0) None Page-3- July 3, 1972 Ordinance No. 180 AN ORDINANCE ESTABLISHING MEETING OF ROHNERT PARK PARK AND RECREATION COMMISSION City Manager Callinan explained the ordinance. Upon motion of Councilman Hopkins, seconded by Councilman Smith, and approved by.a voice vote, with Councilman Beary voting no, the reading of Ordinance No. 180 was waived and said ordinance was introduced. Resolution No. A RESOLUTION DETERMINING UNPAID ASSESSMENT AND PROVIDING 72 -96 FOR ISSUANCE OF BOND - COUNTRY MANOR ASSESSMENT DISTRICT NO. 1972 -1 City Manager Callinan explained the resolution. Upon motion of Councilman.Smith, seconded by Councilman Beary, and unanimously approved, the reading of Resolution No. 72•-96 was waived and said resolution was adopted. New City Building City Manager Callinan brought to the attention of the Coun- Change Orders cil Change Order No 2 requiring $75.00to cover excavation Nos. 2 and 3 expenses and Change Order No. 3 requiring $147 to add ,partitions to.accommodate handicapped persons in the New City Office Building. Upon motion of Councilman Hopkins, seconded by Councilman Beary, and unanimously approved, Change Orders Nos. 2 and 3 for the New City Office Building, were approved. Executive Session Mayor Roberts announced that an executive session had been held prior to the regular meeting and that two candidates would be interviewed for possible appointment to the Planning Commission on Wednesday, July 5th at 6:45 p.m. Ultimate Size Councilman Beary inquired about the possibility of putting of.Rohnert Park a'proposal for ulti.mate.size limitation of Rohnert Park on the November ballot. ,Discussion followed regarding City Council's directive to the Citizens Advisory Committee to consider and make a recommendation as to what the ultimate size of Rohnert Park should be, how this policy will affect the future, and legal time required to put the matter on the November Ballot. Councilman Smith read Senator Collier's Newsletter dated July.3rd, referring to the last election and trends as shown by said election. Discussi.on'followed. Proposition A Councilman Smith brought to the Council's attention Rohnert Parkes vote concerning repeal of Proposition A which gave authorization to the County for the construction of water facilities. Bay Area Sewerage Mayor Roberts informed that he had attended a meeting of Service Agency. the Bay Area Sewerage Service Agency, that three names had been submitted to the Board of Supervisors in order to represent Sonoma County and among those names submitted was Councilman Hopkins. Mayors & Council- Mayor Roberts brought to the attention of the Council the men Meeting Mayors and Councilmen's Association meeting to be held in Sebastopol on July 13th, Proposed 72 -73 Budget City Manager Callinan reported that a copy of the proposed Budget for 1972 -73 had been sent to each Councilman. After a brief discussion Council set July 11, 1972 at 7:00 p.m. for the first in a series of work sessions. Mayor Roberts Leaves Mayor Roberts turned the gavel over to Vice -Mayor Flores and left the Council Chambers at approximately 8:13 p.m. Classification and City-Manager Callinan informed that a copy of the Classi- Salary Survey fication and Salary,Survey prepared ff;r the City by the State Personnel Board had been sent to the representative of the Employeefs.Association that it was staff's intent to have Mr.- .Garret, Survey Director, appear at the,next regular Council meeting to explain the survey. Discussion .followed. Page -4- July 3, 1972 Advisory Committee After a brief discussion the Council requested to receive notice of,meetings.'of..the Rohnert Park Citizens Advisory Committee for Updating General .Plan. SB -1118 Councilman Flores initiated discussion regarding SB 1118 concerning a new Subdivision Map Act. Upon motion of Councilman Flores, seconded by Councilman Smith, and unanimously_approvea, staff was directed to send a letter to Senator Collier expressing support for the bill. Public Library City Manager Callinan informed that the matter had been brought to Mr. Spivock's attention, that he had indicated the property was in the process of being sold, and that the new property owner would be so informed. He also advised that he would ask the City Attorney about various methods to enforce sections of the Zoning Ordinance without being of a criminal nature.. Councilman Smith inquired about Mr. Spivock developing the northern area of the city and distance between the freeway and homes in meeting FHA standards. City Manager Callinan reflected that the distance was in the vicinity of 300 feet and further.advised that he would look into the matter. Waste Water City - Manager Callinan reported on meetings that he had Study with representatives of the'County of Sonoma, Sebastopol, and Santa Rosa, relative to a jointly financed study with each entity paying 25% for a study as generally outlined in the March 8, 1972 letter to the City of Rohnert Park from the'engineering consortium of Brown and Caldwell, Water Resources Engineers, Inc. and Yoder-Trotter-Orlob & Associates.' He pointed out that the study is needed in order to comply with the requirements concerning waste water treatment and disposal as m L) the by the North Coast Water Quality Control Board. Discussion followed during which the Council indicated approval to participate in the study. Discussion also was held concerning back-charging a portion of the study to other sewer users such as Cotati and Sonoma State College.' the status of the present sewer. .facilities and the recent demonstration project, availability of funds under the Clean Water Bond Act, the capacity of the existing sewer facilities and problems with growth in general. Consent Calendar City Manager Callinan explained the concept of establish- ing a consent calendar to expedite action on routine matters at Council meeting thus leaving more time for other matters. Upon motion of Councilman Hopkins, seconded by Councilmaa Beary, and unanimously approved, staff was authorized to prepare a consent calendar, with the understanding that aLy one Councilman could remove an item from its contents without further discussion. Redwood Empire City Manager Callinan informed that the Redwood Empire Kennel Club Kennel Club had made application to use facilities at the Rancho Cotate High School for its annual dog show and received approval for same. Resolution No. A RESOLUTION SUPPORTING TRANSFER OF PROPERTY FROM BELLVUE 72-97 ELEMENTARY SCHOOL DISTRICT TO THE COTATI ELEMENTARY SCHOOL DISTRICT City Manager Callinan explained the resolution. Upon motion of Councilman Hopkins, seconded by Councilman Beary, and unanimously approved, reading of Resolution No. 72-97 was waived and said resolution adopted. Page -6- July 3, 1972 Unscheduled Public Mr. M. Hubley, 135 Alma Avenue, was recognized,and com- Appearances mented on traffic problems in the community. A lengthy discussion followed., upon the.conclusion of which Mayor Roberts,informed..Mr. Hubley that the matter would be looked .into. Mr. Eugene Grenache, 7555 Beverly Drive, was recognized and inquired,if mini -bikes were allowed in City Parks. Mayor Roberts informed that it was illegal to operate a mini -bike in any,park or public street. Discussion was initiated by Councilman Beary regarding reception received by visitors to the Police Department. Stoner Cable TV Councilman Smith asked if the Cable T.V. report made pro - Report vision for the number of complaints received. City Manager Callinan informed that the report did not presently list the number of complaints but that Storer Cable TV staff could be requested to do soon future reports.
