City Manager Callina n'reported that notice of the public ROHNERT PARK CITY COUNCIL MINUTES July 17, 1972 The Council of the-City of Rohnert Park met this date in regular session commencing at 7:08 p.m. in the City Offices, 435 Southwest Blvd.,.Rohnert Park, with Mayor, Roberts pre- siding. Call to Order Mayor Roberts called the meeting of the regular session to order at approxim tely 7:08 p.m. and led the pledge of allegiance. Roll Call Present: (5) Councilmen Beary, Flores, Hopkins, Smith and.Roberts Absent: (0) None Staff Present for all or part of the meeting: City Manager Callinan, City Attorney Maxwell, Engineer Larry Woods, and Bond Counsel Dick Randolph Approval of Minutes Councilman Smith stated for the record*that on page 12 of the June 19, 1972 minutes that he would like added under the subject "Architectural REview" that he had stated for the record that Condiotti Enterprises should be exempted from architectural review but-rorhim Corporation should not since they had submitted their map after the decision on architectural review was made. Councilman Smith stated fdr'the record that on page 10, third paragraph from the bottom, of the June 19, 1972 minutes that he would like added that he had stated for the record that in his opinion this was a political ploy to lay the groundwork to remove 2 or 3 Planning Commissioners. Upon motion of councilman Hopkins, seconded by Councilman Smith, and unanimously approved, the minutes of June 19, .1972 were approved as corrected. Resolution No. 72 -100 RESOLUTION ACCEPTING EASEMENT FROM PETALUMA CITY JOINT UNION HIGH SCHOOL DISTRICT (Snyder Lane - Project No. 1971 -2) City Manager Callinan explained the resolution. Upon motion of Councilman Smith, se conded by Councilman Beary, and unanimously approved with Mayor Roberts absent, the reading of Resolution No. 72 -100 was waived and said resolution was adopted. Mr. Robert Garret City Manager Callinan introduced Mr. Robert Garret of the State Cooperative State Personnel Board, Cooperative Personnel Services. Mr. Personnel Services Garret made a presentation concerning the Classification and Salary Survey prepared for the city, explaining the various services of the agency, and the methods and philoso- phy used in compiling the survey for the city. Mayor Roberts Returns Mayor Roberts returned to the Council Chambers at approxi- mately 7:28 p.m. and resumed chairing of the meeting. Mr. Garret noted that four employees had commented on their individual positions and salary recommendations and that he would be responding to those within the week. General discussion followed concerning the survey and salary recommendations. Upon motion of Councilman Smith, seconded by Councilman Flores, and unanimously approved, the Classification and Salary Survey was accepted and appreciation expressed to Mr. Garret for coming to answer questions of the Council. El Colegio Neigh- City Ma nor Callinan and Director of Parks and Recreation borhood Park and Pekkain explained the site plan for the El Colegio neigh - School - Site Plan borhood park and school which was on display. Councilman Beary Councilman Beary left tha Council Chambers a9- anrirnuimai-01v Leaves and Returns 8:55 P.m. and returned at approximately 8:56 p.m. Discussion followed concerning various aspects of the plan, i.e., access, increments of construction, design, and the possible inclusion of a turfed and treed area where indivi- duals can relax. Upon'mdtion of Councilman Beary, seconded by Councilman Flores, and unanimously approved, the site plan for the El Colegio neighborhood park and school site was approved with the understanding that a turfed and treed area for relaxation would be incorporated into said plan. Page -4- July 17, 1972 Sonoma State College City Manager Callinan reviewed proceedings to date on the Environs Study Sonoma State College Environs Study and noted there had File No..0223, been the original plan prepared by the Sonoma County Plann- ing Dept., the plan prepared at the college, an alternate plan prepared by the County Planning Department and a second alternate plan prepared by the County Planning Department displayed for the first time tonight. Mr. Callinan read ,a letter from Mr. Art Hollingsworth, Chairman of the Citizens Advisory Committee for Updating the General Plan requesting a two -week Council delay on the Environs Study so that the Committee could submit a recommendation. Councilman Smith noted that at his suggestion Mr. Comalli, Sonoma County Assessor, was present to comment on the tax impact_of various land uses in the area. Mayor Roberts.noted that this was a public hearing continued from July 5 and opened same. Mr. George Kovatch, Sonoma County Planning Department, re- viewed the plans on display and explained the new alternate plan displayed for the first time tonight. Discussion followed with Mr. Comalli participating and answering ques- tions, concerning agricultural preserves, guidelines used in assessing property, and the possible affect of a fixed.: boundary for development. Mr. Art ,_ Hollingsworth was recognized and commented briefly on the Citizens Advisory Committee request to postpone Council action on the Environs Plan until the next Council meeting to allow time for the Citizens Advisory Committee to make a recommendation on the plan, Rev, Edward McNair, Episcopal Diocese, was recognized. He questioned what the situation would be in regard to align - ment of:Snyder Lane if a church could be constructed on the diocesan property within the next one or two years. Mel Pedersen.of the ,County Planning:Department ;'responded that the alignment of Snyder Lane could be adjusted so as not to disturb the intended use of the property. Mr. Don Jones, Rohnert Park resident, was recognized. He read a "Request to. the Board of Supervisors of Sonoma County and the City Council of Rohnert Park" dated May 15, 1972, a copy of which is attached to the original of these minutes. Councilman Flores stated for the record that there were those who felt the Council was being indecisive on the Environs Plan but the Council would like to have the recom- mendation of the Citizens Advisory Committee before making a decision on the.plan.:, There being no one else desiring to be heard, Mayor Roberts continued the public hearing on the Sonoma State College Environs Plan to August 7, 1972, Page -5- July 17, 1972 Recess Mayor Roberts declared a recess at this point in the meeting, time being approximately 9:03 p.m. Reconvene Mayor'Roberts reconvened the meeting at approximately 9:10 P•m• Project No. 197 2-7 City Manager Callinan introduced Mr, Richard Randolph of. Expressway. West Wils�,n, Jones, Morton & Lynch. Mr. Randolph reviewed the five bond bids received for Project No. 1972 -7:, Expressway West Assessment District, and announced that the lowest responsible bid was from Stone & Youngberg at 92,51% of par with interest in the rate of 5,5% per annum with an effec- tive interest rate of 0.40 Engineer Larry Woods answered questions of the Council concerning the construction bids for the project. Mayor Roberts declared the public hearing open on the . Engineer's Report concerning Project No..1,972 -7, Express - way West Assessment District, prepared pursuant to the Muni - cipal Improvement Act of 1913 and Resolution of Intention No. 72 -77. The staff submitted the Engineer's Report and evidence relating to the method of spread of assessment in accordance with benefits. The Clerk advised that no written Protests had been received. There being no one desiring to be heard, Mayor Roberts de- clared the public hearing closed. Resolution No. 72 -105 A RESOLUTION DESIGNATING COLLECTION OFFICER (Rohnert Park Expressway West, Project No. 1972 -7) Bond Counsel Randolph explained the resolution. Upon motion of Councilman Beary, seconded by Councilman Flores, and unanimously approved, the reading of Resolution No, 72 -105 was waived and said resolution was adopted. Resolution No. 72 -106 A RESOLUTION AWARDING SALE OF BONDS (Rohnert Park Express- way West, Project No. 1972 -7) Bond,Counsel Randolph explained the resolution. Upon motion of CouncilmanBeary, seconded by Councilman Flores, and unanimously approved, the reading of Resolution No, 72 -106 was waived and said resolution was adopted. Bike Path to College Councilman Hopkins initiated a brief discussion regarding the $262 contribution from the college toward the cost of construction of the bike path from Snyder Lane to the college and the comparison of said sum to the total cost of the bike path. City Manager Callinan advised that the total cost of the bike path was not yet known since much of the material labor and engineering was being contributed or furnished at reduced cost. Petitions for Councilman Hopkins advised that he had several petitions Recreation Facilities expressing support for a bowling alley and theatre in Rohnert Park to present to City Manager Callinan for safe - keeping. He noted that one Boy Scout had obtained 127 signatures while working for a merit badge and asked that any other Boy Scouts asking for projects be referred to him. Deer Meadow Councilman Beary initiated a brief discussion concerning the weeds at the Deer Meadow Village project and the status of the project. Staff will follow -up on the weed situation. City Attorney Maxwell advised that Commonwealth, Inc., the trust deed holder, will betaking over the property by vir- tue of a compromise suit and he had'wr.itten to the bank- ruptcy trustee and.requested that the city's position be protected in any compromise agreement entered into. Page -7- July 17, 1972 SB 1118 Councilman Beary initiated a brief discussion regarding Subdivision Map Act SB 1118,which provides for revisions to the Subdivision Map Act. Upon motion;of Councilman Beary, seconded'by Councilman :..:Smith, and _unanimously approved, the Council re affirmed its support for SB 1118 and requested staff to send a letter expressing same to the appropriate legisla- tors. AB 1000 Councilman Beary initiated a brief discussion concerning Tax Reform AB 1000, the Reagan - Moretti tax reform program, Upon motion of Councilman Beary, seconded by Councilman Hopkins, and unanimously approved, the Council went on record in support of AB 1000 and requested staff to send a letter urging its passage to the appropriate legislators. Construction Councilman Beary initiated a discussion concerning addi- Activity Report tional items he would like to have on the Construction Acti- vity Report prepared periodically by staff. It was decided that Councilman Beary and staff will work out a form for the report. 1915 Act Delin- Councilman Hopkins inquired about the status of 1915 Act quencies delinquencies. City Manager Callinan advised the matter was coming up later in the meeting. CATV Councilman Smith initiated a discussion concerning the Storer Cable TV list of complaints and solicited Council approval to contact some of the complainants and obtain their comments on the service provided and report back to the Council. Council indicated its approval -as requested. Traffic Enforcement Councilman Smith initiated a discussion concerning traffic Problems enforcement problems and advised that there was talk of a ??citizen's patrol" in his neighborhood. He also related comments received that.a city pool employee was frequently "laying rubber" and that it should be pointed out to em- ployees that they represent the city. Proposed Lakewood ?ills Development in Windsor Newcomer's Club= Picnic Tables Southwest Blvd. Councilman Smith initiated a discussion concerning the pro- posed Lakewood Hills development in Windsor and advised that the LAFC considered the development at a special meeting and turned it down. He further reported that dis- cussion had been held regarding the creation of a county service area for the Windsor area. Councilman. Flores brought to the attention of the Council that Mrs. Vida Jones of the Newcomers Club had advised that the club..had.$50 set aside for the purchase of picnic tables for -the parks. Councilman Flores noted there were some broken tree stakes Page -8- July 17, 1972 on Southwest Blvd., near the bike path. Mr. Callinan indicated the matter woul'd.be followed up on. Citizens Advisory Councilman Flores brought to the attention of the Council Committee for Updating that the Citizens Advisory Committee would be meeting on the General Plan July 20, to discuss the Sonoma State College Environs Study and would also be considering the:Noise Element, Seismic Element, and the Bicycle Element and intended to have them ready for presentation to the Council in Septem- ber, Seeking Name Change Mayor Roberts read a. petition seeking a name change of for Cotati School the Cotati School District to the Cotati- Rohnert Park District School District and requested Council approval to circu- late.and present same to the Cotati School District Board of Trustees. Upon motion of Councilman Hopkins, seconded by Councilman Beary,.and unanimously approved, Mayor Roberts was authoriz- ed to—circulate and present the petition regarding the school district name change as requested. Budget Work Session .Councilman Flores initiated a discussion concerning the next scheduled budget work session. Due to several con- flicts the budget work session was rescheduled to 8:00 p.m. July 18 Freeway Overpass City Manager Callinan reported that a letter was on its way indicating that the federal government had given its approval to award the.contract to the low bidder, Blasi Construction, for construction of the freeway overpass. Mr. Callinan also advised that arrangements were trying to be worked out to have Blasi Construction excavate a por- tion of Himebaugh Creek channel and use the dirt for fill in the overpass construction. Traffic Safety City Manager Callinan brought to the attention of the Coun- Program Grant cil a new Traffic Safety Program Grant obtained by the Public Safety Department in the amount of approximately $900 for purchase of Plectrons. Water Situation City Manager Callinan reported that Sonoma County Water Agency had asked all water users to conserve water during the recent hot spell; that a bulletin had been sent out to residents requesting citizen cooperation in conserving .,water; that Boy Scouts, Girl Scouts, and Explorer Scouts. had distributed the bulletins door to door throughout most of the community; and that all,schools and other large water users had been contacted to curtail landscape water- ing until the hot weather passed. He advised that response was excellent and water consumption dropped'significantly. The Council requested that appreciation for the excellent citizen cooperation be expressed to residents. Page -9- July 17, 1972 Erosion Around City Manager Callinan reported that erosion around the Golf Course putting green at the golf course was becoming serious and Putting Green it had been recommended that it be gunited. Discussion followed during which Councilman Beary volunteered to assist in getting the gunite work done. 1915 Act Bonds- City Manager Callinan solicted Council guidance in pursuing Foreclosure Suit the 1915 Act Bond delinquency foreclosure suit. A brief discussion followed. Upon motion of Councilman Hopkins, seconded by Councilman Smith, and unanimously approved, bond counsel was authorized to update the foreclosure suit complaint by adding the current year's delinquencies to those properties on which foreclosure has been initiated. New City Office City Manager Callinan brought to the attention of the Coun- Building cil that the new City Office building should be finished by the end of the month, and that there will be a period of transition during which some inconvenience might be experienced. Plater Quality Control City Manager Callinan reported that Dr. Joseph of the Water Board Quality Control Board had advised of several problems with the quality of discharge from the sewer plant; that the problems have been noted and are being worked on but experiments at the sewer plant will still be carried on since they are an obligation under the grant from the federal government. November 172 Election- City Attorney Maxwell reported, in response to a Council Time required to get request, that in order to place a measure on the November Measure on Ballot 1972 ballot a special election would have to be called and consolidated with the general election not less than 54 or more than 75 days before the general election; e.g. by mid - August since the County Election Department is quite busy. Emergency Ordinances City Attorney Maxwell reported, in response to a council request, that with a 4/5 vote of Council, the 30 day period for ordinances to become effective could be waived, but courts were reluctant to uphold same and that the recently enacted Recreation Fees ordinance would not qualify as an emergency ordinance. Mobile Home Parks Discussion followed concerning mobile home parks, during which City Attorney Maxwell was- asked if the attorney for Golden State Mobile Home Association had contacted him con- cerning the Recreation Fees ordinance. Mr. Maxwell respond- ed that he had been contacted only once, that the attorney was not familiar with our ordinance, and had sent no legal authorities to substantiate his opinion that our ordinance was illegal. Further discussion followed regarding -the rental of mobile homes in Rancho Feliz Mobile Home Park, and possible restrictions on mobile home park use permits to prohibit Page --10- July 17, 1972 such rentals. Councilman.Beary requested that Director of Public Safety Dennett give a report at the.next regular meeting on Civil Defense. Mr. Callinan advised that he would send Council- man Beary a copy of the City's Emergency Plan. Rohnert Park Councilman Beary advised of the formation of the Rohnert Stadium Fund Park Stadium Fund Raising Committee for the purpose of Raising Committee raising funds to build a stadium for the football teams in the area and that the Council would be hearing more from the committee.
