1974/05/20 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES May 20, 1974 The Council of the City of Rohnert Park met this date in regular,sessi.on commencing at 7 :00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Beary presiding. The regular session was preceded by an executive session which commenced at 7 :00 p.m. and at which all Councilmen, City Manager Callinan, and City ,Attorney Flitner were present, and which was held to dis - cuss.p'ersonnel matters and possible litigation matters. Call to Order May Beary called the meeting of the regular session to order'at approximately 7:35 p.m. and led the pledge of allegiance, Roll Call Present: (5) Councilmen Eck, Flores, Hopkins, Smith, and. Beary Absent: (0) None Staff present for all or part of the meeting:.. City Manager Callinan,'City Attorney Flitner, Supt. of Public Works.Wiggins, and Consulting Engineers Milt Hudis and Larry Woods ^pproval of Minutes Councilma;i Smith stated he would like the May 6 minutes corrected to" "show his comments for the record on Page 9 Approval of Bill under Resolution No. '74 -64, that he voted no because we do not know if this chemical is safe for the long term and the fact it had not been approved by the Water Quality Control Board and the EPA. Upon motion of Councilman`Hopkins, seconded by Councilman Smith, and unanimously approved, the minutes of May 6 were approved as corrected'. Bills Upon motion of Councilman Flores, seconded by Councilman Hopkins, and unanimously approved, the bills"presented per the attached list in the amount of $62,239.03 were approved. Communications Communications per the attached outline were brought to the attention of the Council. No action was taken on any communication except as noted specifically in these minutes. Senate Hill 1966 Discussion was held concerning resolutions received from the County of Sonoma and the City of Sant& Rosa expressing opposition to SB 1966`which` would allow use of certain funds from SB 325 funds for BART. Upon motion of Councilman Flores, seconded by Councilman Hopkins, and unanimously approved, a letter will be sent 'over the Mayor's signature to the appropriate legislators expressing opposition to SB 1966 and expressing support for the position of the County of Sonoma and the City of Santa .Rosa. Page 2 May 20, 1974 Dept. of Public Safety At the request of Mayor Beary, City Manager Callinan read a letter from the California Highway Patrol which advised that Rohnert Park had fewer injury traffic accidents in 1973 than in.1972. RESOLUTION OF THE CITY COUNCIL, CITY OF ROHNERT PARK, APPROVING THE APPLICATION FOR LAND AND WATER CONSERVATION FUNDS, RAPOZO RANCH PROJECT Councilman Eck made a motion, seconded by Councilman Smith, to reject the resolution and stated his major reasons for opposition.; that the major-city park should be within the city limits of Rohnert Park; feels strongly that there is a large number of people in Rohnert Park that have feelings about this park and believes..it should go to a vote; that Page 3. May 20, 1974 the agreement between the city and county calls for Rohnert Park to spend $50,000, the County of Sonoma $50,000, and the State $ 100,000; that in addition development costs will have to be paid which will be high if.there are turfed areas; that the residents of Rohnert Park will be sub- ject to the same users fees as anyone else and if the users fees are not sufficient, Rohnert Park will have to make up the difference on a 50 -50 basis with the County which would seem to make Rohnert Park paying an inordi- nate share of the cost; that he finds.himself resentful over some of the pressure tactics used by certain persons; that he would not allow pressure tactics to influence his vote but would prefer not to deal with individuals who would use such pressure tactics. Councilman Flores stated for the record that the proposed regional park was a project that would be totaly beneficial and it was incomprehensible to him to find that so called a advocates of open space opposed this park; that it had been approved by the Parks and Recreation Commission after eval- uating eight sites; approved by the City Council, County Parks and Recreation Commission, County Parks and Recreation Director, County Board of Supervisors, and the State Parks staff; that all the above agencies had made positive statements and recommendations for the park. Councilman Smith stated for the record that he had consist- ently opposed the project but supported the seeking of funds when it was obvious that the City Council was going ahead; that Rohnert Park had more of an obligation to obtain a'flat land park; the land in the hills is not buildable and has no amenities; the urgency in purchasing the land cannot be justified; flat land that is subject to pressures of development and its potential use as a park site will soon be non - existent; Spring Lake had just been opened and it would seem -that the Rapozo Ranch should be a county project; that Rohnert Park should move ahead on a flat land park now.` Councilman Hopkins stated for the record that even though it is no small amount, $50,000 to obtain -a park so near Rohnert Park would be a wise investment; that the Council had not taken the position that it would be the Rapozo Ranch or nothing; that negotiations are now in process with owners of land inside Rohnert Park but it seemed difficult to get a response from the owners. Mayor Beary stated for the record that although there is i no particular urgency n acquiring the site, 01 _ _ the ranch is developable and there are amenities that would make a 5 -10 acre site desirable; that most coTw unities in Sonoma County do not have flat land parks on their priority list, but do have foothill parks on a priority list, that based on the numbers involved and amenities offered on the site, there is no question that it would be a benefit to our community. Page 4e May 20, 1974 Mrs.`Laikie Sani, 768.3 Adrian Drive, was recognized. She .asked if there were °another regional park that had been financed jointly by the county and a city. Mayor Beary responded that there was Shollenberger Park in Petaluma. Mrs. Sani asked if that park was inside or outside the city limits of Petaluma and Mayor Beary responded that it was inside. Bryce Suderow, 373 Bonnie, was recognized. He asked how far the park site was from Rohnert Park. Councilman Flores responded that it was 3.9 miles by road and 1.2 miles if trails were used. Discussion followed during which it was noted that the Citizens Advisory Committee for Updating the General Plan had also supported the park sate. Mr. Tony Carbone, Vice Chairman of said Citizens Advisory Committee, was recognized. He stated that the committee did recommend and strongly endorsed a regional park more than a flat land park because of the taxes that would be required for a large flat land park. He also commented that neighborhood parks were more desirable than a large flat land park. Further discussion followed. Councilman Eck's motion to reject Resolution No. 74 -73 failed by the following roll call vote: AYES: (2) Councilmen Eck and Smith ' NOES: (3) Councilmen Flores, Hopkins, and Beary Upon motion of Councilman Flores, seconded by Councilman 'Hopkins, and approved by the following roll call vote, Resolution No. 74 -73 was approved: AYES: (3) Councilmen Flores, Hopkins, and Beary NOES: (2) Councilmen Eck and Smith Weed Abatement City Manager Callinan advised that notices to destroy weeds had been sent to property owners and also pub lisped in the Clarion. Mayor Beary declared the public hearing open on the NOtice to Destroy Weeds. City Manager Callinan advised that the only commuaica - bans received.had been from property owners requesting that the city remove the weeds and bill the property owners for same. There being no;one desiring to be heard, Mayor Beary declared the public - hearing closed. Page 5. May 20, 1974 Resolution No. 74 -74 RESOLUTION ORDERING CITY MANAGER OF THE CITY OF ROHNERT PARK. TO ABATE NUISANCES EXISTING WITHIN THE CITY OF ROHNERT PARK City Manager Callinan explained the.resolution. Ambulance Service for Cotati Schools Upon motion of Councilman Hopkins, seconded by Councilman Flores, and unanimously approved, the reading of Reso- lution No. 74-74 was waived and said resolution was adopted. Jim Davidson, Cotati- Rohnert Park Elementary School District Superintendent, appeared and relayed a request from the Board of Trustees that a program be worked out for the Rohnert Park ambulance to respond to emergencies at the Cotati schools. He advised -there were approximately 40-50 Rohnert Park students attending the Cotati schools, that -to the best of his knowledge no ambulances had ever been called to the Cotati schools, but the service was desired should it become necessary rather than having to wait for a unit to respond from Petaluma or Santa Rosa. City Manager Callinan briefly reviewed his memo to the Council dated M.ay 16th concerning the ambulance service, advised that investigation revealed that presently ambu- lance service would be from either Cadles or Browns in Santa Rosa, that the "Rohnert Park ambulance could respond faster, and that in view of the past lack of demand for the service, it was recommended that the service be pro- vided as requested. `'A brief discussion followed. Upon motion of Councilman Flores, seconded by Councilman Hopkins, and unanimously approved, staff was authorized to work out an agreement that would enable the Rohnert Park ambulance to respond to the Cotati schools. Mr. Jay Wiseman, 8290 Lancaster Drive, was recognized. He discussed with the Council his investigation of the pos- sible establishment of a private ambulance service that would serve Rohnert Park, Cotati, Penngrove and surrounding area. The Council indicated that Mr. Wiseman should proceed with steps to obtain. a Certificate of Public Con- venience and Necessity;' and if his proposed service proved to be satisfactory, the City's ambulance service would be phased out. Ground Water Basin City Manager Callinan reviewed his memo to the Council Study dated May 17 regarding Water Basin Study. Discussion followed with Consulting Engineer Hudis participating, Upon motion of Councilman Flores, seconded by Councilman ..Hopkins, and unanimously approved by the following roll call vote, staff was authorized to proceed with prepara- tion of plans and specifications for an 8" test hole project as outlined in City Manager Callinan's memo, and to use college students to start gathering information on the wells in the area: Page 6. May 20, 1974 AYES: (5) Councilmen Eck, Flores., Hopkins, Smith, and Beary NOES: (0) None Discussion was held concerning participation, of the County of Sonoma in the cost of the Water Basin Study. Upon motion of Councilman Hopkins, seconded by Councilman Smith, and unanimously approved, the County will be requested to participate in the cost of the Water Basin Study. Discussion was held concerning participation of the City of Cotati in,the cost of.the Water Basin Study. Upon motion of Councilman Hopkins, seconded by Councilman Smith, and unanimously approved, the City of Cotati will be requested to participate in the cost of the Water Basin Study. El Colegio Terrace City Manager Callinan requested and received permission File No. 0215 to discuss with the-Council a request for approval of the final map for El.Colegio Terrace, being the conversion of an apartment project to a condominium. The Council indicated it would like information on the number of student residents that might be affected by the change, an indication from the college Housing Director on whether or not the apartments were needed for college housing and similar information. By consensus of Council the matter was deferred to the.next regular meeting. Golf Course Fencing City Manager Callinan reviewed past action and consid- Requirements - File eration of fencingxequirements for residential lots back - No. 0344 -ing onto the-Municipal Golf Course, and displayed a sample of.green, vinyl clad chain link fencing which had been submitted. Discussion followed. Mr. Hal Janney, Dean of Students and Golf Coach at Rancho Cotate High School, was recognized. He commented he had seen the same,type.of fencing used at other golf courses I nd it blended in beautifully with the landscape, but thought 4 feet was a little low. Further discussion followed. .Upon motion of Councilman Hopkins, seconded by Councilman Flores, and approved by'the following roll call vote, the green vinyl clad chain link fencing at a height of 4 feet was approved for residential lots backing onto the Municipal Golf Course: AYES: (3) Councilmen Flores, Hopkins, and Beary NOES: ` (2) Councilmen Eck and Smith Page 7. May 20, 1974 Federal Aid Urban City Manager Callinan pointed out the Federal Aid Urban System & Funds service area on the map on display and advised that a three year plan for use of FAU funds had to be developed for submittal to the Metropolitan Transportation Commission; that the City of Cotati had made application to improve East Cotati Avenue out to the college under the FAU program. Discussion followed. Upon motion of Councilman Hopkins, seconded by Councilman Smith, and unanimously approved, the Council indicated general support for the proposed improvement of East Cotati Avenue under Federal Aid Urban Systems funding. Rancho Cotate High Mayor Beary advised that meetings had been held with rep- School Athletic Funds resentatives of the Petaluma School District and city staff regarding a deficit in gate receipts at football games as a result of playing on Saturday afternoons rather than Friday nights and that it might be less expensive to make a contribution to the Athletic fund rather than making a commitment for lights on the football field. Dis- cussion followed. Upon motion of Councilman Flores, seconded by Councilman Eck, and unanimously approved, Councilman Hopkins was designated to meet with high school representatives and prepare a report for the Council in considering allocation of funds to the high school athletic fund. The matter was scheduled for further consideration at the next regular meeting. Ordinance - Dedication Mayor Beary advised he would like the City Attorney to of Park Land draft an ordinance that would provide for dedication of park land by developers in commercial and industrial developments as well as residential. A brief discussion followed during which the Council indicated concurrence with the request and that the matter be scheduled for the next regular meeting. Bike Paths Councilman Eck initiated a discussion concerning bike paths and noted there was a bump in the bike path to the college. City Manager Callinan advised that city staff would check on the matter. Councilman Eck also indi- cated there was a need for a bike path which would con- nect Rohnert Park with Santa Rosa. City Manager Callinan advised there was an assessment district now in the design stage for Santa Rosa Avenue and a bike path could be included before the project goes.to bid. The Council indi- cated that the bike path should be included-in said assess- ment district. Page 8. May 20, 197+ Colegio Vista Park Councilman Eck initiated a discussion regarding the slatted. Fence chain link fence in Colegio Vista Park and complaints he had received from adjacent residents regarding lack of privacy. City Manager Callinan noted that these residents were aware of the park site before purchasing homes and the redwood slatted chain link fence was recommended by city staff rather than a wood fence because of its added durability and decreased maintenance. Commerce Blvd. Speed Councilman Flores initiated a discussion concerning reduct- Limit ion of the speed limit on Commerce Blvd. from 35 MPH to 25 MPH.. Upon motion of Councilman Flores, seconded by- Councilman Eck, and unanimously approved, staff was directed to prepare an ordinance reducing the speed limit to 25 MPH on Commerce Blvd. from Southwest Blvd. to the Expressway and to also have Director of Public SAfety Dennett present to review new laws concerning traffic. 11L11 Section Mini -parks Councilman Flores initiated a- discussion concerning devel- and Bike Paths Develop'- opment of the mini -parks and bike paths in the t11,11section ment and a specific timetable for same: Councilman Flores was selected to form a committee to make specific recommendations for development of bike paths and mini -parks in 19L11 section. Fie selected Council - man Eck to serve on said committee and will contact the Parks and Recreation Commission for additional committee members. Myrtle Avenue Councilman Smith inquired if a response had been received Improvement from Sonoma County concerning improvement of Myrtle Avenue to acommodate Golden Gate Transit buses. City Manager Callinan responded in the negative. Water Quality Control Councilman Smith inquired if a response had been received Board from Dr. Joseph of the Water Quality Control Board con - cerning sewer connections. City Manager Callinan responded that a verbal response had been _received but not in writing and that he recently discussed the matter with Dr. Joseph and was promised a written response. Dedication of Country Councilman Smith initiated a brief discussion concerning Club Drive Bridge at the short notice of the dedication ceremony for the Copeland Creek Country Club Drive Bridge at Copeland Creek. City Manager Callinan advised that the contractor had finished work on the project earlier than expected and it was a rather informal- dedication with the anticipation that most of the Council would be unable to attend. Tennis Court Lights Councilman Smith initiated a discussion concerning the possible installation of lights,on the tennis courts in Alicia and Ladybug Parks as'well as the courts at the junior high school on Burton Avenue. Upon motion of Councilman Smith, seconded by Councilman Hopkins, and unanimously approved, staff will direct a Page 90 May 20, 1974 letter to residents on Burton Avenue to solicit comments regarding the installation of lights on the tennis courts at the junior high school. Staff was requested to prepare a cost estimate for light- ing the tennis courts in Alicia and Ladybug Parks including extension of electricity. Rlka Theft Councilman Smith initiated a discussion regarding the large number of bike thefts in the community. CATV Councilman Smith read a.letter from Mr. John Kirstein, 7673 Bonnie Way regarding FM cable reception. A brief duss_.on followed. Upon motion of Councilman Smith, seconded by Councilman Hopkins, and unanimously approved, the letter from Mr. Kirstein will be referred to Storer Cable TV for comment and also the request that a status report be provided to the Council for FM equipment installation. Curb Painting Councilman Smith initiated a brief discussion regarding curbs being painted red for bus stops and that he had not seen any more painting being done recently. AB 2040, Bay Area Councilman Hopkins initiated a discussion concerning AB Planning Agency 2040 which would create a Bay Area Planning Agency. Upon motion of'Councilman Hopkins, seconded by Councilman Flores, and approved by the following roll call vote, the Council went on record as opposing AB 2040: AYES: (3) Councilmen Flores, Hopkins, and Beary NOES: (2) Councilmen Eck and Smith Recess Mayor Beary declared a recess at this point in the meeting, the time being approximately 9 :55 p.m. Reconvene Mayor Beary reconvened the meeting at approximately 10 :08 p.m. with all Councilmen present. Rapozo Ranch Project Councilman Hopkins commented concerning the Rapozo Ranch Project stating that some people in the community seem to have the idea that the City Council is against a flat land park; several people have asked why the Rapozo Ranch was chosen rather than a flat land park;.that if people are as interested in a flat land park as has been indicated, they should appear before the Parks and Recreation Com- mission and state what they want and how much they want to spend, that if they can come up.with something better then to please do so. Sewer Plant Matters Councilman Smith advised he had contacted the EPA regard- ing CUROD which is being applied at the sewer plant to control odors; that the chemical is being reviewed by Agenda Items Plaques for High School Track and Swim Championship Teams Disposal of Old Pickup Truck Federal Revenue Sharing Funds Animal Control Euthanair Machine Page 10. May 20, 1074 EPA and a report will be submitted advising whether or not, in their opinion, the product should or should not be used. .Councilman Eck advised that he had talked to an engineer.. at M.I.F. Corporation and had been advised that CUROD was a hybrid micro - organism and is pursuing use of the product with the State Department of Health. City Manager Callinan commented that the Council Rules of Procedure stated that Councilmen could bring up non - agenda items with concurrence of the Council; that he had counted at least 20 items brought up during the meeting that were not on the agenda and requested that they be scheduled on the agenda. City Manager Callinan reviewed his memo to the Council dated May 16 concerning the City providing plaques for members of the championship high school track and;swim teams. A brief discussion followed. Upon motion of Councilman Hopkins, seconded by Councilman Eck, and unanimously approved, the purchase of plaques for the Rancho Cotate High School Championship Track and Swim teams at a cost of approximately $455. was approved. Coach Bob Lombardi appeared and expressed thanks and appreciation for the City's support of the athletic program at the high school. Upon motion of Councilman Smith, seconded by Councilman Hopkins, and unanimously approved, a letter and Certifi- cate of Appreciation will be sent to Mr. Gil Soto commend- ing him for his past efforts in coaching the community's swim teams. ` City Manager Callinan reviewed his memo to the Council dated May 16 concerning the sale of the old pickup truck formerly used as an Animal Control truck; A brief dis- cussion followed. Upon motion of Councilman Hopkins, seconded by Councilman Smith, and unanimously approved, sale of the old pickup truck for $75 was approved. City Manager Callinan briefly reviewed his memo to the Council dated May 16 regarding anticipated Federal Reve- nue Sharing; Funds for fiscal year 107475 and indicated the use for said funds would be scheduled for formal consideration at the next regular meeting. City Manager Callinan advised that a Euthanair machine would be requested in the next fiscal year budget and requested authorization to call for quotes on same and issue a purchase order for approximately $3,500. Dis- cussion followed. Page 11. May 20, 1974 Upon motion of Councilman Smith, seconded by Councilman Flores, and unanimously approved, staff was authorized to call for quotes on a Euthanair machine, issue a pur- chase order for approximately $3,500 and obtain infor- mation regarding possible contract services with the Humane Society. Resolution No. 74 -75 A RESOLUTION OF THE CITY OF ROHNERT PARK SOLICITING THE COOPERATION OF LOCAL REALTORS IN ADVISING PROS- PECTIVE PURCHASERS RELATIVE TO CERTAIN PROPERTIES WHICH DO NOT COMPLY WITH THE ZONING OR BUILDING ORDINANCES OF THE CITY OF ROHNERT PARK City Attorney Flitner reviewed the resolution. Upon motion of Councilman Smith, seconded by Councilman Hopkins, and unanimously approved, the reading of Resolution No. 74 -75 was waived and said resolution was adopted. Proposed Ordinance City Attorney Flitner read a portion of the Penal Code Requiring Bolt Removal pertaining to firearms and reviewed a proposed ordinance or Sheathing of Firearms prepared by him which would require bolt removal or sheathing of firearms. Discussion followed. No action was taken on -the proposed ordinance since the Penal Code covered the situation under concern. Mini-Bus Mr. Gary Sterner appeared and discussed with the Council the status of the Mini -bus service. Upon motion of Councilman Smith, seconded by Councilman Flores, and approved by the following roll call vote, the present Minibus service will be discontinued and Dial -A -Cab service for senior citizens explored: AYES: (3) Councilmen Flores, Hopkins, and Smith NOES: (2) Councilmen Eck and Beary Upon motion of Councilman Smith, seconded by Councilman Hopkins, and unanimously approved by the following roll call vote, staff was directed to investigate a Dial -A-Cab service, exploring specifically the needs of senior citi- zens for such service: AYES: (5) Councilmen Eck, Flores, Hopkins, Smith, and Beary NOES: (0) None Discussion followed regarding the recent Transit Feasi- bility study by Kaiser Engineers.
