Approval of Minutes Councilman Smiths initiated a brief discussion concerning the December 10th minutes, advising that under the subject of "Water for Petaluma"' the minutes indicated that Council had given staff some guidelines and that he would like those guidelines precisely set forth in the December 10th minutes. Upon motion of Councilman Hopkins, seconded by Councilman Beary, and unanimously approved, tbe,minutes of December 3 were approved as submitted, Action on the minutes of December 10 was deferred:. Approval, of Bills Upon motion of Councilman Hopkins, seconded by Councilman Smith, and unanimously approved, the bills presented per the attached list in the amount of $209,136.32 were approved. December 17, 1973 City.'Manager Callinan read a letter from Mrs. Andrea Kellogg, a former resident, which expressed appreciation for Councilman Roberts. Project No, 1956 -1 Mayor Flores declared the scheduled public .Amended Assessment hearing open on Project No.1956 -1, Amended No..6`.9.5.1 Assessment No. 6.9.5.1. City Manager, Callinan reported that notice of the public hearing had been published in the Rohnert Park - Cotati Clarion, explained the amendment, and advised that no written communi- cations had been received. There being no one desiring to be heard, Mayor Flores declared the public hearing closed. Resolution No. 73 -160 A.RESOLUTION CONFIRMING AMENDED ASSESSMENT, PROJECT NO. 1956: -1, ASSESSMENT NO. 6.,.9.5.1, City Manager Callinan explained the resolution. Upon motion of Councilman Hopkins, seconded by Councilman Roberts, and unanimously approved, the reading of Resolution No. 73 -160 was waved.and said resolution was adopted. Project No.' 1968-3 Mayor Flores declared the scheduled public Amended Assessment hearing open on Project No. 1968 -3, Amended No. 1 -1.3 Assessment No. 1 -1.3. A RESOLUTION CONFIRMING AMENDED ASSESSMENT, COPELAND CREEK IMPROVEMENT PROJECT NO. 1968 -31, ASSESSMENT NO. 1 -1.3 City Manager Callinan explained the resolution. Upon motion of Councilman Smith, seconded by Councilman Beary, and unanimously approved, the reading of Resolution No. 73 -161 was waived and said resolution was adopted. Copeland'Creek City Manager Callinan reviewed his memo to Drainage Plan the Council dated December 14 and pointed out Page 3. December 17, 1973 the boundaries of the drainage plan area on the city map on display. Discussion followed. Engineer Hudis, in.response to a question from the Council, advised that the revised rate of $630 per acre was based on present prices and present rates of increase per year. Further discussion followed during which City Attorney Maxwell advised that he believed Rohnert Park was the only city in the state using this particular type of drainage plan. AYES: (5) Councilmen Beary, Hopkins, Roberts, Smith, and Flores NOES: (0) None AN ORDINANCE ESTABLISHING THE ROHNERT PARK YOUTH ADVISORY PANEL Consideration of Ordinance No. 214 was deferr- ed until after the Student City Council meeting. Mr. Bill Wendel, President of the Rohnert Park Cultural Arts Corporation, was recognized. He introduced Cultural Arts Commissioners Cord, Dietz, LaVoie, and Schmidt. Mr. Wendel explained that the Cultural Arts Corporation had held a contest for black and white line drawings depicting cultural acti- vities in Rohnert Park. He advised that the winner of the contest was Mike Byrne; that honorable mentions had been given to Bruce Bening, Robert Ferguson, Mike Graham, Jerry Moffitt, and Gina Wesley. Staff was directed to review this ordinance each December to determine if the fees pro- vided for therein should be adjusted. Joint Meeting with Mayo . r Flores advised that he and Planning Planning Commission Commission Chairman Goff recommended January 14, 1974 for the proposed joint meeting of +'him Council n A DI 1 0 4* Planning Commission Appointments arming 031HIL EPS OIL. JAM Council indicated concurrence with the recom- mendation. Mayor Flores advised -that the joint meeting would be held in the Conference Room since the regular meeting of the Parks and Recreation Commission would be in the Council Chambers. Mayor Flores advised there were two terms expiring January 1 on the Planning Commission. The Council-indicated action on the appoint- ments would be taken at the January 7th Council meeting. Tennis Courts,and Councilman Roberts advised he had 'di:s'cussed Park Plans a higher priority for tennis courts with the Parks and-Recreation Commission, the Commission had 'made recommendations as contained in a "memo from Parks and Recreation Commission State Park Bond Issue Committee Chairman Hoffman to the Council dated December 13 and reviewed said memo with the Council. Discussion followed with Parks and Recreation Director Pekkain particdpating during which it was noted that each tennis court' t would cost-approximately $10,000 for day use only. Coqncilmdn Roberts asked how much money was available in the Federal Revenue Sharing Fund. Staff responded that the figures would be checked and . reported on at the next regular ' meeting.. - Councilman Roberts reported on the recent meeting held by the County's State Park Bond Is'su,e Committee, advising that:if-the bond issue were approved, 1. Mayor Flores read his proposal entitled "Major City Beautification Project" (Tree and Shrub Planting) a copy of which is attached to the original of these minutes. A brief discussion followed. Upon motion of Mayor Flores, seconded by Councilman Hopkins, and unanimously approved, Mayor Flores' proposal for tree and shrub planting at a total cost of $3,100 was approved. .A brief discussion followed concerning some pyracantha berries being poisonous with Tony ''`'Carbone participating. Staff was instructed to see that the non'-poisonous variety was obtained for the project. Park ' s and Recreation Commissioner Tina Helgren was recognized. She asked why no evergreens were included in the tree planting program. Mayor,Flo res responded that it was hoped that residents:would purchase live Christmas trees and plant same in their yards.. Mayor Flores advised that the Council had authorized Councilman Roberts and himself to arrange for an appropriate presentation to City Attorney Maxwell upon his leaving the 1 4- _' Li POSLon and that arrangements were being made. City Manager Callinan advised that the Rohnert Park Chamber of Commerce would also in I g.an award to Mr. Maxwell. be present- Mayor.Flores commended Tony Carbone, Cotati- Rohnert Park School District Trustee, for his 0 efforts toward unification of the school system. advised he was sorry to learn that Mr. Carbone was no longer on the County Committee for Reorganization, but understood.,he would still be working on the matter. Councilman.Beary initiated a brief discussion concerning Deer Meadow Village being approved some three years ago and that perhaps the building permits should be refunded and new ones issued at the new rates. Bicycle for City Staff Councilman Smith initiated-.a discussion d,bn- purchase of a bicycle for use by city Staff. ­Upon motion of Councilman Smith, seconded by Page 8. Suggestion Box ;for Coundilman "Smith initiated a discussion con - Golf-Course cernang installation of a suggestion box at the golf course. Upon motion of Councilman Smith, seconded by Councilman Hopkins; and unanimously approved, a suggestion box will be installed at the golf course with appropriate forms provided for use by golfers with access to the box not being available to golf course personnel, but only city administrative staff. Christmas Party for Councilman Smith commented regarding.the,:party Commissioners to` be held December `22 for the Cmrrissioners and advised that due to a previous commitment he would not be able to attend but extended holiday greetings to all the Commissioners and expressed regrets that he and his wife could not be present. Animal Control Councilman Roberts initiated a brief discus - sion concerning the possibility of Public Safety Officers following loose dogs•home and •issuing a citation to the owner, rather, than trying; to catch the animal and. poss ;b7.y" ruinn ing his uniform and /or damaging police vehicles. City Manager Callinan explained the resolution. Councilmen Roberts, Smith, and Flores NOES: (2) Councilmen Beary and Hopkins Discussion followed concerning the City agree- ing to pay for one -half the cost of construct- ing the road in front of City owned land. Upon motion of Councilman Smith, seconded by Councilman Roberts, and approved by the fol- lowing roll call vote, the City will pay for one -half the cost.of constructing the road in front of the land being acquired from Northern ('al i �nnvii nnwesl nrNara Tr— AYES: (3) Councilmen Roberts, Smith,' and Flores NOES: (2) Councilmen Beary and Hopkins Councilman Beary stated for the record that he does not feel the city should be in the road building business, that the price tag was too high in exchange for one acre; that if it is necessary that the road be built it should be at the developer's expense. Councilman Roberts stated for the record th4t there.are other streets in Rohnert Park that the city has committed to build, i.e. Southwest Boulevard, Commerce Boulevard going north and others; that he agrees the city is not in the road building business, but the city has obli- gations and this is one of them; that if the park is to be.utilized to its fullest, the road must be built. Mayor Flores stated for the record that he sup- ported the above motion on the basis of (1) construction of the road is necessary to the ; full utilization of Alicia Park and the full.:" utilization of the adjacent school grounds which will be developed under the joint powers agreement with the school district; and (2) that the City will eventually have to build that road and if it is delayed the cost to the citizens of Rohnert Park would be considerably higher. Councilman Hopkins requested that staff give a report at the next meeting on the streets, Page 10. 1. Project No. 197311 City Manager Callinan reviewed his memo to Wells 10 and 11 the Council dated December 14 concerning Project No. 1973 -m11, Wells 10 and 11. Engineer Hudis advised that the bid received from' , Bartley Pump in the amount of $58,252 was approximately 5% higher than the last well bid received which was in line with increased costs. He reviewed and explained the con - ditions contained in the bid from Bartley Pump. Engineer Hudis pointed out the location of the wells on the General Plan map on display. Upon motion of Councilman Beary, seconded by Councilman Hopkins, and unanimously approved, Bartley Pump was awarded the contract for Project No. 1973 -n11, Wells 10 and 11, at the bid price of $58,252. Open Spao- e-Bond City Manager Callinan reviewed his memo to Measure the Council dated December 14 concerning the Open Space Bond Measure which reflected that six months must elapse before the measure can again be placed on the ballot. A brief disW cussion followed. Upon motion of Councilman Beary, seconded by Councilman Hopkins, and unanimously approved, consideration of placing the Open Space Bond Measure on the ballot again was postponed indefinitely. Gasoline Storage City Manager Callinan reviewed his memo to the Regulations Council dated December 14 concerning gasoline storage regulations. Discussion followed during, which it was suggested that the Public Safety Department publicize the safety aspects involved in storing gasoline. t Mr. Dave'Jones`of' the Rohnert Park-Cotati Clarion was recognized. He advised that he had been obtaining information from the Public Safety Department and would be giving coverage On the matter as soon as possible. Water Matters 'City Manager Callinan reviewed his memo to the Council dated December 14 concerning water for Cotati and the December 5 communication from the Sonoma County Water Agency regarding the Page 11 December 17, 1973 new aqueduct system and suggested a: work ses- sion on same. He pointed out the "Critical Path" diagram on display. Wa9tewater'Matters CityManager Callinan reviewed his memo to the Council dated December 14 concerning the efforts being made to use treated effluent to irrigate pasture lands west of Rohnert Park and the status of the Llano treatment plant. He advised he had attended the recent Water Quality Control Board meeting when the sewer connection ban was lifted for Santa Rosa and felt certain that the Llano treatment plant, expansion project would move ahead quite rap-4 idly because of the ban in Santa Rosa. Parks development City Manager Callinan advised that Director of Parks and Recreation Pekkain was trying to get a reasonable proposal from landscape archi- tects for parks development. Further discus- sion was deferred until all proposals are received. ABAG Growth Plan City Manager Callinan announced that a joint meeting of City Councils and Planning Com- missions in the area would be held January 9th to explain the ABAG Growth Plan with the time and place to be announced later. New Conflict of City Attorney Maxwell advised he had received Interest Laws a copy of SB 716, the new conflict of interest and financial disclosure law and suggested that it be duplicated for distribution to the Council to review. He briefly reviewed some of the major changes. Zoning and Initiatives City Attorney Maxwell reported on a question asked at a previous Council meeting regarding zoning amendments being made by the initiative procedure, advising that it could not be done in General Law cities. Deer Meadow Village Councilman Beary asked City Attorney Maxwell File 0143 for an opinion regarding the status of building permits not used within one year, referring to Deer Meadow Ville. City Attorney Maxwell responded that if a building permit was issued but not used within one year, the funds would have to be refunded and new building permits issued. Rohnert Park-Cotati Mayor Flores commended Lyle Amlin and Dave Clarion Jones of the Rohnert Park-Cotati Clarion for the extensive publicity given the Student Council activities. Page 12. December 17, 1973 Storer Cable TV Mayor Flores thanked Mr.,Jack Harper and the other staff members of Storer Cable TV for televising' the meeting. Commission cc: Parks & Rec. Commission City Manager DATE: December 13, 1973 The Parks and Recreation Commission unanimously endorsed the proposal presented by Councilman Roberts in utilizing SB 90 Funds; if available, to construct city tennis courts. The Commission has reviewed the following areas and so recommends priorities for development of tennis courts. 1. Ladybuq Park a. Two tennis courts limited to day use only due to the close proximity of homes. b. Would give new area additional recreational facilities 2. Rohnert Park Junior Hiah a. Upgrading existing two courts b. Adding one new court C. Installing lights for night use because of parking accommodations and a greater buffer zone between courts & homes. Also the close proximity of street for electrical hookup is convenient. d. Recommend expansion of Community Center parking lot to accommo- date Community Center users. 3. Colegio Park a. Two tennis courts limited to day use. b. Commission was concerned about duplication of tennis facilities in that area due to close location of high school courts. 4. Alicia Park a. Last priority due to lack of access road and land development b. Would require revised Master Plan to relocate tennis courts due to close proximity of homes C. If tennis courts are relocated, would be suitable for night use
