1973/11/19 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES November 19, 1973 The Council of the City of Rohnert Park met this date in regular session commencing at 4 :12 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with °Mayor Flores presiding. Call`to Order Mayor Flores called the meeting of the regular session to order at approximately 4 :12 p.m. and led the pledge of allegiance. Present: (3) Councilmen Beary, Hopkins, and Flores Absent: (2) Councilmen Roberts and Smith Staff present for all or part of the meeting :' City Manager Callinan, City Attorney Maxwell, Planning Director Skanchy, and Engineer Larry moods Mayor Flores announced that Councilmen Roberts and Smith had called to say they could not attend this meeting but would be in attendance at the 7:00 p.m. meeting. Approval of Minutes Upon.motion of Councilman Hopkins, seconded by Councilman Beary, and unanimously approved, the minutes of November 5, 12, and 13 were approved ed as submitted. Approval of Bills Upon motion of Councilman Hopkins, seconded by Councilman Beary, and unanimously approved, the ,.balls presented per the attached list in the ;amount of $193,639.64 were approved. Communications Communications per the attached outline were brought to the attention of the Council. No action was taken on any communication except as noted specifically in these minutes. Cultural Arts Com- Upon motion of Councilman Hopkins, seconded by missioner Bullen's Councilman Beary, and unanimously approved, the Resignation resignation of Cultural Arts Commissioner Bullen was accepted with regret and the Mayor directed t& obtain an appropriate plaque and ..:send a letter of appreciation to Mr. Bullen for his years.of'service. CATV Discussion was held concerning televising of City Council meetings upon the receipt of cer- tain equipment by Storer Cable TV as set forth ,in a letter from Storer Cable TV Manager :.Jack Harper: It.was suggested, and Council agreed, _page .;. 'Nqv. ember 19, 1973 that the December 17th meeting be the first to be televised since there will be a. student Council meeting on -that date. Jim Dougherty, Rancho "Jim Dougherty, Rancho Cotate High School base - Cotate High'Scho6l 'ball coach,' was recognized. He presented to Baseball Coach the Council a picture plaque of the.•1973 Rancho Cotate Championship Baseball Team, advised the team had represented Rohnert'`Park ih'the Tournament of Champions held inSan Rafael, and stated that without the support of the City Council and the community the championship and awards for the team members would not have been possible. Resolution No. 73149' ' A RESOLUTION DECLARING RESULT OF SPECIAL MUNICIPAL ELECTION HELD NOVEMBER 6, 1973 IN THE CITY OF ROHNERT PARK, CALIFORNIA City Manager Callinan explained the resolu- tion. Upon motion of Councilman Hopkins, seconded by Councilman Beary, and unanimously approved, the reading of Resolution No. 73 -149 was waived and said resolution was adopted. Country,Club Garden City Manager Callinan advised that upon advice Estates,.,Acceptance of City Attorney Maxwell the public improver. of Puhlic Improvements ments for Country Club Garden Estates could,be accepted, but the-subdivision performance bond should not be released since it did not provide for a one year maintenance period. Discussion followed with Mr. Pat Taylor participating. Upon motion of Councilman Beary, seconded by Councilman Hopkins, and unanimously approved, the public improvements for Country,Club Garden Estates installed to date were accepted with- out-releasing the subdivision bond. File 0254E, Rodavco, City Manager Callinan noted for the record his Country Club, Estates,, ,interest in Rodavco, Inc. and Country Club Sub. 6, Approval. of .Estates, Subdivision No. 6. Final Map Planning Director Skanchy explained the final map for File 0254E, Rodavco, Country Club Estates, Subdivision No. 6,:.on display and advised it conformed to the tentative map forr .same. Discussion followed regarding fencing . along the golf course. Staff advised that de developers were being advised that a six foot chain link fence with redwood slats would be the maximum requirement for fencing along the golf course. It was decided that the Council ..and staff should view other golf courses to determine the best method for handling fencing along the golf course.. Upon motion of Councilman Hopkins, seconded by Councilman Bea.ry and unanimously approved, the final map for Country Club Estates,`Subdi- vision No. 6, was approved and the Mayor autho- rized to enter into an appropriate subdivision agreement prior to releasing the map for re=- cording. File 0143, Deer Meadow. Planning Director Skanchy explained the revised Village, Final Map final map for File 0143, Deer Meadow Village, Revision on display advising that the density would not be changed but some lot sizes and set -backs had been altered somewhat which he considered an improvement He further advised that the. Planning Commission had considered the revised map and had recommended its approval. He also' advised that the developers were requesting that the public utility easement shown on the map be waived. Mr. John Gilligan of Murray 6 McCormick Environmental Group.was recognized. He explained the need for waiver of the public utility easement shown on the map. Discussion followed with Mr. Gilligan participating. Upon motion of Councilman Hopkins, seconded by Councilman.Beary, and unanimously approved, the revised final map for File 0143, Deer Meadow Village, was.approved and staff ` autho® rized to work with the developer in making the necessary changes regarding the public utility easement. November 19, 1973 'Plannin"g'Pireetpr Skanchy advised that the Planning,Commission, following the directive of the City'-Council, had held a,meeting to disevs-s,the recreational vehicle storage matter and.afte,r a lengthy discussion had recommended that the proposed ordinance originally submitted to the Council be set for public hearings. Mr. Skanchy read the proposed ordinance and explained how it would apply by sketching a typical residential lot in Rohnert Park. Discussion follot4ed.with Jack Anderson and Pat Taylor participatin Council indicated the proposed ordinance should be set for public heafting. Lloyd Harwood, Sonoma.-.,-' Mr. Lloyd Harwood, Sonoma Ccufity Fare: Advisor, County. Farm Advisor,,:, -.appeared and discussed with the Council the r.e,i"Red,lamation of report submitted on the experimental project Wastb Water Project at the Waste Water Treatment Plant. Mr. Harwood explained, for the benefit of the audience, how land was graded for agricultural purposes; that the land arDund Rohnert Park ..,..is not prime agricultural .and but that the adobe soil is excellent fcr usage of waste water; P.d.. & E. Repres6nta4- tivesIre Energy Situation Mr. Harwood indicated he would like to conduct the experimental program for at least two more years and would be seeking funds for same from the County of Sonoma as well as the cities in the area. ml,­: :0 *1 *n-I-*cate-4 � Llz�_, Counci i U_L U it would like to see the program continued and that funds would be allocated for same after the County has committed funds for the project. Further discussion followed with Mr. David Eck participating. Mr. Ralph Fitch and Mr. Steve Brodnansky of Pacific Gas & Electric Company appeared to discuss the energy shortages. They explained that the shortages were due to not being able to obtain 'natural gas from Canada and El Paso Natural Gas"Co., delays in construction of nuclear power plants, and with th'e'shortage of fuel to produce electricity, voluntary efforts were being solicited to reduce con- ;sumption. They advised that all large users were being contacted to determine how usage could be reduced. City Manager Callinan advised that a repre- sentative of P.G. & E. had visited the City Offices and Public Safety Building to survey possible areas of reduction in power usage and that his recommendations had already been put Page 6. Review of Park Plans, Review.of Park Plans with regard to tennis re Tennis Courts ,courts was .deferred to the next regular A Lyle Amlin Award re Support of Open Space Bond Measure meeting ue to the absence of Councilman Roberts who had requested discussion of the matter. Mayor Flores read Resolution No. 73 -143 commending Lyle Amlin for his support of the .Open Space Bond measure on the November 6th i'ballot and presented an appropriately pre- pared and framed copy of same to Mr. Amlin. Parks and Recreation Mayor Flores advised that Mrs. Beth Hofmann Commission.Awards', had been selected as chairman of the Parks and Recreation Commission and requested.and received.­Coupcil approval to send her a con- - g: atu'latory .,letter:• -Mayor Flores presented -Mrs, Nancy Mettert a plaque in appreciation of her service on the, Parks and Recreation Commission. She responded with thanks -and appreciation. Anti-Litter Ordinance Mayor Flores presented Mr. Hap Hamann a plaque -in appreciation of his service on the Parks and Recreation Commission. He responded with thanks and appreciation,. Councilman Bury initiated a discussion con - cerning the preparation of an anti - litter ordinance'which would prohibit distribution ,of unsolicited newspapers and si.mi:lar, materials in yards and provide that such materials be placed in appropriate containers or hung on doors to prevent them'being blown around and causing litter' ,in 'the streets and neighborhoods. By consensus of Council staff was directed to prepare an.ordinance-alon-g the lines outlined by Councilman Beary-�., Large Community Park, Councilman Beaty initiated a discussion con cerning the,"possibili.ty of locating a flat land - park­' in the community. Upon motion of Councilman Beary, seconded by Councilman Hopkins, and unanimously approved, .the Planning Commission was requested to review the possibility of locating a flat land park with a minimum of 40 acres in the com- munity. Staff.Indicated a schedule would be prepared for -the next meeting which would show "Che cost of living increase affect on said fees. Water for Petaluma,, 'Councilman Beary reported,that he and City Manager' Callinan had attended the Sonoma County' Water Agency Board of Directors meeting held :....earlier in the day and the Board had indi- cated.it would not finance drilling of wells in Rohnerit'Park to supply Petaluma with water. City-,Manager Callinan advised that Petaluma is presently using llWof,jits contracted amount of water from the Water' y Agenc and faces water rationing even with its current ent population; .that Petalumal''Officials had approached the Water Agency'o'n the matter and the suggestion:.. had been made that Perhaps wells could be drilled in Rohnert Park to augment Petaluma's water supply until the Russian River/Cotati Intertie is completed. * "Discussion followed during which it was agreed that Rohnert Park would work on a solution to the problem only through the Sonoma County Water Agency. Mrs. Thomas who lives on the outskirts of Cotati was recognized, She asked how a study "Y of the water table might affect their well. Staff responded that it was not known at this time, Mr. Jack Anderson was recognized and asked if. the city is still buying water from the County Water;,,.Agency to water the golf course. Staff responded in the negative. Mrs. Lewis was recognized. She advised she lived approximately 1-1/2 miles from Cotati andicomented generally on water matters. ,Mrs. Burger was recognized. She advised she also'lived insthe'rural area and commented that if Rohnert Park does not have enough i grater -to-isiipply.the: -,plaiined new homes, then the new homes should not be built. Mayor Flores responded that the situation is constantly monitored and new homes would not be built if there was an insufficient water supply. Page 8. November 19, 1973 Energy Situation Councilman Hopkins initiated a brief dis- cussion 'concerning the possibility of some city staff going on a 10 hour day to conserve energy. Bicycle Berms Councilman Hopkins initiated a brief dis- cussion concerning the possibility of instal- ling reflectors on the bicycle berms since they were very difficult to see on rainy nights. Staff advised that reflectors had been ordered and would be installed as soon as possible. City Slogan Councilman Hopkins initiated a brief dis- cussion concerning Rohnert Park being known as "The Friendly City" but felt it should also be known as a progressive city and perhaps the slogan could be changed to "The Friendly Progressive City ". Youth Panel Mayor Flores read his proposal for a "Youth Panel" in Rohnert Park, a copy of which is attached to the original of these minutes. Upon motion of Mayor Flores, seconded by Councilman Beary, and unanimously approved, the proposal for a Youth Panel was adopted and the City Attorney directed to prepare an appropriate document to implement same. A brief discussion followed regarding designating a Council member to be advisory to the Youth Panel. It was decided to discuss the matter in an executive session. Farm -City Week Mayor Flores read a proclamation he had Proclamation signed declaring the period of November 16 through November 22 as Farm -City Week. Chamber of Commerce Councilman Beary advised that the Chamber of Industrial Committee Commerce had established an Industrial Com- mittee and volunteered.to attend said com- mittee meetings as a city representative. Upon motion of Mayor Flores, seconded by Councilman Hopkins, and unanimously approved, .. Councilman Beary will represent the city at the.Chamber of Commerce Industrial Committee meetings. Supervisors Vella and. Mayor Flores advised that the Mayors' and Theiller Land Use Councilmen's Association of Sonoma County Proposals would like cities to take action on the land use proposals of Supervisors Vella and `Sheiller prior to the December 13th Mayors' and Councilmen's Association meeting and Page 9. Engaging Traffic City Manager Callinan reviewed his s memo to Consultant the Council dated November 16 regarding traf- fic consultants. A brief discussion followed. Upon motion of Councilman Beary, seconded by Councilman Hopkins, and unanimously approved, staff was authorized to engage Renato G. Martinez as traffic consultant. Capital Outlay Tax City Manager Callinan reviewed his memo to in Mobile Home Parks the Council'dated Novmeber 16 regarding pay- ment of the Capital Outlay Tax in mobile home parks. Upon motion of Councilman Beary, seconded by Councilman Hopkins, and unanimously approved. staff was directed to prepare an amend6nt to the ordinance which would clearly indicate, that the mobile home park owner is responsible for payment of the Capital Outlay Tax. Contribution to Rohnert City Manager Callinan reviewed his memo to Park Street Machine Car the Council regarding the Parks and Recrea- Club tion Commission recommendation for a $250 contribution to the car club recently formed and supervised by Department of Public Safety personnel. Upon motion of Councilman Hopkins, seconded by Councilman Beary, and unanimously approved, a $250 contribution to the Rohnert Park Street Machine car club was approved. Honorary Citizen City Manager Callinan requested Council con- sideration of naming Supervisor Vella as an Honorary,Citizen of Rohnert Park in recog- nition of his support of various matters con- cerning Rohnert Park even though his district does not encompass Rohnert Park. A brief discussion followed. Upon motion of Councilman Beary, seconded by Councilman Hopkins, and unanimously approved, Supervisor Vella was designated as an Honorary Citizen of Rohnert Park and'an ,appropriate presentation to be made by Mayor .Flores at a Board of Supervisor's meeting. was authorized. Napa Annexation Case City Attorney Maxwell's report on the Napa annexation case was deferred to the next regular meeting due to Councilman Smith's absence since he had requested said report.� •Page 10. November 19, 1973 Sp , ivoc,k Condemnation City Attorney,Maxwell reported that the Suit re Interchange Spivock case for which he had been retained Right of Way by Sonoma County to conduct eminent domain proceedings had,been concluded with an:'award of $12,000 rather than the $200,000 plus, originally acre asked for. He also advised tha city staff had participated in the jury trial of the matter. Jack Anderson Mr. Jack Anderson was recognized. He com- mented on action taken earlier in the meeting with regard to installation of reflectors on bike berms and also commented concerning the cat.and dog problem, sug- gosting that the Animal Control Officer be put on a bounty basis rather than an hourly wage. Discussion followed. Adjournment There being no further business, Mayor Flores adjourned,the meeting at 6:28 p.m. to 7:00 p.m. to interview City Attorney applicants and Parks and Recreation Commission applicants. Reconvene in Public Adjournment APPROVED: Mayor The Council met in executive session and interviewed, in separate sessions, Mr. Don Kite, Mr. George Henley, Mrs. Tina Helgren, and Mr. Pete Weber, applicants for openings on the Parks and Recreation Commission. Councilman Roberts was absent during the interview of Mrs. Tina Helgren. The Council adjourned the executive session at approximately 9:25 and reconvened in public session. All Councilmen were present for the public session. Upon motion by Councilman Hopkins, seconded by Councilmen Beary, and unanimously approved, Mr. Don Kite was appointed to the Cultural Arts Commission to fill the vacancy created with the resignation of Mr. Sam Bullen. Upon motion by Councilman Beary, seconded by Councilman Hopkins, and approved by unanimous vote with Councilman Roberts abstaining, Mr. Pete Weber and Mrs. Tina Helgren were appointed to the vacancies on the Parks and Recreation Commission.
