1973/10/15 City Council MinutesCall to Order Approval of Minutes Approval of Bills Communications r, Election Day ROHNERT PARK CITY COUNCIL MINUTES October 15, 1973 The Council of the City of Rohnert Park met this date in regular session commencing at 7:50 p.m': in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Flores presiding. The regular se .s- si:on was preceded by an executive session which commenced at 7:00 p.m. and at which All Councilmen, City Manager. Callinan,-and City 'Attorney Maxwell were present, and which was held to discuss personnel matters. Mayor Flores called the meeting of the regular session to order at approximately 7 :50 p.m. and led the pledge of allegiance. Present: (5) Councilmen Beary, Hopkins, Roberts, Smith, and Flores Absent: (0) None Staff Present for all or part of the meeting: `City Manager Callinan, City.Attorney Maxwell, Engineer Hudis, Director of Public Safety Dennett, and Planning Director Skanchy Mayor Flores announced that an- executive session had been held prior to the regular meeting,to discuss employment of Public Safety Officers and procedures for hiring a City Attorney, and other personnel matters. Upon motion of Councilman Smith, seconded by Councilman Beary, and unanimously approved, the minutes of September 12,. 17, 27, and October l were approved as submitted. Upon motion of Councilman Hopkins, seconded by Councilman Smith,.and unanimously approved, the bills presented per the attached list in the amount of $155,36 -1.28 were approved with the.exception of the Cultural Arts Corporation bill included therein. Communications per the attached outline were brought to the attention of the Council. No action was taken on any communication except as noted specifically in these minutes. October 15, 1973 Pavlick to declare the November 6th Election Day a holiday for employees. Upon motion of Councilman Smith, seconded by Councilman Hopkins, and unanimously 'a.pprrove'd, City Manager Callinan's recom- mendation that November 6th should not be -declared aioliday ,was sustained. A brief discussion was held concerning the vacancy on'the Parks and Recreation Commission, applications were solicited for the vacancy, and,C6uncil indicated that appointment would Resolution No.' 73 -138 City Manag "er C'allinan explained the ordinance. Upon motion'of Councilman Hopkins, seconded by`Councilman''Beary, and unanimously approved by the following roll call vote, the reading of Ordinance No. 212 was waived and said ordinance was adopted: AYES: (5) Councilmen Beary, Hopkins R berts Smith nd Flores NOES: (0) None ACCEPTING GRANT DEED FROM FELLOWSHIP OF BAPTISTS FOR HOME`MISSIONS (Country Club Drive Project 1972 -7) be made at the next regular meeting. Fidelity Bonds: Discussion was'held'on the October 12. letter proposal from Feeney Insurance Agency re employee and City Treasurer fidelity bonds with Tom Feeney participating. The Council indicated concurrence with the recommenda- tion's in said proposal and instructed Mr. Feeney to implement same immediately. Supervisor Joerger City Manager Callinan read a letter dated October 3 from. Supervisor Philip Joerger concerning .remarks made at recent Council meetings'and'Mayor Flores read his proposed '',response to Mr. Joerger. Discussion fol- lowed with the Council indicating approval of the proposed response to Supervisor Joerger. Letters from Rancho Mayor Flores advised he would personally Cotate Government, answer two letter inquiries received from Class students in Rancho. Cotate Government Classes regarding concerns of teenagers., Ordinance :No. 212 AMENDING ORDINANCE' NO. 7, UNIFORM LOCAL SALES APED 'USE ,TAX- Resolution No.' 73 -138 City Manag "er C'allinan explained the ordinance. October 15, 1973 City Manager Callinan explained the reso- lution. Upon motion of Councilman Hopkins, seconded. by Councilman Roberts, and unanimously approved., the reading of Resolution No. 73 -133 was waived and said resolution was adopted. Resolution No. 73-139 APPROVING JOINT POWERS AGREEMENT WITH COTATI-ROHNERT PARK SCHOOL DISTRICT (`Ladybug Park - School Site Improvement and Use) City Manager Callinan explained the reso® lution and the Joint Powers Agreement. Upon motion of Councilman Roberts, seconded by Councilman Hopkins, and unanimously approved, the,reading of Resolution No. 73- I39`.was waived and said resolution was adopted. .A brief discussion followed regarding the status of the park improvements with staff advising that work had started on same. Jeri Cochran and Miss Jeri Cochran, President of the Rancho Rancho Cotate High Cotate Marching Band appeared and gave a. School.Band ., presentation concerning the need for addi- tional uniforms for the Rancho Cotate Band. The Rancho Cotate Band also appeared and played several selections. Discussion followed during which it was pointed out that the uniforms had to be ordered immediately to avoid a price increase and to assure delivery in the Spring in time for band competitions. Upon motion of Councilman Smith, seconded by Councilman Beary, and unanimously approved by the following roll call vote, a donation of $1,000 for band uniforms was approved for public relations purposes with a review to be made in December of the fund raising efforts and additional funds donated if necessary: AYES: (5) Councilmen Beary, Hopkins Roberts, Smith, and Flores 140ES: (0) None Councilman Beary advised that Radio Station KTOB had challenged city staff to a basket - ball game with the proceeds to go to the Mr. Watson of Cotati Ready Mix 'Page 4. October 15, 1973 .Stadium Fund, but since the need for band uniforms was urgent, it was suggested that the proceeds go to the band uniform fund raising effort. Council indicated agree- ment with.-.the suggestion. Councilman Roberts advised:he had received a telephone call shortly before the meeting advising that Mr. Watson would not be able to attend. Councilman Beary related that complaints had been received that Statewide Concrete had:been taking cement to other jobs outside Rohnert Park from its temporary batch plant; not just to projects on which it had been low bidder. A brief discussion followed. Staff was instructed to make certain that Statewide Concrete was complying with all conditions of its use permit. Rohnert 'Park Sign Mr. Nibs Moessmer.of the Rohnert Park ..;Chamber of Commerce made a brief presenta- tion concerning improvement of the Rohnert Park sign referring to a drawing on display. Councilman Roberts Leaves Councilman Roberts advised he had accepted_ the office of Second Vice President with ;the, Chamb "er.of Commerce and therefore would not participate in the discussion and voting. on the Rohnert Park sign. He left the Council Chambers at approximately 8 :50 p.m. Councilman Beary asked City Attorney Maxwell if Chamber of Commerce members need abstain. Mr. Maxwell replied in the negative. Chamber of Commerce Manager Don Jones made a presentation which proposed that the sign be modernized in accordance with the sketch on display; ownership-of the sign remain with the city; cost of the proposed modern- ization, approximately $1,500, be shared equally by the City and Chamber of Commerce with.the City paying all the costs initially and the Chamber reimbursing the city over a three year period beginning with the 1974 fiscal year; maintenance of the sign be shared equally by the City and the Chamber. Chamber of-Commerce Vice President Art Hollingsworth spoke briefly in support of the proposal.,outlined by Mr. Jones. A lengthy discussion followed. Councilman Roberts Returns Councilman Beary,,,., Leaves Welcome to�Roh I n ert Park Sign, Project 1972-3 Hinebaugh Creek RpRolutlon No. 73-140 Page 5. October 15, 1973 Upon motion of Mayor Flores,''s6conded by Counqilman'B�eary, and approved by the fol- lowing roll -call vote , the proposal for the Rohnert Park sign as outlined by Mr. Jones was approved: AYES: (3) Councilmen Beary, Hopkins and Flores NOES: (0) None ABSTAIN: (2) Councilmen Roberts and Smith Councilman,Roberts returned to the Council Chambers at this point in the meeting, the time being approximately 9:28 p.m. Councilman,Beary left the Council Chambers at this point in the meeting, the time being approximately 9-2$ p.m. City Manager Callinan briefly discussed with the.Council a recommendation that the a' "Welcome to Rohnert P. rk" sign be relocated from its presenit position on the corner of .the Expressway and Commerce Boulevard in front of the Exchange Bank to a site on ,.Commerce Boulevard just south of the Rohnert Park Texaco station. The Council and Chamber of Commerce representatives agreed that the relocation of the "Welcome to Rohnert Park" sign as recommended was .agreeable.. City Manager Callinan advised that Project 1972-3, Hinebaugh Creek, was now complete and the Certificate of Completion had been received from Project Engineer Hudis. ..A RESOLUTION ACCEPTING COMPLETION AND DIRECTING ENGINEER TO FILE NOTICE OF .COMPLETION (Hinebaugh Creek, et al. Improvement Project No. 19723) City Manager Callinan explained the reso- lution. Upon motion tion of Councilman Smith, seconded by Councilman Hopkins, and unanimously approved, the reading of Resolution No. 73-140 was waived and said resolution was adopted. City Manager Callinan explained that'the City does not have title to all the right of way for the Hinebaugh Creek Project due to condemnation proceedings, but can assure Councilman Beary Returns Project 1972 --9 Country Club Drive Recess Reconvene Page 6. October 15, 1973 the Sonoma County Water-!,Agency that the necessary_ easements will',be,granted to the Agency when they are'obtain,ed by the City. He further advised that Water Agency staff had toured the improvements with Engineer Hudis and were satisfied with same. Engineer Hudis noted that the contractor had lost several trees from the project due to citizens digging them up and transplanting them elsewhere. Discussion followed. Councilman Beary returned to the Council Chambers at this point in the meeting, the time being approximately 9:33 p-.m. City Manager Callinan advised that dedi- cation ceremonies would be held on October 27th for the completed project with horses available to ride up the creek and ending with a barbeque at a site on Snyder Lane. City Manager Callinan advised that ,work was progressing on Project 1972 --9, Country Club Drive, but that the contractor had, requested an extension of time due to a delay in shipment of materials. A brief discussion, followed. Upon motion of Councilman Smith, seconded by Councilman Beary, and unanimously approved, an extension of time was authorized for :Arthur B. Siri, Inc. as requested in that '"'firm's September 20 letter. City Manager Callinan recommended.installation of only 14' asphalt on the project at this time with the contractor to return later and install 1 -1/2" after the heavy equipment travel on'the road had been completed. A brief discussion followed with.Project Engi- neer Hudis participating. Upon motion of Councilman Roberts, seconded by Councilman Hopkins, and unanimously approved, Arthur B. Siri, Inc. was autho- rized to lay.the asphalt in two lifts as re-c;ommended by City Manager Callinan for Project 1972 -9', Country Club Drive. Mayor Flores.declared a recess at this point in.the meeting, the time being approximately 9e4Q P.M. Mayor Flores reconvened the meeting with all Councilmen present at approximately 9:50 P.M. Page 7. October 15, 1973 File 922.89.Cotati.,_ Planning'Director Skanchy advised that Cotati Performance Center , Performance Center had not complied with all Failure to-ComPly, the conditions of'i.ts use permit. Discussion With Conditions of followed. Use Permit. City `'Attorney Maxwell advised that the matter of revocation of the use permit for Cotati Performance'Center should be set for public hearing before the Planning Commission. A brief discussion followed. Upon motion of Councilman Hopkins, seconded by Councilman Beary, and, unanimously approved, a public hearing will be set before the Planning Commission on the matter of revoking the use permit for Cotati Performance Center,., Unified School Councilman Roberts initiated a discussion District, K -12 concerning a request from the Cotati- Rohnert Park School District for Council support in concept of pursuing a steady for unification of a K.--12 district . Upon motion of Councilman Roberts, seconded by Councilman Beary, and unanimously approved, the`Couneil endorsed.'the idea of conducting a study to determine the feasibility of a K -12 school district. Tree Planting in Councilman Roberts initiated a discussion con - Country Manor, cerning complaints he had received regarding the city planting trees in a three (3) foot easement in Country Manor Subdivision. City Manager Callinan advised that this planting was required by the city along the railroad tracks adjacent to Country Manor Subdivision and the subdivider had obtained a signed statement from all home buyers that the planting could be done later. Discussion followed concerning the advisability of the subdivider reminding.homeowners of this planting since several months had gone by since obtaining permission to do the planting. Staff will follow up on the matter. Crosswalk Sign Councilman Roberts advised that the cross - at Bernice 8 Burton walk sign at the intersection of Bernice and Burton Avenues was missing. Staff will follow up on the matter. KTOB -City Staff Councilman Beary read a letter from Bob Basketball Game Lipman of KTOB which challenged city officials to a basketball. game: Discussion followed during which November 15 was set as the date for the game. Page 8. October 15,., 1973 Rooster Patrol Councilman Smith initiated a brief discussion regarding citizens keeping chickens, advised there were three of his neighbors with chickens, and the roosters crowing in the early morning hours were disturbing to other citizens. He suggested that the Department of Public'`Safety initiate a "Rooster Patrol " <to eliminate the problem. Proposition No. 1 Councilman'Smith advised he had reviewed much material concerning Proposition No. 1 - on the'November 6th ballot and had no rec® ommeiidation . Street Lighting Councilman`Smith'.advised he had received 'complaints from two residents on Bobbie Way that additional street lighting is needed in the 'vicinity of Bobbie Way 'and Adrian Drive. Councilman Hopkins advised that three street lights were out on Southwest Boulevard where the road narrows from two lanes to one lane. Exchange Bank 'Counc'ilman Smith initiated a discussion con- cerning the new Exchange Bank location being too far away for those who must walk and school students not being able to go the bank after school since it now closes at 3:00 p.m. He suggested that the Exchange Bank be requested "to provide minimum services such as check cashing and savings deposits and withdrawals at its old location. Councilman Roberts advised that the drive - up windows at the new bank location were open until 5:00 p.m. and walkup customers were welcome. He also advised that the old bank location was being renovated and would re -open as a student loan center with the minimum services mentioned earlier to be available. Executive Session Mayor Flores advised that during the executive session held prior to the regular meeting, the Council had authorized City Manager';Callinan to advertise the position of City Attorney" in the Bay Area and Western City Magazine. Ranchette Proposal Mayor Flores advised he had received a of Supervisor Theiller letter from Mayor Jones of Santa, Rosa requesting Rohnert Perk to contribute funds for a study of Supervisor Theiller's Ranchette proposal.. Discussion followed. No action was taken. Page 9. October 15, 1973 ABAG Task Force �� -..:,,Mayor Flores advised he had submitted on Housing Councilman Bea*ry's-name-'as the:Sonoma County representative ' 'to the Task Force on Housing of the Association of Bay Area Governments. Community Center Mayor Flores initiated a discussion con- Parking Lot Lighting conerning the very poor lighting of the parking lot at the Community Center which is actually on the junior high school property. Staff indicat6d the school district would be contacted to improve the lighting of said parking lot. Director of Public Director of Public Safety Dennett appeared Safety Dennett re to discuss the Curfew Ordinance with the Curfew Ordinance Council. Councilman Smith advised he had received complaints.from parents concerning appar- -ent violations of the Curfew Ordinance. Director of Public Safety Dennett responded that juvenile arrests are; avoided, if at all possible; that the officers warn juveniles that are out after 11:00 p.m., do not usually take names, but just ask them to go home, and cooperation has been excellent. Fencing Along -the City Manager.,Callinan initiated a dis- Golf Course Adjacent cussion concerning fencing along the Golf to Subdivisions"__ Course adjacent to subdivisions. He advised that a six foot chain link fence with green vinyl dip had been suggested but some thought this was too high,>and the matter was being brought up to the'City Council because of the City golf course operation. 1972-73 External Audit ..Discussion followed during which it was .decided to let the public know the.matter will be, discussed discussed at the next regular Council meeting. City Manager Callinan brought to the atten- tion of the Council the 197273 external audit. Discussion followed during which the lack of recommendations from the ,auditing firm was mentioned. Staff was requested to have the auditing firm submit recommendations and schedule the matter for action at the next regular meeting. Water for Petaluma Gity a ger C llinan reviewed his memo to the Council dated 'September 24th regarding water for Petaluma and also reviewed the propo,sed,.agreement between the Sonoma County Open Space Committee City Manager Callinan advised that the Open Space Committee would be meeting during the' week to go over a citizen information circular on the bond election for distribution door to door. City Attorney Maxwell spoke briefly about p ".off the record.remarks" and reminded the Council of an incident several years ago when a city official 'made "off the. record " remarks about communists at the college and the resulting problems... October 15, 1973 Water Agency, Petaluma, and Rohnert Park :. under which Rohnert Park would. drill wells in order to'produce water for the agency for Petaluma on an interim basis. Dis- cussion followed. Library City Manager Callinan advised he would be reporting on several possible sites for a new library at the next regular meeting. He also noted the very generous offer of`,`', Codding Enterprises to donate land "in Rohnert Park for a. library and post office. Discussion followed during which staff was requested to send a letter to Mr. Hugh Codding thanking him for his generous offer and that it will be taken under advisement. Bond Election City Manager Callinan brought to the attention of.the Council that the next regular meeting was the day before the November 6th bond Street Improvement City Manager Callinan advised there was In Front of`Country , approximately 150 feet of street frontage Club Drive Public on Country Club Drive in front of the public` Facilities Area facilities site recently acquired for the area that would have to improved by the city at an approximate cost of $6,659. Discussion followed. Upon motion of Councilman Smith, seconded by Councilman Beary, and unanimously approved, staff was authorized, subject to audit, to pay the city's pro-rata share of street improvements in front of the Country Club Drive public facilities area.
