1976/07/26 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES July 26, 1976 The Council of the City of Rohnert Park met this date in regular session commencing :at Bt05 p.m. in the City Offices, 6750 Commerce'Boulevard, Rohnert Park, with Mayor Flores presiding. Call to Order ,Ma.yor Flores called the meeting of the regular session . to order'at approkinia.tely bo`05 p.m. and led the pledge of allegiance. Approval of Minutes Upon motion of 'Councilman Hopkins, seconded by Councilman Beary,.'and unanimously approved, two sets of minutes dated July 12, '-1976; one for the Budget Session and one for the 'regular'Coincil meeting," were approved as submitted. Approval of Bills - -Upon motion of Councilman Eck;` "seconded by Councilman Hopkins, and unanimously approved, the bills presented per the attached list 'in "the amount'of $151,401.40 were approved.- Communications Councilman Eck initiated a brief discussion regarding -'a letter from° homeowners in "Country'C1ub Greens, _ Unit. C, wherein they express Aissatisfaction with Condiotti Enterprises,'Inc., they eveloper; for slow repairs -to:; their homes° Councilman Eck noted that the homeowners request a councilmember` attend a meeting on July 30th to discuss the situation. Mayor Flores and Councilman Eck stated they will attend the July. 30th meeting with the `homeowners e Deer Meadow - Councilman' Eck discussed a 'letter from several residents Village _:,of Deer Meadow Village apartments regarding motorcycles Apartments and cars using a drainage ditch area adjacent to the apartments for racing.` 111. Callinan stated the letter will be: referred to the`Public Safety Department for follow up on .this problem. Golden Gate Councilman Roberts initiited a discussion concerning.a Transit, Bus, letter from Ars.' E3len Vail regarding a bus stop in front" Stop of her home at 8034 Adrian Drive which she would like to have moved because of passengers littering her property and sitting on her lawn while awaiting the bus. Resignations Mayor Flores directed the Council's attention to letters from Cultural Arts of resignation from Mrs. Rose D. Sweeney and Mr. Chet Commission and Crowley of the Cultural Arts Commission and Cultural Cultural Arts Arts Corporation Board of Directors. Corporation Upon motion of Councilman Hopkins, seconded by Councilman Eck, and unanimously approved, the resignations of Mrs. ; Rose D. Sweeney and Mrs.Chet Crowley from the Cultural Arts;Commission and Cultural Arts Corporation were accepted; and staff was requested to forward letters to Mrs. Sweeney and Mr. Crowley, over the Mayor's signature, expressing appreciation for. their service to the community. Mayor Flores requested the press to,publicize the vacancies for residents that might be interested in serving on the Cultural. Arts Commission. County 24 Hour City Manager Callinan noted the letter and proposed Gambling ordinance from the County Counsel Office allowing 24 hour Ordinance in gambling on Friday and Saturday nights in the unincorporated Unincorporated areas`of''Sonoma Couxity ;-and solicited comments from the Areas Council concerning same. Councilman Eck expressed concern that this new proposed law might take precedence >over regulations concerning gambling now'in effect in the `City of Rohnert Park. Mr. Callinan and City Attorney, Flitner- stated the law pertain- ed to un ncorporated ;areas of the County only. The consensus -of the Council was to direct a letter to the Sonoma County Board of Supervisors indicating the Council will concur with the County's j udgment in this matter. Page 3 July 26, 1976 Unscheduled Public Mr. Lyle Amblin, Chairman of the Founder's Day Committee, Appearances" spoke briefly stating that this yeax'the Founder's Day celebration would be September 10, 11 and 12; the American Legt94 will handle the parade; discussed various activities planx�edY for those days; presented.copies of the Founder's Founder's Day Day Budget to the councilmembers, and requested a contri- bution of $1,918.00 for this year's Founder's Day expenditures. Rancho Cotate High Mr. herb Gilbert and.Mr. Frank Collins, representing the School Marching Rancho Cotate Music Committee, were present and spoke Band regarding; >the letter received from `Governor Brown's office ., advi- sing,that the Rancho - rotate High School Marching Band had been selected to represent the;State of California at.the inaugural events in Washington, D.C. Mr. Collins indicated :that since;receiving: that letter an article had appeared in' -a local newspaper written by Michael E. Woodson seeming to imply that the procedure for selecting -a band'had been: improper; further stated that consequently :.support anal contributions for.the band had declined; re- quested Council.` support asking that letters be forwarded to Governor Carter, President:Ford "and former Governor Reagan requesting that they support Governor Brown's selec- tion of a'band to'represent..the State`of California at the inaugural events. in Washington, D. C. City Manager Ca.11inan inquired: as to whether Mr. Collins had been in contact with Governor Brown's office; Mr. Collins replied in the affirmative and indicated the `selection`of Rancho Cotate. Hig ;School Marching Band was affirmed® Councilman: Roberts made a motion, seconded by Councilman Hopkins, and unanimously approved, directing staff to forward.letters, over the_Mayor's signature, to Governor Carter, former Governor Reagan,'President Ford and other interested individuals requesting support for Governor Brown's selection of the Rancho Cotate High School Uarching`Band to represent the State 'of California at the inaugural events in Washington, D. Public Safety City Manager Callinan discussed a summer uniform for Summer Uniforms Public Safety Department personnel, and comments made in his memo dated July 22nd pertaining to same. Director of Public Safetv Dennett was present and ci¢ TiiY mi Y iia i the new summer uniform for Council. consideration, indicating the cost of the new uniform wound be considerably less than the usual wool uniforms. The Council expressed its approval of the new summer uniforms for Public Safety personnel. ; Youth Services Director of Public Safety Dennett introduced Mrs. Ardis Specialist Cry who, under a federal grant, will serve the community Counselor as a Youth Services Specialist Counselor. Urs. Cry spoke briefly stating her qualifications for this position and indicated she will be working with youths in the City on an individual basis. The Council thanked Director Dennett and Mrs Cry for - their; presentations. Plaque of Mavor Flokes presented -Mr. Sil Cincera with a Plaque Appreciation o, of Appreciation for his years of serving on the Planning Sil Cincera Commission. lfr: Cincer'a was present, accepted, the Plaque, and thanked the Comical for,its consideration. Rohnert Park , Mrs. Doreen'Brog, representing the Rohnert Park Womens Nomens° 'Association, presented the Council with a check in the Association amount of x$453.74 for the purchase.of a merry -go -round to be installed at Caterpillar Park., Councilman .Eck noted in a communication from the Womens Association a request had been made to have placed on the merry -go -round a plaque reading t°Donated by the Rohnert Park Womens:Associationp`9 recommended.approval of this request.. Upon motion of Councilman Eck, seconded by Councilman Roberts, and unanimously approved, the Council approved the placing of a plaque on a merry -go -round to be installed at Caterpillar Park reading "Donated by the Rohnert Park Womens Asso:ciation , as well as having. staff put similar plaques on equipment previously contributed by the Association;.- The Council thanked Mrs. Brog..and the,Association for the contribution to Caterpllar_:' ark. ,;... Page 5 July 26, 1976 Ad Hoc`" Mr. John Jenssen and Mr...Jack Titus, representing the Committee for Ad Hoc Committee for Building Code Review were present Building'Code -and gave a presentation of the Committee's progress to Review date. Mr. Titus spoke of many `letters being received by the City complaining of the quality of building being constructed,; suggested that a notice be placed in the next ne- asletter directing complaints to his home in order that he may. compile a list of specific problems from ' residents in the community. Mr. Jenssen discussed the Budget with regard to building fees collected', disbursement'of these monies, adding more inspectors to the building department; compared this year's budget with last year's with regard'`to building department costs and 'revenue received; felt there would be a substantial increase in inspection fees for,the coming fiscal year with large businesses moving into -the City. A lengthy'discussion followed with Mr. Jenssen, the Council and City Manager Callinan participating concerning sub- division development fees and disbursement of same; whether the addition of building` inspectors`aould necessarily upgrade the quality of,houses'being built; the hiring of a part- timeinspector`when the work load becomes heavy, etc.; Mayor Flores thanked Mr. Jenssen and Mr. Titus for their efforts and time on 'behalf of the community. Safe and Sane city Manager Callinan advised that,'An accordance with Fireworks a Council directive; a public hearing had been scheduled for citizen reaction to banning the `'sale of fireworks in the community; stated.notice of the public hearing had been published in the local newspapers. Mayor ,Flores declared open the. public hearing on +the sale.,or. banning of fireworks in the City. City Manager Callinan pointed out- letters received from Fire Services Commander Jerry'Bick,''5onoma County Fire Chiefs, Inc. and Waldo•- Rohnert PTA,,,copies of which had been disseminated ;to ,.the Council, all in favor of banning the sale of fireworks in'Rohnert Park. Mr. Jack Titus, 6081 Elsa Ave.,- spgke in favor of ,banning the sale of fireworks;, 'suggested a City supported fireworks' display on. the 4th of July each year. "`There being no other person desiring to speak, Mayor Flores declared the public hearing closed. rt After discussi ons the Council agreed to take the matter of fireworks under advisement an d seek additional community t. input; indicated it would make . a decision on this matter at the first meeting in October. Page 6 July 26, 1976 Budget Mayor Flores,stated at this time the 1976 -77 Budget would 1976 -77 be considered for formal adoption and solicited comments Pr any person in the chamber wishing to speak about the proposed budget. There were no comments from the audience® City Manager Callinan_ advised that one letter had been received from Mr. Tarpley of the`Rohnert Park Taxpayers Association thanking staff for appearing at a recent meeting of that group, to discuss the Budget. Discussion followed between the councilmem'bers and Mr: Callinan concerning the.tax rate which will remain the same, or possibly drop a few cents; the merit of adding additional staff to ,the building department, etc. Mayor Flores made a motion, seconded by Councilman Eck, to hire a. part -time building inspector for three months, at which time the need would,.be evaluated for continuing for the remainder of ,,the' f fiscal `year. Discussion continued as to whether the addition of building inspectors would result in 'a higher quality of housing being built; waiting for a.report from the Ad Hoc Committee on Building 'Code Review before taking any specific action; most complaints being of a nature involving finish-work such as painting and fencing, rather than construction. ter. Callinan spoke of a time lag for recruit - ment, budget recommendation as to salary of a part -time building inspector and indicated staff would like to have recommendations from the Ad Hoc ,Committee with `regard to reviewing the 'Building Code. Councilman Eck withdrew his second to Mayor Flores' motion. Mayor Flores' motion died for lack of a second. Resolution 76 -105 RESOLUTION APPROVING AND ADOPTING A BUDGET FOR THE CITY OF ROHNERT PARK FOR THE FISCAL YEAR 1976 ®77 City Manager Callinan explained the resolution. Upon motion of Councilman:Hopkins, seconded by Councilman Beary,_.and unanimously approved, the reading of Resolution 76-103 was waived and said resolution was adopted. File-0434, City Manager Callinan' directed the Council's attention Lovmark to a,.memo from Planning Director Skanchy listing several Building items to be completed at the Lovmark warehouse site prior to the City issuing an occupancy permit. Councilman Hopkins made a motion, seconded by Councilman Eck, to deny issuing an occupancy permit to August Lovmark until ail ,.c4ndit ons,set forth by staff have been met. Golden Gate Mr. Robert David, representing the Golden Gate Bridge, Transit Highraay "and Transportation Distriet', was present and stated Bus Shelters with regard to the complaint "from firs. Vail regarding the bus stop in front of her property, with the approval of Rohnert Park I and `Cotati,itwould'be possible to move this bus stop.around`the' corner to 'East Cotati Ave.; stated he would follow up on this matter. Mr. David informed the.Council that under a government funded project`Golden Gate Transit would be able to fund and build two bus stop shelters in the City of Rohnert Park; presented pie tures'of 'the designed shelters. .Discussion followed concerning the costs involved in building these shelters.. Mr, David was queried as to whether tine money could be funded to the City with the _.City building the two bus shelters. The Council agreed to confer"with Mr. Joslyn at 7 :00 p.m., August 9th, for one hour prior to the regular Council meeting. No. 143- 050 -54) City Manager Callinan reviewed the resolution and his memo to the Council dated July 22nd concerning same. Mayor Flores advised that:Councilman Roberts would not- participate-in discussion of this matter. (4) Councilmen Beary, Eck, Roberts and Flores DOES: (0) None ABSENT: (1) Councilman Hopkins Project 1974 -12 City Manager'Callinan reviewed with the Council the bids Commerce Boulevard received on Project 1974-1Z, Commerce Boulevard Widening; Widening indicating that the low.bidder was Argonaut Constructors. As noted by Mr. Callinan,` the bids will be forwarded, to the'State for review and approval and then brought back before the Council for consideration and award of contract., City Attorney Flitner stated one sheet submitted by the successful bidder had not been signed, but he did not anticipate any problem due to this oversight. Golf Course City Manager Callinan discussed with the Council his Paving comments outlined in.his.memo ..dated July 22nd concerning some paving work around the golf pro shop and on the road, . to the maintenance yard.' Upon motion of Councilman Eck, seconded by Councilman Robertst and unanimously approved, the Council authorized the expenditure of $7,500 to Ghilotti Brothers, Inc. for extra pavement at the golf c ourse' to be done in conjunction with the Northwest Improvement Project work, as outlined by staff., Personnel for City Manager Callinan referred the Council to a memo Public..Safety from Director of Public Safety Denriett dated July 14th Department concerning the hiring of Publ -'c Safety officers from the reserve'force, and his.memo dated July 22nd and comments made thereino Payment to City Manager Callinan advised-that-the County Treasurer.os'.,�, County for.. office had requested payment from the City in the-, Assessment" amount of $SQ to a shortage'f a 1915 Assessment. 193.5 `Act Act rediomptio"n fund.`'' Page 12 _Tilly 96; 1976 Discussion followed with City Attorney Flitner indicating that ''if reserve officers had been °selected through the Affirmative Action process, it would appear that the selec- tion of regular public safety personnel from the reserve force would'be in order. Donation of City Manager' "Callinar advised that Asst. to the City Stove by Manager Albright had donated a stove to be used at the Mr. Albright heraecia 'Recreation Building, 'and noted the letter of appreciation from the City forwarded to him. Go & E. will ,prepare a revised estimate of the cost of this Project. - here `.is,a possibility that the City may have to advance the money which will be reimbursed by the property owners as building permits are``issued9 and staff will keep the Council advised on this matter.
