1976/08/09 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES August 9, 1976 The Council of the City of Rohnert Park met this date in work session commencing at approximately 7:00 p.m. in the City Offices, 6750 Commerce Blvd., Rohnert Park with Mayor Flores presiding. All Councilmen as well as City Attorney Flitner and Asst. City Manager Albright were present. The meeting was held to discuss with Young America Homes Company representatives the alternatives insofar as developing that company's property in the area east of the railroad is concerned. Present and participating in the discussion with the Council were Young America Homes representatives Bob 0 °Neel, Jack O °Neel, Jon Joslyn and Mary Whitman. The work session adjourned at approximately 3:00 p.m. The Council of the City -of Rohnert Park met this date in regular aession commencing at 3:10 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Flores presiding. Call to Order Mayor Flores called the meeting of the regular session to order at approximately 3:10 p.m. and led the pledge of allegiance. Roll Call Present: (5) Councilmen Beary, Eck, Hopkins, Roberts and Mayor Flores Absent : (0) Staff present for all or part of the meeting: City Manager Pro Tempore Albright, City Attorney Flitner, City Engineer Brust and Parks & Recreation Director Pekkain Approval of Minutes Upon motion of Councilman Eck, seconded by Councilman Hopkins, and unanimously approved, the minutes of July 26, 1976 were approved as submitted. Approval of Bills Upon motion of Councilman Hopkins, seconded by Councilman Roberts, and unanimously approved, the bills presented per the attached list in the amount of $530,197.52 were approved. Communications Councilman Hopkins initiated a brief discussion re the ineffectiveness of marked police cars. Councilman Hopkins feels that to solve neighborhood problems with speeding the City must take steps toward unmarked police cars. Resolution 76 --113 RESOLUTION APPROVING THE APPLICATION FOR A GRANT UNDER TITLE V OF THE OLDER AMERICANS ACT -- SPECIAL PROGRA14 Parks & Recreation Director Pekkain was recognized and briefly informed the City Council of the grant application; advised that the monies would be used for renovation of the Community Center for the use of senior citizens. Page 2 August 9, 1976 Upon motion of Councilman Beary, seconded by Councilman Hopkins, and unanimously approved, the reading of Resolution 76113 was waived and said resolution was adopted. Project 1976-4 Mayor Flores inquired if Mr. Asaf was in attendance. City State Farm Drive Engineer Brust advised Mr. Asaf could not attend the meeting Enterprise Drive however Mr. Brust went over all the Resolutions pertaining Assessment District to this matter with Mr. Asaf and Mr. Asaf found them all in order. Mr. Brust advised this project was for construc- tion of Enterprise Drive and State Farm Drive; Engineer's report was supplied to each Councilman; and that there were eight (18) resolutions to be adopted if the City Council goes ahead with the assessment. (4) Councilman Eck, Hopkins, Roberts and Flores Naming of 11D11 Area Park NOES; (01) ABSTAINED: (1) Councilman Beary Councilman Beary informed the audience that the reason he abstained from voting on these resolutions was that he does work for Codding Enterprises. Mayor Flores advised that Parks & Recreation Director Pekkain had forwarded to the City Council a memorandum dated July 219 1976 advising that as a result of resident input and survey, the Parks & Recreation recommended that the IV area park be named "Dorotea Park". Mayor Flores also referred to a memorandum from the City Manager recommending the possible name of "Davis Park" as a commemorative jesture to Mr. Donald Davis, former member of the Parks & Recreation CommissioT•. Upon motion of Councilman Ecko seconded by Councilman Roberts and approved by the following vote, the City Council approved the name "Dorotea" for the "D" section park: AYES: (4) Councilman Eck, Hopkins, Roberts and Flores NOES: (1) Councilman Beary ABSENT: (0) Page 5 August 9, 1976 Regional Water Quality City Engineer Brust had submitted a memorandum dated Control Board August 4, 1976 re the use o£ treated wastewater for construction purposes; copies were supplied to each council- man. Hr. Brust advised that the Grater Quality Control Board had approved our application for use of treated wastewater for construction purposes and have given us guidelines to follow. The only problem we may have is finding a and standpipe to get the water from the basin into the truckE Discussion was initiated re the use of the treated wastewatez Several possibilities were discussed; i.e., perhaps using the treated wastewater only during the hotest spells of the year; perhaps charging contractors less money for the treated water than the domestic water; perhaps using the treated wastewater for construction on a year—round basis. Martinez was recognized and briefly discussed the procedures used in preparing the report; explained the report and advised the Council -members that if they had any questions, he would be happy to answer them. Additional Pick -ups Hayor Flores advised that all the Councilmen had received for Public Works copies of IIr. Drust's memorandum to I1ro Albright re the purchase of additional pick -up trucks for Public Works Department. Mr. Albright briefly reviewed the information contained in Hr. Brust's memorandum. Discussion followed amongst the Councilmen and !Ir. Albright re the need for these trucks. Upon motion of Councilman Beary, seconded by Councilman Roberts, and approved by the following roll call vote, the City Council authorized the purchase of two additional pick --up trucks for the Public Works Department with the following conditions: (1) the trucks be purchased at the lowest possible price and (2) the money be taken from the General Funds Page 6 August 9, 1976 AYES, 1r C:\ r, . 31 - -2 s, Roberts and 1�11 Councilmen Beary Eel", 1,11opik.I.D. U Flores HOES (0) Possible Bus Route 14r® Albright initiated a discussion re possible transit service to replace the Route 71 Golden Gate Transit dropped to the College; stated the City is working with Petaluma Bus Service to cover this route; would like the City Council to consider this matter at the next regularly scheduled meet-u,( of August 23rd® Mayor Flores deferred this ratter until the next meeting, Resolution 76-122 RESOLUTION OF THE CITY OF ROHNERT PARK INSMUCTING ITS ATTORNEYS TO WITHHOLD DISCLOSURE-TO INTERESTED PARTIES OF ANY Aj,.TD ALL INFOMIATION RELATIVE TO ITS COT111UNICATIONS AND TMAASACTIONS WITH ITS tTTOMEYS City Attorney Flitner explained the resolution re disclosure of information to interested parties in the Hahn v Codding lawsuit. Upon motion of Councilman Hopkins, seconded by Councilman Eck, and approved by the following roll call vote, the reading of Resolution 76-122 was waived and said resolution adopted- AYES.- (5) Councilman Beary, Eck, Hopkins, Roberts and Hayor Flores NOES: (0) result of July 30th 14ayor Flores briefly explained the background of the Hleeting meeting with Home- of July 30th with homeowners in the Country Club area re Owners problems with developers; Mr. Flores advised lie felt a committee should be appointed to handle these complaints and deal directly with the developers; Mr. Flores reviewed his memorandum dated August 4, 19760 Discussion followed re the need for this Committee and whether or not the City Council would receive copies of all complaints submitted to the Committee. The question of being able to charge developers for staff time used in having repairs taken care of was discussed; City Attorney Flitner was asl.-.e(I to report back on legality of setting such a fee for developers. Further discussion followed. Page 7 August 9, 1976 Upon motion of Mayor Flores, seconded by Councilman Beary, and unanimously approved, the City Council authorized a Committee (to consist of Mayor Flores and Councilman Hopkins) to work with the residents in solving their problems; the City Council is to receive copies of all letters and cor- respondence and the Committee is to report to the City Council on a regular basis as to the progress of this effort. Further discussion followed during which City Attorney Flitner was asked to report back at the next meeting on the legal aspects of various approaches to the matters discussed. School Bond Mayor Flores initiated a discussion re the overcrowding Election problem in the Rohnert Park- Cotati School District; referred to his press release dated August 9, 1976 regarding this matter; with the vast amount of single family homes being built in Rohnert Park the problem can only become worse; the City should work towards solving the matter; as residents and parents, we should all work together on the matter, Councilman Hopkins made a motion that the City Council adopt the Press Release as a Resolution and go on record supporting the passage of the school bond issue; the motion was seconded by Councilman Beary® Councilman Eck initiated a discussion re the contents of the press release and advised that in it's present state he could not vote on this motion. Discussion followed re the contents of the press release and any possible changes to alleviate problem wording. Councilman Hopkins made a suggestion that the Third Sentence in Paragraph I of the press release read as follows: "I believe that it is important that City Councilmen and Planning Commissioners use productive and desirable tactics and address themselves to a resolution of the problem." Eesolution 76 -123a A RESOLUTION OF THE ROHNERT PARK CITY COUNCIL RE SCHOOL GROWTH AND OVERCRO1R)ING o Upon motion of Councilman Hopkins,.seconded by Councilman Roberts, and approved by the following roll call vote, the City Council agreed the Press Release be adopted as Resolution 76 -123a with the wording as suggested by Council - man Hopkins above: AYES: (4) Councilman Beary, Hopkins, Roberts and Flores NOES: (1) Councilman Eck Page 8 Auguet 9, 1976 Matters from Councilman Eck initiated a discussion re the City newsletter; Couniilmerk., is it economically the best way to inform the residents of the local news; perhaps too much time and money is being spent on large articles with pictures; would a circular, being enclosed with the water bills, be more feasible. Councilman Eck made a motion that if the City does have a newsletter, instead of elaborate items, we go to a single sheet that would go in the water bills that would list the actions of the City Council and the future actions of the City Council; the motion was seconded by Councilman Roberts, Councilman Roberts Councilman Roberts left the chamber, the time being approxi- Leaves mately-9*45 p.m. Discussion followed re the merits of a single sheet type newsletter. Councilman Roberts Councilman Roberts returned to the chamber, the time being Returns approximately 9:47 p.m. Councilman Hopkins suggested that staff make a study to determine the difference in cost to the City of the newsletter in its present form and the single sheet type newsletter; he suggested that no vote be taken on this matter until a report was made. Councilman Roberts, at this point, withdrew his second to Councilman Eck's motion and asked that the matter be put onthe next agenda. Hayor Flores stated the matter should be put on the agenda for the first meeting in September since City Manager Callinan was on vacation. No Name/Southwest Councilman Eck stated he would like to have the City Council Blvd. Intersection approve a request for staff to look at No Name/Southwest BIv4, intersection to see what recommendations would be re a stop sign on Southwest Blvd. for pedestrian safety because this is still a problem area. Upon motion of Councilman Eck, seconded by Councilman Hopkins, and unanimously approved, the City Council approved the,request as stated above. 19fechanical Play Device Councilman Roberts inquired as to how many people had Article kes.ponded to the mechanical play device article in the paper; asked the secretary to tally the results and send them to the Councilmen in their next packets. San Juan Pools Councilman Roberts initiated a discussion re San Juan Pools displaying pools along the freeway; the unsightly effect for people traveling on the freeway. City Engineer Brust was directed to check into the matter. Page 9 August 9, 1976 Hedges on College Councilman Roberts stated that the hedges on College View View Drive from Bridgit had been cut but still were not low enough; there is still a view problem; directed R. M. Albright to check into this matter. Possible increase Councilman Roberts stated the City Council should check in fees for into the possibility of increasing the fees the developers developers pay to the City for development of lands; the new residents are required to pay their fair share for the expanding school population and the developers should be required to pay more also; suggested the Committee for Coordinating Schools be asked their opinion on this matter. Fred Rohnert Mayor Flores stated that the Fred Rohnert Tournament, held Tournament Saturday, August 7, 1976, was a success; there were 94 participants; suggested that the City Council make this an annual event; a formal report will be given at the next City Council meeting. Mayor Flores advised that Councilman Roberts had submitted a photo showing street-sweepers going around cars parked in driveways; partially out in the street; suggested that perhaps an article in the newsletter re this problem; sub- mitted the matter to R. M. Albright for handling. Speeding.on Mayor Flores initiated a discussion re the problem on speeding. City Streets on City streets; suggested perhaps Chief Dennett prepare a form for residents to fill out containing perhaps the time, place, vehicle license number, description of vehicle. This form would be available for residents who would like to file complaints. Councilman Hopkins opined again that he felt unmarked police cars would contribute to solving this problem; Councilman Eck stated there may be legal ramifications of filling out such a form. Mayor Flores directed R. M. Albright to ask Chief Dennett to prepare such a form and submit it at the next meeting. Adjourned Regular Mayor Flores adjourned the regular session at this point in Session the meeting to convene as Hoard of Commissioners of the Rohnert Park Civic Commission, the time being approximately 10010 P.M.
