1977/01/10 City Council MinutesROHNERT.PARK CITY COU.NCIL_MINUTES January 10, 1977 The Council of the City of Rohnert Park met this date in regular session commencing; at 7:10'p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Pro- Tempore, Beary presiding. The regular session was preceded by an executive session and at which all Councilmen, except Mayor Flores, and City Manager Callinan were present and which was held,to discuss litigation and personnel matters. Call. to Order Mayor Pro Tempore Beary called the meeting of the regular session to, "order at approximately 7:10 p.m. and led the pledge of allegiance. Roll Call Present: (4) Councilmen Beary, Eck.- Hopkins.ancl Roberts Absent:, (1) Mayor Flores Staff present for all or part of the meeting: City Manager Callinan`City Attorney Flitner, Director of Public Works/ City Engineer Brust, Supt. of Public Works Eagan, Planning Director Skanchy, and Student Intern Zimmerman Invocation Bishop Robert Crandall of The Church of Jesus Christ of the batter -Day Saints, Petaluma Ward, offered an invocation prayer for the new year. Approval of Minutes Councilman Hopkins requested that the minutes of December 27th reflect that the Council only approved the first phase. (60 units) of Henry Hicks', et al, File No. 0491, develop - ment plan for a 300 unit apartment complex. Discussion followed. Upon motion of Councilman Hopkins,.seconded by Councilman, Beary, and approved by a voice vote, with Councilman Eck abstaining from the December 27th minutes and Councilman Roberts abstaining from the January 5th minutes, the minutes of December 27th were approved as corrected and the minutes of January 5th were approved as submitted. Approval of Bills Upon motion of Councilman Hopkins, seconded by Councilman Roberts, and unanimously approved, the bills presented per the attached list in the amount of $502,707.339 plus $24,663.90 (J. R. Freethy Co.) were approved. Said total includes $6,600.00.for the Rohnert Park Civic Commission. Communications Communications per the attached outline were brought to the attention of the Council. No action was taken on any communications except as noted specifically in these minutes. Adding Non - Agendaed Councilmen Eck and Roberts requested that time be allotted Items under the City Manager's Report for the following items, respectively: a) park funds, and b) Roberts and Aguirre's December 2€3, 1976 letter concerning cost of refuse disposal service. Councilmen Eck and Beary requested that time be allotted under Matters from Councilmen for the following items, respectively: a) Planning Commission minutes, and b) Scout Hut completion as well as Community Center usage fees. Mayor Pro- Tempore Beary presented Mr. Goetsinger a certificate of appreciation for his efforts in spearheading the distribu- tion of water saving devices. Director of Public Works Brust noted names of other scouts who participated in the program and informe =-that certificates of appreciation would be given to each individual. Sting Ray Swim Team- Financial Report Mayor Pro - Tempore Beary announced that the Sting Ray Swim Team's representative was unable to attend tonight's meeting and, therefore, the matter would be continued to the January 24th meeting. Upon motion of Councilman Hopkins, seconded by Councilman Eck, and unanimously approved, reading of Ordinance No. 320 was waived and.said ordinance adopted. Ordinance No. 321 AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING ORDINANCE NO. 58.(Mechanical.Play Devices) City Manager Cailinan explained the ordinance. Upon motion of Councilman Hopkins, seconded by Councilman Eck, and unanimously approved, reading.of Ordinance No. _ 321 was waived and said ordinance introduced, ordinance No, 322 AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING 8 I OF ORDI14AITCE NO. 307 (1976) AS IT AMENDED 8 1 OF ORDINANCE 190 (1971) AS AMENDED.ALSO KNOWN AS SECTION 15.40.020 OF CHAPTER 15 OF THE ROHNERT PARK MUNICIPAL CODE (Construction Fees) City Manager Callihan explained the ordinance. Discussion followed. Councilman Hopkins made a motion, seconded by Councilman Eck, to waive the reading of Ordinance No. 322 and introduce said ordinance. Discussion followed concerning fees imposed on single family residences as compared to multiple family units. Upon motion of .Councilman Eck, seconded by Councilman Roberts, and approved by the..following roll call vote, the motion to introduce-proposed Ordinance No. 322 was amended to 'have the ordinance provide a fee for duplexes and apartments of $435 for 3 bedrooms and $490 for 4 or more bedrooms. Councilman Eck made a motion, seconded by Councilman Hopkins, to grant architectural approval to Howard Bogg's commercial building subject to the City Council's review and approval of roofing material. File No. 0494 City Manager Callinan reviewed his January 7th memo to C 9 L Enterprises, the City Council concerning the Mayor's calling up for Site Plan and Archi -- review the Planning Commission's approval of the site plan tectural Review and architecture of C A L Enterprises' proposed 56 unit (Appeal) apartment complex located on East Cotati Avenue and the Mayor's subsequent withdrawal of his appeal in a memo dated January 10, 1977. Upon motion of Councilman Hopkins, seconded by Councilman _Roberts, and approved by the following roll call vote, the City Council deleted from the agenda the C & L Enter - ".prises' site plan and architectural design for a 56 unit apartment complex located on East Cotati Avenue. Expressway & dated January ,7, 1977, concerning the property owners' Snyder Lane request for approval of a parcel map in,order to record the sale of five acres located on the northeast corner of Rohnert Park Expressway and Snyder Lane, being the site of a medical center building presently under construction. Discussion followed. Upon motion of Councilman Hopkins, seconded by Councilman Roberts, and unanimously approved, the City Council authorized staff to process a parcel map for .subject area, as described above, subject to any standard conditions. Resolution No. 77 -07 A EMPLOYER - EMPLOYEE ORGANIZATION RELATIONS RESOLUTION (City of Rohnert Park) City Manager Callinan explained the resolution. Discussion followed during which the words "by the City and" was stricken from Page 5, Sec. 6, Election Procedure, paragraph 4. Upon motion of Councilman Hopkins, seconded by Councilman Roberts, and unanimously approved, reading of Resolution No. 77 -07 was waived and said resolution adopted. City Manager Callinan noted that the Council's communications contained a notice dated: January 4, 1977 concerning forma- tion of a '!Peace Cfficers Association ". SCOPE - Recognized :City Manager Callinan suggested that the City Council Employee Organization reaffirm SCOPE as a recognized employee organization. Upon motion of Councilman Roberts, seconded by Councilman Eck, and approved by the following roll call vote, the City Council ratified the Sonoma County Organization of Public Employees as a recognized city employee organization. Engineer Br "Ust explained participation of various agencies, proposed location of subject well and its development. Mr. Tom Wilson and Mr. Rod Sonne of the City of Petaluma were present and introduced by City Engineer Brust. Discussion, followed between members of the City Council and staff relative to conditions under which the well could be developed, i.e. in not jeopardizing Rohnert Park's water rights, unforeseen water shortage within the City, provision for contingencies within the agreement, drilling of a pilot hole9lifetime of a well in relationship of its usage, etc. Upon 'motion of Councilman Beary, seconded by Councilman Eck, and unanimously approved, staff was directed to prepare a program, advantageous to all participating entities, for Council consideration at its January 24th meeting. Discussion followed concerning the State Department of Water' Resources' final report of the Cotati ®Rohnert Park water basin study. Councilman Roberts Councilman Roberts left the Council Chambers at approximately Leaves and Returns 8 :30 p.m. and returned at approximately 8:30 p.m. Housing and Community Mayor Pro Tempore Beary declared the public hearing open Development Act re, the City's proposed application under the Housing and Community Development Act. City Manager Callinan reviewed his memo, dated January 7th, concerning a grant application under the Housing and Community Development Act and informed that no written communications had been received. There being no one desiring to be heard, and no written communications received, Mayor Pro Tempore Beary declared the public hearing closed.-_ City Manager Callinan informed that another public hearing _ was,scheduled for the Council4_s January 24th meeting concern- ''ing said grant application. Cpti-�Rohnert Park City Manager Callinan revvewed his memo to the'City= Council srle Bus Service concerning shuttle bus service. Discussion followed' concern- ing providing sufficient service to various areas of the community. Mr. :Vern Smith, 495 Arlen Drive, was recognized and urged the Council to scrutinize costs in operating the shuttle bus, i.e, its becoming expensive transfering to Golden Gates Transit buses. Discussion followed during which City Manager Callinan advised that revised rates, specifically relating to the cost in transferring, would be presented for the Council4s consideration at its January 24th meeting. Firestone Nursery City Manager Callinan noted that the Paradise Stock nursery stock had started arriving and was being stored in various locations around the city. Discussion followed concerning installation of trees at the golf course and "B" park., Purchase of Backhoe City Manager Callinan reviewed his memo dated January 7th concerning purchase of a backhoe attachment and bids received for same. Director of Public Works /City Engineer Brust and Supt. of Public Works Eagan participated in the discussion that followed. Upon motion of Councilman Hopkins, seconded by Councilman Roberts, and unanimously approved, the City Council authorized the acquisition of a heavy duty backhoe attachment from Empire Tractor Co-. at $6,240, after having first received an additional bid from another John Deer dealer and providing that there was`less than a 104 savings. Northward An City Manager Callinan gave a progress report, as outlined in his January 7th memo to the Council, concerning the northward annexation, January 6th meeting and correspondence with LAFCO. Discussion followed. Peter M. Callinan,, City Manager Callinan reviewed his January 7th memo and Performance Review reminded Council members this was the time for his annual performance review. Discussion followed. Rohnert Park Expressway City Manager Callinan informed of the Board of Supervisors Extension Westward cons.ideration,of Rohnert Park Expressway's extension west - ward, noting that the matter had been continued until the Board's January 17th meeting at the request of Supervisor Koeingshoffer. Roberts and Aguirre, dated December 28, 1976, concerni Disposal Service. garbage rates for mobile homes being inequitable and a�ee that if Roberts and Aguirre were to provide their own garbage service, it would be in violation of the city code. Count y Regional Parks City Manager Call inan, referring to a letter received Advisory Committee from Director of ,Sonoma County Regional Parks Rodota, Appointment II discussed with the Council appointing a representative to the County Regional Parks Advisory Committee re. distrb Lion and funding priorities for funds received from the State Urban and Coastal Park Bond Act of 1976. Councilman Eck was designated as the City's representative with Parks and Recreation Director Pekkain as the alternate to said advisory committee. Police Cars City Manager Callinan reported that the City was soliciting bids on public safety vehicles, as appropriated in the budget, without providing for tradein of the city's used vehicles. Discussion followed. Redwood Empire City Manager Callinan reminded that the Redwood Empire Division, League of Division of the League of California Cities was conducting California Cities its quarterly meeting on January 15th in St. Helena and polled councilmembers concerning attendance. Teen Center Councilman Beary requested Council's authorization to pursue establishing:a program for the development of a teen center as recommended by the Youth and Parks and Recreation Commis- sions. Discussion followed. Councilman Beary made a motion to authorize the expenditure of funds for the acquisition of fixtures and /or appliances not donated by the end of January in order to complete the Scout Hut. Discussion followed concerning preparation of a cost analysi s and during which Councilman Beary withdrew his motion. Said matter was designated for Council review at the January 24th meeting. Community Center Users Councilman Beary initiated a discussion concerning Community Fees Center usage fees as related to community organizations, fund raising programs, usage over 8 hours, etc. Discussion followed. (1) Mayor Flores Water Storage Tanks, Councilman Roberts initiated a discussion concerning a Funding for Same. news article wherein Governor Brown had mentioned assisting small northern communities in constructing adequate water storage facilities in view of the present State -wide drought. Discussion followed during which the City Council directed that a letter should be sent to Governor Brown inquiring about funding for water storage facilities. Mosquito Abatement Councilman Roberts initiated a discussion concerning District appointees to various committees representing the City Discussion followed. Councilman Roberts made a motion to rescind the Council's appointment of Mr. Vernon P. Smith as trustee to the board of trustees of the Marin /Sonom Mosquito Abatement District for the years 1977 and 1978 and to appoint himself (Roberts) to represent the City in said capacity. Page 10 January 10, 1977 The Council indicated that the City's policy for use %of facilities should be reviewed by the Parks and Recreation Commission and its recommendation be forwarded to the City Council for reviews Special Survey by POST City Manager Callinan distributed copies of a Special Survey of the organization of the Department of Public Safety prepared by the State Commission on Peace Officer Standards and Training. Office of Traffic City Manager Callinan also distributed copies of the Depart- - Safety - Quarterly ment of Public Safety's quarterly report on the Office Report of Traffic Safety - Traffic' Specialist Grant.
