January 24, 1977
The Council of the City of`Rohnert Park met this date in
regular session commencing at 7:10 p.m. in the City Offices,
6750 Commerce Boulevard, Rohnert Park, with Mayor Flores
:presiding. The regular session was preceded by an executive'
session and at which all Councilmen and City Manager Callinan
were present and which was held to discuss litigation and
personnel matt6rs.
Call to Order Mayor Flores called the meeting of the regular session to
order at approximately 7:10 p.m and. led the pledge of
allegiance.

Approval of Minutes Upon motion of Councilman Eck, seconded by Councilman Hopkins,
and unanimously approved9 with Mayor Flores abstaining,
the minutes of January 10, 1977were approved.
Approval of Bills Upon motion of Councilman Hopkins, seconded by Councilman
Eck, and unanimously approved, the bills presented per
the attached list in the amount of $796,251.53 were approved.
Communications Communications per the attached outline were brought to
the attention of the Council. No action was taken'on any
communication except I as noted specifically in these minutes.
Commerce Blvd'. Councilman Eck initiated a'discussi6n concerning a letter
Widening, Bicycle received from the State Department of Transportation con-
Path cerning its not participating.in funding the Commerce Boule-
vard widening project if a two-way bikeway is installed.
Discussion followed during which City Manager Callinan
advised that the Dept. of Transportation was re-evaluating
its position.
National League Mayor Flores referred to a letter from the National League
of `Cities of Cities concerning its membership criteria, dues for
the coming year, and recommended that the City's membership
becontinu'ed.

Upon motion of Councilman Beary, seconded by Councilman
Hopkins, and unanimously approved, reading of Ordinance
No. 321 was waived and said ordinance was adopted.

A RESOLUTION OUTLINING POLICY CONCERNING USE OF FEES DEPOSITED
IN CAPITAL OUTLAY FUND
City Manager Callinan reviewed his memo to the City Council,
dated January 20th, concerning subject resolution.
Upon motion of Councilman Eck, seconded by Councilman
Hopkins, and unanimously approved, reading of Resolution
No. 77-08 was waived and said resolution was adopted.
Resolution No. 77-09 A RESOLUTION OF AWARD OF CONTRACT, SOUTHWEST BOULEVARD
AT NO NAME STREET SIGNALS, Project No. 1976-18
City.Manager Callinan reviewed his memo to the City Council,
dated January 20th, and bid results. Discussion followed
with City Engineer Brust participating.
Upon motion of Councilman Beary, seconded by Councilman
Hopkins, and unanimously approved, reading of Resolution
No. 77-09 was waived and said resolution was adopted.

Growth Policy City Manager Callinan reminded that the City Council had
considered the proposed growth program at its January 5th
meeting, informed that the Planning Commission had endorsed
the policy with special considerations; reviewed his memo
to the.City Council, dated January 20th, and informed that
notices of public hearing had been published in the Santa
Rosa Press Democrat and Rohnert Park - Cotati Clarion as
well as various news releases sent to press correspondents
re. same
Mayor Flores declared the public hearing open concerning
a °proposed resolution entitled "Resolution Con cerning
Growth of the City of Rohnert Park and Enacting a Program
for Coping With It ". -
Mayor Flores outlined the format for conducting the public
hearing..
City Manager Callinan reviewed his memo to the City Council,
dated December 9, 1976, and briefly outlined some of the
major points contained in the proposed resolution concerning
growth.
City Attorney Flitner commented on possible conflict of
interest and opioned that, in general, any councilman could
- _,vote upon the proposed resolution.
Mr. John E. Taylor, 8345 Liberty Avenue, was recognized
and questioned City Manager Callinan why multiple family
dwellings with not more than two bedrooms and units proposed
for,only the aged, handicapped, or low income were excluded
from consideration in the determination of the yearly total
of residential units.
Councilman Eck explained to`Mr.`Taylor that although the
growth policy resolution had''been prepared by staff, ques-
tions should be directed to the City Council,
Mr. Taylor questioned why certain units were exempt from
the. growth policy and how many people in the audience had
read the proposed program." There was no response from
any member of the audience.
Mayor Flores, City Manager Callinan and Mr. Taylor partici-
pated in a discussion concerning availability of the proposed
resolution to interested parties, legal notice advising
of the Council's public hearing and ,public response to
same.
Mr. Alfred Parkins, 8315 Liberty Avenue, was recognized
and asked why one and two bedroom multiple family and mobile
home units had been excluded from the growth policy especially
since such apartments would generate children thereby affect-
ing.the need for school facilities°
Mayor Flores explained that the the amount of school aged
children generated from a multiple family district was
lower than normal.

wasrbcognized and advised that he represented the area's
l-ocal carpenters..'
Mr. Lawrence Blanc, 7284 Calcutta Court, was recognized
and commented on the City's enactment of a school impact
fee imposed on development and restricted school growth
expressing that mobile homes and apartment dwellers need
for services was at least As much as, if not more than,
thAt of the single family homeowner®
Mr. Whitmore representing the equipment operators union
was recognized and informed that said organization would,
with ,reluctancei:endorse the proposed growth policy, generally
commented on persons advocating restricted growth, recommended
that Rohnert Park not adopt a restricted growth policy
and 'informed,t.hat-he may move to Rohnert Park in light
of the present availability of water.
Mr. Jim Campbell, representing Teamsters Local 980 of Rohnert
Rohnert Park, was recognized and informed that although
he didn't- care to see enactment of a growth policy, the
program proposed wasi,one that could be lived with.
Mr. Ray Springer, resident and representative of the Build-
ing Trades-Counsel of Sonoma County, was recognized and
informed that although members of the building trades defi-
nitely objected to limiting growth, that the proposed resolu-
tion would be acceptable,
Mrs. Elaine Trowbridge, 6039 Elsa Avenue, was recognized
and expressed her approval of the proposed growth policy
and commented negatively on the exlusion of multi-family,
rhohile home parks and low income housing from the limitation
in the policy.
Mr'Mike Gragg, 7408; Brenda Way, was recognized and generally
.,
expiessed that growth shouldn't be curtailed altogther,
rather slowed down and opioned that the proposed resolution
concerning growth should cover a wider variety of construction,
Mr. Larry Smith, Executive Officer of the Associated Building
i1fidustry, was recognized and recommended that the words
Viand the problems associated with it" be stricken from
page 5, item 4.
Mr. Maurice Fredericks, 242 Alden Avenue, was recognized
and,j after informing that he was addressing the Council
as'a resident, generally reflected on Rohnert Park growth
since its inception in 195.5 and recommended that the issue
.be debated considerably.

City Manager Callinsn noted that a letter had been received
from the School .Board of Trustees of the Cotati - Rohnert
Park School District, dated January 24, 1977, requesting
clarification concerning the growth policy.
Mayor Flores noted that 800 of the recent school bond issues
in California had been defeated. Discussion followed concern -
ing same as related to growth.`,
Mrs. Anna Cousterouse, 7333 Carioca Court, was recognized
and, after informing that,s,he was addressing the Council
as a resident, advised that' there was a misconception of
the proposed growth.policy.`:in that it would alleviate the
overcrowded conditions in the school classrooms. She pointed
out.that there was no provision in the proposed policy
relating to the enrollment pr.oblems;,experienced by the
school district.
There being no one further desiring to be heard, and no
communications received except as specifically noted in
these minutes, Mayor Flores declared the public hearing
closed.
Discussion followed during which each Councilman generally
reflected and commented upon the proposed growth policy,
including exempting specific types of _units from same,
articulated /controlled growths time limitation of subject
policy, over crowded condition of school facilities, type
of units generating children, no growth restrictions, various
industries affected by a growth policy in providing housing
for individuals desiring same, and availability of school
construction funds.
Resolution No. 77 -10 A RESOLUTION CONCERNING GROWTH OF THE CITY OF ROHNERT PARK
AN ENACTING A PROGRAM FOR COPING WITH IT
Councilman Eck made a motion, which was seconded by Council-
man Hopkins, to waive the reading of Resolution No. 77 -10
and adopt same. Discussion followed.
Councilman Eck made a' motion, seconded by Councilman Roberts,
that page 5, item 1 of Resolution No. 77 -10 concerning
the Council's conducting meetings and hearings with major
owners of residentially designated properties to determine
the amount of residential units to be approved for any
one construction year be amended to designate a committee
consisting of the Council and two ex officio representatives
from both the Cotati-Rohnert Park'School District and Petaluma
High School District Board of Trustees. Discussion followed.

Councilman Eck made,a motion to add the following to page
6, item 3 of.Resoluton No. 77 -100 "In order to facilitate
input from,the school districts, the Council will request
information on school capacity from the Cotati- Rohnert
Park and:Petaluma High School Districts, to aide the Com-
mittee.in determining students for the coming year. This
information will be presented prior to the meeting with
the developers."
Said motion died for lack of a second
Councilman Eck made a motion to delete from page 6, item
4(b) of Resolution No. 77 -10, i.e. "multiple family units
with not more than two (2) bedrooms per unit."

,Councilman.Eck made a motion to change from "not more than
two (2) bedrooms per unit" to "not more than one (1) bed -
roomsper unit" as contained on page 6, item 4(b).

Councilman Roberts made a motion, seconded by Councilman

they would be included in the proposed growth policy upon
its enactment.

Councilman Roberts and Hopkins withdrew their motion and
second respectively and staff was directed to monitor occupancy
of the.,family mobile home parks and to not allow more than
the 'approved number of.units in which children are allowed.
Councilman Roberts made a motion to ban future approval
of tentative maps within the City. of Rohnert Park.

Councilman Beary stated for the record that as a result
of the growth policy homeowners are going to experience
more rapid assessments, increases in taxes, renters are
going to experience sharper increases in rent, home buyers
are going to experience higher increases in home costs.

Beary, and unanimously approved by,a roll call vote, the
words "and the problems associated with it" were stricken
from Page 5, item 4, of Resolution No. 77 -10.

Mayor Flores declared a recess at this point in the meeting
the time being approximately 8:45 p.m.
Reconvene
Mayor Flores reconvened the meeting at approximately 8:55
p.m., with all Councilmen present.
Joanne and Kirsten
Mayor Flores announced that the "No All Night Parking"
Courts, "No All
signs posted on Joanne and Kirsten Courts would be considered
Night Parking Signs"
at this time.
Mrs. Trimbley, 913 Kirsten Court, Apt. C, was recognized
and, informing that she managed seven buildings, four apart -
ments each, explained that she had conducted an independent
survey to determine how many vehicles each of her tenants
owned. Overall she found that there were 65 cars, 9 trucks,
10 motorcycles, 1, ,boat, 1. camper and 2 vans or a total
of 85 vehicles..'Mrs. Trimbley explained the difficulty
in providing parking for residents as well as guests in
relationship to areas designated as "no parking" areas.

Mayor Flores explained the purpose of providing city services,
i.e.,,street sweeping and refuse disposal.
Mr. Albert Mahood, property owner of 907 and 909 Joanne
Court, was recognized and informed that he was not aware
upon purchasing the property that no parking would be en-
forded on Joanne Court, expressed that no overnight parking
was discriminatory, noted that most residents owned two
vehicles,, and recommended that one day be set aside for
street sweeping 'services.
Joann Thurston, 910 Joanne Court, was recognized and explained
that upon returning home late at night from work she felt
safe parking on the street (Joanne Court) because it was
patrolled and was well lighted.
Susan Ro.manyk, 908`Joanne Court, Apt. A, was recognized
and informed that her car had been vandalized while parked
in the garage, therefore, she will not walk or park to
the rear of the units at night.
Mr. Larry Rolaf, 913 Kirsten Court, was recognized and
advised that his car had been hit while parked in front
of the apartments, that the suspect left the scene without
notifying anyone, and that if it hadn't been for his neighbors
witnessing the accident he wouldn't have known who was

responsib le.
Mr. Courtney Williamson, 909 Joanne Court, was recognized
and commented briefly on the provision of 1 1/2 parking
spaces per unit in relationship to the number of vehicles
owned by tenants, recommended that the present number of
required parking spaces (2) per unit be increased, that
one day be set aside for street sweeping, and opioned that
Kirsten and Joanne'Courts should not be posted for no parking
because single family districts are not restricted.
Mr. Thurston, 910 Joanne Court, was recognized and informed
that he had conducted an indpendent survey of parking and
garage uses in the single-family district on Camino Coronado
comparing it to that of Kirsten and Joanne Courts. He
noted that homeowners in residential districts parked
their driveways, wHch made a considerable difference as
compared to that of a multiple family district. Mr. Thurston
briefly described the uses of garages, storage areas and
off/on street parking,,
Discussion followed.
...:Upon motion of Councilman Flores seconded by Councilman
Roberts, and unanimously ap p roved, the Council directed
that the "No All Night Parking" signs on Kirsten and Joanne
Courts be removed and that four hours one day a week be
designated specifically for street sweeping purposes. Discus-
sion followed.

Upon motion of Councilman Eck, seconded by Councilman Hopkins,
and unanimously approved, the Council directed that a
letter be sent, over the Mayor's signature, requesting
property owners whose apartments are poorly lighted to
the rear of the structure to instigate measures to alleviate
same.
Planning Director Skanchy informed of Henry Hicks, et al,
application for precise development plan and architectural
review of a 63 unit apartment complex and 13 lot single
family development, described its location, surrounding
zoning and development, site plan and renderings which
were displayed, Planning Commission approval, and informed
that copies of the Planning staff report had been disseminated
to Council members.
Discussion followed with City .Manager Callinan and Planning
Director Skanchy participating concerning there being adequate,
provision for parking within the development.
Mayor Flores declared the public hearing open to consider
Henry L. Hicks',, et al, precise development plan and 11 1
architectural review of a 63 unit apartment complex and 13
lot single family development located south of Copeland
Creek, west of Northwestern Pacific Railraod tracks.
Mr. Henry Hicks advised, upon questioning of Councilman
Hopkins; that the proposed development would not be developed
this year. Councilman Hopkins reiterated the purpose of
approving only the =first 60 units of the original develop -
ment, which is located on the north side of Copeland Creek.
Discussion continued relative to the City's General Plan.
There being no one further desiring to be heard, and no
written communications received, Mayor Flores declared
the public hearing closed.
Councilman Hopkins made a motion to approve the precise
development plan and grant architectural approval subject
to the Council's review of -the first phase of development
i.e. 60 units as approved by the City Council on December
13, 1976. Discussion followed.during which Councilman
Hopkins withdrew his motion.
Mr. Hicks generally reviewed some of the alterations made
to the proposed development to comply with planning staff's
recommendations and necessity;of receiving approval for
the entire development, consisting.of two separate parcels
of land, in order to obtain financing for same.
Discussion followed.
Upon motion of Councilman Hopkins, seconded by Councilman

that he represented both the applicant and property owner
in requesting that the Council consider reducing the 50'
setback from Commerce Boulevard as approved by the Planning
Commission. Mr. Redding cited that the California Skate
structure had a lesser setback, compared the two structure's
architecture, lot dimensions, and tentative map approval
for industrial development in the area.
There being no one further desiring to be heard, and no
written communications reueived, Mayor Flores declared
the public hearing closed.
Discussion followed concerning landscaping and setback
from Commerce Boulevard in relationship to the proposed
structure. '

Roberts, and approved with Councilman Beary abstaining,

professional warehouse building located east of Commerce
Boulevard, north of the California Skate structure (A.P.
No. 143-020-51) was approved subject to conditions recommended
in the planning staff report and changing the required
setback from 50 feet to 43 feet from Commerce Boulevard
right-of-way.

City Manager Callinan reviewed his.memo to the City Council,
dated January 20, 1977, concerning Frank Jones use permit
application for a retail nursery located at 5665 South
Santa Rosa Avenue.
Planning Director Skanchy described the:site plan and
elevations, which were displayed, .parking, storage area,
and fencing.
Councilman'Eck left the Council Chambers at approximately
10:54 and returned at approximately 10:55 p.m.
Planning Director Skanchy continued explaining the Planning
Commission's approval of the use .permit subject to conditions
and related items.
Mr. Norman Francisco, 5665 South' Santa Rosa Avenue, was
recognized and reflected that the conditions imposed on
the applicant, Mr. Jones, were to make him,as property
owner, comply with prior conditions imposed by the City.
Mr. Francisco generally discussed future construction,
landscaping, bumper guards and striping, landscaping and
dedication and improvement of road right -of -way.
Discussion followed between Mr. Francisco, City Manager
Callinan and members of the City Council.
Councilman Eck made'a motion to approve Frank Jones use
permit application for a retail nursery at 5665 South
Santa Rosa Avenue, subject to those conditions listed in
the staff report and imposed by the Planning Commission.
Mr. Frank Jones, 965 Elizabeth Avenue, was recognized and
generally discussed approval of his use permit in relationship
- to conditions imposed on Mr. Francisco, reminded that the
City would benefit from,.sales, tax derived from the busimss.
Mr. Francisco informed that the Council's position would
leave him no choice but to return the applicant's deposit.
Councilman Hopkins seconded the motion made by Councilman
Eck, which was approved by the roll call vote, approving
Frank Jones' use permit application for a retail nursery,.
at 5665 South Santa Rosa Avenue (A.P. No. 143- 040 -40) sub-
ject to conditions contained in the staff report and stipulat-
ing that `a building permit cannot be issued until Mr.
Francisco complies with conditions (prior and current)
and that Mr. Jones resubmit revised building plans fcr review
by the Planning Commission.

Mayor Flores declared the public hearing open re. the City's
proposed application under the Housing and Community Develop-
ment Act.
There being no one desiring to be heard, and no written
" communications received, Mayor Flores declared the.public,,
hearing closed.
Upon motion of Councilman Beary, seconded by Councilman
Eck, and unanimously approved, the-Council authorized staff
to submit an application�.under'the. Housing and Community

Deveiopmeut Act for l) a water storage Cann in 1i neighbor-
hood,
2) pedestrian and bicycle bridge over Copeland Creek,
3) pedestrian walkway over U.S. 101 freeway.
Transit'Shuttle City Manager Callinan reviewed his memo to the City Council,
Service dated January 20, 1977, concerning transit service provided
by Petaluma and proposed increase:.n student's local fare.
Discussion followed.
Upon motion of Councilman Eck, seconded by Councilman Beary,
and unanimously approved,.the.City Council endorsed the
increase in the student's local fare from 15� to 25� and
the issuance of transfer tickets as outlined in the County
of Sonoma's January 4,,.977 letter.

Upon motion of Councilman Beary, seconded by Councilman
Roberts, and unanimously approved, reading of Resolution
No, 77 -09 was waived and said resolution was adopted.

Councilman Beary made a motion to accept the agreement
with an amendment to include that if an emergency arose
that Rohnert Park would have the ability to "buy back"
subject wells and further to include that North Marin and
Petaluma would not receive water for any less than they
are now getting by aqueduct and that the difference
be credited to Rohnert Park to defray the cost of Rohnert
Park buying the wells when the agreement expires. Said
motion died for lack of a seoncd.
Upon motion of Mayor Flores, seconded by Councilman Eck,
and approved by the following vote, Mayor Flores and Council-
man Hopkins were appointed to a committee to meet and confer
with staff and the other agencies concerning the proposed
agreement with the Sonoma County Water Agency, North Marin
County Water District and City of Petaluma for development
of two wells.
