The Council of the City of Rohnert Park met this date in
special..session commencing at approximately 4:35 p.m. in the
City Offices, 6750 Commerce Boulevard, Rohnert Park, with
Mayor Flores presiding.
Call to Order.
Mayor Flores called -the⢠special`meeting to order at approxi-
mately 4:35 p.m., and led the pledge of allegiance.
Roll Call
Present: (4) Councilmen Eck, Hopkins, Roberts and Flores
Absent: (l) Councilman Beary
Staff and /or others present for all or part_of the meeting:
City Manager Callinan, City Attorney Flitner, City Engineer
Brust, and John Nelson representing the North Marin County
Water District.
Mayor Flores explained that the special meeting had been called
to consider a proposed agreement between the City of Rohnert
Park, Sonoma County Water Agency, City of Petaluma, and North
Marin County Water District for the development of two wells
to provide water 'to the County aqueduct for transporting to
Petaluma and North Marin.
It was noted that Councilman Eck, Mayor Flores, City Manager
Callinan and City Engineer Brust, had met with Mr. John Nelson
of North Marin County Water District on Friday, January 28th
to extensively review the proposed agreement.
City Manager Callinan reviewed the proposed agreement, copies
of which had been disseminated to each Councilman. Discussion
followed between Council members, with City Manager Callinan,
City,Engineer Brust and Mr. Nelson participating.
Councilman Hopkins initiated a discussion concerning the pro-
posed agreement's.stipulation that Rohnert Park's surplus
water "shall" be transported to Petaluma and North Marin during
the term of said agreement. Councilman Hopkins suggested
that the word "shall" be changed to "may ". General discussion
followed concerning the context of the agreement.
City Attorney
City Attorney Flitner arrived at this point in the meeting,

the time being approximately 4:50 p.m.
Discussion continued concerning the pros and cons of the pro-
posed agreement, projected amount of surplus water, cost of
aqueduct water, determining when surplus water was available
from Rohnert Park's existing wells, etc.
Councilman Hopkins
Councilman Hopkins left the Council chambers at this point,

in the meeting, the time being approximately 5:00p.m. and
returned at approximately 5:02 p.m.
Upon conclusion of the discussion City Attorney Flitner suggest-
ed that the following be added to No. 12 of the proposed agree-
ment:

"The City of Rohnert Park .reserves the right to determine
when well production capacity exists in excess of its

direc.t.needs and agrees to exercise such determination
reasonably.and equitably..'
The Council concurred.
Discussion was held concerning fees for legal defense, costs
for maintenance and operation and capital improvementsā¢.of
subject wells, amount charged.to equal the same rate that
Petaluma and North Marin are paying for aqueduct water, and
Councilman Iiopkins suggested that the agreement also include
"That Petaluma, North Marin and Sonoma County Water Agency
agree not to enter into any agreement.'to purchase or produce
any well water within a two (2) mile radius of Rohnert Park."

Upon motion of Councilman Eck, seconed by Councilman Roberts,
and approved by the following roll call vote, reading of
Resolution No. 77-12 was waived and said resolution adopted
with the understanding that should the City of Petaluma decide
not to enter into the agreement that the.City of Rohnert Park
will still enter the agreement with North Marin County Water
District and the Sonoma County Water Agency.

Upon mot -ion of Councilman Hopkins, seconded by Councilman
Roberts.,,.and unanimously approved, reading of Resolution
No.,;77 -13 was.waived and said resolution adopted.
Adjournment
There being no further business, Mayor Flores adjourned the
s.pecial meeting at approximately 5e2O p.m.
