1977/03/14 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES March 14,,'1977 the Council of the City of Rohnert Park met this date in regular session commencing.at 7 :12..p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Beary presiding. The regular session was preceded by an executive session which commenced at 7 :00 p.m. and at which all Councilmen and City Manager Callinan were present and which was held to discuss personnel matters. Call to Order Mayor Beary called the meeting of the regular session to order at approximately 7 :12 p.m. and led the pledge of allegiance. Roll Call Present: (5) Councilmen Eck, Flores, Hopkins, Roberts and Beary Absent: (0) None Staff present for all or part of the meeting: City Manager Callinan, City Attorney Flitner, Director of Public Works/ City Engineer Brust, and Planning Director Skanchy. Approval of Minutes Upon motion of Councilman Flores, seconded by Councilman Roberts, and unanimously approved, the minutes of February 28th and March 9th were approved as submitted. Approval of Bills Upon motion of Councilman Roberts, seconded by Councilman Eck, and unanimously approved, the bills presented per the attached list in the amount.of $414,822.36 were approved. Communications Communications per the attached outline were brought to the attention of the Council. No action was taken on any communications except as noted specifically in these minutes. City Manager Callinan advised that the following correspon- dence should also be added to the communications outline. 1. Letter dated March 13, 1977 from Vern Smith, 495 Arlen Drive, concerning development of a golf course north of Golf Course Drive (File No. 0205). 2. Letter dated March 14, 1977 from Robert S. Ford, Dept. of Water Resources re. effect of Wells 15 and 16 on ground water basin (Project No. 1977 -05) 3. Letter dated March 14, 1977 from Peter Moras, 18 Anne Court, Sonoma Grove concerning development of the area north of Golf Course Drive (File No. 0205) Postal Service Councilman Flores called attention to item No. 12 of the communications outline noting that the City had been corre- sponding with Congressman Clausen concerning postal service. Drought Councilman Eck, referring to a letter from the State.Office of Emergency Services (Item No. 28 of the communications outline), questioned if there would be any funding available for drilling of wells other than loans. Miss Sonoma County Mayor Beary, noting that Mrs. Guren Adkins wasn't present, Pageant postponed until later in the meeting her presentation con- cerning the Miss Sonoma County Pageant R.C.H.S. Wrestling Mark Sanchez, representing the Rancho Cotate High School Team championship wrestling.team, was recognized and requested the Council to finance the acquisition of plaques for the championship wrestling team. Discussion followed. City Manager Callinan advised the Council of the bill forward- ed by Rancho Cotate High School Baseball Coach Jim Dougherty for plaques for the 1975 Championship team in the amount of $210. Upon motion of Councilman Roberts, seconded by Councilman Hopkins, and unanimously approved, the City Council authordmd that the funds allocated in the 1976-77 budget for Champion- ship Team Plaques be used for the 1977 wrestling and the 1975 baseball championship teams. Upon motion of Councilman Hopkins, seconded by Councilman Eck, and unanimously approved, reading of Resolution No. 77-51 was waived and said resolution was adopted. Miss Sonoma County Mrs Gwen Adkins, Executive Director of the Miss Sonoma Pageant County Pageant, gave a presentation of this year's pageant and requested a contribution from the City. City Manager Callinan, at Mayor Beary's request, reviewed his memo to the Council relative to last year's budget discussions and the arrangement that the City has with the Chamber for business license revenues and it assuming responsibility for funding the Miss Rohnert Park and Miss Sonoma County pageants. Discussion followed. Upon motion of Councilman Flores, seconded by Councilman Eck, andunanimously approved, the Council directed that the Rohnert Park Chamber of Commerce be apprised of the pageant's request for a contribution and requested to make a $200 contribution on behalf of the community as soon as possible. Project No. 1975• 13, City Manager Callinan reviewed his March 11th memo to the Copeland Creek City Council oouncerning bids received for the Copeland Bicycle/Pedestrian Creek Bicycle /Pedestrian Bridge and recommended'that the Bridge bids received be rejected. Discussion followed. Upon motion of Councilman Iiopkins, seconded by Councilman Roberts, and unanimously approved, reading of Resolution No. 77 -52 was waived and said resolution adopted. Resolution No. 77 -53 A RESOLUTION AUTHORIZING PURCHASE OF AMBULANCE City Manager Callinan reviewed his memo dated March 11th and explained the resolution. Upon motion of Councilman Flores, seconded by Councilman Hopkins, and unanimously approved, reading of Resolution No. 77 -53 was waived and said resolution was adopted. League of California City Manager Callinan reviewed his memo to the Council, Cities New Building dated March 11th, relative to the City's assessment to be paid for constructing; the new League of California Cities headquarters in Sacramento. Discussion followed. Upon motion of Councilman Hopkins, seconded by Councilman Flores, and unanimously approved, the Council went on record as desiring to make one lump sum payment ($2,448) for the City's assessment for the construction of the permanent League of California Cities headquarters office building. Golden Gate Transit- City Manager Callinan reviewed his memo to the Council, Commuter Bus Service dated March 11, 1977, concerning allowing Golden Gate Transit on Country Club Drive to operate a commuter bus service on Country Club Drive. Mayor Beary declared the scheduled public hearing open on Golden Gate Transit's proposal to operate commuter buses on Country Club Drive. Mayor Beary requested a show of hands of those persons in the audience desiring to speak, then persons desiring to speak in favor or in opposition to the proposed extension of bus service to Country Club Drive. Mrs. Madsen, 6077 Elsa 'Avenue was recognized and informed that both she and her husband commuted to the city. Mrs. Madsen pointed out that it is difficult to find parking near the Park Plaza Shopping center, that Rohnert Park Expressway was congested with traffic during commute hours and expressed that if buses were allowed to run up and down Country Club Drive that it would benefit the area because there would be less traffic during peak commute hours. C� Mr. B. Johnson, 6084 Country Club Drive, was recognized and expressed his opposition to commuter bus service on Country Club Drive because of the safety hazard, opined that buses would add to the traffic burden, that bus stops would be established at corner lots and that he already had enough problems because he lived on a corner lot. Mrs. Morman Beatty, 6175 Country Club Drive, Was recognized Ca %A expressed that she was in favor of the extension of commuter bus service to Country Club Drive as bus service would be more accessible to the public, that she felt it would reduce traffic rather than increase vehicular conges- tion and questioned how often the buses would be scheduled. City Manager Callinan explained that commuter buses would operate generally during early morning and late'afternoon hours. Mr. Robert Doney, 5400 Country Club Drive, was recognized and expressed his opposition to the proposed bus service because of the amount of traffic that would be generated. Mr. Doney suggested that a bus stop could be established at either end Of Country Club Drive at the Expressway and Golf Course Drive. He noted that when the school buses stopped at corner lots it had resulted in problems and observed that allowing commuter buses would destroy the aesthetics of the community. Mrs. Alice Wilson, 6054 Country Club Drive, was recognized and expressed that at 6:00 a.m. the commuters were not going to deface the neighborhood,'that school aged children might but adults would not. r .. nd Page 7 March 145 1977 Mrs. Mary Adams, 5650 Country Club Drive, was recognized and expressed opposition to the extension of the commuter bus service to Country Club Drive because of the safety to her children, especially in the afternoons. Mrs. Adams informed that the bus drivers do speed and opined that the property values would go down because of the proposed bus service. Mr. Burt, Country,Club Drive, was recognized and expressed his endorsement of the proposed bus service, compared commut- bus traffic to that of construction vehicles, felt buses would reduce the overall traffic on Country Club Drive. Mr. Burt expressed that anyone purchasing property on Colmtry Club Drive should realize that it was a commute road and noted that it would be a long walk to a bus stop at either end of Country Club Drive. Mr. Jino Richard, 5779 Country Club Drive, was recognized and. expressed that construction trucks in the area would eventually cease, after construction was completed, and noted that if the number of customers for bus service increas- ed so would the number of buses. Mr. Ron Miller, 829 Santa Dorotea Circle, was recognized and complained that notice to residents of the public hearing did not cover enough area, noted that there is currently no parking for commuters, that other residents of Rohnert Park had bus service, Country Club Estates being the only area not to have such a service, that because a bus stop was in front of his home in San Rafael his property value had increased, and commented that residents in the area were just as proud of their homes and would not deface property near bus stops. Mrs. Kreager, 5679 Country Club Drive, was recognized and expressed that she felt a bus stop on Country Club Drive at the Expressway would be adequate, that extensive bus service would be a safety hazard and property values would depreciate. Mr. George Kurish, 5500 Country Club Drive, was recognized and endorsed the concept of extending bus service to Country Club Drive and commented on no provision for parking in the Safeway parking lot. Mrs. Jino Richard, 5779 Country Club Drive, was recognized and commented that she and others living on Country Club Drive were extending themselves to live in the area and questioned why individuals couldn't walk a few blocks to catch a bus off Country Club Drive. Mr. Phil Madsen, 6077 Elsa Avenue, was recognized and observed that if buses stopped on Country Club Drive it would create a parking problem, suggested limiting the num- ber of bus stops, and expressed endorsement of commuter bus service to Country Club Drive. 1. Page 8 March 14, 1977 Mrs. Adams, 5650 Country Club Drive, was again recognized and questioned i-F the residents of Country Club Drive would again be allowed to express their views on the extension of bus serv, ice and requested further clarification of bus scheduling. City Manager Callinan explained that buses would probably be scheduled for early morning and late afternoon hours. He also advised that commuters could park their vehicles at th,e Self Service Furniture parking lot, explained that the City and other agencies in the County pay for the Golden Gate bus service to Rohnert Park. At the request of Mayor Beary, City Manager Callinan explained the maiiling off the Nnctiece of P i'hl i c T4P.;i-r' u---- concerning commuter bus service to residents north of Rohnert Park Expressway. Mrs. Kreager, 5679 Country Club Drive, was again recognized and asked how soon a decision would he made concerning bus service. Mayor Beary explained that a decision would be made at tonight's Council meeting. Mrs. Kreager questioned why there was such short notice and opined that there should be some other way to voice opposition to the extension of bus service in the Country Club Estates area. Mayor Beary advised that a petition had been submitted ex- pressing objection to the p.0opose"' OummuteP bus St--_-PVIICt--_. Mrs. Kreager noted that besides the safety hazard involved in allowing buses to use Country Club Drive, the 25 mile per hour speed limit wasn't being observed. Mr. Peter Bailey, 7491 Adrian Drive, was recognized and observed,..that if the buses were hazardous he hadn't heard of any accidents. Mr. Tom Naugh, Eleanor Way, was recognized and informed that his wife took him to the bus every day, that being a totaLof four trips up and down Country Club Drive. Everyone having been given the opportunity to speak once, Mayor Beary declared the public hearing closed. Councilman Flores made a motion, which was seconded by Councilman Hopkins, and which failed by the following Poll call vote, to allow a bus route along Country Club Drive in the northern area for a six month period, with the condi- tion,that no bus stops would be located in front of residences, but rather at the intersection of Country Club Drive and Rohnert Park Expressway and at the site of the future public safety facility near Country Club Drive and Golf Course DriveA Page 9 March 14, 1977 AYES: (2) CUt.�,ci? men F:L.ores and Hopkins NOES: (3) Councilmen Eck, Roberts and Beary Upon motion of Mayor Beary, seconded by Councilman Roberts. and unanimously approved, the Council directed staff to more adequately prepare planning for commuter bus service, i.e. bus stops and vehicular parking facilities. Recess Mayor Beary declared a recess at this point in the meeting, the time being approximately 8:35 p.m. Reconvene Mayor Beary reconvened the meeting at approximatley 8:45 p.m. File No. 0486 - City Manager Callinan reviewed his memo to the City Council, A.B. Dick, Fxrccsta.nding dated March 11, 1977, concerning A. B. Dick's request for Sign Review architectural review for a freestanding sign at its new facility on South Santa Rosa Avenue. Planning Director Skanchy reviewed his staff report concern- ing A.B. Dicks request for a freestanding sign, described the sign's location, height, design as shown on a rending which was displayed, and explained the Planning Commission's recommendation for a low profile sign. Mr. Gilbert, A. B. Dick, was recognized and explained that the sign as proposed would be approximately 20 feet high, it would not exceed the height of the A.B.Dick structure and explained that the firm needed good identification from the freeway. Upon motion of Councilman Eck, seconded by Councilman Flores, and approved by the following roll call vote, the Council upheld the Planning Commission's action of approving the freestanding sign. for A.B. Dick subject to conditions contained in the planning staff report. AYES: (3) Councilmen Eck, Flores and Roberts NOES: (2) Councilman Hopkins and Beary File No. 0205 - Mayor Beary indicated that he would abstain from discussing Crocker Ho"Ies and or voting on the proposed Mountain Shadows subdivision, Debra Homes, General general plan amendment and rezoning, and turned the gavel Plan Amendment and over to Vice - -Mayor Hopkins and left his Council seat. Rezoning City Manager Callinan reviewed his memo to the Council, dated March 11th, concerning Crocker Homes and Debra Homes general plan amendment and rezoning of the area north of Golf Course Drive to provide for residential, commercial and golf course development. Mr. Callinan commented on previous city /county attempts to acquire the Spivock property as a open space buffer, overall density of the proposed development, acquisition of Golf Course Drive right --of -way, and presented Council members with a document title "Proposed Page 10 March 14, 1.977 New Golf Course Finzirvcial_ Recap", a copy of which is attached to the original these minutes. Planning Director Skanchy read his staff report dated March 10, 1977. Discussion followed between City Manager Callinan, Planning Director Skanchy, and Council members. Vice-Mayor Hopkins declared the public hearing open on Crocker Homes/Debra Homes application for a general plan amendment and rezoning of the area north or Golf Course Drive between U.S. 101 and Snyder Lane for residential, commercial and public facilities -uses, including a golf course. City Manager Callinan read the following correspondence: 1. Letter from Peter Moras, 18 Ann Street, Rohnert Park, dated March 14, 1977. 2. Letter from Vernon P. Smith, 495 Arlen Drive, dated March 13, 1977. Mr. Harvey Kameny, Crocker Homes, Inc., 6375 Park Avenue, was recognized and informed that the project's engineers and planners had worked hard with City staff to develop a viable alternative to the open space concept shown on the General Plan and expressed his desire that the City Council take the same action as the Planning Commission and approve the proposed amendment to the General Plan and rezoning. Upon questioning of Councilman Flores, Mr. Kameny in formed that it was estimated development of the proposed golf course would cost $2.2 million. Councilman Flores questioned what percentage of the golf course would be developed. Mr. Kameny responded that the entire golf course,would be developed Councilman Eck quired Mr. Kameny relative to the $3,000 contribution towards development of the golf course. Mr. Kameny explained that the contribution would be made by the company for lots backing onto the golf course. Councilman Eck questioned why a contribution was not being imposed on other lots not fronting on the golf course. Councilman Flores asked if automatic sprinklers would be provided and Mr. Kameny, responding to said question indicated that Gary Baird of Robert Trent Jones could comment on same. Mr. Gary Baird, Robert Trent Jones, golf course architects, was recognized and explained that the proposed course had not been designed but an automatic watering system is in mind. Page 11 March 14, 1977 City Manager Ca:llinan informed that the City would have the opportunity to approve the golf c,xwse improvernents, i.e. plans and specifications and projected cost for improve- ment s . Councilman Flores questioned if the proposed golf course would compare to the same high standards of the Robert Trent ,zones firm. Mr. Baird responded in the affirmative. Councilman Eck requested Mil. Baird to compare the proposed golf course to the existing municipal course. Mr. Baird explained that the proposed new golf course would probably generate more play because of its planned aesthetic features and attraction to golfers. Mr. Baird continued to explain, at Councilman Eck °s request, the various aspects of developing a championship golf course. Mr. Baird, at Councilman Flores request, also commented on'the varying grades of the proposed course. 'Vice -Mayor Hopkins explained prior plans approved for development of the northern area. Mrs. Stewart offered that.several questions should be kept in mind when considering the proposed development, i.e. that the present golf course was just starting to break even, would a second golf course affect the operation of the present municipal course, was the proposed golf course land being; donated'to the City by the developer, what would cost of development be, etc. Mr. Peter Bailey, 7491 Adrian Drive, was recognized and asked if the City could support two golf courses. Councilman Flores responded that the best indication would be the increased play at the present municipal golf course. Councilman Eck commented that it was formulated that every 25,000 people could support one golf course and Mr. Baird elaborated on the feasibility of developing a golf course, based on population, revenue and operating and maintenance costs. City Manager Callinan advised that when the city purchased the existing municipal golf course, that it was the smallest municipality in the state to own an 18 hole golf course. Mr. Brice Benson, 244 Adele Avenue, was recognized and advised that the present golf course drew golfers from Marin, the Bay Area, and Santa Rosa and`explained that he had talked with various golfers who indicated the the course was very good. Mrs. Elaine Trowbridge, 6039 Elsa Court was recognized and -expressed concern that the City should not use park development fees for development of a golf course, i.e. in meeting a $750,000 obligation. City Manager Callinan explained that there was no intention to take monies away from the development of parks, for instance "E" '.Park. Mrs. Trowbridge explained her concern relative to the develop- ment of parks and recreational facilities in the area of the proposed residential development and questioned if there would be any parks. City Manager Callinan pointed out that there would be one park in the northern area's residential development, explained financing of parks and recreational facilities, and funds generated by new neighborhoods for park development. Mr. Rick Smith, 495 Arlen Drive, was recognized and expressed that he was concerned about deviating from the General Plan, observed that response to the public hearing was rather small in relationship to development of a golf course and opined that the matter should b e presented to the voters for a final decision. Lease Agreement City Manager Callinan explained the lease agreement that with Rohneot's would be entered into between the City and the Rohnert's for use of the portable school site property. Project No. 1077-05- Wells Nos. 15 & 16, Environmental impact Consideration Upon motion of Councilman Roberts, seconded by Councilman Hopkins, and unanimously approved, the Council approved entering into an agreement with the Rohnert's for leasing the property upon which the portable school will be located and authorized the Mayor to execute same. City Manager Callinan reviewed his memo dated March 11th to the City Council concerning conducting a publi^ hearing to consider Planning Commission Resolution No. PC 77-08 and its recommendation that a Negative Declaration be filed for Project No. 1977-05, Wells Nos. 15 and 16 and the agree- ment between the City, Sonoma County Water Agency, City of Petaluma and North Marin:County Water District; informed Page 16 March 14, 1977 that copies of all pertinent information had been provided to each Councilman and recommended that the sole bid received for the construction of Wells Nos. 15 and 16 be rejected. City Attorney Flitner briefly commented on the Planning Commission's findings concerning Project No® 1977-05 and explained that the Council could, after concluding the public hearing, do nothing, adopt the findings of the Planning Commission ( Resol. No® I '0' � I / "' -08) or deterri-iine that an environ- mental impact report should be prepared. Mayor Beary declared the public hearing open regarding con- sideration of Planning Commission Resolution No. PC 77-08 and its recommendation that the Rohnert Park City Council authorize the filing of a negative declaration for Project No. 1977-05, Wells Nos. 15 and 16 and the agreement for providing water to the City of Petaluma and North Marin County Water District. Mayor Beary requested a show of hands of those persons in the audience desiring to speak. After surveying the hands, he requested that each speaker limit his presentation to four minutes. Mayor Beary also described proceedings of the public hearing and Council consideration of the matter. City Manager Callinan read a letter dated March 14, 1977 from Robert S. Ford,, State Department of Water Resources, stating that proposed Wells 15 and 16 should have very little effect on water wells outside of the city limits. City Attorney Flitner noted that Planning Commission Resolu- tion No, PC 77-08 had several attachments, as listed below, and that City Engineer Brust could explain them in detail: 1. Environmental Impact Questionnaire, for construction of two municipal water wells (15 and 16), 2* Notice of Public Hearing, Council consideration of Planning Commission Resolution No. 77-08 and support data and data since received to file a Negative Declara- tion dated February 28, 1977, 3, Engineer's Report for Well Nos. 15 and 16 (Project No. 1977-05) and Excess Well Capacity for North Marin County Water District and City of Petaluma, with Exhibits 'YAT' & "B" attached thereto, dated February 23, 19770 4. Letter dated January 28, 1977 from Mr. Don Finlayson, Department of Water Resources; for expressing opinion that this action (drilling deep wells) will not adversely affect the ground water resources of the area. 5. Agreement, dated January, 31, 1977, between Sonoma County Water Agency, City of Rohnert Park, City of Petaluma, and North Marin County Water District. 6. Various pages referenced from the State Department of Water Resources Bulletin No. 118-4, dated December, 1975. Page 17 March 14, 1977 Members of the City Council_. arknowl -odged that they had read Planning Commission Resolution No. PC 77 -08 and the reports, letters and documents contained therein; had familiarized themselves with the statements of City Engineer Brust at the Planning Commission meeting, and read the minutes of the Planning Commission meeting regarding the public hearing of same. Mr. William Pinkus, 9094 Old Redwood highway, was recognized and questioned whether a negative declaration could be filed in connection with the findings made at the Planning Commission meeting. He argued that there was insufficient information available to make the determination that there couldn't be a. significant impact. Mr. Pinkus stated that the negative declaration didn't consider the effect of the project on other wells, excess water being committed to Petaluma and Marin, the additional energy required to pump the water, and that Rohnert Park didn't fulfill its obligation as the lead agency. He felt the study didn't consider the project's short term vs. long term environmental goals, and referred to Sec, 15082 of the Govt. Code. He stated that possible effects of the project on Well No. 14 and other wells or wells being drilled hadn't been considered and expressed that he wanted it made clear that the initial study was insufficient and that it was vulnerable: to legal attack. He again noted that there was not sufficient data for the finding that there could be no effect on the environ- ment and also that the declaration of a "state of emergency" was a means for getting well No. 14. Mr. Larry Swenson, 345 Highland Avenue, representing SCORRA, was recognized and emphasized that the purpose of the public hearing was to determine whether or not there could be a significant impact.on the environment and generally discussed considerations in determining that there could be no signifi- cant; adverse impact. Mr. Swenson expressed his opinion that determining that there was a "state of emergency" had no bearing on the matter being considered at tonight's meeting; and that so doing for Well No. 14 was a blatant attempt to conceal facts. He commented that the Council had previously agreed that there was no state of emergency and that even City Engineer Brust's report did not indicate that there was an emergency. Mr. Swenson noted that the Council must consider the affect of the contract and of the County's drilling wells. He also stated that staff had informed him of possible Council action in one manner while the Council took another action. In concluding, Mr. Swenson advised that a hydrologist had been retained to speak on the information presented to the Council and reflect- ed. that there was no indication that Rohnert Park intended to prepare an environmental impact report. Mr. Swenson then introduced. Mr. Verne I?. Scott, Professor of Water Science and civil engineer, at this point in the meeting and presented Council members, City Manager Callinan and City Attorney Flitner with copies of Mr. Scott's resume, a copy of which is attached to the original set of these minutes. Page 18 Mayor Beary indicated over five minutes and, be deferred. March 14, 1977 that Mr. Swensonts comments had gone that Mr. Scott's introduction would Mr. Swenson presented to Mayor Beary petitions, signed by residents of Sonoma County, protesting drilling of deep wells by Rohnert Park to supply water to Petaluma and North Marin County Water District and requesting a public hearing by Sonoma County Water Agency. A copy of the petition is attached to the original set of these minutes. Discussion was initiated between the Council members relative to continuance of the public hearing past the 11:00 p.m. deadline. It was noted that extension of the meeting required a L[/51S favorable vote. Councilman Eck made a motion to extend the meeting without time limit. Said motion died for lack of a second. Councilman Flores made a motion, which was seconded by Council- man Roberts, to extend the Council meeting's deadline for one additional hour. Said motion failed to receive the necessary four (4) votes for approval by the following roll -call vote. AYES: ) Councilmen Eck, Flores, Roberts and Beary NOES: (1) Councilman Hopkins Mr. Verne Scott was recognized and informed that he would discuss the status of known information, lack of information and conclusions. Mr. Scott commented on known information available concerning various formations in the area and geographic locations, i.e. the Glen Ellen and Merced forma- tions, commented that the Merced formation was reasonably well defined, noted that its water levels are highly variable depending on the location and depth, noted that in reviewing the water levels being monitored by the State that there had been no significant change although he had noticed that two of the City's wells showed a downward trend for the last few years, commentedon Engineer Milt Hudis' report citing large water storage in the area but which, in his opinion, offers no conclusion on how much is actually usable water storage and noted that the conclusions are based on relatively short term records. lie also noted that the report cited the recharge capacity which he questioned because there has been no.significant rain to constitute a recharging of the system. Mr. Scott maintained that -there was Jnsii-F_ ficient information in order to reach the conclusion relative -to the significance of the project as it related to natural resources (Environmental Impact Questionnaire, No. 7), main- tained that -there was too short a period of time as far as monitoring wells in the area to make any judgement, Page 1-9 March 14, 1977 that previous records did not reflect two years of drought, L cited that various aspects of the report were unknown, i.e. sustained pumping, water quality of a deep well, reduction in storage and yield and energy consumption. Mr. Scott contended that there was a large number of "unknowns!', that more information was needed on the various formations as they relate to the two phases of the water basin, there was a need for intensive pumping tests; that the amounts to be pumped by the two wells was relatively small compared to what the City is now pumping, that planned alternatives should be provided and in conclusion recommended that the City proceed with considerable caution, that perhaps the city should drill one well and that it be thoroughtly tested, and suggested that any additional wells not be drilled until the information mentioned above is completely ascertained. Mr. John Nelson, Manager of North Marin County Water District , was recognized and expressed opposition to previous statements that a state of emergency had not been properly addressed, noted that insofar as energy use is concerned that the amount of water which would be pumped would be considerably less than that which would have been pumped from the Russian ,River if the drought did not exist. He noted that the environ-- mental impact of the project had been considered by the Planning Commission and that he supported the Council's making a finding for filing a negative declaration for drill- ing of the wells. Mrs. Thara Laris was recognized and expressed that she was very concerned about her well., that she wanted to continue living in the area but didn't want her property values to go down because of the,proposed wells, that she had a emotional and economic-concern in the matter being considered, infcrmed that she had joined water groups in order to gain knowledge on the subject, noted that other users in the area depended on ground water, that she would like to share water with people who need it, but that she wanted careful monitoring and wanted management by a body that would be responsible to the users. Mrs. Laris requested an explanation of the safeguards for the proposed wells, commented that the report prepared by Robert Ford showed that the water table was lower for two wells and expressed opposition to the project being done by Rohnert Park but indicated her agreeableness to having a larger agency do the project and requested that a high standard of safeguards be observed. Adrienne Swenson, representing the City of Cotati, was recog- nized and explained that she wanted to make sure that the Council had received copies of.The City of Cotatils February 22,_1977 letter. Council members responded in the affirma- tive and the letter was made part of the record. Mrs. Swenson continued that Cotati felt, in the case of drilling deep wells, an environmental impact report should be prepared prior to drilling wells 15 and 16. Page 20 March 14,. 1977 Mr. Andrew Kovaily,.3923 Poplar Avenue, was recognized and expressed that he didn't object to drilling of the wells, but would like sufficient safeguards noting that he didn't want to be without water. Mrs. Sherrill Burton, 9575 Kelly Lane, was recognized and expressed her concerns about,the contract between Petaluma, North Marin and Rohnert Park, lack of monitoring of water levels outside of Rohnert Park, that Petaluma and North r1al,111 WOUIG nave as much water, as Rol-inert Park considered surplus, that she didn't understand what the City's "emergency' consideration was. Mr. Frank Kresse, 5735 Davis Circle, was recognized and informed that in his letter dated February 24th to Mr. John Nelson, North Marin County Water District, he (Mr. Kresse) supports the filing of a negative declaration for proposed wells 15 and 16, pointed to a map which was displayed and explained that it showed those wells in the area being moni- tored which provided for a long term record (20-25 years), informed that the two proposed additional wells are being drilled at this time at the same depth as Well Nos. 15 & 16, informed that a number of wells are presently being monitored by the Department of Water Resources in order to make a thorough study of the area's well capacity. Ile informed that the Dept. of Water Resources offered a course for individuals desiring to monitor their own wells. Mr. Kresse opined that the basin was little affected from the pumping of water and that the drilling of Wells 15 and 16 would be a landmark in learning about the area's water basin. Mr. Jaak Saame, 10950 Minnesota Avenue, was recognized and reflected that after listening to several people he still had concern about the effects of the proposed drilling on his well. He informed that he was a professional engineer and recommended that the City prepare an environmental impact report for one well only, the other to be abandoned. Mary Stewart, 578 Lorraine Court, was recognized and expressed that she had several questions, ie. who determined that there was an emergency, commented that peoples feelings were not going to be quieted just by one person saying this or that, that a judgement shouldn't be based on one geologist's opinion, would like to see something done on this matter that would give people more confidence, question- ed that if the City Council didn't listen to the people who elected them then to whom were they going to listen. Mrs. Stewart commented on growth, its effect on school facilities, recent defeat of the school bond measure, listening,to other communities, or developers. Mayor Beary informed Mrs. Steward that the citizens of Cotati were responsible for defeating the school bond issue inasmuch as Rohnert Park residents overwhelmingly voted for it and stated that the water situation and wells matter was a very serious problem for Petaluma and North Marin. Page 21 March 14, 197 T Mrs. Peggy Mathews, Cotati, was recognized and noted that the City would be pumping three times as much water, that there was no possibility of recharge at this point, and requested for an explanation of the drop in the water table at Wells A and B. City Engineer Brust described a graph (which was displayed) depicting water levels for wells monitored by the State from 1956 to 1976 and explained that the graph showed that there was a slight change in the water level although it was felt not to be significant. Councilman Hopkins asked how many acre feet were being committed to Petaluma and North Marin County. Mr. John Nelson was recognized and informed that 1100 acre feet of water were going to the subject communities and reflected that four communities would benefit from the wells, either directly or indirectly, namely Forestville, Santa Rosa, Petaluma and North Marin County Water District. City Engineer Brust continued to explain the graph in rela- tionship to rainfall and water levels and noted that the graph showed that the ground water had not dropped signifi- cantly. Everyone having been given the opportunity to speak once, Mayor Beary declared the public hearing closed. Mr. Larry Swenson expressed his objection to the closing of the public hearing. Discussion followed concerning repetition of information presented, possibility of cross examining persons during a public hearing and closing of the hearing. Councilman Eck made a motion to allow Mr. Swenson to address the Council for 10 minutes. Said motion died for lack of a second. Discussion followed between City Manager Callinan, City Attorney Flitner and Council members during which Mr. Scott in answering a question of Councilman Eck indicated that he had not read the report prepared by the State Department of Water Resources despite his efforts to contact Mr. Ford, but that he suggested the drilling of one well with extensive long term monitoring. We feel that the information sent to us does not adequately address the following concerns: limitations of the Merced formation proposed to be tapped; inter- connection between the Merced formation and other water tables in the area; amount of water proposed to be drawn from the wells; cumulative impact of these and other wells proposed to be drilled in the area; details of the contract to provide water to non -local agencies without regional agreement on use of the local water resource; growth and water use projections of the agencies to which the water will be sold; and the effect of exporting local water resources on existing wells in this area. We feel strongly that this information should be provided and discussed publicly in the form of an environmental impact report before construction of the proposed wells is approved. Section 15082 of the California Environmental Quality Act provides that mandatory findings of significance shall be made for projects falling under any one of four categpries: 1) Impacts which have the potential.... to curtail the range of the environment; 2) Impacts which achieve short -term, to the possible disadvantage of long -term, environmental goals; 3) Impacts for a project which are individually limited, but cumulatively considerable; and a 4) The environmental effects of a project will cause substantial adverse effects on human beings. To Planning Commissioners February 22, 1977 Page 2 We feel that the proposal to drill three new wells and to provide water to non -local entities without adequate regional supervision falls in the first three, and possibly all four, categories for which a mandatory finding of significance must be made. Section 15080 of CEQA provides that a negative declaration may be substituted for an EIR when projects are revised to eliminate signifi- cant environmental impacts. Cotati would endorse such a procedure could, it be shown that adequate water conservation efforts, regional supervision and other details were worked out in a manner that could eliminate the negative impacts mentioned above. We would be happy to meet with you and other concerned agencies regarding those problems.
