Stine Ray Swim Team Financial City Manager Callinan reviewed his May 5th memo to the Report Council and informed that each Council member has pre- viously received a copy of the Sting Ray Swim team's financial statement (a copy of which is attached to the original set of these minutes). Mrs. Hendersonj.,Board Member of the Sting Ray Swim Team, was recognized and participated in a discussion with Council members relative to the expenditures and income outlined in the financial statement. Mr. Taylor and during which it was ascertained that Mr. Taylor's major objection was the fact that multiple family units were not included under the,present growth policy (Resolution No. 77-10). Councilman Eck suggested he amend his motion to reflect that,'a p would wou be ublit hearing conducted at a special meeting ,of the City , Council On May 25th. Councilman Hopkins indicated that he was , n't agreeable to such an amendment. Discussion followed.. Councilman Eck made a motion, which was seconded by Councilman Flores, that the reading of Ordinance No. 329 be waived,and said ordinance introduced. Discussion followed concerning personal decorum, .. i.e. dress. Councilman Eck made a; motion, which . was seconded by Mayor Beary, to delete the wording "shirt or blouse" as contained in subsection.9.56.130 Decorum and Dress. Discussion fol- lowed `concerning .other provisions of the proposed ordinance as it relates to trespassing jogging, etc. The Council agreed to amend.the proposed ordinance to add Language to Section 9.56.02.0 so as not to restrict strolling or jogging on the course, to add "or shorts" to Section 9.56.130, and to add Section 9.56.2LL0 concerning retrieving golf balls from private property. City Attorney Fletner indicated that he would finalize the language for these _ changes and have revised copies of the ordinance distributed to the Council_pri.or to the next meeting. Codding, Codding Enterprises, developer of the proposed Northbay Shopping Center, was recognized and `generally commented on parking facilities and the proposed structure's appearance. Discussion followed. Upon motion of Councilman Roberts, seconded by Councilman Hopkins, and unanimously approved`, consideration of Lyons Restaurant's application for architectural review of its proposed restaurant in the'Piorthbay Shopping Center (File No. 0534) was continued' until the May 23rd meeting in order to receive a colored rendering for the proposed structure, . File No. 0337 -' City Manager Callinan reviewed his'May 5th memo to the Western Business Park, Council concerning We Business Park Associates' appli- Architectural Review cation for architectural review of a proposed 15,600 square of Warehouse foot industrial building to be located east of Commerce Boulevard, south of and adjacent to the Fostmeier Building. Mr.`Callinan distributed "photographs of structures with ,a'similar appearance to that proposed by Western Business Park Associates. 'Planning Director'Skanchy reviewed his April 25, 1977 planning staff report and described the proposed structure as depicted in a rendering which was displayed. Mr. Skanchy showed the Council a sample rock which would be used in the structure's 'facade. City Manager Callinan noted that the Planning Commission had granted architectural review for the project, but deleted a condition requiring the 'applicant to work out a program for the development, of Transport Avenue. Dis- cussion followed. Mr. Jim Redding, Western Business'Park Associates, was present in the audience and recognized by the Council. Discussion followed. Parcel Map` Noe 39 City Manager Call in an explained Parcel Map No. 39, which was displayed, and affects the area on the west side of U.S. 101 freeway on South Santa Rosa Avenue, being the Pisani Monument Property. Planning Director Skanchy, commented on same, showing utility easements in the area and explaining the Planning Commis-_' sion's conditions of approval. Upon motion of Councilman Roberts, seconded by Councilman Hopkins, and unanimously approved, Parcel Map No: 39 was approved subject to conditions ,as, approved by the Plan- ning Commission. Parcel Map No. 40 City Manager Callinan explained Parcel Map No. 40, which was displayed, and affects the area east of Commerce Boulevard, south of and adjacent to the Fostmeier Building, being the area of Western Business Park Associates' pro - posed industrial building. Planning Director Skanchy commented on same, showing utility easements in.the area and explaining the Planning Commission's conditions of approval. Upon motion of Councilman Eck, seconded by Councilman Roberts, and unanimously approved,,Parcel Map No. 40 was approved subject to conditions as approved by the Planning Commission. Bus Service to Sonoma City Manager Callinan reviewed his May 5th memo to the State College Council pertaining to Professor Woefel's request regarding; re- routing Golden Gate Transit Route No. 70 to have it extending eastward on ;Southwest Boulevard to Snyder Lane in order..to. provide service to Sonoma State College. Associate Professor Woelfel, Sonoma State College, was recognized and explained in detail his request to extend bus service to the college campus. Discussion followed. Mayor B`eary withdrew his second, and indicated that the matter should be scheduled for the Council's consideration at the May 23rd meeting in order to further discuss the cost factor concerning the proposed extension of Route. 70 to Sonoma State College. George ' Carli, City Manager'Callinan'reivewed -his 'May "5;' "1977 memo to Purchase of .Property the Council concerning Mr. Carli's interest in acquiring Along Hinebaugh the unused Hinebaugh Creek right -of -way area adjacent Creek to his residence at 6097 Dubarry Court. Discussion followed. Mr. Carli was present in the audience and was recognized by Mayor'Beary. Councilman Flores made a` motion, which was seconded by Councilman Hopkins, endorsing staff's recommendation that subjectcreek right -of =way be sold to Mr.. Carl. Discussion followed concerning subject area's configuratica and'' maintaining a'open space vista. :It was suggested "that'the motion be amended to provide that 'staff be 'directed to work out the details of the sale, subject to other concerns of the City Council members. Councilmen Flores and Hopkins accepted the additional wording to the motion as:a friendly amendment. Discus- sion followed. The original motion.approving, the sale of unused Hinebaugh Creek right-of -way area adjacent to 6097 Dub arry Court and its amendment with certain conditions was unanimously approved by a roll call vote. City Manager Callinan; noted that he and Councilman Eck would meet with Mr. Carli concerning the subject area's configuration in relationship to preserving view of open space. Park's & Recreation City Manager Callinan reviewed,Di.rector of Parks and Matters Recreation - Pe*kkain's April 25,.'1977 memo concerning the 1976:.Bark Bond Act.,_the.Parks and Recreation Commission's 1977-78-Budget recommendations, and its challenge to the City Council to participate in the Get Acquainted Days tug -of -war. Wastewaters Use of City Manager Callinan: reviewed his May 5th memo to the Council concerning a proposed order of the Regional Water Quality Control Board concerning the use of treated waste- water for construction uses and landscaped irrigation. Discussion-followed concerning reclamation of wastewater. Mechanic Position City Manager Callinan noted that a memo from Director of Public Works /City Engineer Brust and Director of Public Safety.Dennett' concerning the need for a full time mechanic had been disseminated to Council members and indicated that because there had been insufficient time for the Council to adequately review the matter, that further consideration be continued to the May 23rd meeting. Resolution No. 77 -88 RESOLUTION OF THE COUNCIL OF THE CITY OF ROHNERT PARK APPROVING AN AGREEMENT WITH SAM,MAROVICH TO 'PUMP STORED EFFLUENT AND IRRIGATE PASTURELAND AND CORN CROPS City Manager Callinan explained the resolution and agree - ment. Upon motion of Councilman Hopkins, seconded by Mayor Beary, and unanimously approved, reading of Resolution No. 77 -88 was waived and said resolution adopted. Golf Course Well City Manager Callinan reviewed a memo from Golf Course Repairs Supt. Singh concerning cost ,estimates for repairing the well by No. 2 green. Discussion followed. Upon motion of Councilman Hopkins, seconded by Councilman Flores, and unanimously approved, the Council authorized the necessary repairs to the well.near the No. 2 green, estimated at between $3,500 to $4,000. Page 10 May 9, 1977 SB 90 Population City Manager Callinan called the,COuncil?s attention Estimate to a communication received from the State Department of Finance transmitting a population estimate (SB 90) for the City of Rohnert Park at 159100 persons. Streets Highway City Manager Callinan informed that copies of the Streets Code Sec. 2156' Report and Highway Code Section.2156 report had been disseminated to each.:; Councilman an& requested the Council's acknowledge.°. ment of filing same. „ Upon motion of Councilman Roberts, seconded by Councilman Flores,, and unanimously approved, the City Council ack- nowledged having seen the Streets & Highway Report and approved the figures contained therein as well as the filing of same. Gratuity City Manager; Calli Page 11 May 9, 1977 Public Records City Attorney Flitner reviewed his April 26th memo to the "Council concerning public records. Councilman Hopkins Councilman Hopkins left at this point in the meeting, Leaves the time being approximately 10:20 p.m. Teen Center City Attorney Flinter commented on donations to the pro- posed teen center in respect to obtaining bids and informed that any public works project over $5,000 is required to be put out to bid. Discussion followed. Supevisorial Mayor Beary reported on a meeting on the Supervisorial Distri.cts Redistricting Committee and various alternatives concerning the reconfiguration of supervisorial districts. Discussion followed. Growth Mayor Beary indicated that community growth had been ad- dressed earlier in the meeting. File No. 0529, Quick Councilman Eck informed that he had exercised a Council - Stop Market man's prerogative and called up for review the proposed Quick Stop Market on Southwest Boulevard (File No. 0529) for the Council's consideration at its May 23rd meeting. Postal Service Councilman Roberts initiated a discussion concerning postal service and placing of mailbox receptacles at the sidewalk. Joint Elementary Councilman Eck initiated a discussion concerning the school and City Meeting district's establishing a formula which would be presented at the Council's May 23rd meeting. Discussion followed concerning conducting a meeting with the new unified school board of trustees. Disclosure Statement Councilman Flores initiated a discussion concerning estab- for New Homeowners lishing a "disclosure statement" form to be signed by new homeowners relative to the school situation. He indi- cated that he would work with staff in drafting the form. Upon motion of Councilman Flores, seconded by Councilman Beary and unanimously approved, the Council directed staff to develop an appropriate statement indicating the present school situation for presentation at the May 23rd Council meeting. May 23rd Council City Manager Callinan informed that several public hearings Meeting were scheduled for the May 23rd Council meeting and dis- cussed with Council members preference in scheduling of agenda matters, with the idea of getting the routine matters disposed of early on the agenda. Mr. Kalin's Letter City Manager Callinan noted that a letter had been received from Mr. Kalin concerning a willingness to sell his prop- erty immediately north of the city limits as it relates to the open space /community separator. This will make the Resolution also apply to mobile homes, multi-family units and to units proposed for the aged, the handicapped and the poor, and so bring these types of dwelling;... units wit#in the purview Of the 600 figure adopted by the council as the reasonable and acceptable number of the residenti&1 units to be built in Rohnert Park, per year* I request that a public hearing on this proposed amendment be scheduled for the next regulat city council meeting. And I also request that at that meeting the citizens of Rohnert Park have priority in filling this chamber, not that I desire to keep outsiders out, but I do believe that we can fill this chamber with pur pwn people, voters who have elected yo-at and to wbLom you are responsible, and that they should have priority in at- tending. Two weeks ago I said to you that it is your duty to protect the in- terests of the people of Rohnert Park. I ask you not to forget that now. I do not speak for the people of Marin county, who have their own elected officials to represent them, nor for the people of Santa Rosa, whose jobs can best be protected by you by withdrawing any legal ojections Rohnert Park has made to the proposed Santa Rosa urban development project, or for anyone else outside of the city of Rohnert Park. On page 21 second paragraph eight of Resolution 77-10t it is recited that parochial attitudes exist in Marin county and in Petaluma, each community protecting its own interests. What else do you expect? At the community level, that is exactly what each oommunity should do. Rohnert Park must protect its own interests, no other community will or should, and I do believe that this council has been remiss in that regard. As for the job situation, I under- stand that the trouble in the building trades is that, nationally$ six million people are after three million jobs, and we certainly cannot solve that problem at this level* We do not need further studies, referendums, or delay of any kind for any cause. We must have, and we demand, action now. If action is not now taken to effectively limit growth along the lines I have suggested; approximately fifty people will shortly be soliciting -2® signatures to a much more drastic growth ordinance than the one which I have proposed, and one which, when enacted, can thereafter be changed or amended only by a referendum. And these people will be circulating petitions for recall, too. It is not my intention or desire to threaten the council, I am only saying that if you do not take effective action now, we will. So I ask you to submit the ,amendments which I have suggested to a public hearing at the co uncil meeting two weeks hence. It will then be up th those who appear before you tonight on this subject to see that that hearing is well attended. I now yield to Mrs, Helen Lawrence, who has some further comments to make. City Council - May 9, 1977 As a result of my involvement in the last school bond campaign and the recent golf course controversy, I am all too aware of just exactly how the citizens of Rohnert Park feel regarding the rampant and uncontrolled residential growth that is taking place in this town. The people of Rohnert Park want some realistic restraints put on residential development and they want them now. They are not impressed with the spineless growth management plan contained somewhere within the seven pages of meaningless political rhetoric which comprises Resolution No. 77-10. It is unfortunate that the City Council, through its total disregard for public opinion, has forced thecitizens into a position where they must use our children as pawns in a political battle that J has been waged on school grounds rather than in City Hall. Just recently, over 700 (citizens of this tovYn signed Upetitions circulated againstOi -oning ordinance WO. Many of those petition signers stated that they were signing the peition because they felt it was another way of expressing ther dissatisfaction with the City Council and with the growth policy -- or lack of growth policy -- in this town. The growth issue has not been settled and most certainly the problems being caused by this uncontrolled growth are not being solved. We have a crisis situati on in the schools. We have seware flowing into open fields. We have the immediate need to drill emergency wells.... just to name a few. You, as elected representatives of the citizens of this community, would be nothing short of negligent and xZXMa Mx if you do not heed the rumblings from without before you find that the angry crowd will no longer you give the choice of listening to them. While some citizens feel our current growth policies are more than adequate and restrictive, there is a growing number of citizens who seem to disagree. The issue ds of such paramount importance to our community that I feel nothing less than a ballot measure and the accompanying debate and discussion will be adequate to resolve the issue. With that in mind I will propose that the City Council at the earliest possible time place an issue on the ballot that asks the public as to whether the city should be more restrictive in its growth policies or not.
