ROHNERT PARK CITY COUNCIL MINUTES 23 May 1977 The Council of the City of Rohnert Park met this date in regular session commencing at 7:20 p.m. in the City Offices, 6750 Commerce Blvd., Rohnert Park with Mayor Beary presides ing. The regular session was preceded by an executive session which commenced at 7:00 p.m. and at which all Councilmen, City Manager Callinan and City Attorney Flitner were present and which was held to discuss litigation and personnel matters. Mayor Beary called the meeting of the regular session to order at approximately 7:20 p.m. and led the pledge of allegiance. Present: (5) Councilmen Eck, Flores, Hopkins, Roberts and Beary, Absent: (0) None Staff present for all or part of the meeting: City Manager Callinan; City Attorney Flitner, Planning Director Skanchy, City Engineer Brust and Fire Services Commander Bick Approval of Minutes Upon motion of Councilman Flores, seconded by Councilman May.9, 1977, Roberts and unanimously approved, the minutes of May 9, 1977 were approved as submitted. Approval of Bills - Councilman Roberts questioned two bills submitted for approval on bills for approval, The one to Community Hospital, and the one to Petaluma High School District. City Manager Callinan responded that the hospital was for physical examinations, given the Department of Public Safety volunteers and new Reserve applicants and the Petaluma High School District for bus transportation for the Recrea- tion Department. Upon.motion of Councilman Roberts, seconded by Councilman Hopkins and unanimously approved the bills presented per the attached list in the amount of $160,553.76 were approved. Adding Non�Agendaed Councilman Flores requested that discussion of recommenda- Items Lion of appointee to Library Board be added to the agenda. Discussion followed concerning whether or not the week -day Pate-for residents should be reduced rather than the week - end rate. Councilman Flores made -a motion; whth wasis condpd by Councilman Eck'that the Council reduce the 18 Hole week- day rate for Rohnert Park residents from $3.00 to $2.50. Said motion was approved by the following roll call vote: (4) Councilmen Eck, Flores, Hopkins, Roberts NOES: ' (1) Mayor Geary 'Councilman Flores made a motion, which was seconded by Councilrrian'Eck,' that the` Council reduce the 18 Hole wee: k; -end rate for Rohnert ;Park residents from $5.00 to $4.50. AN ORDINANCE OF THE CITY OF ROHNERT PARK ADDING CHAPTER 9.56 TO THE ROHNERT PARK MUNICIPAL CODE (Golf Course Rules and Regulations) City- Manager Callinan discussed' the hours concerned in Section 9.56.020 of this ordinance. He felt that "after the normal hours of use of the golf course" should be taken out of the section. The Council agreed. Upon motion by Councilman Eck, seconded. by Councilman Roberts, and unanimously approved the reading of Ordinance No.. 329 was waived and said ordinance was adopted with the change to Section 9.56.020. AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING ORDINANCE NO., 326 (Conflict of Interest Code, Definition of Public Official) Upon motion of Councilman Roberts, seconded by Councilman Eck and unanimously approved, the reading of Ordinance No. 330 was waived and said ordinance was adopted. AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING CHAPTER 10 OF THE ROHNERT PARK MUNICIPAL CODE BY ADDING SECTION 10.60.100 (Operation of Vehicles in Parks, School Grounds, Drainways, Etc) Upon motion by Councilman Eck, seconded by Councilman Flores and unanimously approved the reading of Ordinance No. 331 was waived. Upon motion by Councilman Eck, seconded by Councilman Roberts and approved by the following roll call vote, Ordinance No.. 331. was adopted: AYES: (4) Councilman Eck,, Flores, Hopkins, Roberts NOES: (1) Mayor Beary Resolution No. RESOLUTION EXPRESSING SUPPORT FOR THE ARCTIC GAS PROJECT 77 -87 Discussion was held between the Council and Mr. Ralph Fitch represerti.ng P.G. & E. Mr.-Fitch read a statement briefly explaining the need for the project. Copeland Creek Apartment,Probl.ems Mrs. Alice Steel of Copeland Creek Apartments #34 was pre- sent and spoke to the Council regarding problems with child- ren in the area of the Copeland Creek Apartments. Mayor Beary stated that he had,'spoken to the Director,bf Public Safety regarding the extra patrol. of this area after the Town Meeting to help alleviate the problems. City Manager Callinan stated that a fence has been approved for this urea. Planning & Zoning Planning Director Skanchy explAined this application and File INo. 0529 r the Planning Commission's approval of same. Ernest McCulloh Use Permit for Quick Stop Market Mrs. Patricia Bogue of.1,71.Alma.Avenue was present and read and presented a petition,to the. Council regarding the feel - ings of the residents on Alma Avenue against the Quick Stop Market. Discussion followed. Councilman Flores made a�motion,which was seconded by Councilman Eck to overrule.tbe, actions of the Planning Commission and not approve the application for the use Permit for the Quick Stop Market. Mr. Mayne Lawson, designer of the project was in the audience and discussed the matter with the council in the absence of the owner Mr. McCulloh. Mr. Lawson pointed out that the T,ro- k, k' ose l .0 use was a convenience type operation and he did not see how it would cause any problems. During the discussion that followed, it was pointed out that the residents of Alma Avenue have had to put up with a`lot over the years.due to heavy traffic, lighting, etc, on'Southwest.Blvd. Discussion was held regarding the possibility of granting the use permit but without the prcposed gas pumps. Mr. Tom Bogue also commented on the gas pumps and hours ...of use. Councilman Hopkins made a motion to amend the use permit to exclude the gas,pumps' and establish the hours of operation from 7;,00.m.'rto 7:00 p.m. Said motion died for lack of second. Councilman'Flores' pending motion to overrule the Planning Commission., and not approve the use permit application for the Quick Stop Market c&nplex'was approved by the follow- ing roll call vote: Upon motion by Councilman Flores, seconded by Councilman Eck and approved by the following roll call vote the application for architectural review of the Lyon's Restaur- ant was approved as approved by the Planning Commission but with the following conditions: (1.) that the roof be constructed of green concrete the shingles instead of the shake roof; (2). the exterior walls be faced with used brick, and (3) the landscaping use large mature trees. File No. 0254 Planning Director Skanchy explained the final map. It Final Map Country was noted that the subdividers are Arthur B. Siri and Club Estates No. 8, Jimmie Rogers. File No. 0216 City Manager Callinan explained that due to the fact that Sonoma Grove the Sonoma Grove Use Permit: review matter had been con Permit Review tinued by the'Planning Commission until its June 9th meet - ..Use ing, that the Council should not consider it until it had the recommendations of the Planning Commission. He recom- mended that the scheduled Public Hearing be continued to the Council meeting of June 27th. Mayor Beary declared the public hearing open and asked if there were anyone that wished to be heard regarding this matter. There being no one, the public hearing was con- tinued until the Council meeting on June 27th. File No. 0534 Planning Director Skanchy explained the colored elevations Lyons Restaurant of the plans for the first stage of the Lyons Restaurant. Discussion was held with Planning Director Skanchy, Mr. Gary Mayes, architect for the project and the Council, regarding the type of shingles for the roof, installing used bricks on exterior walls and the landscaping includ- ing larger trees. Mr. Mayes initiated a discussion on the possibility of having three signs on the building; he was told that proposed signs would have to be processed through the Planning Commission before the Council could act on same. Mayor Beary .declared the public hearing open and asked-if anyone wished to be heard concerning this. Mr. Thomson presented Commander Bick with the aspiration equipment purchased by the Volunteers to be used in the ambulance,`i,t was also noted that there was One 'waiting. for the new ambulance. Mr. Jose Rodriquez; Trustee of the Elementary School Board $ presented the.Council with a worksheet labeled "Discussion 5' a copy of which is attached to the original of these minutes, concerning allocation fo the space in the portable school now under construction. ,A lengthy discussion was held regarding portable classrooms, double session vs. 45/25 staggered,, the affect the overcrowding has on students etc. ,,Mayor Bearry...ihanked Mr. Rodriquez, and requested that a resolution might be proposed fir the next meeting by the Cotati.-Rohnert Park School District. .City Manager Callinan- suggested that the School. Board also keep pressuring the City of Cotati regarding obtain- ing a financial contribution towards school facilities ®'`. Mr. Rodriquez'stated.that'he.is on the agenda of the Cotati Planning Commission'later.this evening. Mayor Beary declared a five minute recess, time being approximately:9 :25 p.m, Mayor Beary reconvened the meeting at approximately 9 :38 P.m., with'all,Councilmen present. Mayor.Beary declared the.public hearing open at this time regarding the Growth Management Policy and suggestions for changes and /or a November ballot measure. Herequest- ed that comments be limited for four minutes per person as there were so many to be heard this evening. Mr. Samuel Krieger, 586 Lamont Ct., was recognized and Spoke against rapid growth and that the builders and Page -8- 23 May 1977 developers are the ones that profit from rapid growth. He stated he did not feel that the City Council has dealt with the situation properly but personally wanted to thank Councilman Eck for his stand that he has taken against growth. Mrs. Helen Lawrence,,942'Ellen Street was recognize d and rnsponded to several remarks made by Mrs. Luttrell and Mr. Krieger : She stated that she felt it would be a mistake to combine the growth issue and bond issue on the same ballot. She asked the Council to assume responsibility and control growth. Mr. John Wuerthner, 5745 Davis Circle was recognized and stated he was here as a citizen and representing the Cham- ber of Commerce. He read a prepared letter from the Board of Directors of the Chamber of Commerce. He then spoke on his own behalf'in favor of controlled growth stated that there must be industrial and commercial growth as well as residential. He complimented the Council for doing such a fine job in the past. Mr. Jack Eddinger, Manager of Exchange Bank was recognized. He stated that he felt that citizens of Rohnert Park should be proud of what they have done and are doing by making this a fine community.and providing the young people an opportunity to purchase homes, employment, etc., and that this city does need commercial and industrial growth. Wanda McCulloh, 5653 Davis Circle was recognized She stated that she has been a resident for approximately 15 years and has seen this community grow to a self sufficient mature, community of which she is proud. She explained there is a need for growth but in a controlled manner. Tom Johnson, 795'Bern.ice Avenue was recognized. Mr. John- son stated that he has been a resident for about 15 years and he is happy to see as much as we have here now. He recalled having'to take his children to Santa Rosa for all recreation, whereas now Rohnert Park has a roller rink, bowling ali6y,'etc., which are the products of good growth. He advised that-he is for controlled growth. Ma ry t-ewar 'S" t, 578 Lorraine Ct., was recognized. She stated that she has helped out in the past on both political issues, and school bond issues. She felt that most everyone h . dr. , e.was in favor of controlled growth; asked the city council to consider putting some "teeth" ,in�the growth ordinance already passed by including apart - vents. Mary Hermans, 7387 Barbi Lane was recognized, she stated that she felt the growth issue should be on•;he-ballot and that it would not be a mistake to combine the two issues on the ballot, 'i.e., school bonds and growth. Page -9- 23 May 1977 She suggested the r__7_ty r issuing building permits in stor+ ; ��„ the interim until the election or delete the two exceptions from the grcwth policy. Anna Costerouse, 733 Carioca Ct. was recognized. She stated she is here as a member of the school board and would like a clear definition of a negative impact on school district. Several Councilmen and City Manager Callinan .discussed items such as portable class rooms, revenue tax basis, etc. with Mrs. Costerouse. Jack Titus, 6081 Elsa Avenue was recognized. He stated that he is in full agreement with Anna Costerouse and the Trowbirdgeb. He said that three Councilmen had agreed to make the necessary I amendment to the growth policy resolution and suggested it be done. Anne Schultz, 6080 Elsa Avenue was recognized. She stated that she feels that..most,are not against growth, but to have it controlled both residential and industrial and commercial. She expressed support for the Trowbridgeb and the Lawrencet and is concerned with the number of apartments. Larry Smith, 1309 College Avenue, Suite C, Santa Rosa, Executive Officer for the Construction Industry of Sonoma County read a prepared statement in favor of growth, both residential and commercial /industrial. He stated Rohnert Park has now and in the past been a community of fore - sight by providing adequate water, sewer, parks, moderately priced homes. Gordon Adam, 7235 Belita Avenue was recognized. He stated .he is a homeowner and businessman here in Rohnert Park and thinks the Council does a fantastic job although schools are a problem. He thinks that there is a defin- ite need for commercial and industrial growth along with residential as business won't come here unless there is enough to support it. Xavier Messmer, 105 Alma Avenue was rarnvq_ni�ar1, He stated he is also a resident and businessman within the community and feels the need for growth in commercial, industrial and residential areas.' Stated a town has to grow to sur- vive. He commended the Council for its performance. Howard Boggs, '5430 Commerce Blvd. was recognized. He supported the ideas that had already been expressed dur- ing the evening and complimented the council on the job they are doing and have done. He indicated he was against artificial limits on growth because of the problems they create. Extension of meeting'` "gay or Beary asked,about the 11:00 p.m. extension. The "Council indicated'that it would have no objection to allowing extension of the meeting past its 11:00 p.m. deadline. Page -10- 23 May 1977 Dave Fuller, 11 Varda Sonoma Grove was recognized. He stated he is not a homeowner but a resident at the college and would like to see more open space and limited growth. ,Peter Morris, 18 Anne Street, Sonoma Grove was recognized and stated he is also a student at the college and not a homeowner and is in full support of limited growth. He suggested that the Master Plail be revised to include more schools, neighborhood parks, open space, etc., and indi- cated that he supported the Trowbridge's proposal. Tom Cato, 1045. Camino Coronado was recognized. He stated he is against growth and fully su pports the Trowbridge proposal and would like to,see more imput from people liv- ing in Rohnert Park. He expressed that Rohnert Park in many ways is a wonderful city. Larry Stogdell, 345 Lindsey Avenue was recognized and stated without the planning so far of this city, he wouldn't be here and hopes that the Council will take under con- sideration the points that the people have brought before -them. He said he supports planned growth. Jim Redding, 7147 Barbi Lane was recognized. He stated he has lived here for over 11 years and that there must be industrial and commercial growth and you need resi- dential growth for that to continue. He urged the Council not to kill the economic growth of the City by a short- term solution. Laiki Sani, 7683 Adrian Drive, w . as recognized. She stated she has been a resident for a long time and that the question is not no-growth, but the speed at which we grow. She said that the Council let growth get out of hand and urged that growth be paced. Louis McBride, 5550 Country Club Drive, was recognized. He agreed with the others that.had spoken. He thanked the council..for allowing subdividing so that he could live in Rohnert Park. He cautioned the City however, not to over extend resources. Ray Springer, 1741 Bever , ly Drive, was recognized and stated that he represented the construction workers as well as being" a resident for many years and that he was for growth. He said the people he represents are con- cerned with schools, planning, apartments, etc. and his "people" need jobs. John Taylor, 8345 Beverly'Drive, was recognized, stated Rohnert Park is a good place to live and that he wa s for controlled growth; that growth should not come too fast. He congratulated the Council on its performance and City Manager Callinan on his memo re Growth Management. He suggested the Council enforce a 600 unit limitation. V4 c Development Corporation, Padre Town Center and expressed the feeling that without growth, business will not come to Rohnert Park, that he is very proud to be associated with the City of Rohnert Park and its Council, that his firm could have chosen many other cities for its $8 million project, that Rohnert Park rolled out the carpet, other cities had sword in hand,;and suggested f9paced94 growth or any other name will taint future commercial development, Joe Rodriquez9''840 Lancewood Court, was recognized again and .stated that he was in favor of growth as long as the people get what they need and deserve° He stated that there had�been a problem in the past of poor service citing the response time of the police deeartasaert, fire department and problems with phone exchanges and postal service. Andrew Kovelly, 6410 Commerce Blvd., was recognized. He stated 'he has a business here in Rohnert Park and is for more commercial and industrial growth, and is very glad to be here. He stated he has been a resident of Rohnert Park 18 years and that he`is: very proud to live here and gave the Council his vote of confidence that they will do what is right and will resolve this crisis if it is really a crisis. City Manager Callinan was asked by Mayor Beary to read the communications received, if any, concerning the public hearing tonight. City Manager Callinan read a letter from Clarence Branscomb of North Bay Tractor, and Ralph Jones of 931 Eve Court and staled that h_� had re- ceived a call from Bob DeWan regarding his letter that was in the newspapers. There being no one else present wishing to be heard, Mayor Beary then declared the public hearing closed, the time being approximately 12 :20 a.m. Further discussion was held with Mr. Trowbridge and Mr. Cato taking part with the Council. Other Agenda Items Due to the lateness of the hour, the other items on the agenda were dispenced with. Wastewater Treatment City Manager Callinan referred the Council to his memo dated May 19, 1977 with reference to the wastewater situ- ation and asked that he be given permission to allocate some money towards the efforts to keep all treated waste- water out of the Russian River. Discussion was held. Upon motion by Councilman Roberts, seconded by Councilman Flores and unanimously approved, City Manager Callinan was given authorization to spend between $20,000 and $40,000 to pursue the irrigation projects with Poncia and Carinalli. City Manager Callinan reminded the Council of the meeting to be held Thursday, May 26th with the Regional Water Quality Control Board. Sonoma County Tax- City Manager Callinan also reminded the Council of the payers Association Sonoma County Tax Payers Association meeting on June 10th. Rohnert Park, CA 94928 views regarding the growth meeting. Please enter this time. May I take a moment to establish why I feel it necessary to enter an opinion regarding this issue. My wife,.and three children and I moved to Rohnert Park in 1963 which we resided in Rohnert Park for approximately four years, then moved back to Rohnert Park approximately three years ago. Three of our children have gone thru the school system to the point that my youngest has one more year remaining in high school. When moved to Rohnert Park it was the only city north of San Francisco where I could find a decent house to rent and I feel that t�.is is the reason most people have moved to Rohnert Park (to re.4F or buy). About one year after moving here I was fortunate to find local employment with Braden Realty located in Cotati, -ince that time I have continuiously had a vested `nterest in Roha -,rt Park and the nature of my business requires that I be informed of zoning laws taxation etc. Also by being a Realtor I see, to improve the rights of every individual to own their own ;ome. The presentation of any property that we would represent would be based on the existing zoning ordinance, current general I -lan, etc. I believe very strongly in a general p.an for all eler::;ents of property ownership, commercial, multiple and single family, residence. Prior to the adoption of a general plan numerous public hearings are held resulting in the adoption of a general plan. If any changes are to be made relative to the growth issue it should be done by ammending -the general plan rather than putting the item on a ballot. What was Braden Realty later became Century 21 Braden & Jones Realty now in our Cotati office which serves Rohnert Park anc. Cotati. We have approximately fourteen employees and independent agents working to meet the goals and working by the standarC as I have indicated above. One of our company's policy's for employees is that they live in the immediate area and it is hoped that the commercial and individual employers have a similar hiring procedure.
