1977/06/20 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES June 20, 1977 The Council of the City of Rohnert Park met this date in adjourned regular session commencing at 5:00 p.m. in the City Offices, 6750 Commerce, Blvd., Rohnert Park, with Mayor Beary presiding. Call to' Order 'Mayor Beary called the adjourned regular session to order at approximately 5:00 p.m. Roll cal]. Present: (5) Councilmen-Eck, Flores, Hopkins, Roberts and .: •. City Manager Callinan, at the Mayor's request, reviewed various aspects of the growth management plan contained in Resolution No. 77 -10, communications received from Fire - stone Construction Co., Qantas; Development Corporation and Summit,Building Co., and referred to a detailed listing of those units approved for the balance of 1977 displayed on the blackboard (a listing of same is attached to the original set of these minutes). Mr. Callinan explained that a Council decision was needed in order to determine whether or not the goals of the growth management plan would be based on a calendar or fiscal year. Page 2 June 20, 1977 City Attorney City Attorney Flitner arrived at this point in the meeting, Flitner.Arrives the time being approximately 5:20 p.m. Mr. Jimmie W. Rogers was recognized and informed that the McKellar project had fully developed lots and that it was anticipated the final engineering plans would be approved next week. Discussion followed concerning various :ways in which to administer the growth policy with its recent amendments. Mr. Art Condotti, Debra Homes, Inc., was recognized and queried the Council as to a previous commitment assuring Debra Homes and Crocker Homes of , It ° ur,1 L per year during construction of the new golf course. Discussion commenced concerning the City's commitment for single family development to various developers; equitabi- lity in distributing building permits over a fiscal year as opposed to a calendar year, and total number of units approved to date compared to the recent amendment to the growth policy providing for 650 units yearly. Mr. Jimmie Rogers was recognized and expressed opposition to having the so- called "construction year" start in July as well as limiting growth to 650 units yearly. Discussion followed between Council members and City Manager Callinan concerning conducting meetings with developers to determine the number of units for each construction year, figures displayed on the blackboard and whether or not the «naL.Lve maps approved to date should be included under the orignal growth plan,.at which date the amended growth Policy providing for 650 unite yearly should commence, i.e. January 1, 1978 or immediately, withholding further approval of tentative maps., and placing a specific condition on ten- tative reap approval which would relate to the implementation of the growth policy. Mrr. Mr. Jon Joslyn, Qantas Development Corporation, was.recog- nized and advised that the tentative map for subject sub - division had been submitted 3- 5`weeks ago. Discussion followed regarding establising guidelines for approving projects and various areas of the city in which development is` and /or will be taking place.' Mr.. Jimmia Rogers was recognized and indicated that if the Council would approve the projects as outlined by City Manager Gallivan, that_the developers would pledge to come up with-'a-plan whereby they could police themselves in the Com ng'yeays.. k Page 3 June 20, 1977 Mr. Art Condiotti was recognized and generally commented on the concept of growth control, processing of development plans and final constructions . marketing and financing factcrs involved in development, occupancy /vacancy factors. Councilman Flores made a motion, which was seconded by Council man Hopkins, to approval all projects as indicated in City Manager Callinan's outline* "Units Approved for Balance of .1977" totalling 684 for the remainder of the calendar year and commencing January istimplement the new growth policy. Discussion followed between the Council and members of the audience concerning speculation as to the number of building permits that would be alloted. Councilman Eck made a motion, which was seconded by Council- man Roberts, to amend Councilman's Flores motion by deleting 152 multiple family units listed under Qantas Development Corporation. Mr. Jon Joslyn was recognized and explained that the tenta- tive map and development plan had,been submitted to the Planning Commission based on the, City's original growth management policy. City Attorney Flitner commented on conditioning of tentative maps. Councilman Flores indicated that he would support Council- man Eck's amendment if he`would,agree to allowing Qantas 104 of the total 152 multiple family units. Councilman Eck withdrew his amendment to the original motion and made a motion to amend Councilman. Flores motion to allow 68 units for Qantas Development Corporation, but delete the 104 multiple family units from the units being approved for the balance of 1977. Councilmen Hopkins. Councilman Hopkins left the Council Chambers at approximately Leaves and; Returns 5:55 p.me And returned at approximately 5:57 p.m. Mr. Jon Joslyn, Mr. Robert O'Neel and City Attorney Flitner participated in a discussion which,followed concer4.ng legality of deleting a pending tentative map. Mr. Warren White was recognized and commented on Mr. Condiotti's remark concerning over- development of one parti- cular type of income property and possibility of over -sat- urating thG, market. Councilman Hopkins withdrew his second to Councilman Eck's motion. Councilman Roberts indicated he would second same. Councilman Eck's motion to amend the original motion was approved by the following roll call vote: AYES: (3) Councilmen'Eck, Flores and Roberts �� NOES: (2) Councilmen Hopkins and BearlT Mayor Beary requested that the record state that the public, as always, is going to be picking up the tab on this. It will be a financial burden on Qantas Development Corpora- tion but sooner or later the general public will pay. Councilman Flores' original motion, as amended, was unanimous- ly approved by a roll call votes Councilman Eck requested that the record reflect that it was questionable if Mayor Beary should have voted on the matter of Qantas Development because there was a possi- bility Young America Homes would be developing the lots of.Qantas Development Corporation and because Mayor Beary's Statement of Economic'Interests'indicated that he worked for Young America Homes he should not have voted. Councilman Flores commented on'the Council's action and its relationship to the best interests of the citizens of Rohnert Park. Mayor Beary responded'to Councilman Ecks' allegations informing that he had yet to do work for Qantas Development or Young-America Homes in-Rohnert 'ark because they did note•use stucco and/or very little dry wall. Discussion commenced concerning the relationship of separate legal entities. Mr. Jon Joslyn, Qantas Development Corporation, was recognized and asked if it would be possible to process a tentative map just.:short of assuring issuance of building permits. City Manage. - Callihan and City Attorney Flitner commented on the conditioning of a tentative map and issuance of building permits based on the approval of a final map. .Councilman Hopkins generally commented, to the firms present, on the concept of hiring individuals who resided within the community, i.e. Rohnert Park. Page 5 June 20, 1977 Mayors' and City Manager Callinan informed that the City would be Councilmen's Assoc. hosting the next Mayors' and Councilmen's Association Meeting meeting and requested the Council's authorization to host a "western style barbecue ". Upon motion of Councilman Flores, seconded by Mayor Beary, and unanimously approved, the City Council authorized the necessary expenditures in order to host a western style barbecue for the Mayors' and Councilmen's Associaton meeting hosted by Rohnert Park. Through the cooperation of your offices we have received our tentative and final map approval and are now in a position to start construction within a matter of days. Based upon the above approvals, we entered a contract to purchase said property and further contracted for the site plan, architecture, engineering and legal agencies for the expeditious completion of our project. Discounting our time invested in the project, our actual costs amount to several hundred thousand dollars. In light of this vested interest in both time and money, we are asking for an exemption from this ordinance or if this is unobtainable, our building permits to be considered a part of the first approved within the 650 limit. If there are any areas that I have not covered which would be of interest to you in making your decision, I would welcome the opportunity to appear before you. Some months ago, we submitted a request for 20 single - family units, and have since that time incorporated that allowance in a tentative map (Colegio Vista #4) which also includes 48 units of proposed multiple, all of which are two bedrooms or less. This proposal is scheduled for hearing before the Planning Commission on June 23. We have also submitted for review and approval another tentative map, Colegio Vista #5, consisting of about 100 units of multi- family, again all of which are two bedrooms or less. This is scheduled for the Planning Commission on July 14. Both projects represent a substantial investment in time and professional services, undertaken on the basis that the proposals qualified under the city programs in effect at the time. We are now in the position of having submitted maps for which we have not requested unit approval. Our intent is to construct this year, upon approval of the City. Will these proposals continue through normal processing? Are either of them in any danger of falling outside the new 650 unit total? If so, what are the criteria used in determining which applications proceed this year? Does the unit limitation apply to tentative map approvals, building permits, or some other point of action? My understanding is that several other developers share my uncertainties. Perhaps you would prefer to have a meeting'at which these and other questions could be answered once for the benefit of all. At this time, we woald like to apply for 70 building permits. We propose to take these permits out at the rate of 14 per month over the next 5 months in order to insure that our development will be continuous and gradual.
