1975/07/07 City Council MinutesROH14ERT PARK CITY COUNC --L MINUTFS July 7, 1975 The Council of the City of Rohnert Park met this date in adjourned regular session commenning at approximately 3:00 p.m. in the C::; t y offices, 6750 Commerce Boulevard, Rohnert Park with Mayo 'Hopkins presiding. Call to Order Mayor Hopkins called the meeting of the adjourned regular session to order at approximately 3:00 p.m. and led the pledge of allegiance. Roll Call Present: (3) Councilmen Beary, Flores and Hopkins Absent: (2) Councilmen Eck and Smith Staff present: City Manager Callinan, Asst. to the City Manager Albright, Director of Public Safety Dennett, Supt. of Public Works Wiggins, Finance Director Sheehan, City Engineer Brust. Others present: "Santa Rosa Press Democrat Reporter Mike McCoy and Mrs. Cantwell, 8520 Liman Way. Cotati Police Chief Thomas Gray appeared and discussed Co',--,-ti Dispatch Service the dispatch arrangements and possible ways to resolve the difference in positions between the two cities at the present time. He indicated that he would like to continue having Rohnert Park do dispatching for the Cotati Police Department if a suitable arrangement could be worked. He further indicated that he had been authorized by the Cotati City Counc4_1 to negotiate in this matter. Discussion followed with the Council members, City Manager Callinan and Director of Public Safety Dennett participating. Mayor H -)pkins stated for the record that from a law enforce - ment standpoint he would hate to see Cotati go somewhere else and for that reason he would be willing to compromise. Discussion continued with Chief Gray indicating that he felt that a increase in the rate to $1100 per month would be acceptable to Cotati with the understanding that Rohnert Park would do no typing or clerical work for the Cotati Police Department. Further discussion followed. Upon motion by Councilman Flores, seconded by Councilman Beary, and unanimously approved, Council went on record as willing to accept Cotati's proposal for payment of $1100 per month effective July 1, 1975 for dispatch service with the understanding that all clerical work being preforr- by the clerk dispatchers for Cotati by the Police Departmen would cease. Page 2 July 7, 1975 l:3i5 -76 Proposed A work session was co=.enced on the Proposed 1975 -76 Budget Budget. City Manager Callinan gave an o- °erview of the budget highlighting some of the contents thereof and the city's overall financial co-adition. City Manager Callinan provided the•Council with year -to- date budget versus expenses report for the 11 months of the prior fiscal year, that is through May 31, 1975. He also passed out a sheet which indicated some comments or.concerns that Councilman Smith had concerning the proposed budget and which he had telephoned into the city staff earlier in the day. A review was undertaken of the revenues and general government sections of the budget. Discussion was held on several items in the budget and detailed explanatio%a were given of those items requested by the Counc4_l. A review was undertaken of the Public Safety section of the proposed budget. The Council participated in a discussion and asked questions of City Manager Callina -a and Director of Public Safety Dennett concerning var ous items in the budget and various operating rules,.°regsa-- .Jtions and policies of the Department of Public Safety. Mayor Hopkins stated for the record that Councilman Beary was attending a Comprehensive Health Planning Association meeting. Approval of P.�inutes Councilman Smith asked that a correction be made of the minutes of June 30th under the subject "Appointments to Plann- ing Commission", page 6, paragraph 3, to read "Councilman Smith stated for the record that he had no personal dfferencc with Mr. Mullins but felt that Mr. William White would hdire made a fine contribution to the Planning Commission." Upon motion of Councilman Smith, seconded by Councilman Flores, and unanimously approved, the minutes of June 30, 1975 were approved as amended. Communications Communications per the attached outline were brought to the attention of the Council. No action was taken on any communication except as noted specifically in these minutes. Sonoma County Fair City Manager Callinan initiated a discussion concerning the Tickets - Rohnert letter from Mr. Lyttle, Sonoma County Fair Manager, Park Day Festivities regarding Rohnert Park Day festivities and the complimentary tickets that were enclosed. The Council indicated their suggestions as to distribution of the tickets. Mayor Hopkins commented on the fact teat Rohnert Park, combined with other Sonoma County cities, was designated only one day's recognition. It was his feeling that Rohnert Park should have greater recognition and not be restricted to one day. Discussion followed. Underground Utility City Manager Callinan, referring to his memo of July 2nd District No. 2 and various plans on display, explained that the proposed resolution would provide for the establishment of an underground utility district and direct the undergrounding to take place. Mr. Callinan stated that notice of the public hearing had been mailed to utility companies. Mayor. Hopkins declared open the scheduled public hearing on Underground Utility District No. 2 (on Southwest Blvd. and Burton Ave, adjacent to Rohnert Park Junior Nigh School). There being no person desiring to speak, Mayor Hopkins declared the public hearing closed. Resolution 75 -159 ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 2 City Manager Callinan explained the resolution. Upon motion of Councilman Flores, seconded by Councilman Smith, and unanimously approved, the reading of Resolution 75 -i59 was waived and said resolution was adopted. Project 1975W -4, City Manager Callinan explained the proposed improvement of Enterprise Blvd. Enterprise Boulevard and Hunter Drive. lie stated copies of and Hunter Drive the Engineer's Report had been presented to the Council members. Milt Hudis, Project Engineer, was present to answer questions from the Council. Taft the recent presentation of Resolution of Commendation for Mr. William H. Taft. She stated she was going to have the Resolution framed and displayed for everyone to see. Councilman'Smith made a motion, seconded by Councilman. Flores, and unanimously approved, that the City have the Resolution of Commendation for William H. Taft suitably framed and ..presented to Mrs. Taft. Sonoma County Mayors City Manager Callinan initiated a discussion regarding the and Councilmans° meeting of Sonoma County Mayors and Councilmans` Association Assoc. Resolution 75 -162 A RESOLUTION. OF INTENTION TO ACQUIRE AND CONSTRUCT IMPROVE - MENTS, ENTERPRISE DRIVE - HUNTER DRIVE, IMPROVEMENT PROJECT NO. 1975-4 City Manager Callinan explained the resolution. Upon motion of Councilman Smith, seconded by Councilman Flores, and I unanimously approved, the reading of Resolution 75 -162 was waived and said resolution was adopted. Resolution 75 -163 A RESOLUTION OF PRELIMINARY APPROVAL OF ENGINEER'S REPORT ENTERPRISE DRIVE HUNTER DRIVE, IMPROVEMENT PROJECT NO 1975-4 City Manager Callinan explained the resolution. Upon motion of Councilman Smith, seconded. by Councilman Flores, and unanimously approved, the reading of Resolution 75 -163 was waived and said resolution was adopted. Resolution 75 -164 A'RESOLUTION ESTABLISHING PREVAILING WAGE SCALE, ENTERPRISE DRIVE — HUNTER DRIVE'; IMPROVEMENT PROJECT NO. 1975 -4 City Manager Callinan explained the resolution. Upon motion of Councilman Smith, seconded by Councilman F1ox and unanimously Approved9 the reading of Resolution 75 -164 was waived and said resolution was adopted. AND THE RECORDATION OF NOTICE OF ASSESSMENT, ENTERPRISE DRIVE- HUNTER DRIVE, IMPROVEMENT PROJECT,NO. 1975-4 City Manager Callinan explained the resolution. Upon motion of Councilman Smith, seconded by Councilman Flores, and unanimously approved, the reading of Resolution 75 -168 was waived and said resolution was adopted. File 0426,,Proposed Amendment to Zoning Ordinance to Allow Schools as Conditional Uses in "CN " Districts City Manager Callinan, referring to his memo of July 2nd, explained the Petaluma High School District had requested an amendment to the Zoning Ordinance to allow schools as conditional uses in the Neighborhood Commercial Districts. This matter was considered by the Planning Commission and the Commission recommended against making the amendment to the Zoning Ordinance. Subsequently, the Petaluma High School'District withdrew its application. Mr. Callinan recommended that the Council proceed with the public hearing as scheduled and then formally deny the change in the Zoning Ordinance. Mr. Callinan stated notice of the public hearing had been published in local newspapers. Mayor Hopkins declared open the public hearing on File 0426, Proposed Amendment to Zoning Ordinance to Allow Schools as Conditional Uses in Y"CN" Districts. There being no person desiring to speak, and no correspondent received,,Mayor Hopkins declared the public hearing closed. Councilman Flores made a motion, seconded by Councilman Smith, and unanimously approved, to deny the Petaluma High School District application to amend the Zoning Ordinance to allow Schools as Conditional Uses in "CN" Districts. Page 5 July 7, 1975 File 0350, Proposed City Manager Callinan referred the Council to his memo of Change in Zoning July 2nd wherein he discusses the proposed change in the Ordinance to Change Zoning. Ordinance which would,allow commercial vehicles not Regulation Concern- exceeding.4...tons (8,000.1bs) gross unladen vehicle weight in Parking,of to park in,resident3al districts. Mr. Callinan presented to Park commercial Commercial Vehicles the Council several photos taken in Rohnert of in the vehicles parked in residential areas. He stated that past police officers had given courtesy notices only to owners of these vehicles.. He further stated that in the future the officers will issue only,one or two courtesy notices and then will issue a citation. Mr. Callinan read,.a memo from Director of Public Safety Robert Bennett, copies.of which had been disseminated to the Council members, wherein he indicates the unladen vehicle weights of various vehicles, i.e., passenger cars, half. -ton and three- quarter ton pickups, vans, etc. Mr. Callinan.stated that this matter had been considered by the Planning Commission and that their recommendation was that the proposed change be made in the Ordinance. Mr. Callinan stated that notice of the public hearing had been published in local newspapers. Mayor Hopkins declared open the scheduled public hearing on File 0350, proposed change in Zoning Ordinance to change regulation concerning parking of commercial vehicles in residential areas to increase, from 2 tons to 4 tons gross unladen...weight,.the size of trucks that may be parked in residential. areas. City Manager Callinan read.a petition dated July 7th from some,six teen residents stating,.their objections to amending the present Zoning Ordinances Mrs. Vida Jones, 8763 Laurelwood Dr.., spoke briefly asking that Large trucks be prohibited from parking in residential neighborhoods, as-stipulated in the present ordinance. She felt they were unsightly and unsafe. She asked the Council to deny the request for amending the ordinance. Mr. John Greener of Bridget Drive was recognized by the Council and stated that because he was handicapped he required his three - quarter van for transportation. Mr. Greener was apprised that special consideration had always been given in cases such as his. Mr. Jim Hall, 750 Barry Ct., was recognized and stated that he had two.commercial vans. He commented that he did not feel'-that they were unsightly or unsafe, and that they took up less space than,many campers. He asked for clarification nJith regard to tonnage vs. weight. Councilr responded that th,matte'r of interpreting the ordinance had been under study for some time and that the police department had been instructed to give only courtesy notices until the problem had been resolved, Mr. Art Huenergardt, 8764 Laurelwbbd Drive, asked for clarif ication': of the ordinance as' it now stands. City Manager Callinan complied with Mr. Huenergardt °s request. Mrs. Daniel Rishe, 8739 Laurelwood Drive, stated that she felt the decision had been made some time ago concerning commercial vehicles parking in residential areas- She stated her opposition to amending the present ordinance - Mr. Allen spoke briefly regarding tonnage limitations. There being no other person desiring to speak, and no other corre'spondence'received,-Mayor Hopkins declared the public hearing closed. Discussion followed with the Council and City Manager Mayor Hopkins commented that he had had several residents indicate to'him that they had received a "citation when actually they,toad received a courtesy notice. Mr,'Hopkins felt this should be clarified. Mayor Hopkins suggested that a sticker .be placed on vehicles opera- ted by handicapped persons, to identify them for the police department. Councilman Flores made a motion to'deny File No. 0350, proposed change in Zoning Ordinance to change regulation concerning parking of commercial vehicles in residential areas to increase, from 2 tons to 4 tons gross unladen weight, the size of trucks that may be parked in residential areas. Councilman Smith made a motion to amend Councilman Flores' motion to include•a provision that would exempt vehicles used by handicapped persons. Councilman. Flores agreed to the amendment of his motion, Councilman. Smith seconded Councilman Flores° "motion, and the motion as amended was approved by the following foll call vote. AYES. (3) Councilmen Flores, Smith and Hopkins NOES. (0) None AH ENT> (2) Councilmen Beary. and Eck Mayor Ho p kins'Cimmented that he didn't feel that the 4 ton limitation was unreasonable but voted yes on the motion anyway. Spivock Land City Manager Callinan informed the Council that there had been no new recent development in the acquisition of the Spivock land for open space. Page 7 July 7, 1975 Naval Operation Gity,Manager Callinan, referring.to his memo of July 2nd, informed the Council of a. motorboat which is operating in the second pond at the sewer >pl;ant:to provide aeration into that body of water. Expressway West City.Manager Callihan reviewed with the Council his letter to.Supervisor:Kortum, copies of'which had been provided to them, concerning acquisition of right of way for extension of Expressway west. Irrigation of open City Manager Callihan advised the Council that the irrigation Space on Country system was being ordered and would soon be installed on the Club Drive open space area at Country Club Drive and future extension of Golf Course Drive. Public Liability Mayor Hopkins initiated a discussion concerning the recent Cancellation cancellation of the City's public liability coverage. Upon motion of Mayor Hopkins, seconded by Councilman Smith, and unanimously approved, staff was authorized to direct letters, over the Mayor's signature, to appropriate legislative representatives and the Insurance Commissioner informing them of the recent mid -term cancellation of the City's liability insurance by Imperial Insurance Company. City Attorney Flitner suggested that it be pointed out in said letters that the policy was cancelled in the middle of the term, rather than on the anniversary date, which is an unusual action. Filing of Conflict City Attorney Flitner advised the Council that he was in of Interest the process of looking into the number of times required for filing of Conflict of Interest forms. Ex officio Assignment It was the consensus of the Council that this matter be Changes considered when all councilmen were present. Golden Gate Transit Councilman Smith initiated a discussion concerning the Fare Increases recent increases in fares for Golden Gate Transit. Mr. Smith indicated a public hearing would be held in Petaluma Wednesday, July 9th regarding same. Upon motion of Councilman Smith, seconded by Councilman Flores, and unanimously approved, Council went on record as opposing the fare increases imposed by Golden Gate Transit, and requested the Bridge District to conduct extensive public hearings in the effected communities prior to any fare increases. Page a july 7, 1975 Landscaping of Bike Councilman Flores queried staff regarding the landscaping Path North of planned for the bike path north of Expressway. City Expressway Engineer Brust advised Mr. Flores that a map showing the planned landscaping was in his office for viewing.
