Mr. Callinan replied in the affirmative. Non- Agenda Item City Manager Callinan requested that the Council consider at the appropriate time on the agenda a proposed resolution concerning.sale of property by.the County Tax Collector. October 14, 1975 The Council of the City of Rohnert :Park met this date in regular session commencing at 7:00 p.m. in the City Offices, 6750 Commerce' Boulevard, Rohnert Park, with Mayor Hopkins presiding. Call to Order Mayor Hopkins called the meeting of the regular session to order at' approximately 7:00 p.m. and led the pledge of allegiance. Roll Call present: (5) Councilmen Beary, Eck, Flores, Smith and Hopkins Absent: (0) None Staff present for'all or part of the meeting: City Manager. Callinan, City Attorney Flitner, City Engineer Brust and Parks and Recreation Director Pekkain Approval of Upon motion of Councilman Beary, seconded by Councilman Eck, Minutes and unanimously.approved, the minutes of September '22 and September 25 were approved as submitted. Approval of Bills Upon motion of Councilman Smith, seconded by Councilman Eck, and unanimously approved, the bills presented per the attached list in the amount of $470,110.73 were approved. This amount includes $322.77 for the Ciyic Commission. Communications Communications per the attached outline were brought to the attention of the Council. No action was taken on any . communications except as noted specifically in these minutes. Associated Building . Councilman Eck initiated brief discussion asking if staff Industry Re 'a intended to follow up on the suggestions contained in Sewage System the letter from Associated Building Industry, i.e., that the City schedule meetings with the Water Quality Control Board for projected growth and subsequent sewer usage. City Manager Callinan felt that it was somewhat premature at this time to return to the Board for additional capacity, since the Board just lifted its cease and desist order. He felt we should continue to monitor the treatment plant for a period of time in order to make sure tests continue to show good results. Page 2 October 14, 1975 Resolution 75 -217 A RESOLUTION ACCEPTING COMPLETION AND DIRECTING CITY ENGINEER TO FILE NOTICE OF COMPLETION, FLASHING BEACONS - ROHNERT PARK EXPRESSWAY COUNTRY CLUB DRIVE City Manager Callinan explained the resolution. Upon motion of Councilman Smith, seconded by Councilman Beary, and unanimously approved,zthe °reading of Resolution 75 -217 was waived, and-said. resolution was adopted. Mayor Hopkins asked about the brightness of the flashing beacons at this intersection. City Engineer Brust explained that staff could place smaller bulbs in the beacons, but time and dust will make the lights dimmer. Councilman Flores opined that'..bright lights were desirable. Upon motion of Councilman Beary, seconded by Councilman Eck, any approved by the following roll call vote, Council approved the consideration of a non - agenda item concerning sale of property by the County Tax Collector as a proposed resolution. Pedestrian Safety Mr. Lennon representing the American Automobile Association, Citation addressed the Council commending the City of Rohnert Park and Chief Dennett for a record of si=p years without a traffic fatality. Mr. Lennon presented to Mayor Hopkins and the City .•a Pedestrian Safety Citation for 1974 Mavor Hopkins thanked Mr. Lennon for the citation. 1 Project No. 1975 -10, City Manager Callinan referred the Council to his memo of Adrian Drive and October 10th, and to bid summaries presented to them. Burton Ave. 'Mr. Callinan pointed out that low bidder on this nro;ect waG Overlay W. R. Forde Construction Company at $22,209. Councilman Eck initiated a discussion asking if award of contract must always go to the low bidder. City Attorney Flitner replied in the affirmative, stating? that only where the bidder could not post the required bond, or similar failure to .perform, could an exception be made. Resolution 75 -216 A RESOLUTION OF AWARD OF CONTRACT, ADRIAN DRIVE AND BURTON AVE. OVERLAY, PROJECT NO. 1975 -10 City Manager Callinan explained the•resolution. Upon .motion of Councilman Beary, seconded by Councilman Smith, and unanimously approved, the reading of Resolution 75y -216 was waived, and said resolution was adopted. Upon motion of Councilman Eck, seconded by Councilman Beary, and unanimously approved, the reading of Resolution 75 -218 was waived and said resolution was adopted. Resolution 75 -219 A RESOLUTION ACCEPTING COMPLETION AND DIRECTING ENGINEER TO FILE NOTICE OF COMPLETION, PARKING LOTS IN ALICIA PARK, PROJECT NO. 1975 -6 City Manager Callinan explained the resolution. Upon motion of Councilman Beary, seconded by Councilman Eck, and unanimously approved, the reading of Resolution 75 -219 was waived and said resolution was adopted. Resolution 75 -220 A RESOLUTION ACCEPTING COMPLETION AND DIRECTING ENGINEER TO FILE NOTICE OF COMPLETION, SOUTHWEST BLVD. WIDENING, PROJECT 1975 -12 City 'Manager 'Callinan explained the resolution. Upon motion of Councilman Bearyli seconded by Councilman Smith, and unanimously approved, the reading of Resolution 75 --220 was waived and said resolution was adopted. Resolution 75 --221 RESOLUTION DESIGNATING, AUTHORIZING AND APPROVING INSTALLATION OF STOP SIGNS City Manager Callinan explained the resolution. Resolution 75 -222- Mayor Hopkins Leaves the Chamber Upon motion of Councilman Smith, seconded by Councilman Eck, and unanimously approved, the reading of Resolution 75 -221 was waived and said resolution was adopted. A RESOLUTION OBJECTING TO SALE OF PROPERTY BY COUNTY TAX COLLECTOR UNDER SEALED BID PROCEDURE AND RESOLVING TO ENTER INTO PURCHASE AGREEMENT City Manager Callinan explained the resolution and advised that the County Tax Collector was calling for bids on a 20' by 7389 section of land from Mrytle Ave. to Ladybug Park. Mr. Callinan stated that this section of land contains a 'drainage channel and creek adjacent to Rohnert Park homeowners, and feels that it would be beneficial to the City to acquire this property. At' this poitt in the meeting Mayor Hopkins left the Chamber, the time being approximately 7 :17 p.m. Discussion followed with the Council and City Manager Callinan discussing the merits of acquiring the property offered for bid by the Tax Collector. Amendment of Noise City Manager Callinan reviewed the Council's recent directive Ordinance to amend the existing noise ordinance whereby all noise and outcry by vendors would be prohibited. Ordinance 299 AN ORDINANCE OF THE CITY OF ROHNERT.PARK REPEALING ORDINANCE NO. 297 AND AMENDING ORDINANCE NO. 152 (HAWKERS AND PEDDLERS) City Manager Callinan explained the ordinance. Upon motion of Councilman Eck, seconded by Councilman Beary, and unanimously approved, the reading of Ordinance 299 was waived and said ordinance was introduced. Recreation- City Manager Callinan informed the Co uncil that notice of Cultural Complex the scheduled public hearing had been sent to the local newspaDers and various organizations, throucrhou+ tho rnMm,-n,+- Mr. Callinan stated that he had visited the government classes of Mr. Kite at Rancho Cotate High School with draw- ings and made a presentation to the students. Mayor Hopkins declared open the scheduled public hearing on the proposed development.of a-Recreation Cultural Complex. Discussion followed with the Council and Mr. Callinan participating. It was,felt by all concerned that the turn-out was very small for public input on this large project Mrs..Alice Wells, President, Cultural Arts Corporation, suggested that another presentation be made to Mr. Kite's government classes requesting the students to talk with their parents about the proposed project, and then another public hearing be scheduled. There being no other person wishing to speak, Mayor Hopkins declared the public hearing closed. Councilman Smith made a motion that staff place a conspicuous ad in the local newspaper informing the public as to when the next public hearing on the Recreation-Cultural Complex project would be held. This would, In effect, place the Council on record as making a great effort to inform and invite the public to attend said public hearing. Councilman Eck seconded Councilman Smith's motion and the motion was approved ur1an1L111Q--U-S­- Page 5 October 145 1975 City Manager Callinan gave a staff report on the proposed exchange of the,Martin Stone property,.on Snyder Lane, for City owned property at the Civic Center site. Mr. Callinan advised the Council that he, Councilman Beary, Jimmie Rogers and Planning Commissioner Goff had met with Mr. Stone regarding this exchange of property for the proposed Recreat?oz. Cultural Complex. Mr. Stone was receptive but would like an ,. evaluation placed on the two properties, primarily for tax purposes, and indicated he might want the City to pick up the bonds on his property. Mr. Callinan stated that after the appraisal there will be further meetings with Mr. Stone concerning this project and the desired property exchange. Councilman Beary initiated a discussion asking if the exchange of properties would necessitate a change in the General Plan. Mr. Callinan replied in the affirmative. Discussion continued. with,the Council quering Mr. Callinan and City Attorney Flitner as to whether the acquisition of the Spivock Land and the exchange of the Stone property could be construed as one change to the General Plan this year in order to retain the maximum three changes for the next year. it was felt that this could be done. Upon,motion of Councilman Beary, seconded by Councilman Flores,, and approved by.'the following, roll call vote, Council approved combining several proposed changes to constitute one amendment to the General Plan before the end of this year; thereby retaining three amendments for the following year. . "AYES: (5) Councilmen Beary, Eck, Flores, Smith and Hopkins NOES: (0) None City Manager Callinan referred the Councilmembers to his memo of October 14th which sets forth various methods of financing municipal building projects. Discussion followed with the Council comparing the different methods of possibly financing the Recreation Cultural Complex and the dollar amounts involved. Councilman Beary made a motion to place the issue of whether the City should or should not build the Community Center of the Complex on the March.baliot.' Discussion followed. Councilman Beary withdrew his motion. Parks and Recreation'Director pekkain was present and recognized and stated the Parks and.,,Recreation Commission had reviewed the proposed.plans and concept,of the proposed Recreation- Cultural'Complex and were very supportative of the project. Mrs. Alice Wells advised'the'Council that the Cultural Arts. Corporation had taken a very positive and approving position regarding the,', proposed:Recreation- Cultural Complex Page 6 October 14, 1975 P. G. 6 E. City Manager Callinan informed the Council that Mr. Ralph Offsetting 'Fitch had advised him of forthcoming increases in electric and sd1V 1'CCxJC gaol Pates CJ tom, resiaential and commercial accounts in Rohnert Park .Mr.. Callinan further stated that Rohnert Park now qualifies fora lower rate structure, hence, the increases will be offset and should not be reflected in future bills. The matter was continued to a later meeting to give the Council time to study the various ways'to finance the complex. The Council indicated that another hearing will be held. Wells No -l-and City Engineer Brust gave a staff report on recent problems No. 2 at Wells No. 1 and.2, advising the Council that both wells had been breaking suction causing the well capacity to be lowered. Mr. Brust also stated that a bearing on the pump shaft had required some works Well No. 1 is expected to be producing at normal capacity.within a, few weeks, at which time work will commence on Well No. 2, Mr. Brust indicated that ,it is best to work on one well at ,a time. Councilman Eck queried Mr. Brust as to whether a lowered water table, might.be.the cause of the problems with the wells. Mr. Brust did not believe this was the reason. Councilman Beary asked when the City would go to bid on drilling the next .well. Staff replied within the next two months. Council,was apprised that-the time line from bid to completed well was three to four months. League of.California. Councilmembers indicated they would be attending. City Manager's City Manager Callinan gave a brief report on his recent Conference attendance at the ICMA conference in Seattle. Mr. Callinan advised the Council that Rohnert'Park was fortunate to have most municipal services under City jurisdiction and excellent cooperation with the school districts. Many cities do not enjoy these advantages and consequently experience quite a few problems. Spivock Land for City Manager Callinan gave a.brief update on acquisition of Open Space the Spivock land for open space indicating that the matter should,be up for consideration very shortly by the Sonoma County.Board of Supervisors. Councilman Eck initiated a brief discussion asking for clarification concerning some vague rumor with regard to a "deal" whereby the City, would drop its lawsuit against Santa Rosa and Santa Rosa would follow: through on their commitment for purchase of the Spivock land. Councilmembers and City Manager Callinan stated they had no discussions with Santa Rosa along these lines. P. G. 6 E. Page 7 October 14, 1975 Dedication of Bike City Manager Callihan suggested that recent improvements Paths and Other to the City such as the bike paths, turfing of A Park, Improvements widening of streets, etc., be dedicated. Mr. Callihan suggested October 16th or 17th for the dedication of these improvements. The Council concurred. Location of East Cotati Avenue Information to Prospective Home Buyers on Schools City,�Attorney Flitner informed the Council that he had talked with the Cotati City Attorney concerning the relocation of East Cotati Avenue, and maintenance thereof. It was felt by Mr. Flitner and Mr. Callihan that both cities should recognize the existing right -of -way line; that Cotati could maintain the property if they so desire, but a boundary line cannot legally be moved. Mr. Callihan stated he had no objection to what Cotati is requesting, in concept, but he did feel that Rohnert Park landowners in that area should be protected. Mr. Flitner will follow up on the boundary line clarification and advise the Council. City Attorney Flitner reviewed with the Council his memo of October 14, 1975 to Councilman David Eck, copies of which had been provided to councilmembers, wherein he discusses the requiring of real estate offices to give prospective buyers information concerning the school situation in Rohnert Park, and asking them to sign indicating they had received this information. Mr. Flitner opined that the City and the Council would, in effect, be regulating businesses. He felt this type of regulation or ordinance could not be enforced. Mr. Flitner suggested that real estate businesses might be willing to go along on a voluntary basis. Discussion follwed with the Council and City Attorney Flitner participating. Upon motion of Councilman Smith, seconded by Councilman Beary� and unanimously approved, Council requested that this matter be referred back to the School Board to try and work out an agreement between buyers and sellers to accomplish the objective of disseminating current school information. Sweeping of Councilman Eck initiated a discussion regarding the sweeping Bike Paths and cleaning of bike paths. Mr. Callihan stated that the City contracted with a private concern to sweep all bike paths once a week. Mr. Eck also expressed some concern about cars parking over the.bike paths at the High School. It was suggested that Mr. Eck bring up this subject with the City- Schools Coordinating Committee. Mr. Eck stated he would do so. Scout Hut Councilman Beary asked about the progress on the Scout Hut. Mr. Callihan stated staff expects the plans from the architect to be in this week. Staff was hopeful that the foundation for the Scout Hut could be poured this week, also. Page 8 October 14, 1975 Young America Councilman Smith initiated a` discussion stating that the Quadraplex Young America quadraplex development south of Southwest Development Boulevard had allowed a very limited parking area. Mr. Smith stated it was very difficult to maneuver a normal size car in and out of the parking area.'.Mr. Smith requested that City Engineer Brust look at the.•driveway and parking area, . as he.would like to have his comments. Mr. Brust said he -would -look into, 'the matter. ; Crossing Guards .Councilman Flores referred.to the letter from School at.Lancaster and Superintendent Davidson concerning_ crossing guards wherein Lords Manor Way Mr. Davidson cites sections of the state law which appears to indicate that it is a.City'responsibility rather than school responsibility to provide -adult crossing guards. Mr. Flores cited many school districts which provide school crossing guards, and felt that 6th graders were responsible for this type of duty. Mr. Flores suggested that members of the Public Safety Department conduct some training :sessions for training 6th graders as- ' crossing guards. Discussion followed with the general feeling of the Council being.that the School Board should assume more responsibility in these matters and not call upon the City so frequently -in. solving these problems, Zt,w.as: also pointed out that .City staff will be installing stop signs at this intersection. Upon motion of Councilman Flores, seconded by Councilman Beary, and unanimously approved, Council.directed that a letter be sent to the Rohnert Park - Cotati School Board, over the signature of the Mayor, stating that the City of Rohnert Park will assist the professional staff at LaFiesta School to set up a school crossing guard program. Upon motion of Councilman;Flores, seconded by Councilman Beary, and unanimously approved, Councilman Eck was requested to represent the Council at the City - School Coordinating 'Committee in advising said Committee that in the opinion of the Council and City staff adult: - crossing guards are not needed at the intersection of Lancaster Drive and Lords Manor Why. SB l Mayor Hopkins initiated a discussion concerning SB 1, Open Meeting Laws Amended, which included an amendment precluding the holding of executive sessions to appoint or dismiss_ an officer. Mayor Hopkins queried City Attorney Flitner as to whether this would eliminate executive sessions insofar as the City was c.ancerned, and if hiring and firing would . have to be done in public session. Mr. Flitner stated he had written for a copy of the bill in question and that he would review same and return to the Council with clarification of the bill. Adjournment There being no further business., Mayor Hopkins adjourned the meeting at approximately 8:30 p.m. APPROVED; Deputy City Clerk 9 Mavor RD TPE.U�TNKJNF: 795-64.16 NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN that the City Council of the City of Rohnert Park will on Tuesday, the 14th day of October, 1975, at the hour of 7:00 p.m. (or as soon thereafter as the matter is reached during the Council meeting) in the City Council Chambers, 6750 Commerce Boulevard, Rohnert Park, hold a public hearing to consider the review of the master plans for the recreation- cultural complex. The total complex is a four - phased project which is not anticipated to be completed until the ultimate city's population of 35,000- 45,000 people is reached. The first phase of the complex planned for development is a community center. The community center would consist of a 20,000 sq. ft. building housing activities for the pre- schoolers, teens, senior citizens and providing a large multi -use room for community functions such as dances, receptions, and the like. The other three phases consist of a theater-arts facility, gymnasium, and indoor and outdoor swimming pool. The proposed complex will be located on the southwest corner of Rohnert Park Expressway and Snyder Lane, consisting of approximately 14 acres (1), immediately north of Copeland Creek. Individuals interested may view the complex plans located in the Rohnert Park City Offices. All persons interested should appear at the meeting.
