June 28, 1976
The Council of the City of Rohnert Park met this
date in regular session commencing at 8:00 p.m. in the
City Offices, 6750 Commerce Boulevard, Rohnert Park,
with Mayor Flores presiding.
Call to Order Mayor Flores called the meeting of the regular session
to order at approximately 8:00 p.m. and led the pledge
of allegiance.
Roll Call Present: ("4) Councilmen Beary, Hopkins, Roberts and'
Flores
Absent: (1) Councilman Eck, Mayor Flores stated
Councilman Eck was out of town.
Staff present for all or part of the.meeting:
City Manager Callinan and City Attorney Flitner.
Approval of Minutes Upon motion of Councilman Beary, seconded by Councilman
Hopkins, and unanimously approved, the minutes of June
14, 1976 were approved as submitted.
Approval of Bills Upon motion of Councilman Hopkins, seconded by Councilman
Roberts, and unanimously approved, the bills presented
per the attached list in the amount of $693,398.30 were
approved.
Communications Communications per the attached'outline were brought
to the attention of the Council. No action was taken
on any communications except as noted specifically in
these minutes.
Letter from Wayne Councilman Roberts stated he had handed City Manager
Pixley Concerning Callinan a letter from Wayne R. Pixley which he would

Rancho Cotate Councilman Roberts initiated a discussion concerning
High School the letter from Governor Brownts office advising that
Marching Band the'Rancho Cotate High School Marching Band has been
selected to represent the State of California at the
inaugural events in Washington, D. C.; noted that this
was quite an achievement and asked the news media to
publicize. Mayor Flores requested that a letter of
endorsement and encouragement be forwarded to the Rancho
Cotate High School Marching Band.

Letter from Chubb/
Councilman Hopkins initiated a discussion concerning
Pacific Indemnity
a letter from Chubb /Pacific Indemnity Group regarding
Group Concerning
the Brazil /City of Rohnert Park lawsuit; queried City
Lawsuit
Attorney Flitner as to whether there was any danger
that the City might not be adequately covered. Mr.
Flitner responded that a legal technicality risk was
always present in any lawsuit, but felt.the City had
adequate coverage in the Brazil matter.
Letter of
Mayor Flores asked City Manager Callinan to read a

Relocation of
Mayor Flores initiated a discussion concerning a letter

way; stated he would set up a meeting with representatives
from the City of Cotati and the State Department of
Transportation regarding this matter.
Unscheduled Public
Mr. Frank, Collins, Activities Coordinator for the,
Appearances
Rancho Cotate High School Music Committee spoke of
the honor accorded the Rancho Cotate Marching Band
in being selected to represent the State of California
at the inaugural events in Washington, D.C.; felt the
City should be very.proud of the band and requested
the City and the Council give full support to the band;
suggested the City consider issuing booster buttons
to residents showing its support.
Mayor Flores thanked Mr. Collins for his comments and
assured him of the Council's backing and support of
the Rancho Cotate High School Band.
Lilac Tot Lot
Mrs. Kitty Collins, 828 Lilac Way, was recognized and
expressed displeasure with the Parks and Recreation
Commission, stating she had requested that the subject .
of improvements to the Lilac Tot Lot be considered
at its last meeting, and the Commission had not done
so. Mrs. Collins read a petition signed by residents
in her area concerning improving the Lilac Tot Lot,
said petition being attached to the original copy of
these minutes.
Discussion followed. Mayor Flores stated an inspection
of the Tot Lot would be 'made by councilmembers and
recommendations presented at the next meeting concerning
same; and thanked Mrs. Co1lins for her interest in
the community.

Car Washes During Mrs. Barbara Rowan, 7406 Adrian Drive, was recognized
Hot Spells and expressed: concern with the fund raising car washes
that had been donducted recently during the extreme
heat in the City; indicated it was difficult to teach
water conservation to her children when teens were
running hoses washing cars at local service stations.
Discussion followed concerning the amount of water
used in washing cars; whether this source of revenue
should be eliminated for fund raising during hot spells,
etc. The consensus of the Council was that during
extreme hot spells in the City groups would be requested
not to conduct car washes. The Council thanked Mrs.
Rowan for her interest in conserving water in the community.
Unification of Mr. Maurice Fredericks, a member of the Board of Trustees,
Cotati - Rohnert Park Cotati- Rohnert Park School District, was recognized
School District and made"a presentation regarding school district unifi-
cation; indicated there would be a meeting with Wilson
Riles, State Superintendent of Public Education and
the State Board of Education on July 8th; invited the
councilmembers to attend, if possible.
A discussion ensued concerning the cost of financing
unification of the Cotati- Rohnert Park School District.
It was generally felt that unification would be desirable,
but the cost of same should be carefully considered.
The Council thanked Mr. Fredericks for his presentation.
Councilman Hopkins made a motion, seconded by Councilman
Roberts, and unanimously approved, designating Councilman
Beary as the Council representative on school unification
at the July 8th hearing.
Certificates Mayor Flores made a presentation of a Certificate of
of Appreciation Appreciation to the Boy Scout Troop No. 352 for circulating
notices in the 11L" neighborhood notifying of a City
Council meeting in that section.
Mayor Flores presented Certificates of Appreciation
to the following public safety personnel for their
outstanding service during the recent pipeline explosion
in Cotati: Jerry R. Bick, Robert Williams, David C.
Cal.lagher,.Delane E. Patton, James C. Park, and
Robert E. Dennett.
Chief Dennett thanked the Council on behalf of all
the public safety personnel
Mechanical Play City Manager Callinan indicated that, at the Council's
Devices direction, a 20 minute time period had been scheduled
at this meeting, for Mr. Chumley, Mr. Swiss Restaurant,
to request a change in the zoning ordinance to allow
mechanical play devices in his business establishment,
and present support for same.

Mayor Flores declared open the scheduled public hearing
concerning amending prohibition against mechanical
play devices,
Mr. Chumley.was not in the chamber, Mr. Callinan read
a letter from Rev. Holm of Crown Lutheran Church opposing
amending the existing ordinance to allow mechanical
;.splay devices in the community; indicated he had received
a call from Mrs. Kathy Logue, a former owner of Mr.
Swiss restaurant, supporting an amendment of the
existing ordinance to allow the devices,
Mr. Callinan referred the Council'to his memo dated:
June 25th, and comments made therein; to City Attorney
Flitner'.s memo dated June`14th with two draft ordinances
attached establishing the'use of mechanical play devices
in C -Rec zoning only, subject to a use permit.
Mr, Bryce Sudernow, 8010 Petaluma Hill Rd., was recognized
and spoke in favor of permitting mechanical play devices
in the community; did not feel they would present a
problem.:
Mrs. Alice Wells, 5249 Callecita Ct., was recognized
and opposed a change in the existing ordinance to
allow mechanical play devices in the community.
There being no other person desiring to speak, Mayor
Flores declared the public hearing closed.
Discussion followed with the councilmembers, Mr. Callinan
and Mr. Flitner participating. Mr. Callinan directed
the Council's attention to the agreement with Jim Decker
'concerning his b-)wling alley, and suggested the zoning
ordinance be amended to allow mechanical play devices
in C -Rec zoning only, subject to a use permit, proceeding
through the proper channels via the Planning Commission
for public hearing, etc.-
Councilman Beary made a motion; seconded by Councilman
Hopkins, and approved by the following voice vote,
to refer the proposed ordinace drawn by City Attorney
Flitner, permitting mechanical play devices in C -Rec
zoning only, subject to a use permit, to the Planning
Commission for public hearing and 'a recommendation to
the Council.

Resolution 76-101 RESOLUTION ACCEPTING SUBDIVISION IMPROVEMENTS AND
AUTHORIZING RELEASE OF BONDS (DeerMeadow Village,
Unit No. 1)
City Manager Callinan reviewed the resolution and his
memo to the Council dated June 25th concerning same.
Upon motion of Councilman Hopkins, seconded by Councilman
Beary,'and unanimously approved,'the reading of Resolution
76-101 . was waived and said resolution was adopted.
Resolution 76-102 RESOLUTION AUTHORIZING PAYMENT FOR IMPROVEMENT OF
SANTA ALICIA DRIVE
City Manager Callinan reviewed the resolution and his
memo to the Council dated June 25th concerning same,
advising that the referral on the agenda to Qantas
Development Corporation was in error.,
Upon motion of Councilman Beary, seconded by Councilman
Hopkins, and unanimously approved, the reading of
Resolution 76-102 was waived and said resolution was
adopted.
Resolution 76-103 A RESOLUTION OF AWARD OF CONTRACT, WELL NO. 13, PROJECT
1976-11
City Manager Callinan reviewed the resolution and his
memo to the Council dated June 25th concerning same.
Upon motion of Councilman Beary, seconded by Councilman
Roberts, and unanimously approved, the reading of
Resolution 76-103 was waived and said resolution was
adopted.
Resolution 76-104 RESOLUTION ENDORSING STUDY OF FEASIBILITY OF LIABILITY
SELF-INSURANCE

memo to the Council dated June 25th concerning

Resolution 76-105 RESOLUTION AUTHORIZING FILING OF GRANT APPLICATION
FOR DEMONSTRATION PROJECT GRANT FOR BICYCLE PATHS
City Manager Callinan reviewed the resolution and his
memo to the Council dated June 25th concerning same.
Upop,motion of Councilman Roberts, I seconded by Councilman
Hopkins, and unanimously approvpd, the reading of
Resolution 76-105 was waived and said resolution was
adopted.

Agreement with City Manager Callinan requested that the matter of
County of approving an agreement with the County of Sonoma for
Sonoma Services of Fiscal Agent on Improvement Bond Issuance
be deferred until the next meeting, at the request
of the County Treasurer's office. The Council agreed.
File 0476, City Manager Callinan explained the application of
Cofego Enterprises Cofego Enterprises for rezoning of 5.31 acres on the
..ea.st.side of Commerce Boulevard between Hunter Drive
and.Enterprise Drive from PA -PD to CR -PD; stated notice
of the public hearing had been published in the local
newspapers and mailed to surrounding property owners;
further'stated Mr. Codding had phoned and was unable
to appear because of a prior commitment.
Councilman Beary stated he would abstain from discussion
and voting on this matter because of a possible conflict
of interest.
City Manager Callinan stated for the record that he
was a member of the Board of Directors for the Rohnert
Park Savings and Loan Association, which owned a portion
of the property involved. :Councilman Roberts stated
he was a member of the Board of Directors for the Rohnert
Park Savings and Loan Assoication and queried City
Attorney Flitner as to whether he should abstain from
voting on this matter. Mr. Flitner stated that if
the conflict of interest was determined to be remote,
and in consideration of .the "rule of necessity" of
conducting Council business, it would appear that Councilman
Roberts could discuss and vote on this matter.
Mayor Flores declared open the public hearing on File
0476, Cofego Enterprises application for rezoning 5.31
acres on the east side of Commerce Boulevard between
Hunter Drive and Enterprise Drive from PA -PD to CR -PD.
There being no person desiring to speak, Mayor Flores
declared the public hearing closed.
Ordinance 314 AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING
TITLE 17 OF THE ROHNERT PARK MUNICIPAL CODE (Zoning .
Map Change - A. P. No. 143- 050 -54
City Manager Callinan explained the ordinance.
Upon motion of Councilman Hopkins, seconded by Mayor
Flores, and approved by the following voice vote,
the reading of Ordinance 314 was waived. and said ordinance
was introduced.

Site Plan for City Manager Callinan.referred to the displayed site

memo dated June 23rd, reading the proposed changes
to the plan as outlined therein.
Discussion followed regarding a swimming pool in the
northern area. Commissioners Helgren and Hofmann were
present and answered questions from the Council concerning
said proposed swimming pool. ;Councilman Roberts suggested
that developers, using heavy duty equipment at hand,
prepare the proposed.park areas by leveling and grading
the land which would leave only the landscaping and
sprinkling work to be completed by the City; felt this
could be done at the time the subdivisions are being
developed and a credit allocated to the developer for
this extra work.

Transport Avenue
City Manager,Callinan. explained the proposed alignment

of Transport,Avenue between Rohnert Park Expressway
and Hinebaugh Creek, referring to a map on display.
Discussion followed with the feeling of the Council
being that owners of the properties north of Hinebaugh
Creek adjacent to the road be advised of the change
in the configuration of same. Mr. Callinan stated
he would do so.
Mr. Jim Luger,, representing RCW Development Company,
was recognized and stated that with the road currently
curving to,the right,,a small triangle of Codding
land bisects the RCW property; stated it would be to
the benefit of both parties for the road to be aligned
at a straight angle as suggested by City staff.
Lovmark
City tanager Callinan discussed City Engineerts Brust's
Building
memo dated June 28th,concerning items to be completed
at the site.of the Lovmark Building on South Santa
Rosa Avenue; and solicited comments from the Council
concerning its previous expression that it wanted to
personally approve occupancye
The Council indicated i:t.would individually inspect
the structure and aesthetics of the Lovmark property
and return at the next meeting with recommendations
thereto.
ASA Girls
City Manager Callinan reviewed the request of the Parks
Softball League
and Recreation Commission to allocate funds for the
purchase of a trophy for the ASA Girls Softball team.
Councilman Hopkins made a motion, seconded by Councilman
Roberts, and unanimously approved, approving the purchase
of a trophy for the ASA Girls Softball Team.

Tennis Court City Manager Callinan read that,portion of Parks and
Priority Rules Recreation Director Pekkain's memo dated June 23rd
pertaining.to the tennis court priority rules, copies
of which had been presented to the Council.
Terry Hofmann was recognized and advised that a tournament
had just been completed; expressed appreciation for
the two:hour priority time for adults, 16 and over,
in the:su.mmer evenings; felt that this rule was a good
compromise for all concerned.
Councilman Beary made a motion, seconded by Councilman
Roberts, and unanimously approved, to continue the
tennis court priority rule of making the tennis courts
available fr om, 8:00-10:00 p.m. for adults 16 years
of age and over.
Spivock Land City Manager Callinan gave an update on the Spivock
land; advised that Mr. Spivock had appeared before
the Board of Supervisors and was advised to pursue
the golf course concept for the open I space land, as,
from the,County standpoint, the original project to
purchase the land as open space appears to be a dead
issue.
Bicentennial,. City Manager Callinan requested input from the council-
Time Capsule members as to items to be placed in the time capsule,
'which will be buried July 4th at the Library site;
and specifically a statement from each member of the,
Council.
'Mrs. Alice Wells, of the Bicentennial Committee, was
present and described the festivities planned on July
4th; indicated the exact site at the Library where
the capsule would be buried had not been determined.
Mayor Flores thanked Mrs; Wells and the Bicentennial
Committee for the time and work expended for this
Bicentennial project.

Radio Station City Manager Callinan reviewed his memo dated June
KSUN 25th with the Council and comments made therein pertaining
to councilmembers participating in a public affairs
program at•Radio Station KSUN concerning City matters.
Discussion followed with the feeling being that a member
could appear once every five weeks on.an alternating
basis. Councilman Roberts indicated he made himself
available to the residents of the City at his place
of business and at his home, and felt his limited free
time schedule would prohibit him from participating.
Staff was•request.ed to advise the station that at
least the other.three present members of the Council,
as well as possibly Councilman Eck, would participate
in the KSUN public affairs program on an alternating
basis.'
Proposed Budget City'Manager Callinan presented copies of the proposed
1976 -77 budget would be available to the public and thanked
the Commissions, department heads, and many volunteers
for their. help this past year. Mayor Flores indicated
budget discussions would commence on July 6th at
7 :00 p.m. and invited the public to attend.
Letter of Mayor Flores explained the House of Representatives
Appreciation to has passed an extension of the Federal General Revenue
Congressman Sharing Bill with Congressman Clausen voting in the
Clausen affirmative; suggested that a Letter of Appreciation
be presented to Congressman Clausen for his help to
the cities.
Councilman Roberts made a motion, seconded by Councilman
Hopkins, and unanimously approved, to prepare a Letter
of Appreciation to Congressman Clausen for support
of the Federal General Revenue Sharing bill, over the
signature of the Mayor', and present same to him at
the Mayors and Councilmen Assoication Meeting on July
Tour of Sewer City Manager Callinan suggested:a tour of the wastewater
Plant treatment plant and the work in progress at that facility.
The councilmembers indicated Tuesday, July 6th would
be a convenient time to take the tour.
State Bond City Manager Callinan advised that some $38,997 had
Money for been received by •the City from the State for
Regional Park partial reimbursement of the City's acquisition cost
of the Ropoza'Regional Park land.
Beautification City Manager Callinan advised that the tree planting
Project program was being very well received by the residents
of the City. Approximately 241 trees have been made
available to City residents.

Water for
City Manager Callinan referred the Council to his memo
Dairymen
dated June 25th concerning a recent meeting with Sonoma
County Water Agency and the.Farm Bureau for providing
surplus water to dairymen in the County; indicated'
Mr. Benedetti of Petaluma had phoned and requested
that the large'connection fee be waived for the dairymen.
Discussion followed concerning the hours the dairymen
could take water from the City, water being available
at the City Engineer's discretion; how much water would
be involved, etc.
Councilman.Beary made a motion, seconded by Councilman
Hopkins, and approved by.the following voice vote,
to waivethe requirement. for diirymen drawing water
from the City to furnish ,a deposit.

Mayor Flores made a motion, seconded by Councilman
Hopkins, to set the charge for water supplied to
the dairymen in.the County at $60.00 per acre foot.
Discussion followed concerning safeguards insuring
the residents of the City did not suffer a loss of .
water. Mr. Callinan indicated he did not foresee any
abuse on the part of the dairymen being supplied water.
Mayor Flores amended his original motion to indicate
a charge of $57.00 per acre foot, rather than $60.00,
and Councilman Hopkins accepted the amendment for his
second.

City Manager Callinan directed the councilmember °s
attention to a letter from Mayor Flores dated June
25th to the Board of Supervisors concerning dump fees,
copies of which tad::been.presented to them; and a
meeting of the`Barod of Supervisors on this subject
attended by City Engineer Brust at which the Board
decided to make no changes in dump fees other than to
allow one free Sunday per month for all dumping.
City Manager Callinan spoke briefly concerning the
upcoming election regarding the unification of the
Cotati- Rohnert Park School District; felt the Council .
should provide leadership for this unification, and
should take a positive stand for same; felt control
of the local school district should.be localized;
felt the financing could be controlled just as the
City finances are controlled by.the.Council.
Discussion followed faith the feeling of several council-
members being that the Board of Trustees had not provided
adequate information as to how.muchIit would cost the
City to have a unified school district, and felt they
were not prepared to proceed with an endorsement until
those cost figures were available; further indicated
that many residents were satisfied with the current
school district.
City Manager Callinan read a letter from Wayne Pixley
concerningbanning fireworks, in future years and for
this year, requested that the booths,selling fireworks
issue warnings as to where said fireworks should be
set off.
Mayor Flores made a motion, seconded by Councilman
Hopkins, and unanimously approved, directing staff
to instruct persons selling fireworks to advise buyers
to exercise extreme caution this year in setting off
fireworks.
Mayor Flores made a motion, seconded by Councilman
Roberts, and approved by the following voice vote,
requesting that a letter be directed to Fire Services
Commander Bick requesting that he do an analysis and
make recommendations regarding the selling of fireworks.

that Mr. Brick, being a. fireman, would simply state

City Attorney Flitner advised the City of Cotati/
Qantas Development Company EIR lawsuit decision should
be handed down the latter part of July or first of
August.
Councilman Roberts indicated the following individuals
had agreed to serve on an ad hoc committee of citizens
established to.review building codes: Gordon Adam,
George Bell, Robert DeWan, Michael Fore, John Giertz,
John.Jensen, John peacock, Andrew'Sotak, Jack Titus
and Harry Wright. Councilman Roberts stated the first
meeting would.be July lst and a report will be submitted
to the Council at the September 27th meeting,
Councilman Hopkins made a motion, seconded by Councilman
Beary, and .unanimously approved, ratifying appointment
of the names submitted by Councilman Roberts to the
Ad Hoc Citizens Committee for Review of Building Codes.
Major Flores made a presentation, referring to his
memo to the Council dated June 24th, of a proposed
golf tournament to be named The Fred Rohnert Residents
Golf - Tournament, a copy of the proposal being attached
to these minutes. Mayor Flores outlined the scope
of the .tournament, stated Mr. Rohnert had contributed
$500, and requested that the Council appoint a Chairman
forth s. tournament.
Councilman Hopkins made a motion, seconded by Councilman
Roberts, and unanimously approved, to,approve the
recommendations set forth by Mayor Flores with regard

to The Fred Rohnert Residents Golf Tournament, and
appoint Major Flores as Chairman of the tournament,
Councilman Roberts initiated a discussion stating Mrs.
Al Appleton of Dexter Circle, had informed him of
swarms of mosquitos on the golf course. Mr. Callinan
stated the City was in the mosquito abatement district
and he would check into this matter.
Councilman Roberts indicated he had reports of the
water being turned off in the northern area of the

AB 2654 Counclman.Hopkins initiated a discussion concerning
AB 2654, which limits local property taxes to support
of those functions primarily related to property; suggested
the Council go on record opposing this bill.
Councilman Beary made a motion, seconded by Councilman
Roberts, and unanimously approved, that the Council
go on record as opposing AB 26 54, and directed staff
to forward letters to appropriate legislators so stating.

SB 1652 Councilman Hopkins initiated a discussion concerning
SB 1652, which reimburses local governments for losses
in revenue resulting from a State requirement; suggested
the Council go on record supporting this bill.
Councilman Beary made a motion, seconded by Councilman
Roberts, and unanimously approved, that the Council
go on record in support of SB 1652, and directed staff
to forward letters to appropriate legislators so stating.
AB 3000 Councilman Hopkins initiated a discussion concerning
AB 3000 (Special Mandatory Legislation for Peace Officers);
suggested the Council go on record opposing this bill.
Upon motion of Councilman Beary, seconded by Councilman
Roberts, and unanimously approved, the Council went
on record as opposing AB 3000, and directed staff to
forward letters to appropriate legislators so stating.
Cotati - Rohnert Park Councilman Hopkins initiated a discussion concerning
School District the enrollment recap of the Cotati - Rohnert Park School
Enrollment Recap District, copies of which had been presented to the
Council; stated he felt there were several discrepancies
in -the increase /decrease of student figures particularly
as they pertained to classroom facilities; felt the
report should be more clearly defined. Mr. Callinan
stated he would request an explanation of the figureso
Adjournment There being no further business, Mayor Flores adjourned
the meeting at approximately 10:35 p.m. to 7 :00 p.m.

must be received by July 27 with the green fee.

Overview
Tnere ed,play on our golf course has resulted in a significant
revenue increase and the utilization of an important recreational
resource. It is my belief that extensive efforts should be
continued to maintain this highly favorable trend. With this in mind,
1 suggest the organization of an annual golf tournament open only to
residents.
Since this is the bicentennial year, a desirable aspect would be to
name this tournament after the person most closely associated with owner -
ship of the lands from which our City was formed. This person would
be Fred Rohnert,
I have approached Mr. Rohnert's representative and he will contribute
$500 for this initial tournament. This money will be used to provide
prizes and for organizational expenses,
Basic Proposal
1, Name -'The tournament will be called. the Tred Rohnert Annual

2,, Eligibility - The tournament will be open to all residents of
Rohnert Park who are 18 years of age and over.
3. Prizes - Prizes will be purchased with the contributed funds»
Local merchants may also contribute prizes.
