1972/05/01 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES May 1, 1972 The Council of the City of Rohnert Park met this date in regular session commencing at 7:35 p.m. in the City Offices, 435 Southwest Boulevard, Rohnert Park, with MaVor Roberts presiding. The regular session was preceded by an executive session which commenced at 7:00 p.m. and at which all Coun- cilmen and City Manager Callinan were present and which was held to discuss ex- officios to Commissions, committees, and ABAG. Call to Order Mayor Roberts called the meeting of the regular session to order at approximately 7 :35 p.m. and led the pledge of alle- giance. City Attorney Maxwell Mayor Roberts announced that City Attorney Maxwell was not present due to the death of his mother. Roll Call Present: (5) Councilmen Beary, Flores, Hopkins, Smith and Roberts Absent: (0) None Staff Present for all or part of the meeting: City Manager Callinan and Assistant to the City Manager Albright. Approval of Minutes Upon motion of Councilman Hopkins, seconded by Councilman Smiths and unanimously approved, the minutes of April 17 and 18 were approved as submitted. Approval of Bills Upon motion of Councilman Hopkins, seconded by Councilman Smith, and unanimously approved, the bills presented per the attached list in the amount of k4,184.20 were approved. Communications Communications per the attached outline were brought to the attention of the Council. No action was taken on any communication except as noted specifically in these minutes. Informational. Mayor Roberts announced the May 6 Informational Congress Congress for Sonoma County and cities in the county, reviewed the planned agenda for the audience, and reminded that the meeting was open to the public. Executive Session Mayor Roberts announced that an executive session had been held prior to the regular meeting to discuss ex- officios to commissions, etc. and that his appointments were as follows: Parks and Recreation Commission - Councilman Beary Planning Commission - Councilman Flores Cultural Arts Commission - Mayor Roberts School Coordinating? Committee - Councilman Hopkins ABAG - Councilman Hopkins, Alternate -Mayor Roberts League of Calif. Project No. 1956..1 Mayor Roberts declared the scheduled public hearing open on Project No. 1956 -1, Amended Assessment Nos. 6.9.4 and 6.81.2.2. City Manager Callinan reported that notice of the public hearing had been published in The Clarion, explained the amendment, and advised that,no written communications had. been received. There being no one desiring to be heard, Mayor Roberts declared the public hearing closed. Project No. 1968 -1a City Manager Callinan reported that Project No.,.1968 -1a,. Coddingland, Unit No '.2 .'Coddingland, Unit No. 2,.had been completed and Progress Payment No. 7 in the amount of($920.51)to Argonaut Construc- tors had been recommended for approval by Engineer Hudis.. Upon motion of Councilman Flores, seconded by Councilman Hopkins, and unanimously approved, Progress Payment No. 7 in the amount of($920.51) to Argonaut Constructors was approved. City Manager Callinan explained that since this progress ; payment was the final one for the project, that the 10* retention on same is automatically paid to the contractor, without additional Council action, payment being made.35 days after. recording the notice of acceptance.on, the project. Weed Abatement Mayor Roberts declared open the scheduled public hearing Public Hearing on weed abatement and,the.Notice to Destroy Weeds which City Manager Callinan reported, had been published and mailed to .property owners., There being no,one present desiring to be heard, the public hearing was closed. Resolution-No. 7-2 -62 RESOLUTION ORDERING CITY.MANAGER OF THE CITY OF ROH.NERT PARK TO.ABATE NUISANCES EXISTING WITHIN THE CITY OF ROHNERT PARK City Manager Callinan explained the resolution. Upon motion of Councilman Hopkins, seconded by Councilman Beary, and.unanimously approved,.the reading of Resolution No. 72 -62 was waived, and said resolution was adopted. Ordinance -So. 174.' AN ORDINANCE AMEN DING ORDINANCE NO. 63 (Zoning Map Change, Octagon Co. >File 0216) City.Manager Calltnan explained the resolution. Upon motion of Counelman Smith, seconded by Councilman Flores, and unanimously approved, the reading of Ordinance No> 170 was waived and said ordinance was adopted. Page -3- May 1, 1972 Proposed Ordinance Re City Manager Callinan reviewed the proposed ordinance which Firearms would regulate the use of firearms and guns within the city. Discussion followed during which it was decided to defer action on the matter pending submission of guidelines by Director of Public Safety Dennett for use in issuing permits. Resolution No. 72 -63_ RESOLUTION ACCEPTING EASEMENT FROM MARTIN STONE (Snyder Lane Water Main- Expressway to Himebaugh Creek) City Manager Callinan explained the resolution. Upon motion of Councilman Hopkins, seconded by Councilman Beary, and unanimously approved, the reading of Resolution No..72 -63 was waived and said resolution was adopted. Resolution No. 72 -64 RESOLUTION OF.INTENT TO OBLIGATE TOPICS FUNDS City Manager Callinan explained the resolution and reviewed the TOPICS funds program. A brief discussion followed. Upon motion of Councilman Hopkins, seconded by Councilman Beary, and unanimously approved, the reading of Resolution No. 72 -64 was waived and said resolution was adopted. Chamber of Commerce City Manager Callinan reported that the Rohnert Park Chamber Request for Funds of Commerce Manager Dan Murray had suggested that the letter from the Chamber requesting funds for Founders Days be ignored since funds for the 1972 Founders Days would not be budgeted until July. File No. 0216 City Manager Callinan read a recommended additional condi- Octagon Company tion relative to non- transfer of the use permit for the Octagon Company use permit which was reviewed by Mr. Alexis Tellis and approved by him, a copy of which condition is on file. Upon motion of Councilman Smith, seconded by Councilman Flores, and unanimously approved, the additional condition for the Octagon Company use permit was approved. Discussion followed concerning the possibility of adding this condition to all use permits. The condition concerns prohibiting any substantial change in control of a company without Planning Commission approval. Citizens Advisory City Manager Callinan reported that approximately eight Committee for Updating citizens had submitted letters asking to serve on the General Plan Citizens Advisory Committee for updating the General Plan. A brief discussion followed during which the Council indi- cated that it would like more letters for a good cross - section of citizens to serve on the committee. Staff was directed to send a letter to concerned organizations request - ing a representative from each group. Page -4- May 1, 1972 Hospital. Meeting Mayor Roberts .reported on a recent.hospital meeting held in Petaluma by the Irate Taxpayers Association. Discussion. followed during which the possibility of withdrawing from the Hillerest Hospital District was mentioned. City Manager Callinan reminded the Council this had been discussed a year or so ago, City Attorney Maxwell had advised of the steps necessary to accomplish same, and that he would furnish a copy of the necessary procedures to each Councilman. Joint Meetings Mayor Roberts initiated a brief discussion concerning his desire to have joint work sessions with other city commis - sions. May 10 was selected for a joint meeting with the Planning Commission. UHF TV Station Councilman Smith initiated a brief discussion concerning a new UHF TV station in Santa Rosa and wondered if Storer Cable TV was planning to carry it. City Manager Callinan . indicated he would check on the matter. Concealed Weapons Councilman Smith initiated a brief discussion concerning the carrying of concealed weapons in the Council Chambers. City Manager Callinan relayed the report of Chief Dennett that if.an, individual has a permit to carry a concealed weapon there is no prohibition against bringing same into the Council Chambers. Staff was requested to solicit. City Attorney Maxwell's opinion on the matter. Code of Ethics Councilman Smith initiated a brief discussion concerning the Code of Ethics for the Council and the desirability of hav- ing same properly framed and placed for public view. City Manager Callinan responded that staff was in the process of doing same. AB 2005 Councilman Smith initiated a discussion on AD 2005 which would prohibit lease purchase arrangements through non - profit corporations. It was suggested that each individual Councilman send a letter or wire expressing his own view. School Space Councilman Smith reported that he had intended to present a resolution relating to school space and new residential developments but.in view of the pending Cotati School District -City Coordinating Committee meeting he would reserve the right to introduce the resolution at a later date if the committee does not move ahead on same. League of California .City Manager Callinan announced that Councilmen Beary and Cities - New Council-. Flores would be attending the New Councilmen's Institute meW s Institute to be held.in San Diego on May 17 -19 and that Councilman .Beary would like to arrive in San Diego a day early to visit city officials and investigate the methods of providing school space in San Diego. Upon motion of Councilman Smith, seconded by Councilman Hopkins and unanimously approved, Councilman Beary was Upon motion of Councilman Flores, seconded by Councilman .Smith, and unanimously approved, staff was authorized to send a letter to the appropriate federal administrator favoring the allocation of funds to the Golden Gate Bridge District under its pending application for ferries and buses. Upon motion of Councilman Smith, seconded by Councilman Flores, and unanimously approved, staff was directed to send a letter to Director William Lucius expressing appre- ciation for the improved bus service for Rohnert Park and requesting that it be improved further. Young America Homes- Councilman Flores brought to the attention of staff that a Colegio Vista Sub- citizen had called. him concerning a large open drainage division pipe in the Colegio Vista Subdivision area. Mr. Callinan. indicated he would check on same. Councilman Flores reported he had received several complaint- from citizens regarding the transfer of soil to the park sit in Colegio Vista Subdivision and the large amount of dust being created. City Manager Callinan responded that the area is now being watered down to minimize the dust problem. Park Development Councilman.Flores initiated a brief discussion concerning various methods of financing park improvements. Speakers from Council Mayor Roberts initiated a brief discussion concerning Councilmen speaking at local schools on the subject of local government. Staff was directed to write a letter to the local schools and organizations alerting them to the avail- ability of speakers from the Council. Page -5- May 1, 1972 authorized to spend an extra day investigating the methods of providing school space in San Diego. Bedroom Tax - Councilman Beary initiated a discussion concerning Ordinance Ordinance. No. 47 No. 47 - Bedroom Tax - and requested staff to revamp said ordinance by the next Council meeting whereby it could be used to generate more revenue in an effort to require new developments to pay their way in development of new parks and recreational facilities. Upon motion of Councilman Beary; seconded by Councilman Smith, and unanimously approved,'staff was authorized to come back in two weeks with a revised Ordinance No. 47 and send copies to various organizations requesting their pre- sence at the meeting for input. Sonoma State College CouncD man Beary initiated a discussion concerning the possi- Enrollment bility of seeking the cooperation of the'regents to limit enrollment at Sonoma State College at the current level.. Page -6- May 1, 1972 Population City Manager Callinan announced that official word had been received from Sacramento advising that the Rohnert Park pop- ulation was 7., 450 as of February 1. 1972. Cotati School Board- City Manager Callinan announced the May 3rd joint meeting City Council Meeting of the Cotati School Board and the City Council to be held at the CArriage House. Cotati School District- City Manager Callinan announced that the May 4th meeting City Coordinating of the Cotati School District - City Coordinating Committee Committee had been cancelled. Work Session for City Manager Callinan suggested a work session for the New Councilmen benefit of the new Councilmen. The Council indicated its approval and directed the Mayor to set a date for same. Southwest Boulevard- City Manager Callinan reviewed the proposal of Chief Almond Avenue. Dennett for improving the intersection at Southwest BoulO- Intersection vard and Almond Avenue, noted that the Santa Rosa traffic bngineer had been consulted on the matter and had. made some good suggestions. He noted that this was done in response to a request from John Reed PTA. Bike Path Snyder Lane City Manager Callinan reported that John Reed PTA had also inquired about the lack of a bike path on Snyder Lane and advised that it had been omitted from the project due to the high cost of improving Snyder Lane, but that a bike path could be added as the project develops. Proclamations Mayor Roberts signed proclamations for Goodwill Week, May 7-13; Poppy Days, May 26-27; and Volunteer Week, May 22-27. At the. request of Councilman Flores, Mayor Roberts read the Goodwill Week Proclamation. Bishop McNair Bishop McNair was recognized and commented generally about his interest in local government and affairs in Rohnert Park. but was sorry that the impetus had to come through the ' Octa- gon Company. He stated he was still opposed to the Octagon Company's location of its motorhome park. He also commented that he could not hear very well because the mikes did not seem to carry very well. A brief discussion followed concerning methods of displaying maps and materials 8o the audience could see better. Joe Torti Mr. Joe Torti was recognized and also commented that the acoustics in the Council Chambers are not the best. He also asked when comments from the public were proper. Mayor Roberts advised him that any time he desired to speak he would be recognized.
