ROHNERT PARK CITY COUNCIL MINUTES
July 20, 1970
The Council of the City of Rohnert Park met this date in
regular session commencing at 7 :00 p.m. in the City Offices,
435 Southwest Boulevard, Rohnert Park, with Mayor Smith
presiding.
Mayor Smith called the meeting of the regular session to
order at approximately 7 :05 p.m. and led the pledge of
allegiance.
Present: (3) Councilmen Hopkins, Rogers, and Smith
Late: (1) Councilman Roberts, his time of arrival
is specifically noted in the minutes.
Absent: (1) Councilman Buchanan
Staff Present: Supt. of Public Works Wiggins, .Asst. to the
City Manager Albright, Engineer Hudis, County Planner Wes
Vail, and Deputy City Attorney Mawson.
Staff Late: City Manager Callinan, his time of arrival is
specifically noted in the minutes.
Approval of Minutes Upon motion by Councilman Rogers, seconded by Councilman
Hopkins, and unanimously approved, the minutes of June 29,
July 1 and 6 were approved as submitted. Action was de-
ferred on the minutes of July 7.
Approval of Bills Upon motion of Councilman Rogers, seconded by Councilman
Hopkins, and unanimously approved, the bills presented for
approval were approved.
Proposed Pigeon Councilman Rogers reported he had met with both sides of
Ordinance the pigeon matter and should have a report by next meeting.
Communications Communications per the attached outline were brought to
the attention of the Council. No action was taken on any
communication except as noted specifically in these minutes.
File 0014 Supt. of Public Works Wiggins read a letter from Mrs.
Yvonne McCulla for continuance of a family care home use
permit at 7481 Boris Ct. Deputy City Attorney was requested
to check on whether the permit went with the property or
the individuals involved.
Redwood Empire Supt. of Public Works Wiggins brought to the attention of
Kennel Club the Council a request from Redwood Empire Kennel Club to
File 0101 use Benecia Park for its annual dog show on May 8 and 9,
1971®
Upon motion of Councilman Rogers, seconded by Councilman
Hopkins, and unanimously approved, the request of Fndwood
Empire Kennel'Club to use Benecia Park on May 8 and 9, 1971
was approved.

Undergrounding of Councilman Hopkins reported he had received a letter from
Utilities - Young Mr. Paul Golis regarding undergrounding of utilities by
America Homes Young America Homes in Subdivision 15 and 16B, and advised
it was being referred to City Manager Callinan.
CATV Equipment Councilman Hopkins reported that Jim Bergen had checked
for Program Origina- with the Petaluma High School District and had been in-
tion formed that the TV equipment used for the recent Candidate's
Night had cost $2,934.70. Councilman Hopkins also reported
that equipment used in Healdsburg had cost approximately
85,000 although it was not up to TV studio standards.
Public Safety Dept. Councilman Roberts inquired about a re- assignment of per-
sonnel referred to in the Public Safety Department report.
Staff advised that either Chief Dennett or City Manager
Callinan would be contacted to clarify this.
Property Assessment Mayor Smith reported that his property hadii4� bee ' assessed
Practices since 1960 and requested that City Manager Callinan be
directed to contact the Assessor's Office regarding assess-
ment practices in Rohnert Park.
Burton Avenue Playlot Supt. of Public Works reviewed the matter of the Burton
Avenue Playlot re- development and expressed the hope that
the Sonoma State College people involved would not be
offended that the city had done some work in the playlot.
Mssrs.Patrick Bailey and Michael McBride were recognized
and showed some slides to illustrate the fact that the nlav-
lot was unsatisfactory for small children as redesigned
by a college art class. They suggested that the tree
stumps and tunnel in particular should be removed and
replaced with swings as well as the addition of some baby
swings, and a sand box and presented a drawing to the Coun-
cil. They also suggested that no age restriction be imposed
on the park by means of signs.
Mr. Barry Godolphin, 332 Burton Avenue, and teacher at
Sonoma State College, was recognized and reviewed the
college students involvement with the redesigning of the
playlot and submission of plans to the Recreation Commis-
sion. City Council and city staff. He advised that no one
from the city had contacted Mr. DuBov, Sonoma, State College
Art professor, to apprise him of the situation and he did
not know of the remodeling until coming to work one morning
to find heavy equipment at work. Mr. Godolphin proposed
that City Manager Callinan send a letter of appreciation
for the work done and also an apology to Professor DuBov,
the Acting President of Sonoma State College, Argus Courier,
Press Democrat, and the Central County Clarion.
Councilman Roberts stated for the record that he did not
know of any problem until reading about it in the Press
Democrat. He further advised that the college students had
assured the City Council the work would be done by the end

of school in June and felt that Professor DuBov had
been negligent in not advising the city that work would
not be done on schedule.
Discussion followed in which Mary Moher, Sonoma State
College student, and Louis Beary participated as well as
those already mentioned.
File No. 0156 Supt. of Public Works Wiggins reviewed the application of
Northern California Northern California Dwelling Development for a zoning
Dwelling Development change.
Mayor Smith declared the public hearing open on the applica-
tion of Northern California Dwelling Development for zoning
change of AP143- 060 -13 to RM- 1500 -PD.
Supt. of Public Works Wiggins advised that notices of the
public hearing had been mailed to property owners within
500 feet of the parcel of land. No one appeared in opposi-
tion to the zoning change and Supt. of Public Works Wiggins
advised that no written communications had been received.
There being no one wishing to be heard Mayor Smith declared
the public hearing closed.
Ordinance No. 130
AN ORDINANCE AMENDING ORDINANCE NO. 63 (Zoning Map Change -
AP143- 060 -13)
Upon motion of Councilman Rogers, seconded by Councilman
Roberts, and unanimously approved by the following roll
call vote, Ordinance No. 130 was introduced:

Mr. Bill Mueller of Young America Homes was present and
Colegio Vista Sub -
was asked about the use of Masonite vs. Plywood in the con -
division No. 2
struction of homes currently being built by Young America
Homes in Subdivision 15 -B. Mayor Smith obtained samples
of Masonite from his car and demonstrated how it could be
broken. Discussion followed. Engineer Hudis advised that
Masonite was approved by the Uniform Building Code and the
Federal Housing Administration, both of which were.conser-
vative agencies.
Councilman Rogers stated for the record that he would ab-
stain from any discussion and voting on Subdivisions 15B
and 16B.
City Manager City Manager Callhan arrived at this point in the meeting,

City Manager Callinan reviewed the improvement plans for

Councamsn Rogers made a motion to approve the Colegio Vista
Subdivision, Unit No. 2 improvement plans prepared by Milton
Hudis, R.C.E. with the condition that additional landscaping
improvements will be installed in the walk -way and access
easements shown in the plans. Said motion was seconded by
Councilman Roberts and approved by the following voice
votes

Discussion followed concerning cost of the houses in Colegio
Vista Subdivision No. 2 as opposed to Subdivisions 15B and
16B.
Councilman Roberts made a motion to approve the final map
of Colegio Vista Subdivision No. 2 prepared by Milton Hudis,
R.C.E. and authorized the mayor to execute the standard
subdivision agreement. Said motion was seconded by Council-
man Rogers, and approved by the following voice vote:
AYES: (3) Councilmen Roberts, Rogers, and Smith
NOES: (0) None
ABSENT: (2) Councilman Hopkins and Buchanan
File 0014 A brief discussion was held concerning Mrs. McCulla's letter
McCulla letter relative to buying the residence at 7481 Boris Court if she
could continue the family care home operation now concsucted
by the Kenworthy's® Mr. Callinan advised that according
to the city's zoning ordinance, a use permit runs with
the land and not an individual.
Councilman Hopkins Councilman Hopkinsreturned to the Council Chambers at this

Annexation No. 6 City Manager Callinan reviewed the status of Annexation No.
6 and advised that Mr. Paul Golis and Mr. Pred Rohnert had
requested a meeting with the City Council. Mr. Callinan
further reported that notices of the public hearing had
been published and mailed, Mayor Smith declared the public
hearing open on Annexation No. 6.
City Manager Callinan read a letter from Rohnert Park
Realty signed by Paul Golis, dated July 7, 1970, requesting
a meeting to discuss Annexation No. 6 before its finaliza-
tion.

Mr. Golis was recognized and staled for the record the
reason annexation had not taken place before was due to
the contract requirement for a park site.
Deputy City Attorney explained the stepsinvolved in the
annexation procedure. A brief discussion followed. Mayor
Smith declared the public hearing continued to July 28,
1970 at 700 p.m.
Lion William Reynolds William D. Reynolds, 243 Arlen Drive, Rohnert Park Lions
Club member and institutional representative of Boy Scout
Troop No. 68 and Cub Scout Pack No. 68 advised of a fund
raising project of selling American Flags. He proposed that
flag holders be installed in front of each business with
the cost to be borne by the city and that each business ob-
tain a flag and fly it each day. Discussion followed.
Upon motion of Councilman Hopkins, seconded by Councilman
Rogers, and unanimously approved, tentative approval was
given to Mr. Reynolds proposal and he was requested to work
with Supt. of Public Works Wiggins on the Project.
Mr. Paul Golis Mr. Paul Golis was recognized for his scheduled presenta-
tion but deferred commenting at this time upon assurance
from the Council that he would have an opportunity to
speak when the budget item came up on the agenda.
Mr. Dan Logue Mr. Dan Logue appeared before the Council, introduced
Pop Warner Football Ray Jones who was appdihted a Pop Warner All- American, and
requested a contribution to help defray expenses of send -
ing Ray Jones to the All - American conference. Discussion
followed.
Upon motion of Councilman Rogers, seconded by Councilman
Hopkins, and unanimously approved, the Council authorized
a contribution of $100.00 to the College View Youth Club.
Recess Mayor Smith declared the meeting recessed at this point,
the time being approximately 9 :10 p.m.
Reconvene Vice Mayor Hopkins reconvened the meeting at approximately
9 :20 p.m. with Councilman Rogers, Roberts and himself
present.

Resolution RESOLUTION APPROVING AND ADOPTING A BUDGET FOR THE CITY
70 -101 OF ROHNERT PARK FOR THE FISCAL YEAR 1970 -71
City Manager Callinan summarized the budget for 1970 -71.

Vice Mayor Hopkins asked if anyone in the audience had any
comments on the budget.
Mr. Paul Golis was recognized and read from a prepared
statement regarding the effect of mobile homes on the tax
rate, a copy of which is attached to the original of these
minutes.
Upon motion of Councilman Roberts, seconded by Councilman
Rogers, and unanimously approved, payment of Progress Pay-
ment No. 2 to A. Teichert & Son, Inc. in the amount of
$42,133.40 was authorized.
Project HUD Engineer Hudis reported on Project HUD WS- Calif -333 and
WS -Calif -333 recommended an extension of time for Argonaut Constructors
Well #6 and Tank #1 to September 1, 1970. He also advised that Progress Pay-
ment No. 2 in the amount of $41,611.19 was in order for

Upon motion of Councilman Rogers, seconded by Councilman
Roberts, and unanimously approved, an extension of time to
September 1, 1970 was granted to Argonaut Constructors.
Upon motion of Councilman Rogers, seconded by Councilman
Roberts, and unanimously approved, Progress Payment No. 2
to Argonaut Constructors in the amount of $41,611.19 was
authorized.

Southwest Blvd. that the Northwestern Pacific Railroad Company hod con-
sented to a 64 foot crossing and that a Public Utilities

due to more than usual excavation, draInage improvements
in anticipation of ultimate development, an eight inch
thicker street than usual due to anticipated heavy traffic,
and probable bond discount, as well as the fact that part
of Southwest Boulevard is included 'in this project. Dis-
cussion followed with Mr. Hudis and Mr. Golis participating
after which City Manager Callinan was directed to proceed
toward calling for bids.

Resolution A RESOLUTION ORDERING REDUCTION OF ASSESSMENTS
No. 70-102 (Southwest Boulevard Improvement Project No. 1970 -4)
City Manager Callinan summarized the resolution.
Upon motion of Councilman Rogers, seconded by Councilman
Roberts, and unanimously approved, the reading of Resolu-
tion No. 70 -102 was waived, and said resolution was adopted.
Resolution A RESOLUTION OF INTENTION TO MAKE CHANGES AND MODIFICATIONS
No. 70 -103 (Southwest Boulevard Improvement Project No. 1970 -4)
City Manager Callinan summarized the resolution.
Upon motion of Councilman Rogers, seconded by Councilman
Roberts, and unanimously approved, the reading of Resolu-
tion No. 70 -103 was waived and said resolution was adopted.
Project No. 1970 -6 City Manager Callinan reviewed Project No. 1970 -6 and
Cofego Drive and recommended that the assessment district proceed in the
Santa Alicia Drive hopes that the involved property owners`tax delinquencies .
could be corrected but provided that the involved property
owners agree to pay the engineering fees of Milton Hudis in
the event the project was not consummated.
Mr. Paul Golis was recognized and explained that his com-
pany was no longer interested in participating in the pro-
ject, but that he would work privately with Western Hosts
in order to protect its development.
Mr. Victor Freeman of Western Hosts was recognized and re-
quested some assurance from the Council that it would
cooperate in working out the access problem to the north
side of Western Hosts' proposed development. A lengthy
discussion followed involving various methods of dealing
with the access problem of Western Hosts.
Upon motion of Councilman Rogers, seconded by Councilman
Hopkins, and approved by the following voice vote, Council
indicated a willingness to cooperate with Western Hosts in
solving the access problem to the north side of Western
Hosts' development with construction of Transport Avenue
as a last resorts

Project No. 1970 -7 City Manager Callinan reviewed the Water.-Pollution Control
Water Pollution Plant Demonstration Project and advised that Mr. James
Control Plant Gibson, recently retired from the City of Santa Rosa, had

Solid Waste and sought Council support to prevent location of a Sonoma
Disposal Site County Solid Waste Disposal Site on Hammel Road near his
home.
City Manager Callinan announced that Mr. Don Head, Sonoma
County Director of Public Works, would be appearing at
the August 3, 1970 meeting to discuss possible locations
for the disposal site.
Park and Recreation City Manager Callinan advised there were approximately 110
Director Applicants applicants for the position of Parks and Recreation Direc-
tor and that a written test would be necessary.
Culverts on South City Manager Callinan reviewed the need for, and benefits
Santa Rosa Avenue of, large drahage culverts on South Santa Rosa Avenue and
that cost of the culverts had been estimated at approximate-
ly $1,000. He commented on the County's willingness to
install the culverts if they are provided by the City.
A brief discussion Vollowed during which staff was directed
to contact property owners benefitted to solicit their
participation in the cost of the culverts.
Upon motion of Councilman Rogers, seconded by Councilman
Roberts, and unanimously approved, the expenditure of up
to `1,500 for culverts on South Santa Rosa Avenue was
authorized.
Revised Plans for City Manager Callinan reported that the revised plans for
Alicia and Benecia Alicia and Benecia Parks and related school grounds had

that a joint meeting of the Recreation Commission and City
Council be held Monday, July 27, 1970, at 7030 p.m. to
review the plans. The Council concurred in the recommenda-
tion.
Commercial Trucks City Manager Callinan noted he had observed several heavy

proposed a public hearing be held for an amendment to the
zoning ordinance which would prohibit such parking. The
Council concurred.
County Commission City Manager Callinan announced the July 2-ist meeting of

Maurice Fredericks, member of the Cotati School District
Board of Trustees, was recognized and solicited support
from the Council members to appear with him at the meeting.

Proposed Telephone City Manager Callinan reported on discussions with tele-

golf course in exchange. He requested Council approval in
concept of the negotiations to date and authority to pro-
ceed.
Upon motion of Councilman Rogers, seconded by.Councilman
Roberts, and unanimously approved, approval in concept of
negotiations held to date with the telephone company was
given as well as authority to proceed relative to a possi-
ble exchange of landscaping along the railroad side of.the
golf course by the telephone company for an easement to lay
a telephone cable through the golf course.
Rohnert Park Dodgers City Manager Callinan stated for the record that the
Rohnert Park Dodgers had won first place in the Rohnert
Park Boys Baseball League.
Baseball Playing in Mrs. Clay Jewell was recognized and asked if there were any
City Streets regulations prohibiting the playing of baseball in city
streets. A brief discussion followed. Mr. Callinan ad-
vised that he would discuss the matter with Chief Dennett.
Adjournment There being no further business the meeting was adjourned
at 11:05 p.m. to Monday, July 27, 1970 at 7 :30 P.M.

municipal officials in analyzing the to detriments and benefits of
mobile home parks. They are exerting their efforts to solve a
political and taxation problem by'bringing pressure on the developers
who are providing the parks for this type of home. This again, is
a retreat by municipal officials from their proper course in soly-
ing the tax and political problem. They should go to the legislature.
During the past few weeks I have heard the mayor of this com-
munity state that there were two too many mobile home parks in the
city of Rohnert Park; and that a study should0be made to determine
how many per with how many units should be a*'$-lowed in Rohnert Park.
The mayor could not be more wrong. A study is not needed on the
planning merit s; nor do we have any money to waste on needless
studies. We donit have too many parks; and due to our fiscal situA-,,
tion we should be encouraging more parks as I shall later demonstrate.
The problem is aggravated by the fact that the city staff has
been pushing the proposed mobile home park located north of the mu-
nicipal golf course on,I'Iland belonging to the Spivocks because of the
