1975/04/21 City Council MinutesROHNERT PARK CITY C()UNCIL MINUTES April. 21, 1975 The Council of the City of Rohnert Park met this (late in -closed executive session commencing at 6:30 p.m. in the City Offices, 6750 Commerce Boulevard, with Mayor Hopkins presiding. All Councilmen were present during the executive session as was City Manager Callinan and Attorneys William 'Brinton and Ricardo Hecht of the law firm of Cotton, Seligma-)-, & Ray. The Council met with these attorneys to discuss the. city°s action against the Santa Rosa Urban Renewal Project. The meeting with the attorneys ended at approximately 7:30 p.m. at which time Attorneys Brinton and Hecht left the meeting and Planning Commission member Michael Mullins met in executive session with the Council to discuss a personnel matter. Upon departure of Mr. Mullins from the executive session meeting, City Manager Callinan discussed two personnel I , matters with the Council. The executive session was adjourned at approximately 7:45 p.m. to regular session. The Council of the City of Rohnert Park met this date in regular session commencing at 7:50 p.m, in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Hopkins presiding., Call to Orjer Mayor Hopkins order at appr allegiance. City i4anager Callinan commented that Mr. Timm has stated t"lat funding for the Rohnert Park operation will be requested in the new grant application. Ligbting of Baseball Councilman Flores initiated a brief: discussion concerning F.eld the letter and estimate of cost from C. R. Fedri.ck, Inc. for lighting of the baseball field at.Rohnert Park Junior High School field. City Manager stated we had received only the one estimate in the amount of $97,000, which he considered to be. extremely high. Letter from City Manager Callinan read a letter from Mike Mullins Mike Mullins wherein Mr. Mullins commented on an article in a local newspaper regarding the Council's action in denying his request for a change in required fencing on his property. Ordinance 263 AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING ORDINANCE NO. 6 (Special Gas Tax Improvement Fund) City Manager Callinan explained the ordinance. Upon motion of Councilman Smitl., seconded by Councilman Beery and unanimously approved, reading of Ordinance No. 268 was waived and said ordinance was adopted. Ordinance 267 SEWER USE ORDINANCE City Manager Callinan explained the ordinance and minor changes that had,been made thereto. Councilman Smith,initiated a discussion with regard to the section concerning the policy of the City for persons in arrears on payment of their bills. Discussion followed with the councilmen, City Manager Callinan and City Engineer Brust participating. The Council approved deletions from the proposed ordinance in Section 11, paragraphs,B and E. Upon motion of Councilman Eck, seconded by Councilman Beary, and unanimously approved, reading of Ordinance No. 267 was ... waived and said ordinance was adopted as amended in Section 11, paragraphs B and E. Ordinance 294 AN ORDINANCE REGULATING THE SUBDIVISION OF LAND WITHIN THE CITY OF ROHNERT PARK AND PROVIDING PENALTIES FOR VIOLATION THEREOF. City Manager Callinan and City Engineer Brust explained the ordinance and some minor chAnges. -that had been made thereto. Councilman Smith initiated a discussion concerning certain -sections of the ordinance que-kyingMr. Callinan and City Engineer Brust for clarification. Councilman Smith made a motion, seconded by Councilman Eck to 'amend Ordinance 294, Sections 8-800 through 8-801 to make public hearings on tentative maps mandatory rather than permissive. 'Councilman Smith's motion failed by the following roll call vote: AYES: (2) Councilmen Smith and Eck NOES: (3) Councilmen Beary, Flores and Hopkins Further discussion followed with the Council, City Manager Callinan and City Engineer Brust participating. Page 7 April 2i, 1975 Councilman Smith made a motion, seconded by Counciliran Beary to change Section 13-1300, Appeals, subparagraph B of Ordinance 294 to provide that any interested person may file an appeal with the city. The motion passed unanimously. Councilman Flores made a motion, which was seconded by Councilman Eck, and unanimously approved, to waive the reading of Ordinance No. 294, and adopt said ordinance as amended. Resolution 75-98 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK AUTHORIZING AND APPROVING AN AGREEMENT BETWEEN THE CITY OF ROHNERT PARK AND THE STATE OF CALIFORNIA FOR THE CONSTRUCTION OF SIDEWALKS ON THE SOUTH SIDE OF ROHNERT PARK EXPRESSWAY FROM SANTA ROSA AVE. TO COMMERCE BOULEVARD. City Manager Callinan explained the resolution. Upon motion of Councilman Beary, seconded by Councilman Eck, and unanimously approved, reading of Resolution 75-98 was waived and said resolution was adopted. Resolution 75-99, RESOLUTION OF THE COUNCIL OF THE CITY OF ROHNERT PARK AUTHORIZING AND APPROVING THAT CERTAIN AGREEMENT FOR TEMPORARY EASEMENT BETWEEN MARY C. PIMENTEL AND THE CITY OF ROHNERT PARK City Manager Callinan explained the resolution. Upon motion.of Councilman Beary, seconded by Councilman Smith, and unanimously approved, reading of Resolution 75-99 was waived and said resolution was adopted. Resolution 75-100 RESOLUTION OF THE COUNCIL OF THE CITY OF ROHNERT PARK AUTHORIZING AND APPROVING THAT CERTAIN AGREEMENT FOR TEMPORARY EASEMENT BETWEEN HOWARD SISKEL AND NOR24AN SISKEL AS GENERAL PARTNERS AND THE CITY OF ROHNERT PARK City Manager.Callinan explained the resolution. Page S April 21, 1975 Wastewater The subject calling for Sealed Proposals, Wastewater Treatment Plant Treatment Plant Modifications, Project 1973 -2 on the agenda Modifications was deferred pending E.P.A. approval of the plans. Resolution 75 -101 RESOLUTION ESTABLISHING PLANNING, ZONING SUBDIVISION AND RELATED MATTERS FEES City Manager Callinan explained the resolution. Upon motion of Councilman Beary., seconded by Councilman Flores, and unanimously approved, reading of Resolution 75- -101 was waived and said resolution was adopted. File 0406 City Manager Callinan explained the proposed addendum, Addendum to General referring to the Planning Commission Staff Report which Plan by Adding Scenic had been disseminated to the Council. He further stated Highway and Safety that notice of public hearing had been published in the Elements local newspaper. Mayor Hopkins declared the scheduled public hearing open on File 0406, Addendum to General Plan by Adding Scenic Highway and Safety Elements. There being no one present wishing to speak, and no correspondence received, Mayor Hopkins declared the public hearing closed. Councilman Eck asked for clarification with reference to the water system and capacity for delivering water to all areas of the City to control fires, as set forth in the Safety Element segment of the addendum. Discussion followed with City Manager'Callinan, the Council and City Engineer Brust participating. Councilman Flores initiated a brief discussion with reference to the Scenic Highway Element section of the addendum, as to whether when a use permit on a billboard expires it can be reinstated. Planning Director Skanchy advised that the applicant must re -apply for another permit. Resolution 75.102 RESOLUTION OF THE COUNCIL OF THE CITY OF ROHNERT PARR APPROVING AN ADDENDUM TO THE GENERAL PLAN BY INCLUDING A SCENIC HIGHWAY ELEMENT AND A SAFETY ELEMENT. City Manager explained the resolution. Upon motion of Councilman Beary, seconded by Councilman Flores, and unanimously approved, Resolution 75 -102 was adopted by title. File No. 0411, City Manager Callinani explained the proposed development Ray Hoffman III, plan, and stated that notice of public hearing had been Development Plan published in the local newspaper and mailed to property & Architectural owners in the subject area. Review, 80 Unit Apartment Complex Page 9 April 21, 1975 Planning Director Skanchy, referring to plans on display and Planning Staff Report dated March 26, 1975, further explained the proposed apartment complex development. Mr. Skanchy submitted to the Council a sample of the roof composition material which the developer would like to utilize. City Manager Callinan reviewed his April 17th memo to the Council commenting on this project. Discussion followed with the Council, City Manager Callinan and Planning Director Skanchy participating. Mayor Hopkins declared the scheduled public hearing open on File No. 0411, Ray Hoffman III, Development Plan for 80 Unit Apartment Complex on Southwest Boulevard. Mr. Callinan read a letter from Mr. John R. Simmons, Chairperson, Housing Dept., of California State College, Sonoma, wherein Mr. Simmons stated he had reviewed the proposed development and suggested the providing of two items; i.e., spaces for two bicycles per unit which would be lockable and enclosed activity space for group meetings and recreational activities. Mr. Ray Hoffman, developer and applicant, Mr. Brent Dickens, Architect and Mr. Cruz, Landscape Architect and Planner were present and recognized. Mr. Cruz spoke to the Council and explained their feelings regarding the design of the proposed development. Mr. Dickens, Architect, was recognized and presented to the Council photos and renderings of similar projects recently completed. Mr. Dickens stated that he felt wood shingles would be attractive and appropriate and had samples to present to the Council. Discussion followed;with. the Council, Mr. Hoffman, Mr. Cruz, City Manager Callinan and Planning Director Skanchy participating. There being no other person desiring to be heard and no other correspondence received, Mayor Hopkins declared the public hearing closed. Discussion followed with the Council considering the various aspects of the plan with regard to wood shingles vs. cedar shakes, a 30 foot set "track on Southwest Blvd., installation of fencing, amount of open space and completion of the pool and recreation facilities simultaneous with the completion of phase one. Councilman Flores made a motion, seconded by Councilman Smith, to approve the site development plan and give architectural approval for the proposed Ray Hoffman SO Unit Apartment Complex contingent on the conditions imposed by the Planning Commission plus the use of cedar shingle; and a 30 foot set back on Southwest Boulevard. Discussion followed. Page 10 April 219 1975 Councilman Eck made a motion which seconded by Councilman Flores, and unanimously. approved, to amend Councilman Flores' motion to include the two items suggested in the letter received from Mr. John R. Simmons, California State College, Sonoma. Councilman Eck made a motion, seconded by Councilman Smith, to amend Councilman Flores° motion to state that the recreational facilities and pool would be included in phase one of the development. Councilman Eck's motion was approved by the following roll call vote- AYES: (4) Councilmen Beary, Eck, Flores and Hopkins NOES: (1) Councilman Smith Councilman Eck made a motion, seconded by Mayor Hopkins, to amend Councilman Flores' motion to include some fencing on the boundaries of Southwest Boulevard. Councilman Fek's motion failed by the following roll call vote: AYES: (2) Councilmen Eck and Hopkins NOES: (3) Councilmen Beary, Flores and Hopkins The motion of Councilman Flores, seconded by Councilman Smith, to approve the Hoffman apartment complex development plan as amended was approved by the following roll call vote: AYES: (4) Councilmen Beary, Eck, Flores and Smith NOES: (1) Mayor Hopkin_q Recess Mayor Hopkins declared a recess at this point in the meeting, the time being approximately 9:40 p.m. Reconvene Mayor Hopkins reconvened the meeting at approximately 9:55 p.m. with all Councilmen present. File No, 0412 City Manager Callinan explained the proposed site plan for Codding Construction the office complex. Co., Development Plan and Architec -- Planning Director Skanchy, referring to plans on display, tural Review, and Planning Staff Report dated March 21, 1975, further Office Bldg. on explained the site plan, which included a total of four Commerce Blvd. professional office buildings intended for future develop- ment on the same site, and proposed architecture. Mayor Hopkins declared the scheduled public hearing open on File No. 0412, Codding Construction Company's site development plan and architectural review for a professional.office building on Commerce Blvd. Mr. Eivin Falk of Codding Construction Company was present and recognized by the Council. A brief discussion between the Council and Mr. Falk ensued. Page 11 April. 21, 1975 There being no other person desiring to be heard, and no correspondence received, Mayor Hopkins declared the public hearing closed. Upon motion of Councilman Flores, seconded by Councilman Smith, and unanimously approved, the site plan for the proposed development of an office building on Commerce Blvd., was approved subject to the conditions imposed by the Planning Commission. Development and City Manager Callinan advised that each Councilman had been Residential Survey given tonight a copy of a report prepared by the Planning Director and City Engineer concerning development activity. He advised that since the Council had not yet had time to study it that it would be put on the next Council agenda for discussion. CYO Basketball and City Manager Callinan, referring to Park and Recreation Uniforms Director Pekkain's memo of April 15, 1975, requested that the Council approve the expenditure of $365.82 for basketballs and uniforms for the CYO Basketball program. Upon motion of Councilman Flores, seconded by Councilman Beary, and unanimously approved, Council approved $365-82 for basket balls and uniforms for the CYO Basketball program. Noto-Cross Dirt City Manager Callinan, referring to Park and,Recreation Track Facility Director Pekkain's memo of April 15, 1975, explained to the Council that their consideration was requested for a dirt track facility for bike events. He recognized Park and Recreation Commission member Ron Fiori and also Mr. Mike Hodgins who were in the audience. Mr. Hodgins stated that he and volunteers would design the track, oversee parking facilities, portable chemical toilets and the insurance. Discussion followed with the Council, City Manager Callinan, City Attorney Flitner and Mr. Hodgins participating. There was some concern expressed regarding an area where adequate parking facilities would be available. Upon motion of Councilman Flores, seconded by Councilman Beary, and unanimously approved, the Council endorsed the concept of the loto-Cross Track Facility and requested the City Manager to make a survey for a feasible site and report back to the Council. Jean Hoyt, Park 1234 Camino Coronado, were recognized and spoke to the -Council regarding the current situation of Colegio, Vista Park. They specifically asked for a Tot Play Area with appropriate equipment, and a Play Area for Older Children, with appropriate equipment. Discussion followed with City 14anager Callinan explaining some equipment had been placed in the park, but that the rainy season had held up the completion of the play areas and turf. Page 12 April 21, 1975 Upon motion of Councilman Smith, seconded by Councilman Flores, and unanimously approved, the Council acknowledged the request of Mrs. O'Halloran and Mrs. Hoyt and requested the Public Works Department to ,proceed with the placement of the requested playground equipment at Colegio Vista Park. Letter from Cotati City Manager Callinan referred to a letter from Chief�Rippin Fire District of the Cotati Fire Protection District, copies of which Concerning Fireworks had been presented to the Council, wherein the Chief states that the sale of fireworks had been banned within the Cotati Fire Protection District. He asked for the City of Rohnert Park to also join in banning the sale of fireworks. Discussion followed with Mr. Callinan and the Council participating. It was.felt that the safe and sane fire- works sold in Rohnert Park were not hazardous and added much to the duly 4th holiday, as well as gave service organizations a means to raise funds. Upon motion of Councilman Flores, seconded by Councilman Beary, and unanimously approved, the Council requested that the current policy of the City be maintained in regard to the sale of fireworks, and that a letter be directed to the Cotati Fire Protection District so stating. Spivock Land City Manager Callinan gave a brief report stating he had met with the County and Santa Rosa officials on April 16th with regard to acquisition of the Spivock land for open space. He further stated there did not seem to be any outside money available at this time. He anticipated getting in touch with Supervisor Kortum within the week for further discussion on this matter. Fringe Benefits for City Manager Callinan, referring to his memo of April 17th, Retired and explained that-.it would be most beneficial for retiring Disabled Employees or disabled employees to be able to retain the health and medical programs under which they participated with the City. Resolution 75 -103 RESOLUTION OF THE COUNCIL OF THE CITY OF ROHNERT PARK OUTLINING POLICIES FOR CONTINUATION OF CERTAIN FRINGE BENEFITS TO RETIRED AND DISABLED EMPLOYEES' City Manager Callinan explained -the resolution. Upon motion of Councilman Flores,- seconded by Councilman Smith, and unanimously approved, the reading of Resolution 7.5 -103 was waived and said resolution was adopted. Increasing Dispatch City Manager Callinan, referring to his memo of April 17th, Charges for City explained that due to increased costs it was necessary of Cotati to increase the dispatch service charges to Cotati from $1,000000 to $1,500000 per month. A brief discussion followed. Upon motion of Councilman Beary, seconded by Councilman Eck, and unanimously approved , Council authorized the increase in dispatch service charges to the 'City of Cotati to $1,500..00 per month: effective May 19 1975. Page 13 April 21, 1975 Parkside Apartment City Manager Callinan briefly reported on complaints that Tenant Complaints he had received from tenants of Parkside Apartments. Mr. Callinan checked into the matter and talked with the new manager of the apartments . concerning these complaints. He stated that the new manager seemed cooperative, had just taken over the management of Parkside Apartments, and assured him that she would work with the tenants having problems. AC on Golf Course City Manager Callinan advised the Council that staff was Bridge looking into the possibility of putting asphalt covering on the golf course bridge with the funding to be from the balance available in the Hinebaugh Creek Drainage project fund. Golf Course Score City Manager Callinan advised the Council that the City was Cards out of score cards for the golf course and would like to purchase in the quantity of at least 50,000 to cost approximately $2,000, but that more might be ordered depending on the price break. Councilman Flores suggested that the bridge on holes 4 and 6 be shown on the score card. Upon motion of Councilman Beary, seconded by Councilman Smitb,and unanimously approved, Council authorized the purchase of golf course score cards. League of California City Manager Callinan advised the Council that the League Cities Redwood of California Cities Redwood Empire Meeting would be held Empire Meeting in Calistoga on April 26th. Councilman Hopkins and Councilman Smith stated they would attend the meeting. Public Health City Manager Callinan stated he had looked at a possible Service Site public heilth service location behind the shopping center next to the rear entrance of the Post Office. He indicated that repairs would be needed, and the rental cost would be approximately $150000 per month. Mr. Callinan stated there might be some funding forthcoming from the County for this facility. Mr. Callinan will follow up on this matter with a letter to the Public Health Nurse. Councilman Eck indicated he would like more information on the facility as to need and financing. Emergency Plan City Manager Callinan advised that a rough draft of the Draft Emergency Plan prepared by the Department of Public Safety had been sent to the Council. Mr. Callinan asked for comments and suggested they be submitted to him at the Council's convenience. Meetings re City Manager Callinan advised that on Thursday, April 24th Library and the County Board of Supervisors would be meeting to Wastewater consider recommendations for use of Federal Revenue Sharing Funds and the City's request to use same for libraries construction, and that the Regional Water Quality Control Board would also be meeting to consider Rohnert Park's situation. Mayor Hopkins indicated that he and Councilman Beary would represent the City at these two meetings. Page 14 April 21, 1975 Wastewater Project City Manager Callinan stated a work session regarding the Wastewater Project should be scheduled. The consensus of opinion was for April 28`3,. 1975, 7.00 p.m. Selection of City Attorney Flitner briefly discussed his memo of April Mayor 17th to the Council concerning selection of a Mayor for a four year term, and a proposed ordinance attached thereto. Discussion followed with the Council, City Attorney Flitner and City Manager Callinan participating. Reference was made to City Manager Callinan°s memo regarding his thoughts on the selection of a Mayor. Further discussion followed with questions concerning the General Law being clarified by Mr. Flitner. Councilman Eck made a motion, seconded by Councilman Smith, to explore the possibility of changing the name from Mayor to some other designation such as Chairman. Councilman Eck °s motion failed by the following roll call vote, AYES. (2) Councilman Eck and Smith NOES' (3) Councilman Beary, Flores and Hopkins Councilman Flores made a motion, seconded by Councilman Beary, to request City Attorney Flitner to prepare a questionnaire for the next ballot election asking the voters whether the Mayor of Rohnert Park should be selected by the Council or elected by the people. Councilman Flores' motion was approved by the following roll call vote. AYES. (3) Councilmen Beary, Eck and Flores NOES. (2) Councilmen Smith and Hopkins Tenants Rights City Attorney Flitner briefly discussed tenants rights and landlord vs. tenant rights and laws from the Civil Code. He opined that the question of whether a landlord could or could not enter a tenant's apartment was a matter of contract between the landlord and the tenant as per the State Code. He stated he had contacted the City of Berkeley regarding their policies. Nuclear Power Councilman Eck advised that the Secretary of State had declared as qualifying an initiative to be on the State ballot concerning nuclear power and that the Governor has requested the State Resources and Conservation Development Commission to make an inquiry into the ramifications of developing nuclear power in California. Upon motion by Councilman Eck, seconded by Councilman Smith, and unanimously approved, staff was directed to send a letter over the Nayor °s signature urging Governor Brown to require the Commission to submit its report on nuclear power by January.l, 1976 so that the information can be used by voters in considering the nuclear power matter to be on the ballot. Circle Mayor Hopkins initiated a discussion regarding the Golden Dinner Circle dinner attended by himself and Councilman Eck, Mayor Hopkins suggested that perhaps a Bar- B -nQue facility and some horseshoe pits could be installed at the rear of the Community Center for use by the Fun Over 50 group this summer. Upon motion of Councilman Beary, seconded by Councilman Eck, and unanimously approved, Council requested that staff install some horseshoe pits and Bar°B-Que facilities at the rear of the Community Center. Proclamation A Proclamation Denouncing Litter was presented by Mayor Denouncing Litter Hopkins. Upon motion of Mayor Hopkins, seconded by Councilman Flores, and unanimously approved, the first week of I•lay was designated as AntiLitter Week under the Proclamation Denouncing Titter, AB 307 Councilman Smith initiated a discussion regarding AB 307 (Mandatory Time Off for Law Enforcement Representatives). Upon motion of Councilman Smith, seconded by Councilman Beary, and unanimously approved, the Council went on record as opposing AB 307 and directed a letter be sent to appropriate State officials over the Mayor's signature concerning same. AB 306 Councilman Smith initiated a discussion regarding AB 306 (Required Time Off for Employee Representatives) Upon motion of Councilman Smith, seconded by Councilman Beary, and unanimously approved, the Council went on record as opposing AB 306 and directed a letter be sent to appropriate State officials over the Mayor's signature concerning same. AB 958 Councilman Smith initiated a discussion regarding AB 958 (Maximum Hours and Time and One-Half for Overtime). Upon motion of Councilman Flores, seconded by Councilman Beary, and unanimously approved, the Council went on record as opposing AB 958 and directed a letter be sent to appropriate State officials over the Mayor's signature so stating. Beautification Councilman Flores initiated a discussion regarding the Project Beautification Project stating that weather permitting the tree planting will be accomplished in Mayo Mr. Flores asked City Manage" Callinan if information regarding the project could be written up in the next Newsletter. Mr. Callinan replied in the affirmative. Deputy City Clerk Page 16 April 219 1975 Newsletter Councilman Smith asked City Manager Callinan if it would be possible to include in the Newsletters some type of questionnaire for the residents,of Rohnert Park to express their opinion on various.subjects such as how to select the Mayor. Mr. Callinan replied in the affirmative. Extension Courses mayor Hopkins briefly discussed the Extension Course bko- chures from the University of California. He felt posgibly some member of the staff should be interested and encouraged in attending some of the sumposiumse Disclosure Councilman Eeary queried City Attorney Flitn.er with regard Requirements to the Disclosure Requirements of public officials. Mr. Flitner stated they must file twice, on the anniversary of their election and after the first of the year.
