Mr. Richard Day, 7605 Beth Court resident, appeared before the Council and stated that he had talked to Young America Homes representatives and City staff, and was now opposed to this particular type of development; that he felt the Council was approving spot development which was not shown ROHNERT PARK CITY COUNCIL MINUTES August 25, 1969 The Council of the City of Rohnert Park met this date in special session at 8:30 p.m. in the City Offices, 435 Southwest Blvd., Rohnert Park, with Mayor Rogers presiding. Call to i•sayor Rogers called the meeting of the special session to .Order order at approximately 8:30 p.m. Present, Councilmen Buchanan, Roberts, Smith and Rogers Absent: Councilman Hopkins Staff Present: _ City Manager Callinan, Deputy Attorney Mawson, County Planner Vail Colegio Vista City Manager Callinan brought the Council up to date on Sub. No. 2 the Young America Home tentative map for Colegio Vista Tentative Subdivision No. 2 in the El Colegio Area, north of South- i' °iap west . Blvd o , east of the railroad. The City I- lnager ad- vised that Young America Homes had also submitted a site development plan for their proposed development south of Southwest Boulevard. County Planner Wes Vail recommended approval of the tenta- tive map with the provisions that the conditions set by the Council be complied with and on the basis that before the final map is approved that the zoning ordinance be amended to permit the proposed development. At this time, Mayor Rogers solicited comments from the audience. Mr. 'roar► Piazza inquired and was advised by the Council that the Council was discussing only the tentative map, i.e. those lots around the school and park site at this time. Mr. Piazza suggested that the Council use this development as a trial basis, and if this development proves successful after two or three years let Young America Homes build others. Mr. Bill Ayers, resident, was present, and stated that he was in favor of low cost housing, but opposed to 459 wide lots in general, that he had never seen 459wide lots as an asset to a community. Mr. R. W. O'Neel of Young America Homes complimented Mr. Day on his presentation, and commented that Mr. Day's knowledge of the subject proved that citizens were taking an interest in the development of their City. Mr. O'Neel advised that it isn't the size of the lot that counts, but what is done with the lot itself: He then introduced Mr. Bob Hayes of Iiayes, Smith, Trocket & Blair, an architect and planning firm. Mr. Hayes displayed a siting plan for the proposed subdivision and four site plans of individual lots showing what can be accomplished on a 45' lot, and explained that the entire street will be planned at one time so that building set backs and fencing can be stagger- ed to give each lot individuality. Mr. Ayers asked Mr. Hayes how an individual was to maintain the side of the house sitting on the property line. Mr. Hayes explained that the property owner whose house set on the property line would have a maintenance easement to maintain that portion of the house setting on the property line., but that that side of the house would have to corres..- pond with the adjacent property owner's landscaping and color scheme. In response to a question from Mr. Maurice Fredericks, a resident, Mr. Hayes advised the Council that the lots would have two car garages and driveways sufficient to permit off-street parking. Mr. James Cronin, resident, asked how many homes would be in the $16,000 bracket. Mr. Hayes replied that approxi- mately 20% of the homes will be two bedroom in the $16,000 price range, but this figure might change depending on public demand. In reply to a question from Mr. Day, Mr. O'Neel advised that Young America Homes would do the landscaping and fencing on the front or street side of the homes. At the inquiry of Councilman .Roberts, County Planner Vail advised that this development had one -third greater density as compared with other city lots of 60' to 65' width. Deputy City Attorney Mawson informed the Council that with the use of building permits the Council could limit the number of two bedroom homes in the development. City Manager Callinan reviewed twenty -two (22) conditions that staff recommended be conditions of Council approval of the tentative map for_Colegio Vista Subdivision No. 2. The City Manager reminded the Council of the PUC re-- hearing relative to the Southwest Boulevard Grade Crossing Page v. 3 to be held in the Council Chambers on September 11 and 12 indicating that any proposed development such as that being considered could help get approval of the grade crossing. A motion was made by Councilman Smith and seconded by Councilman Buchanan to approve the tentative map sub3ect to the developers agreement on all, part or a portion of all twenty -two recommended conditions recommended by staff. The motion was reworded following a discussion relative to the recommended conditions Mr. O'Neel, Young America Homes, questioned recommendations No. 9, 21 and 22. Mr. 09Neel advised that Condition No. 9, the undergrounding of utilities, had not been discussed and he had no idea as to the difference in cost of stream- lining or undergrounding utilities. Ivir. Ken Valine, PG&E' representative.was present and advised that at the present time streamlining utilities cost was 80� per lineal foot and full undergrounding cost was $1.20 per lineal foot. Councilman Smiti stated that he did not feel that now was the proper time to discuss the undergrounding of facilities that this should have been brought before the Council at the August 18th meeting. Mr. O'Neel also advised that Young America Homes could not agree to construct Southwest Boulevard (Condition into. 21) because they did not own Southwest Boulevard, but if Young America Homes did own Southwest Boulevard they would agree to its construction. Relative to Condition No. 22, Mr. O'Neel asked who was going to enforce the TV antenna restriction. The Council suggested that a covenant be placed in the deed restric­ tions and that the prospective property owner be made aware of it at the time of purchase and the the City would enforce the restriction. Mr. Art Howard, Sonoma Campus Company, questioned Condition No. 2, the dedication of the park site. 1,4r. Iioward advised that there was a problem of getting title to the property and that the park site could not be dedicated to the City at this time. Hr. Callinan indicated he was informed of Sonoma Campus Company's problem concerning the park site, but that it was imperative for the City to acquire same by some method to avoid any possible difficulty concerning its acquisition. Mr. Richard Day asked. the Council how the Council could vote on something that is in violation of the City Ordi- nances. Deputy City Attorney Mawson advised that the Council was only approving the tentative map, that the necessary City Ordinances would be amended prior to approval of the final map. Mr. Bill Ayers initiated a discussion regarding full under.. grounding in future developments, and asked if the Council was going to force future homeowners to use CATV if they Deputy Csty Cleric APPROVED, wanted television. The City Manager advised thatgthe subject of full undergrounding was scheduled to be dis- cussed at the next regular meeting of the City Council.. At City Manager Callinan's inquiry the Council indicated that the City would remain with the understanding that the City had with Valley View Land Developers regarding the park site which was a purchase price of $750 per acre. Council Upon motion by Councilman Smith, seconded by Councilman Action Buchanan, and unanimously approved by roll call vote, the tentative map of young America domes for Colegio Vista Subdivision No. i2 was approved subject to the twenty -two (22) conditions recommended by staff, a copy of which is attached ,hereto. Adjourn -- There being no further business the meeting was adjourned ment at approximately 9 :30 p.m. Deputy Csty Cleric APPROVED, Recommended Conditions for Colegio Vista Subdivision No. 2 Tentative Map 1. Prior to water service being provided to the subdivision, that the City of Rohnert Park be reimbursed $4,305 (700'x $6.15)for the first 700 feet of the Southwest Boulevard water main immediately east of the railroad and that Sonoma Campus Company enter into an agreement with the City relative to the refunding to City of the balance of costs for said water main. 2. The park site being dedicated to the City immediately. The park site shall have frontage on Southwest Boulevard from Lot 48 eastward to the elementary school site as shown on the site development plan submitted for Colegio Vista Terrace. 3. The City's per acre assessment development fee being paid upon filing of final map. (With City Council approval payment requirement may possibly be deferred until building permit is issued.) 4. Submission of improvement plans for streets in accordance with City Standards. 5. Submission of improvement plans for water and sewer system in accordance with City standards. Connection to City's sewer and water system will require advance payment of per acre assessment development fee. 6. That fire hydrants shall be located as required by the Department of Public Safety and water service to same shall be at least 6 inch service. 7. Drainage improvements shall be constructed and drainage easement areas shall be offered for dedication in accordance with the Flood Control Design Standards and as required by the Chief Engineer of the Sonoma County Flood Control and Water Conservation District and the City Engineer of Rohnert Park. The Engineers shall provide such cal- culations and /or analyses as is required by the District's Plan Checking Guidelines to thoroughly support the drainage proposals and to investigate all areas of potential flood hazard to this subdivision. 8. That all sewer, water, drainage and walkway easements shall be provided. 9. That utility easements required by Pacific Gas 8 Electric Co. and Pacific Telephone Co. shall be shown on the final map. Said easements shall be those necessary for the installation of total underground -type construction for telephone, power and street lighting facilities. 10. That prior to filing of the final map the subdivider shall enter into an agreement with the City for construction of the subdivision improvements. Subdivider shall post security, cash or bonds, to guar- antee completion of the improvements. Said agreement and security shall be approved by the City Attorney. 11. That no construction of any of the required subdivision improve - ments shall be commenced until improvement plans for same have been submitted and approved by the City Engineer, Superintendent of Public Works, Director of Public Safety, the Chief Engineer of the Sonoma County Flood Control & Water Conservation mist., and the City Council. 12. That building set back lines shall be shown on final map. To avoid monotony actual building set backs shall be staggered. 13. Submission of detailed drawings of fencing for review and approval prior to construction. This applies to fencing on Southwest Boulevard where back-up treatment will exist and also along Copeland Creek. 14. Submission for review and approval of the landscaping plans for Southwest Boulevard. 15. That for circulation purposes, a temporary roadway be constructed through Lot 49 on Via Chiquita and Southwest Boulevard be constructed therefrom easterly to its present terminus. 16. Walkway from Via Chiquita to park site shall be improved and landscaped by developer. 17. Walkway from Camino Coronado shall be increased to 151 and shall be improved and landscaped by developer. 18. That the names of Via Chiquita and Via Callecita be changed,res- pectively, to Chiquita Court and Callecita Court or some other less confusing name. 19. Submission for approval, prior to construction of any houses, of typical lot layouts for the various model houses and a complete siting plan for the subdivision. 20. Submission of a certified statement from Engineer Hudis that the sewer and water mains existing in the area will be able to handle the increase in density without any difficulty or without jeopardizing the orderly development of other areas to be served by said mains. 21. Developer, i.e., Young America homes and Sonoma Campus Company, both agreeing in writing to construct Southwest Boulevard from Country Club Drive to the railroad at such time as approval for a grade cross- ing is received. 22.
