1969/11/03 City Council MinutesROM= PARK CITY COUNCIL MINUTES November 3, 1969 The Council of the City of Rohnert Park met this date in regular session commencing at 7 :00 p.m. in the City Offices, 435 Southwest Boulevard, Rohnert Park, with Vice -Mayor Smith presiding. Call to Order In the absence of Mayor Rogers and Vice Mayor Smith, Councilman Buchanan called the meeting of the regular ses- sion to order at approximately 7 :05 p.m. Councilman Smith's Councilman Smith arrived at this point in the meeting, the Arrival time being approximately 7:07 p.m. Roll Call Present: (4) Councilman Buchanan, Hopkins, Roberts and Smith Absent: (1) Councilman Rogers Staff Presents City Manager Callinan, City Attorney Max - well and Consulting Engineer Hudis Approval of Minutes Upon motion by Councilman Buchanan, seconded by Councilman Hopkins and unanimously approved, the minutes of October 20, 1969 were approved as submitted. Approval of Bills Upon motion by Councilman HopkIftel, seconded by Councilman Roberts and un+mously approved, the bills presented for approval in the amount of 813086.64 were approved. Communications Communications per the attached outline,were brought to the attention of the Council. No action was taken on any communication except as noted specifice4ly in these minutes. Dog Show in April City Manager Callinan read a communication from the Deber- man Fanciers organization asking to use Benecia Park in April 1970 for a dog show. A discussion followed concern- ing provisions for refreshments for participants and observers with the Council indicating a preference that local service clubs be given the opportunity to sell. Upon motion'`by CouncilmanBuehanan, seconded by Councilman Roberts and unanimously approved, the Council approved the use of Benecia Park for the Doberman Fanciers Dog show in April 1970. Recreation Commis- City-Manager Callinan advised that a letter had been reoeiv- sion Candidate ed from Mr. Mark Raymond submitting his name for the vacancy on the Recreation Commission left by Mike Crowley. The Council thanked Mr. Raymond for his letter and Vice Mayor Smith suggested that an executive session be scheduled preceding the November 17th City Council meeting to discuss the vacancy on the Recreation Commission. Beautification of Railroad right of way November 3, 1969 Page --2-- Upon motion by Councilman Buchanan, seconded by Councilman Hopkins, and unanimously approved, the Council accepted Dr. Cord's resignation with regret and directed a letter to be prepared for the Mayor's signature thanking Dr. Cord for his past services on the Cultural Arts Commission. Councilman Roberts suggested that Dr. Cord's name be kept in mind should a vacancy occur after Dr. Cord's Sabbatical Leave in 1970. City Manager Callinan initiated a discussion relative to a letter received from Mr. Paul Golis concerning the beauti- fication of the railroad rights of way. 'City Attorney MWWell suggested that perhaps the PUC might be interested in the landscaping and maintenance of the railroad rights of way, but that there may be legal questions insofar as a city,requ#Apg railroads to beautify their right of way is concerned. > The Council requested Mr. Maxwell to investi•- gate the matter so it can be discussed at the next meeting. Traffic- Problem Councilman Roberts initiated a discussion on the traffic on Southwest Blvd. problems he felt the City was having on the west end of Southwest Boulevard due to the construction of new business- es, and suggested that Chief Dennett be contacted relative to a left turn lane in this area. I:hxchanan Addition Councilman Buchanan advised that he had obtained a building permit to construct an addition to his home, and that no variance was required from the Council. He showed plans for the addition to the Council. CATV Complaints Vice Mayor Smith initiated a discussion relative to the :.poor reception and poor repair service he has been receiv- ing from Storer Cable TV, Inc'. He also advised that other residents on Arlen Drive were having reception problems. City Manager Callinan advised that he had discussed this matter with Mr. Harper of Storer Cable TV, Inc., read a letter written to Mr. Harper, and advised that s'L. Harper would be at the November 17th meeting to answer any ques- tions the Council might have,relative to Cable TV recep- tion and repair service in Rohnert Park. Ordinance No. 125 AN ORDINANCE .AMENDING ORDINANCE NO. 63 - ZQWNG ORDINANCE (Changing Text of Planned Unit Development Districts) City Manager Callinan review/edhe ove ordinance which had been introduced at the O, 1969 meeting follow- ing a public hea ring. Upon motion by Council Bueconded by Councilman Roberts, and appthe £ ®�;ZoWjt g ro11 call vote, Ordinance No. 125 was AYES: 3) Councilmen Buchanan, Roberts & Smith, NOES: 1) Councilman Hopkins ABSENT: 1) Councilman Rogers November 3, 1969 Page -3-- File No. 0138 Dr. Lauren Anderson was present and reminded the Council of Dr. Anderson his request for rezoning of a portion of Mr. Owens property on Country Club Drive near the Rohnert Park Expressway. Dr. .Anderson then introduced Mr. Philip Rush of Jim Clark Realty his realtor. Mr. Rued relayed to the Council his conversations with Mr. Martin Stone and Mr. Paul Golis, property owners in the area, relative to the possible pur- chase of property for a medical center. Since there was some question regarding the conversation that Mr. Clark and Mr. Rush had with Mr. Stone the property )caner, Mr. Rush had requested dates of the conversation from the telephone company. Vice Mayor reviewed for the benefit of the Councilmen not present at the first public hearing and the audience, Dr. Anderson's request for rezoning, and the Council's motion on October 6th, that it had denied without prejudice the re-- quest for rezoning, but that if the applicant returned to the Council stating that he was unable to acquire suitable property in an area now designated for Professional use in the General Plan at satisfactory terms, the Council would again consider his request. City Manager Callinan summarized for the Council and those concerned his telephone conversations of this date with Dr. Anderson, Mr. Phil Rush, Mr. Martin Stone, and Mr. Robert Hicks (realtor for Mr. Stone) concerning the purchase of Mr. Stone's property which revealed that Mr. Stone was apparently willing to sell property to Dr. Anderson. Mr. Paul Golis was present and asked to address the Council relative to whether Dr. Anderson had received a reasonable offer of property. Vice Mayor Smith asked if Mr. Golis' remarks concerned the purchase of Mar. Stone's property. When Mr. Golis advised that it concerned his offer of property to Dr. Anderson, Vice Mayor Smith asked counsel of City Attorney Maxwell. Mr. Maxwell reminded the Council that they had denied the request for rezoning until the applicant had made a reasonable effort in trying to obtain property that is zoned for medical center use, and that Mr. Golis should be allowed to speak to this point. Mr. Golis related his conversations with Mr. Stone relative to the possible sale of his property and of Mr. Stone's property. Mr. Golis then began a detailed discussion of his proposal presented to Dr. Anderson, Dr. Anderson's objections, and Mr. Golis' feelings relative to the con- struction of a general hospital, a medical center and the establishment of a hospital board of directors for Rohnert Park. Vice Mayor Smith advised Mr. Golis that since his presenta- tion did not pertain to the purchase of Mr. Stone's property or any other property now designated for Professional Medical use that he was out of order. Yoder Agreement November 3, 1969 Page -4- A lengthy discussion followed concerning conversations between individuals concerned, City Attorney Maxwell, City Manager Callinan, and the Council relative to the procedure the Council should take in this matter. During the dis- cussion Mr. Golis asked that the record show that he would never deal with either one of these gentlemen, indicating Dr. Anderson and Mr. Phil Rush. Mr. Golis stated that the October 6th and 20th, 1969 minutes were nttoorrectly writ- ten and did not reflect the discussions at these two meet- ings, he asked that the Council tape their meetings for future reference. It was the decision of the Council that a Public Hearing be set on the rezoning of Mr. Owens' property for Dr. Anderson's medical center, :Br the November 17th meeting, and that City Manager Callinan try to meet with Dr. Anderson and Mr. Robert Hicks relative to the possible purchase of Mr. Stone's property to determine if a reasonable offer is made insofar as Dr. .Anderson's proposed use is concerned. City Manager Callinan requested that action of the proposed agreement with Yoder/Orlob Associates be deferred until the next meeting. Project 1969 -4 City Manager Callinan gave a progress report on Project No. 1969.4, the Southwest and Commerce Boulevards Overlay Project, advising that the overlay had been completed and traffic striping would be completed within the week. Annexation #6 City Attorney Maxwell advised that he and City Manager Callinan had been scheduled for the November 6th LAFC meeting to request an extension on Annexation No. 6, Rohnert land south of East Cotati Avenue. City Attorney Maxwell also advised that the annexation agreement should be confirmed by Mr. Rohnert prior to the LAFC meeting. Recreational City Manager Callinan advised that the Suggested Change in Facilities City Policy for Community Use of Recreation Facilities was still under discussion, but possibly would be ready for presentation to the Council at the November 17th meeting. Animal Control City Manager Callinan advised that the noise reducing Area structure around the anirna.l control area behind the Public Safety Building had been started by the Public Works Department. ICMA Conference City Manager Callinan reported briefly regarding his ICMA Conference in New York in October. Snyder Lane Improve - City Manager Callinan advised that a petition for an ment Project 1969 -1. Assessment District for the improvement of Snyder Lane be- tween East Cotati Avenue and the Rohnert Park Expressway had been signed by enough property owners to commence the assessment district proceedings, and that City Engineer Hudis had signed a certificate stating that the signatures November 3, 1969 Page -5- on the petition were over the 60% of property owner signa- tures required. Golf Course The City Manager requested an executive session following this meeting to discuss litigation relative to the improve - ments to the golf course. Sprinklers for City Manager Callinan advised that the Recreation Commis - Benecia Park sion had recommended to the Council the installation of sprinklers in the west end of Benecia Park with funds of the City of Rohnert Park Recreation Corporation, and re- quested tbuncil's approval for installation. Upon motion by Councilman Roberts, seconded by Councilman Hopkins, and unanimously approved, the Council authorized the installation of sprinklers in the west end of Benecia Park. CYO Basketball The City Manager also advised that the Recreation Commis- sion also approved the allocation of funds for the CYO basketball program, and requested Council's approval of this allocation. Upon motion by Councilman Buchanan, seconded by Councilman Hopkins, and unanimously approved, the Council authorized the allocation of funds in the amount of $700 for the 'CYO basketball program. Benecia Park City Manager advised that he would try and have figures Dugouts to present to the Council at their next meeting relative to the cost of installing a concession stand and dugouts in the Benecia Park area. City kttorney's City Attorney Maxwell gave brief verbal reports on the Report "progress of the Davi operation on Commerce Boulevard; the cat regulations for the.City; the suggested ordinance for requiring health permits for food handling establishments within the County; and the Southwest Boulevard grade crossing. Medical Facilities Mr. Paul Golis addressed the Council and advised that dur- ing the meeting he had wanted to discuss the importance of providing a medical facilities in this area. He indi- cated that he felt the Council was not cooperating in this important matter and that Councilman Smith allowed more time during the meeting for his personal CATV complaint than he permitted to be allowed on the hospital matter. Resident Complaints Mrs. Lillian Gonzales, 369 Bonnie Court, appeared before the Council and requested information concerning weed abate- ment, fencing regulations, and the City Ordinances9 which she stated she was unable to obtain upon inquiry to the City Manager's office. The City Manager advised Mrs. Gonzales that the City Ordinance files are open to the November 3, 1969 Page W6-4 public and she could review them any day between 8:00 a.m. and 5000 P.M. in the City Offices® Adjournment There being no further business the meeting was adjourned at approximately 8 :35 P.M. to an executive session in the City Offices, O g Deputy City Clerk APPROVED-.
