1968/12/02 City Council MinutesCall to Order Approval of Minutes' Approval of Bills ROHNERT PARK CITY COUNCIL 14INMS December 2, 1968 The Council of-'the City of Rohnert Park met this date in regular session commencing at 7:15 p.m. in the City Offices, 435 Southwest Boulevard, Rohnert Park, with Mayor Roberts presiding. This meeting was preceded by a brief executive session to discuss personnel matters, appointments to the Recreation Commission and the Cultural Arts Commission. Mayor Roberts called the meeting of the regular session to order at approximately 7:15 p.m. Presents (3) Councilmen Hopkinp, Rogers and Roberts Late: (2) Councilmen Buchanan and Smith Staff Present: City Manager Callinan, Consulting Engineer Milt Hudis and County Planner Wes 'fail. Upon motion by Councilman Rogers, seconded by. Councilman Hopkins, and unanimously approved'the'ftinutes of November 18, 1968 were approved as submitted. Upon motion by Councilman Rogers, seconded by Councilman Hopkins, and unanimously approved the bills presented for approval were approved. Executive Session Mayor Roberts advised that an executive session had been held prior to the commencement of the regular session to discuss personnel matters, and appointments to the Recrea- tion and Cultural Arts Commissions. Mayor Roberts reported that.no decision had been reached. Communications Incoming correspondence and communications, per the attached outline, were brought to the attention'�:of the Council. No action was taken on any communication except as specifically noted in these minutes. Cultural Arts Com- .City Manager Callinan read the letter of resignation received mission from Mrs. Maxie Anderson of the Cultural Arts Commission. Upon motion by Councilman Rogers, seconded by Councilman Hopkins, and unanimously approved, Mrs. Anderson's letter of resignation from the Cultural Arts Commission was accept- ed with regret, and the Mayor was asked to inform.Mrs. Anderson of their action and express the Council's apprecia- tion for her contributions to.the Cultural Arts Commission in the past. City Manager Callinan reviewed the ordinance and advised that notice of a public hearing on the matter had been pub - lished in the local newspaper. Public Hearing on Mayor Roberts declared open the scheduled public hearing on Ordinance No, 109 Ordinance No. 109. There being no one wishing to be heard and no written com- munications received on the matter, Mayor Roberts declared the public hearing closed. Upon motion by Councilman Rogers, seconded by Councilman Hopkins, and unanimously approved, the reading of Ordinance No. 109 was waived and said ordinance was adopted. Ordinance No. 110 AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING ORDINANCE N0. 91 BY CHANGING THE SCHEDULE OF RATES FOR COMKMTY ANT.EEMA TELEVISION SERVICE SET FORTH THEREIN. City Manager Callinan reviewed the ordinance. Due to Councilman Roger's declaration of a nnnoiM p of interest in the matter the adoption of Ordinance No. 110`. was deferred because only three Councilmen were present. Ordinance Nos 111 AN ORDINANCE OF THE CITY OF ROHNFRT PARK RELATING TO CITY GOVMM'=T, PROVIDING FOR THE TIME AND PLACE OF MWINGS OF THE CITY COUNCIL AND REPEALING ORDINANCE NO. 2. City Manager Callinan reviewed the ordinance. Upon motion by Councilman Rogers, seconded by Councilman Hopkins, and unanimously approved, the reading of Ordinance No. 111 was waived, and said ordinance was adopted. Cultural Arts Com City Manager Callinan read a letter received from Dr. Cord mission dated November 14, 1968 regarding secretarial service for the Cultural Arts Commission. A. lengthy discussion' followed between Dr. William Cord, President of the 'Cultural Arts Commission, and the Council regarding various ways to-handle secretarial duties. City Manager Callinan suggested that if the Cultural Arts' Coiianission continues to expand and solicit funds that the Commission should possibly be set up as a non - profit corpor- ation December 20 1968 Page -3- It was the decision of the Council that the Mayor, City Manager Callinan and Dr. Cord have a meeting to explore the matter further and report back to the Council. File No. 108 City Manager Callinan reviewed Mr. James Gimblett's appl.ica- James Gimblett - tcn for a use permit to operate a Christmas Tree sales Use Permit lot on'.Southwest Boulevard between the car wash and the shopping center. County Planner Wes Vail suggested that some provision be made to have Mr. Gimblett clean up the lot after trees are sold. Upon motion by Councilman Rogers, seconded by Councilman Hopkins and unanimously approved, the Council approved Mr. Gimblett's application for a use permit to operate a Christ- mas tree sales lot from December 7 through December 2% 1968 in the area on Southwest Boulevard.between the car wash and the Manor Center, with the condition that Mr. Gimblett post a $15.00 cleaning deposit to insure that the lot is cleaned up upon termination of the operation. File No. 0060 City Manager Callinan reviewed correspondence with Mrs. Marie Davi, et al Davi, regarUng, non - compliance with conditions of the use permit issued to her in April 1967, for a wholesale - re- tail building materials operation at 5202 Commerce Boulevard. The City Manager advised that many attempts had been made to have the conditions of the use permit completed by Mrs. Davi over the past nineteen months. He indicated that the use permit was issued for a building materials operation; however, it appears the area is being used also as a truck terminal. Bicycle Paths. Master Plan of College area Upon motion by Councilman Hopkins, seconded by Councilman Rogers, and unanimously approved; the Council recommended that a public hearing be set for Monday, January 6, 1969 at 7 :00 p.m. to consider revocation of the use permit issued to Mrs. Davi. City Manager Callinan reported on the November 21st meeting with representatives of the County Planning Department, Nore Thiesfeld from Sonoma State College and Engineer Milt Hizdis regarding bicycle paths development. He indicated that it was the recommendation of those that met that the 8' parking lane on the south side of Southwest Boulevard, be used for a bicycle path and that possibly bike paths could be developed on other major City streets in a similar manner. Mr. Vail of the County Planning Department advised the Council that the County has assigned a plarnaer, who is work - ing full -time, to master plan the area around Sonoma State College. He reported that County staff has scheduled a December 2, 1968 Page -4- meeting with the Campus Planning Staff and hopes for a meet - ing with the City of Rohnert Park staff and the Campus Plan- ning Staff in `the near future. Traffic Counts City Manager Callinan summarized one day traffic analysis prepared by Chief Koch and the Public Safety Department at the intersections of Adrian Drive and East Cotati Avenue, and Adrian Drive and Arlen Drive. Stop Signs at John City Manager Callinan reported that Mayor Roberts, Chief Reed School Koch and he met with members of the John Reed PTA regarding the PTA's request for stop signs at the intersect-on of Adrian Drive and Arlen Drive. As a result of the meeting the PTA decided that stop signs at the John Reed School were not necessary at this time. Councilmen Smith and Councilmen Smith and Buchanan arrived at this point in the Buchanan arrive meeting, the time being approximately 8005 P.M. Expressway-Commerce Mr. Paul Golis appeared and displayed And Axplsa.int?r7 his pro_ Blvd. Development posed development at the intersection of the Expressway and Commerce Blvd. He indicated that the development would con- sist of an additional service station, an auto service cen- ter, a restaurant over the expressway and a tourist center. Mr. Golis asked for Council's approval to widen Commerce Boulevard and the Expressway to allow turn -in lane to the proposed tourist center development. A lengthy discussion followed concerning the widening of Commerce Boulevard and the development at the intersection. Councilman Rogers made a motion, which was seconded by Coun- cilman Buchanan, that the Council go on record as expressing an interest in the development and authorizing the City Nana- ger to proceed in working out the details with the necessary agents, and Mr. Golis and reporting back to the Council. Councilman Smith asked that the record show that he is com pletely onnosed to approving +wn Rprvi r.R qi:a.i-i nnr ai +M',e location at this particular time, and suggested that the Council try to obtain a planned unit for this area. Councilman Roger's motion was then approved by the following roll call vote: AYES: (5) Councilmen Buchanan, Hopkins, Rogers, Smith and Roberts NOES: (0) None File No. 0064 Mr. Paul Golis asked for Council permission to change the Rohnert Park Realty wording on the Rohnert Park sign, approved by the Council Sign on November 18, 1968, to read "Federman Industrial Park" December 2, 1968 Page -5-- on one.panel of same. Councilman Rogers made a motion to approve the request to change the wording on the sign but withdrew it after the Council decided to simply turn the matter over to the City staff for handling. Acquisition of Gas Mr. Golis gave a verbal progress report on obtaining cost & Electricity systems figures of feasibility studies for City operation of gas and electricity distribution systems. Ordinance Yo. 110 AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING ORDINANCE NO. 91 BY CHANGING THE SCHEDULE OF RATES FOR COMKUNITY ANTENNA TELLTISION SERVICE SET FORTH THMIN. City Manager Callinan again reviewed the ordinance. Council -- man Rogers declared a conflict of interest and asked that the record show he had not entered in the discussion or voting on the matter. A discussion followed concerning date of completion of CAN service to residents in Rohnert Park. Councilman Hopkins moved that the Council defer adoption of Ordinance No. 110 until the December 16, 1968 meeting. Said motion was seconded by Councilman Smith but failed to pass for lack of a majority by the following roll call vote: AYES: 2) Councilmen Hopkins and Smith NOES: 2) Councilman Roberts and Buchanan ABSTAIN: 1) Councilman Rogers The Council requested that Mr. William Schiller of Storer Cable TV appear before the Councilmat their December 16, 1968 meeting to give a progress report on installations and to explain why CATV service was not available to all resi- dents in Rohnert Park as promised by Mr. Schiller at the Council's November 4, 1968 meeting. Ordinance No. 110 was deferred until December 169 1968. Recess Mayor Roberts declared a five minute recess. Reconvene Mayor Roberts reconvened the meeting with all Councilmen present. The time being approximately 8 :45 p.m. Project No. 1966 2 City Manager Callinan presented a bill from the Northwestern Expressway Pacific Railroad in the amount of $15,507.01 for construe® tion of the grade crossing at the Expressway. Upon motion by Councilman Buchanan, seconded by Councilman Smith, and unanimously approved, the bill presented by Northwestern Pacific Railroad in the amount of $15,507.01 was approved for payment. December 2, 1968 Page -6- Mr. Callinan advised that Arthur B. Siri, Incas lawsuit for additional compensation was still pending in the Express- way project. Project No. 1968 --1 Engineer Hudis reported on the status of the improvement Area west side of plans and the engineer's report for this project. He re- freeway viewed with the Council and Mr. Hugh Codding, who was present, the proposed assessment diagram. 'Several ' ques- tions were raised by the City Manager and Council relative to the four assessment parcels shown at the Expressway and frontage road intersection. A discussion was held concern - ing the advisability of splitting the assessments into sizes that would make the bonds more saleable. During the discussion Mr. Codding expressed concern over what uses he might be allowed on the corners and what ob- jections he might expect from the City. The Council indi- cated that they would not make a definite dicision until they knew what specific uses were proposed, although, the assessments as indicated on the assessment diagram made the assessment parcels appear as proposed service station sites. Mr. Codding also indicated that unless he had some assurance that his company would be allowed to develop the property commercially then he had reservations about proceeding with the assessment district. The Council assured Mr. Codding the area is designated as commercial. City Manager Callinan initiated a discussion concerning the alternative methods available for financing the electrical and gas improvements which were to be a part of the assess- ment district. Upon motion by Councilman Rogers, seconded by Councilman Buchanan and unanimously approved, the Council requested that Engineer Hudis, City Manager Callinan, Mr. Codding and Bond Counsel get together to develop the most acceptable assessment diagram and the best program for retaining the financing ability for the electrical and gas improvements. Project. 1968-3 Engineer Hudis gave an up to date verbal progress report Copeland Creek on Project 1968 -3 9 the Copeland Creek improvement and East Cotati Avenue water main project. City Manager Callinan presented a bill in the amount of $8,912.80 from the El Colegio Gardens for acquisition of the water main and related improvements installed on East Cotati Avenue from the Petaluma acqueduct easterly to the city limits south of East Cotati Avenue. Upon motion by Councilman Smith, seconded by Councilman Buchanan, and unanimously approved, the Council authorized payment of $89912.80 to El Colegio Gardens for the water main and improvements on East Cotati Avenue. December 2, 1968 Page -7- Recreation & Community City Manager Callinan gave an up to date report on the pro- Center gress of the construction of the Community & Recreation Center. He suggested that the Council appoint a member of the Council to work with him in setting up a dedication committee for the Community & Recreation Center. Councilman Rogers was appointed as a member and chairman of the Community & Recreation Center dedication committee and was requested to present for Council approval a list of persons who would also be on the committee. Annexation No. 6 City Manager Callinan advised that there had been no progress on the status of Annexation No. 6, therefore, adoption of Ordinance No. 97 approving the annexation was deferred. County -wide tele- City Manager Callinan summarized a proposed agreement be- type System tween Sonoma County and cities in the county regarding the county -wide law enforcement teletype system. City Manager Callinan advised that City Attorney Maxwell had reviewed the proposed agreement and had suggested some changes which will be sent to the County for consideration. Model City Commission City Manager Callinan reported briefly on the November Model City Commission meeting, advising that the Commission had set up a meeting between college students, the Commission and members of the Council. Mayor Roberts asked if the date of December 12 set for the meeting could be changed as he would be unable to attend due to a conflicting meeting. City Manager Callinan indicated he would contact Chairman Tappin regarding a change of the meeting date. Benecia Pool City Manager Callinan brought the Council up to date on the college's request to keep Benecia Pool open during the winter months for development of a swimming team for which the college would be able to contribute $200.00 for opera- tion of the pool. There was a brief discussion regarding the expense to the City in keeping the pool open vs. benefits to the community. Upm motion by Councilman Rogers, seconded by Councilman Hopkins, and approved by the following voice vote, the Council agreed to continue to have Benecia Pool open on a month -to- month basis, and the Council to be kept advised when the pool is no longer useable. AYES: (4) Councilmen Hopkins, Rogers, Smith & Roberts NOES: (1) Councilman Buchanan Insurance specifi - City Manager Callinan mentioned the "Invitation for Insurance cations Proposal" specifications, copies of which had been forwarded to the Council for thier review, He advised that insurance proposals would be officially called for at the next meet- ing. December 2, 1968 Page -8- The Council asked that insurance companies be informed that the bids should be submitted exactly as requested on the bid proposals, and bids that do not conform with what is required would be rejected. Recreation Commission City Manager Callinan reported that he had contacted Mr. Haggett, Principal of Rancho Cotate High School regarding appointing a high school student to the Recreation Commis - sion and that Mr. Daggett suggested that possibly the stu- dent government by -laws could be amended to provide for filling the position, but until such could be done he would be willing to submit the names of several students for con - sideration. A lengthy discussion followed regarding proposed student housing in Rohnert Park, and the disadvantages to the community of on ®campus student housing. Mayor Roberts suggested that the Council meet with the College President's Cabinet to discuss the matter. Golf Course City Manager Callinan gave a brief up to date report on the progress of the improvements and operations of the .Iiohnert Park Municipal Golf Course, and advised that the back nine should be open for play by February 15. He presented ,.an expense and budget report for the golf course for the fiscal year through October 51, 1968. Volunteer Fireman City Manager Callinan reminded the Council that in the past the Council has provided the Volunteer Firemen with refresh - ments after the Council and Firemen's meetings just prior to Christmas.. The Council agreed that the tradition should be upheld as a small token of the City's appreciation for the `volunteer Firemen's services during the year. Student Housing Mr. Ralph Fitch of P.G. & E. was present and reported that there had been approximately 160 housing units connect - ed in Rohnert Park during the past year, with an estimate in excess of 50 units being for four or more students.
