The Council of the City of Rohnert Park met this
date in regular session commencing at 7 :15 p.m.
in the City Offices, 435 Southwest Boulevard,
Rohnert Park, with Mayor Roberts presiding. This
meeting was preceded by a brief executive session
to discuss possible appointments to the Recreaticm
Commission and Cultural Arts Commission and per -
sonnel matters.
Call to Order Mayor Roberts called the meeting of the regular
sessionto order at approximately 7 :15 p.m.

Approval of Min- Upon motion by Councilman Rogers, seconded by

Upon motion by Councilman Rogers, seconded by
Councilman Smith and unanimously approved, the
bills presented for approval were approved.
Communications
Incoming correspondence and communications were
brought to the attention of the Council. No
action was taken on any communication except as
specifically noted in these minutes.

Resolution No. RESOLUTION CONCERNING PROPOSED SANTA ROSA- ROHNERT
69 -19 PARK CONSOLIDATION.
City Manager Callinan read the subject resolution.
Upon motion by Councilman Rogers, seconded by
Councilman Hopkins, and unanimously approved,
Resolution No 69 -19 was adopted.
Ordinance No. 115 AN ORDINANCE AMENDING ORDINANCE NO. 86 (Cultural
Arts Commission)
City Manager Callinan summarized the above ordln-
ance.
Upon motion by Councilman Buchanan, seconded by
Councilman Smith, and unanimously approved the
reading of Ordinance No. 115 was waived and said
ordinance was introduced.
Ordinance No. 116 AN ORDINANCE PROHIBITING LOITERING, STANDING,
SITTING OR LYING ON ANY STREET, SIDEWALK OR PUBLIC
PLACE IN A MANNER TO UNREASONABLY PREVENT, DELAY
OR INTERFER WITH THE FREE PASSAGE OF OTHER PERSOM
AND PROVIDING PENALTIES FOR VIOLATION THEREOF.
City Attorney Maxwell and City Manager Callinan
reviewed the Ordinance. Chief Koch, Director of
Public Safety, was present to answer any questions
the Council might have. Dr. William Cord was pre -
sent and asked if provision had been made for
parades when streets and sidewalks might be block -
ed by crowds. City Attorney Maxwell and Chief
Koch assured Dr. Cord that provision for this had
been included in the ordinance.
Upon motion by Councilman Rogers, seconded by
Councilman Smith, and unanimously approved, the
reading of Ordinance No. 116 was waived, and said
ordinance was introduced.
Resolution 69 -20 RESOLUTION REQUESTING ADDITIONAL STUDY CONCERNING
ON- CAMPUS STUDENT HOUSING PLANNED FOR SONOMA STATE
COLLEGE.
City Manager Callinan read the above resolution
and distributed copies of the resolution to the
Council.
Upon motion by Councilman Buchanan, seconded by
Councilman Rogers, and unanimously approved,
Resolution No. 69 -20 was adopted.
Del Monte Visitor Councilman Smith introduced Mr. Gerry Hall of
Del Monte Corporation who he advised, was pre-
paring an article on Mr.' Smith's participation
in City Government and was attending the City

Council meeting to take notes and pictures for
his article.
Resolution No. RESOLUTION APPROVING AGREEMENT WITH THE DEPART -
69 -21 MENT OF FINANCE OF THE STATE OF CALIFORNIA CON -
CERNING POPULATION SURVEY.
City Manager Callinan reviewed the resolution.
Upon motion by Councilman Rogers, seconded by
Councilman Hopkins, and unanimously approved, the
reading of Resolution No. 69 -21 was waived and
said resolution adopted.
Nursery Education Mayor Roberts read a proclamation proclaiming
Week the week of March 3 through March 9, 1969 as
"Nursery Education Week" and urged the citizens
of Rohnert Park to participate by visiting nur-
sery schools to gain further knowledge.
Recess A brief recess was held during which Mayor Roberts
presented a copy of the proclamation to Mrs.
Evelyn Hahn, President of the Cotati Parents
Nursery School Club who was present.
File No. 0117 City Manager Callinan reviewed Mr. Bart Mitchell's
Mitchell Rezoning application for a zoning change from R -2 -3000 to
on Arlen Drive RM -1500 of AP's 143 - 081 -01 & 02 on Arlen Drive at
Commerce Boulevard.
Councilman Rogers abstained from discussion and
voting in this matter due to a declared conflict
of interest.
The City Manager advised that a public hearing
had been set on the proposed Zoning Change and
that notices had been mailed to adjacent proper -
ty owners and published as a legal notice in the
-local newspaper.
Mitchell Public Mayor Roberts declared open the scheduled public
Hearing hearing on the zoning application to change
AP 143- 081 -01 and 02 to RM -1500 district.
There being no one wishing to be heard and no
written protests filed, the Public Hearing was
declared closed.
County Planner Hulse discussed Mr. Mitchellts
development plans for a six -plex on the two lots
and advised that the proposed plans did not meet
the required rear yard set back and parking re-
quirements. City Attorney Maxwell suggested that
Mr. Mitchell file an application for variance on
these points.

Ordinance No. 117 AN ORDINANCE AMENDING ORDINANCE NO. 63 (Zoning
Map Change - Arlen Drive at Commerce Boulevard)
Upon motion by Councilman Buchanan, seconded by
Councilman Hopkins and unanimously approved by
the following voice vote, Ordinance No. 117 was
introduced:

Councilman Smith asked if the proposed develop-
ment would architectually blend with neighboring
buildings. Applicant Bart Mitchell was present,
and assured the Council that the development would
blend with surrounding buildings.
File No. 0118 City Manager Callinan reviewed Rohnert Park
Golf Lake Estates Realty's request for a lot split in the Golf Lake
Lot Split Subdivision. area,
The City Manager explained that the lot split had
been discussed with Mr. Golis and Mr. Van Logan,
the parties involved.
A lengthy discussion followed concerning Hinebaugh
Creek easement, access to the parcel, elementary
school site within parcel, and the 1913 Act Assess-
ment on the parcel. Councilman Smith asked that
the City receive some evidence in writing that
the land designated on the General Plan will be
set aside for a park and elementary school.
Upon motion by Councilman Rogers, seconded by
Councilman Buchanan, and unanimously approved, the
lot split requested by Mr. Golis in the Golf Lake
Subdivision area was approved with the conditions
that the easement for Hinebaugh Creek be dedicated
to the City; that there be ample access to the
parcel in question; that the new owners be made
aware that the City has included in its General
Plan an elementary school and park site within
subject parcel; and that the applicant post with
the City $150.00 to cover amending of the 1915
Act assessment, and that the City be given evidence
that the park site is available for $750 an acre.

ment could not begin until sewer service was
available in the area.
Upon motion by Councilman Buchanan, seconded by
Councilman Hopkins, and unanimously approved the
City Council recommended that the County Planning
Commission deny the Giacometti application for
zoning change to 11R -3" at 5825 Petaluma Hill Rd.
File No. 119 City Manager Callinan distributed copies of a
Giffin Mobile preliminary layout submitted by Mr. Everett Giffin
Home Park for a mobile home park west of Snyder bane and
north of Hinebaugh Creek.
Mr. Everett Giffin was present and explained the
plans for the development, and distributed copies
of the pictures of the mobile homes in settings
similar to the type proposed for his development.
A lengthy discussion followed regarding Mr.
Giffin's request for C ouncil preliminary feelings
regarding a mobile home-in this location, and the
proper procedure to be taken in this regard.
In response to a question from Councilman Rogers,

ment on Petaluma Hill Road was endorsed in prin-
ciple.

City Manager Callinan advised that the temporary
College View Youth
use permit applied for by the College View Youth
Fireworks
Club to sell fireworks in the shopping center
from June 29 to July 5 had been withdrawn by the
Club due to supply problems.

City Manager Callinan summarized a temporary use
Presbyterian
permit application filed by the Faith United
Church Fireworks
Presbyterian Church to sell fireworks in Sissa.'s
parking lot from June 28th to July 4th.
Upon motion by Councilman Buchanan, seconded by
Councilman Hopkins, and unanimously approved,
the temporary use permit application by the Faith
United Presbyterian Church was approved.

City Manager Callinan advised the Council that a.

(Rural Residential) to 11R -3" (Garden Apartment.)
County Planner Hulse was present and advised
that the Giacometti's were planning to construct
a convalescent home.
Upon motion by Councilman Buchanan, seconded by
Councilman Hopkins, and unanimously approved the
City Council recommended that the County Planning
Commission deny the Giacometti application for
zoning change to 11R -3" at 5825 Petaluma Hill Rd.

Mr. Giffin assured the Council that development
would be started as soon as the necessary City's
permits had been obtained.
Upon motion by Councilman Rogers, seconded by
Councilman Hopkins, and unanimously approved, the
Council went on record as generally favoring the
proposed development and suggested to Mr. Giffin
that he file an application for the rezoning
necessary for the mobile home park so that the
matter could be set for public hearing.
Subdivision north City Manager Callinan informed the Council that

Mr. Paul Golis had contacted the City and asked
that the matter of preliminary subdivision lay-
out for the area north of the Rohnert Park Express-
way be withdrawn at this time.

The City Manager brought the Council up to date
Old College
on the problems the City was having relative to
Buildings
student housing in the Old College Buildings in
Ma.rin and Mendocino Halls and the Administration
Building. The City Manager displayed pictures of
the living facilities and cases of overloading
wiring to the Council, and advised that the build-
ings had been inspected by the City's Building
Inspector and the Director of Public Safety and
had been found to be illegally occupied.

The City Manager then read a telegram sent to
Mr. Norman Spivock, owner of the property, to
advise him of the 5 day eviction notice. The
City Manager also advised that he had contacted
Mr. Spivock by telephone that same day to inform
him of the City's action.
Upon motion by Councilman Buchanan, seconded by
Councilman Rogers, and unanimously approved, the
Council endorsed the staff's action and instructed
the City staff to follow up to insure that the
buildings are brought up to Code and that there
is to be no occupancy until this is done.
Mayor Roberts declared a five minute recess.
Mayor Roberts reconvened the meeting with all
Councilmen present. The time being approximately
9:05 P.M.
City Manager Callinan gave a verbal up to date
progress report on the construction of the
Community & Recreation Center.

Project No. 1968 -1 City Manager,Callinan gave an up to date progress
West side of Free- report on Project No. 1968 -1, the area west of
way the freeway, regarding attempts to obtain buyers
for the assessment district's bonds and the agree-
ment with Sonoma County Flood Control District
relative to the construction of the frontage road
bridge over Hinebaugh Creek.

AND AUTHORIZING EXECUTION THEREOF (regarding box
culvert on westerly frontage road at Hinebaugh
Creek)
City Manager Callinan reviewed the agreement with
the Sonoma County Flood Control District and
summarized the above resolution.
Upon motion by Councilman Rogers, seconded by
Councilman Buchanan, and unanimously approved,
Resolution No. 69 -22 was adopted.
Bicycle Safety
Chief Koch reported on the bicycle safety program
for the year and informed the Council that
Rohnert Park had no bicycle accidents involving
bicycle - bicycle or bicycle - vehicle during
1968. Chief Koch advised that the program on
bicycle safety included giving instruction on
riding at the time licenses were issued, talking
to the children in school, bike clinics, articles
in the newspapers, and a list of violators were
kept on file for future reference and disciplin-
ary action to be taken on repeated violators.

Mayor Roberts questioned the fact that there was

an increase in misdemeanor and burglary cases
during 1968 and suggested the Council set up a
work session to discuss this matter with Chief
Koch.
Chief Koch Letter
City Manager Callinan read Chief Koch's letter
of Resignation
of resignation, and expressed his regret over
Chief Koch's leaving for a more challenging role
with P.O.S.T. in Sacramento, and commended the
Chief for his outstanding past performance of
duty.
Mayor Roberts also expressed his and the Council b
regret in losing the Chief.
Chief Koch thanked the City Manager and the Coun-
cil for their commendations and expressed his
thanks for the cooperation and assistance re-
ceived during the four years of his tenure as
Director of Public Safety.

Downstairs City Manager Callinan brought the Council up to
Balance Due date on staff's attempts to collect $184.00 due
the City for the services of Reserve Public Safety
Officers at the Downstairs dances held during
I ast summer. Mr. Cobs and Mr. Capocy read beeyn
contacted with no results.
There was a lengthy discussion between the Council
the City Manager and City Attorney regarding legal
procedure in attempting to collect this over due
balance.
Upon motion by Councilman Rogers, seconded by
Councilman Smith, and unanimously approved, Coun-
cilmen Buchanan and Hopkins were authorized by
the Council to appear in Small Claims Court in
an attempt to collect this long overdue balance.
Financial Insti- City Manager Callinan advised that the Financial
tutions Education Institutions Education Day was scheduled for Tues-
Day day, March 4, 1969, and approximately 20 institu-
tion representatives were expected to attend.
Cultural Arts City Attorney Maxwell advised the Council of the
Commission problems he was encountering regarding the estab-
lishing of by -laws and articles for a non - profit
corporation for the Cultural Arts Commission to
allow them to raise, deposit and expend funds.

Report
bat reports on the progress of obtaining Copeland
Creek rights of way; the Expressway- Interchange
right of way lawsuit with Spivock Company, the
Siri Lawsuit relative to the Expressway project;
and the agreement with the County regarding the
interchange and freeway agreement with the State;
and the Southwest Boulevard grade crossing appli-
cation; and the dispute with Spivock Company rela-
tive -to the Capital Outlay Recreation Fees for
the former College buildings being converted to
student housing.
