1969/05/19 City Council MinutesMay 19, 1969 Golfs letter to FAA & HUD Councilman Smith commented on V o letter dated May 13, 1969 from Mr. Paul Golfs to the Department of Housing and Urban Development, Federal Housing Administration in San Francisco; regarding Golf Lake Estates, and expressing Mr. Golfs' feelings relative to FHA. Councilman Smith then requested that the City Manager read the letter for the benefit of the audience. After the reading, a brief dicussion followed. Upon motion by Councilman Smith, seconded by Councilman Roberts, and unanimously approved, the Council requested the City Manager to prepare for the Mayor's signature, a letter to FHA advising them that the City seeks and needs FHA cooperation. It was agreed that the Mayor and Councilman Hopkins would approve the contents of the letter prior to its release. Councilman. Buchanan Councilman Buchanan arrived at this point in the meeting, Arrives the time 'being approximately 7 :20 p.m. Float Award Mr. Harold Kenworthk., Rohnert Park Chamber of Commerce Presentation Float Committee member, introduced Miss Pam Dettling, the 1969 Vass Rohnert Park, who in turn presented the Mayor with the 3rd place trophy won by the Rohnert Park float in The Council of the City of Rohnert Park met this date in regular session commencing at 700 p.m. in the City Offices, 435 Southwest Boulevard, Rohnert Park, with Mayor Rogers presiding. The regular meeting was preceded by a brief executive session to discuss possible appointments to the Cultural Arts Commission. Call to Order Mayor Rogers called the meeting of the regular session to order at approximately 7 :10 p.m. Roll Call Presents, (4) Councilmen Hopkins, Roberts, Smith and Rogers Late: (1) Councilman Buchanan, his time of arrival is noted. Staff Presents City Manager_Callinan, City Attorney Maxwell, Consulting City Engineer Milt Hudis, County Planner Gary Mann. Approval of Minutes Upon motion by Councilman Hopkins, seconded by Councilman May 1969 Smith, and unanimously approved, the minutes of 5, were approved as submitted. Approval of Bills Upon motion by seconded by Councilman Roberts, and unanimously the bills presented for approval were approved. Communications Communications were brought to the attention of the Council. No action was taken on any communication except as specifi- cally noted in these minutes. Cultural Arts Mayor Rogers advised that appointments to the Ctural Arts Commission Co-�m,ssion were discussed during the .Executive Session held prior to the regular meeting. Upon motion by Councilman Smith, seconded by Councilman Roberts, and unanimously approved, Mr. Jason L. Seale, Jr., 7494 Bobbie Way was appointed to fill the Vacancy left by the resignation of Mrs. Marie Anderson whose term expires July 1, 1011; and Mrs. Mari Evelyn Panttaja, 196 Santa Alau4 Drive, was appointed to fill the vacancy left by the resign- ation of Mr. George Verley whose term expires July 19 1970. ABAG Representative City Manager Callinan advised the Council that the Associa- tion of Bay Area Governments had requested re-affirmation of the official representatives for the City of Rohnert Park The Council indicated approval of the present representative; Councilman Vernon Smith, with alternate representatives being Councilman Rogers, Roberts, Buchanan and Hopkins in that order per Council action taken on October 7, 1968. Speeding Traffic Councilman Roberts reported he had been contacted by numer- ous citizens regarding traffic speeding vehicles on Burton Avenue, Arlen Drive and Adrian Drive. Councilman Roberts also commented on speeding school buses, and suggested that City Manager contact the Superintendent of the Petaluma School District and advise him of this problem. Use of Community Councilman Roberts questioned the use of the Community Center Center by local organizations, stating he felt that the building was not being used to its fullest capacity. Assembly Ball 2233 Councilman Smith summarized Assembly Bill 2233 presented by Assemblyman Z'Berg which would tax various recreation events, sporting equipment and vehicles to provide funds for the development of recreation facilities. After a brief discussion by the Council the matter was referred to the recreation Commission for their recommenda- tion, Concession Mr. George Andersen reported that the concession stand and Announcers Booth announcer's booth in Alicia Park would be completed by the end of this week, May 25, 1969. Emblem Sign Dr. William 0. Cord, Chairman of the Cultural Arts Commis- sion, was present and requested Council approval of the design presented for the Service Clubs Emblem Sign to be erected at the entrance to Roh-nert Park. Upon motion by Councilman Hopkins, seconded by Councilman Buchanan, and unanimously approved, the design of the Service Clubs Emblem Sign as presented by the Cultural Arts Commission was approved with the location for erection May 19, 1969 Page -3- of the sign to be determined by theCity Staff and the Cultural Arts Commission Chairman. Resolution No. 69 -50 RESOLUTION REJECTING THE CLAIM OF ANNA MADDEN City Manager Callinan read the above resolution. Upon motion by Councilman Hopkins, seconded by Councilman Smith and unanimously approved, Resolution No. 69 -50 was adopted. Resolution No. 69-51 RESOLUTION COMMENDING, SUPERVISOR LEIGH SHOEMAKER City Manager Callinan summarized the above resolution. Resolution No. 69 -52 Resolution No. 69-53 Upon motion by CoundjWn Hopkins, seconded by Councilman Buchanan, and unanimously approved, the reading of Resolu- tion No. 69 -51 was waived, and said resolution adopted. RESOLUTION ESTABLISHING MILITARY RATES FOR ROHNERT PARK MUNICIPAL GOLF COURSE. City Manager Callinan reviewed the above resolution. Upon motion by Councilman Roberts, seconded by Councilman Hopkins, and unanimously approved, the reading of Resolu- tion No. 69 -52 was waived and said resolution adopted. AUTHORIZING THE ATTORNEY GENERAL OF CALIFORNIA TO CONDUCT LEGAL PROCEEDINGS City Attorney Maxwell reported on background information relative to this resolution. Upon motion by Councilman Buchanan, seconded by Councilman Smith, and unanimously approved, Resolution No. 69 -53 was adopted. File No. 0019 City Manager Callinan reviewed the use permit application George Andersen submitted by Mr. George Andersen to construct a manager's apartment above the storage room and laundry room at 333 College View Drive'. Mayor Rogers declare open the scheduled public hearing on the use permit application of Mr. George Andersen. City Manager Callinan advised that no written communcations had been received on the matter. Mr. Gary Mann, Sonoma County Planner, read the report pre - pared by Mr. Wes Vail of the Sonoma County Planning Depart - ment who recommended denial of the application due to the building 'being too close to the rear boundary and feeling that the second story would invade privacy of residences to the rear of property. May 19, 1969 Page °4- Dr. William 0.'Cord was present and advised that while he was not the owner of,the residence to the rear of the proper- ty in question, he did live next door to it. He objected to having second story windows looking Down zntio the rear yards of houses and asked that the use permit be denied. Mr. George Andersen was present and stated that the building would not be any closer to the rear yard than the present building and that there would be no windows in the rear to look down into the neighboring rear yards. Councilman Roberts declared a conflict of 'interest as an owner of property adjoining Mr. Andersen's, And abstained from discussion and voting on this matter. Councilman Smith reminded: the Council of the discussion held concerning past variances on this property relative to the swimming pool, buildings being close to boundary lines and parking problems. Mr. Andersen advised the Council that there was more than adequate parking facilities even with the addition of this new apartment. There being no one else wishing to be heard and no written protests filed the public hearing was declared closed. Upon motion by Councilman Buchanan, seconded by Councilman owlton9 and approved by the following roll call vote, the use permit application of Mr. George Andersen to construct a second story apartment over the laundry and storage room at 333 College View Drive was denied: AYES: 2 Councilman Buchanan and Smith NOES: 1 Councilman Rogers ABSTAIN: 2 Councilman Hopkins and Roberts Redwood Empire City Manager Callinan advised that he had been contacted by Kennel Club the RedwoodEmpire Kennel Club regarding the use -of Benecia Park on May 2 and 3 of 1970 for their 1970 Dog Show. File No. 0082 City Manager Callinan reviewed the conditions of the use 7411 Market permit granted to the 7 -11 Market to be constructed on the Southwest Boulevard, specifically the fencing required. He inquired as to whether a full redwood fence was required by the Council, since there was an existing cyclone fence bn the east side of the property. The Council indicated that even though the cyclone fence was there, there should be a redwood fence put right next to it. May 19, 1969 Page -5- File "No. 0089 City Manager Callinan brought to the Council's attention Schlangen for architectural approval a four -plex proposed for con - struction on Southwest Boulevard in the E1 Colegio area. City Attorney Maxwell reviewed the changes made in the above Mr. Gary Mann, 'Sonoma County Planning Department, read a report prepared by Mr. Wes Vail, advising the Council that the architectural design should be harmonious with existing structures, there was no access to the parking in the rear from the second floor; also the stairway is not compatible with other developments nearby. Mr. Vail recommended that the architectural design of the four -plex not be approved. Mr. Schlangen was present, and advised the- Council that he had not seen the County Planning report as yet, that he felt that the building was similar, but should not be - exactly as the others in the vicinity. There-to a lengthy discussion regarding parking facilities, stairways, overall design. Mr. Ayers, Homeowners Associa- tion, was recognized and stated that the slogan of the winner of the Spruce Up Campaign poster contest was "repeti- tion is a bore ". Also participating in the discussion was Mr. Art Howard. Upon motion by Councilman Buchanan, seconded by Councilman Hopkins, and unanimously approved on a roll call vote, the architectural design of the four -plex proposed by Mr. Schlangen for construction on Southwest Boulevard in the El Colegio Area was approved. Group Care Facility City Manager Callinan reported that an application for a had Home for Elderly use permit for a boarding home for elderly persons discussing it with Planner Vail and been received and after the County Social Service Department that it will be classi- fied as a nursing home under the City's zoning ordinance and will be set for public hearing at the next Council meeting. Storer Cable TV City Manager Callinan advised that an FCC report had been received from Storer Cable TV advising that the FCC had authorized the delivery of Channel 12 to the Rohnert Park area, however the San Francisco 49er's football games carried on that channel could not be delivered. Upon motion'by Councilman Buchanan, seconded by Councilman Roberts, and unanimously approved, the City Manager was directed to prepare a letter to Storer_Cable TV, Inc. ad- vising them that the Council expected, according to CATV franchise, to receive Channel 12 in its entirety, that is with the San Francisco 49er's football games. Ordinance No. 121 AN ORDINANCE PROHIBITING THE ENTRY OF HORSES, COWS, SHEEP AND OTHER. HARD HOOFED ANIMALS UPON ANY PUBLIC STREET, PARK, OR PUBLIC PLACE. City Attorney Maxwell reviewed the changes made in the above May 19► 1969 Page -6- proposed Ordinance since its introduction and suggested that since the changes were substantial changes that.the ordinance be reintroduced. Upon motion by Councilman Buchanan, seconded by Councilman Smith, and unanimously approved, Ordinance No. 121 was re- introduced. Miss Mary Hopper, resident and horse owner, was recognized and objected to the ordinance. Mr. Bill Ayers, Homeowners Association, advised that he had received numerous calls regarding objections to the ordin- ance. Mr. Paul Golis advised that he was against the adoption of the ordinance because he intended to develop a subdivision catering to owners of horses. Mr. George Andersen advised that to the best of his know - ledge the City of Santa Rosa had no such ordinance. Councilmen Roberts and.Smith restated that they had received numerous telephone calls regarding horses in the streets and parks. Ordinance No. 122 AN ORDINANCE AMENDING ORDINANCE N0. 47 (Mobile Homes In- cluded as Dwelling Units). City Attorney Maxwell reviewed the above Ordinance No. 122 to include mobile homes as dwelling units in Ordinance No. 47. A lengthy discussion followed relative to when mobile homes are to be charged the recreation fee. City Attorney Maxwell was directed to change the language in proposed Ordinance No. 122 to indicate that the recrea- tion fee applies to mobile homes, and they are to be taxed only when new pads for the mobile homes are constructed. Sissa's Complaint Mayor Rogers acknowledged Mr. Robert Sissa of Sissa's Market who in turn introduced Mrs. Robert Sissa. Mrs. Sissa read a letter to the Editor of the World from Mayor Rogers relative to Sissa's and T.G. &Y. transferring their adver- tising from the World Newspaper to the "Shopper ", printed in the May 14 issue of the World; she then read a letter written by a number of merchants in the shopping center protesting the Mayor's letter. Project 1968. --3 Project 1968 -1 May 19, 1969 Page -7- Councilman Smith requested the names of the merchants who had signed the letter. Mr. Kauffman of T.G. &Y. Stores was present and informed Councilman Smith that he had signed the letter. Mr. Sissa, advised that the original letter was in his safe in the store and that he would furnish the City with it in the morning. 00unC11man Smith again requested the names of the merchants signing the letter and Mr. Sissa advised that Mr. Kauffman, Mr. John E. Halleck and Mr. Edrie I. Whittaker had signed the letter. Mr. Paul Golis was present and advised that he had person - ally taken a survey of merchants in the shopping area to determine if, in their opinion, the "Shopper" advertising was getting results. Mr. Golis advised that some of the merchants had not noticed any increase in business *chile others had shown a marked increase in business due in their opinion, to "Shopper" advertising. Mr. Robert Sissa stated that he noticed a 17% increase in business which he felt was due to the wider circulation of the "Shopper" than The World newspaper. A brief discussion followed between Mr. Sissa and Mayor Rogers relative to the request for Mayor Roger's resigna- tion. Vice-Mayor Smith ruled the discussion out of order and ask - ed that the Council proceed to the next item on the agenda. Consulting Engineer Hudis gave a verbal progress report on Project 1968 -39 Copeland Creek improvement Project advis- ing that the ground was too wet for the contractor to resume work. Consulting Engineer Hudis gave an up to date progress report on the proceedings of Project 1968 -1, Coddingland area, and also advised that meetings had been held with City staff and Mr. James Groom regarding his assessment for the improve - ment_project and the acquisition of necessary right -of -way. A discussion followed between the Council, Mr. James Groom, Mr. Paul Golis, and City Manager Callinan regarding the improvement project and payment of assessments. The Coun- cil indicated it would meet in executive session with Mr. Groom after this meeting to discuss the acquisition of the right of way which he owns. Expressway Inter City Manager Callinan brought the Council up to date on change Utility the plans for relocating the existing overhead utilities Relocation on the west side of the freeway for the Freeway-Express- way Interchange and of meetings relative to this held be- tween City Staff, Sonoma County Road Development, Division Of Highways and utility company representatives. The City Manager also explained the various alternatives for reloc- ating the existing utilities, with and without the use of P.U.C. "Rule 20" funds. Community & Recreation Center Golf Course Press. Day May 19' 1969 Page -C- A lengthy discussion followed between representatives of P.G.&E., Mr. Ralph Pitch and Mr. Hack Boyette, the City Manager and the Council regarding alternatives for relocat- ing the existing facilities, The OmInri l ao aed +h a+ per - haps the most feasible relocation of the existing facilities would be to place the primary and secondary power lines on wood poles along the frontage road, and the 60KV on wood poles along the, Preeway, and telephone underground. Mr. Rack,Boyette of P.G ®&E. asked that another meeting be held by all concerned before a final decision was reached. City Manager Callinan advised that the dedication of the new Community Center was scheduled for 11:00 a.m. on May 24th. City Manager Callinan reported that the Golf Course Press Day held recently at the municipal golf course was a suc- cess and he felt profitable for the golf course. Office Space Needs The City Manager advised that further study would be made of office space needs, with the possible assistance of Archi- tect Lawrence Simons. Ordinance Book City Manager Callinan displayed one of the five ordinance books prepared by Deputy City Clerk Connie Harris under the supervision and instructions of City .Attorney Maxwell. Upon motion by Councilman Smith, seconded by Councilman Roberts, and unanimously approved, the Council agreed to continue the established policy that the pools be open free of charge to the public on Memorial Day, May 30p 1969. City Attorney's City Attorney Maxwell gave an up to date progress report Report on the By -Laws for the non - profit corporation for the Cultural Arts Commission; the expressway interchange right of way lawsuit; and the Siri lawsuit reg rding the Express - Y.YIf Sr U'H.. A� ncaJ +.mvjcv,VO Southwest Boulevard City Attorney Maxwell advised that the petition for hearing Grade Crossing before the full Public Utilities Commission relative to the Southwest Blvd. Grade Crossing had been filed this date, and that a ruling should be received within twenty days. .Article on Council - City Manager Callinan presented the Council with copies of man Smith the Del Monte Shield, a magazine distributed by the Del Monte Corporation. The publication contained an article on Councilman Smith regarding his community service,who is also an employee of the Del Monte Corporation.
