The Council of the City of Rohnert Park met this date in regular
session'at 8 :00 p.m, at the City -Office, 435 Southwest Blvd.,
Rohnert Park, with Mayor Buchanan presiding. This regular
session was preceded by a work session at which no forme) action
was taken.

Councilmens A discussion was held concerning the past councilmen's expense
Expenses ,. accounts and -the meeting was turned into a public hearing at
this time. The following persons raised questions from the
floor: Mr. Jack Smuck, Mr. Gil Soto, Mr. Jack Collins, Mr. Tom
Loebsack, Mr. Jack Stretton,.Mrs. Margaret Sovey.
Mr. Smuck questioned in particular some items on the recent
expense account submitted. by Councilman V. Smith and also some
items for which expense accounts were submitted by Councilman
Rogers and Mayor Buchanan,
Councilman Pezonella moved that the .Council have a roll call
vote concerning whether or not Councilman V. Smith's recent
expense account bill should be paid or not.
At this point Councilman V. Smith made a statement concerning
expense accounts and the recent letters that have been appear -
ing in the Rohnert Park Press concerning this matter.-and
especially the letter degrading his wife.
City Clerk City Clerk, Lillian Sani,.came into the meeting at this point®
Public Discussion The discussion,:from.the audience, continued concerning the
expense accounts of the City Council and particularly the
.expense account recently submitted by Councilman V. Smith.
. Those making comments were Mr. Smuck,, Mr. Wetzel, Mr. Loebsack,
Mr. McGraw., Mrs. Sherrill and Mrs. Roberts.
Councilman Pezonella then rescinded his above motion.
Councilman Pezonella moved that the City pay the expense account
of Councilman V. Smith when and if legitimate receipts are sub-
mitted to the City Manager and:not before.
After some discussion, this mo.t.ion was rescinded by Councilman
Pezonella,
Councilman Rogers made. the motion that Councilman V. Smith's
expense account be paid.
At this point, Mr.,Maxwell, City Attorney, pointed out that the
expense account was approved by the Council at their July 6,
1964, meeting, at which time they approved the bills for payment
as submitted and this was reflected in the:change in the minutes
that was made at this meeting when the minutes of the July 6,
1964, regular session were approved.
Councilman Rogers rescinded his above motion and moved that the
City Council reaffirm it's approval of this expense account.
Said motion was seconded by Councilman C. Smith.
Councilman Pezonella stated that he felt the motion was out of
order because of an agreement made at the June 15, 1964, City
Council meeting. Councilman V. Smith reviewed the minutes of
June 15, 1964, and pointed out that they reflected that no

agreement had been made other than the approval of the expense
account was deferred at that time.
Councilman Rogers pointed out that he felt that due to the past
policy-and .practice of the Council, the Council had no choice
but t6'approve the bill and to recognize the need for the
establishment of guide lines and a policy to control City
Council expense accounts in the future.
Upon a roll call, Councilman Rogers motion was passed by the
following-vote:
AYES: (4) Councilmen Rogers, C. Smith, V. Smith, Mayor Buchanan
NOES: (1) Councilman Pezonella
Council Policy After an expression of feeling from those present at the City
Regarding Expense Council meeting, the City Council turned the meeting into a
Accounts work session= in order to adopt guide lines and a policy for
controlling the expenses of the Councilmen.
The Council then proceded to review guide lines and a proposed
policy submitted by City Manager'Callinan, copy attached.
City Manager Callinan read his suggested policy which was
broken down-into four categorieb : "(1) In- County Meetings; (2)
Out -of- County Meetings; (3) Overnight attendance at Meetings;
and (4) Exceptions to the policy. Any exception to the policy
would.require: prior approval of the majority of the City Coun-
c it .::
The Council then proceeded to review and discuss the proposed
policy sugg.ested•by City Manager Callinan..
Upon motion by Councilman Rogers, seconded by Councilman V.
Smith, Section 1-2 in the recommended policy was completed to
read "the maximum expense allowable to any Councilman at an IN
COUNTY meeting is the price of the meal 'plus mileage at 8¢ per
mile." The motion was approved by the following roll call
vote: AYES (5) Councilmen Pezonella, Rogers, C. Smith, V. Smith,
Mayor Buchanan. NOES: (0)
.Upon motion by Councilman Rogers,. seconded by Councilman V.
Smith,. paragraph I -3 of the recommended policy was completed to
read: "The Mayor or Vice -Mayor or other Councilman so designated
by the Mayor, may incur expenses representing the City at Civic
Affairs up to a limit of prase of meal,.plus mileage at 80 per
mile.' Said motion was approved by the following roll call
vote: AYES (5) Councilmen Pezonella,.Rogers, C. Smith., V. Smith
Mayor Buchanan. NOES: (0)
Upon motion by Councilman Rogers, seconded by Councilman V.
Smith,,paragraph II -2 in the proposed policy was completed to
read: "The maximum expense allowable to any Councilman for
attendance at the above OUT -OF- COUNTY meetings is price of meals
plus mileage at 80 per mile or the actual cost of transportation."

At this point a general discussion was held concerning the work
session conducted thus far and Councilman Pezonella stated that
he wanted to reconsider his votes on the above motions and
change them to abstentions.
Councilman Pezonella then moved to defer the matter until such
time as the City Council has had an opportunity to study the
matter in detail.
At this point Mayor Buchanan requested a show of hands from the
audience as to whether or not the City Council should continue
with the work session or defer the matter. The show of hands
indicated that the majority present desired the City Council to
continue with the work session to arrive at a decision regarding
Council expenses.
Councilman Pezonella's motion died.for lack of a second.
Councilman Pezonella then stated that he wanted the record to
show that he abstained and that he has reservations on the
proposed .draft of the policy submitted by City Manager Callinan.
At this point the meeting was once again turned into a public
hearing and discussion and comments from the floor were permit-
ted to be made to the City Council.
After .comments from several residents, the discussion from the
floor was terminated.
Councilman Rogers moved that the City Council adopt, as it's
policy concerning Councilmen's expense accounts, the policy that
Councilmen would.be reimbursed for meals; and lodging, where
applicable, and transportation costs or mileage at 80 per mile
for attending any and all meetings which they attend in the
course of their duties as City Councilmen. Said motion was
seconded by Councilman V. Smith and approved by the following
roll call vote: AYES: (3) Councilman Rogers, V. Smith and Mayor
Buchanan. NOES: (1) Councilman C. Smith. ASSTAIN: (1) Council-
man Pezonella.
Communications Communications, per the attached outline, were brought to the
Council's attention.. No action was taken by the Council on any
of the communications.
Ordinance #47 City Manager Callinan read the title of Ordinance No. 47 - AN
ORDINANCE OF THE CITY OF ROHNERT PARK PROVIDING FOR PAYMENT OF
FEES IN CONNECTION WITH. CONSTRUCTION OF DWELLING UNITS, THE
DEPOSIT OF SUCH FUNDS IN THE CAPITAL OUTLAY RECREATION FUND,
AND THE USE OF SUCH FEES FOR PUBLIC PARK AND RECREATION
PURPOSES.

City Manager Callinan then presented and read to the Council a
copy of a resolution that was submitted by the Rohnert Park Home-
owners Association recommending the adoption of proposed Ordinance
No. 47.
Upon motion by Councilman V. Smith, seconded by Councilman Pezon-
ella and unanimously approved, reading of Ordinance No. 47 was

Upon motion by Councilman V. Smith, seconded by Councilman Pezon-

City Manager Callinan brought to the Council's attention the report
Interference
that has been filed with the Federal Communications Commission by
Radio Electronic Co..of.Sebastopol concerning the results of their
investigation of the complaints received that the operation of Mr.
Whitcomb's ham radio set, at 233 Alma Avenue, was causing inter -
ference with TV and radio reception.
City Manager Callinan pointed out that the report indicated that
Mr. Whitcomb's set is being operated,properly and was not causing
any radio and TV interference-. He pointed out the report further
indicates that probable cause of the TV interference may be a re-
sult. of faults with TV receivers or installation of antennas for
same. He b!^iefed the Council on his discussion with the FCC Office
'
in San Francisco which advised him that it doesn't appear that the
FCC will pursue the matter any further but that a definite decision
has not been made on this and will not be made for a few days.
Upon motion by Councilman V. Smith, seconded by Councilman Pezon-
ella, City Manager Callinan. was requested to send a copy of the
investigators report to the compaiants. Said Motion was unani-
mously approved by voice vote..
Public
Mrs. Bettye K. Wright appeared before the Council to discuss the

City policy of levying late charges on service bill payments made
after the 20th day of the month in which the bill is issued, even
though the bill itself covers a two month period.
The matter was opened for further comments from the floor. Mr.
Loebsack_ asked about.the City's present policy and Mrs. Sherrill
raised some questions concerning the extra garbage fee that she
pays on her service mill...
City Manager Callinan reviewed the outline that he had presented
to the Council of the billing .practices of the Cities of Petaluma,
Santa Rosa,,Sebastopol and Sonoma and his recommendations for
changes in Rohnert Park's policy concerning late payment charges.

After further brief.. discussion, the Council decided to defer this
matter until the next regular meeting.

Mr. Ray Steveson appeared before the Council to discuss the prob-

Dr. lem..he is having getting.a,,decision from the City Planning Com-
mission concerning.his. request for a use permit to construct an
apartment building at 7444 Bridgit Drive. He stated that he felt
that a decision should be made concerning all the lots on Bridgit
Drive.as to what set -back requirements, front and rear, are
acceptable to compensate. for the odd sizes of the lots.
City Manager... Callinan,.reveivedf, -for the City Council, the history
to date, on the Stevenson application. He pointed out that the
Planning Commission. had discussed this matter at their July 15th
meeting.and that the matter was tabled until their July 23, 1964,
meeting at which time a dec islion and recommendation to the City
Council would be made.

Council grant the..use permit for-.the construction of the apart-

City,Manager Callinan advised the Council that the assessment
bonds for this.projpct had been issued, monies received and the
payments to.Argonaut.Constructors-and Milton Hudis, engineer,
approved by the City., Council at their last meeting had been made.
He also advised the,Council that billing in the approximate
amount of $377000.00 had been made to the State of California in
accordance with the contract with them to provide sewer service
to Sonoma State College.
(2) Health-and Medical Insurance Program

City Manager advised the the that he has been work -
ing with several insurance representatives on a health and medical
program for City employees, the funds for which were included in
the 1964 -65 budget. ,The City Manager suggested that the City
Council set up a.me.eting at which time representatives of the
insurance agencies.,:could come and explain their programs to the
Council."
The,.Council agreed that it would adjourn this meeting to Monday,
July 271 1964, at-which time.they will allow presentation by the
insurance representatives.
(3) Pool Ojening_
City_Manager.Callinan advised the.Council that the pool opening

and dedication for the Neighborhood 'B" Park Pool would be held
on Sunday, July 26, 1964, and .the.Recreation,Commission is working
up a complete program for the opening and dedication.

Report City Attorney Maxwell advised the Council on the status of the

A recent opinion was handed down by the State Attorney General's
Office concerning whether or not the Rohnert Park District con-
tinues to exist. City Attorney Maxwell pointed out that the
Attorney General's opinion does not go into complete detail as
to the question of existence, but it is their ruling that the
District cannot annex additional lands to it. Mr. Maxwell
pointed out that the Rohnert Park District must continue to

what by the judge being on vacation and by Hardin's attorneys

City Attorney Maxwell pointed out that since we are now
there is a provision in the government code allowing the County
to act -as paying agent for the collection of special assessment
levied by the City. He advised the Council he had discussed
this matter with the County Councel's office and an agreement
will be prepared for Council consideration at their August
meeting.
Map of Cotati
Cdiandilman'Pezonella requested that the City Manager obtain a
Council
map of the City limits of the City of Cotati for the
Chamber so that when discussing area problems the City Council
will have a clear picture of the entire area. City Manager
Callinan advised that he would obtain such a map.
Chamber of
Mr. Art Roberts, president of the Chamber of Commerce requested
the
Commerce
that the City provide the Chamber of Commerce with a copy of
map of the City of Rohnert Park_'whfdh °h- said would be used for
display purposes in the Sonoma County Fair. The map the County
Fair is using does not reflect the City of Rohnert Park at all.
Councilman C. Smith requested that a letter be sent to Super-
visor Shoemaker thanking him for inviting Councilman C. Smith
to the Rohnert Park - Cotati days held at the fair on July 17th.

There were some questions raised from the audience by Mr. Gibe-- -
son as to whether or net the-City Council can still draw the
$15.00 per meeting as District Directors. Mr. Maxwell expresses
his opinion that they can, and such compensation is legal since
the District is still in existence even though it cannot annex
territory.
There being no further business, the meeting was adjourned at
12:05 a.m. on July 21, 1964 to Monday July 27, 1964, at 8:00 p.m.

conventions, etc. each Councilman submitting a request must present an
itemized estimate of the expenses he expects to incur.
a. These requests should be submitted at least two Council meetings
prior to the date of the convention, seminar, etc. but no later
than the last regular Council meeting before the date of the con-
vention, seminar, etc.
b. Council consideration of such requests will not be made during
adjourned meetings or special meetings of the Council.
c. A limitation on the amount of expenses that may be incurred will be
determined by the City Council when approving the "requests.
3V Exceptions
1. Any exceptions to this policy must be approved by the City Council prior
to the incurring of any City expense by any member of the Council.
2. No member of the Council is authorized to incur any City expenses other
than those listed in Paragraph I and II without the prior approval of a
