Mayor Rogers called the.meeting to order, Roll Call Present; (4) Mayor Rogers, Councilmen Pezonella C. Smith and V. He presented a suggested dra_ °t of a resolution. for, adoption by the Council. Resolution :Wo. 282 A RESOLUTION RELATING TO THE LOCAL CONTROL OF THE CRIMINAL ASPECTS OF SEXUAL ACTIVITY. Upon motion by Councilman. C. Smith, seconded by ;V`. Smith and unanimously approved, Resolution No. 282 was adopted. Powell of the County Planning Staff introduced Mr. Jac k :,Prather, Sonoma County Plan - n ng Director who gave a verbal report on the progress_o the land.use study for the college area and.:his reaction to several uses being pro- - posed for the area. Use Permit Appli- Mr. Golis introduced Mr. Arthur Howard, Charles cation - Student Howard, Fred Howard, Marshall Palmer and Mr. and Housing - Southeast Mrs.. Glyd.e of Forsyth Realty. Mr. Golis stated... corner Sonoma State that he,and Messrs. Howard are now associates Expressway & Snyder and have recently bought all of the Valley View Lane Land., Page -2-- November 8, 1965 Mr. Golis requested a use permit be granted to construct a dormitory complex on the southeast corner of Sonoma State. Expressway and Snyder Lane. The complex would house approximately 500 single and 80 married students. Mr. Golis further stated that he and his associ- ates would do everything they could to see that the Expressway was put in''.as soon as the City needed it, and that the land just purchased would be completely devdloped as fast as possible. Dr. Tappin, of Sonoma State College, commented on the student housing buildings proposed by the Howards. He stated that he had gone to Santa Barlhn,rn and perk real l y i nwpen-tera +he WmArarrl development and was very impressed. Councilman V. Smith asked Dr. Tappin and Dr. Burford if they approved of the philosophy of this type of housing, and whether or not the College had any objection to the location being proposed for.the student housing. Both Dr. Tappn'and Dr, Burford stated that they approved,.of,tk e proposed buildings and the site. Mr. G'ols stated that "the property in question is across.Copeland Creek and not contiguous to the College and Highschool-'site. He requested that a pedestrian and /or bicycle bridge be allowed to go from the property being discussed, directly across the.highschool property to the college. Mr Prather indicated that he felt the details coul'd'all be worked out at the time the plot ply: was submitted, and that the basic policy determination at this time was whether or not the Council feels the land use is compatible with the college. He recommended approval. Upon.`motion by Councilman C. Smith, seconded by Councilman Pezonella and unanimously approved, the Council 'approved the southeast corner of Sonoma State Expressway and Snyder Lane for multi= - family use subject to a. preliminary plan being prepared and submitted for scrutiny and approval.by the County Planning Staff and City Council. Use Permit Appli- °Mr.- McCurdy, representing Bart Mitchell Realty, cation -'Church presented ` request to the Council from the Site Prote kA Episcopal Church in the Northern California Diocese for a use permit for a church on the property located south of the intersection Fage -3- November 8, 1965 of Snyder Lane and.East`Cotati Avenue. Councilman.V. Smith moved that the Council grant the use permit subject to the conditions listed in the plannin staf_f''s report dated November 8, 1965 on file in the City Offices, and also subject to submission of a plot plan for complete review prior to any construction. Smith Supervisor Supervisor Shoemaker spoke on the presentation Shoemaker by Mr. Prather and the meeting of the; County's coinmittments to the college. Agreement for City.Manager Callinan reviewed the proposed Lands Around agreement for the Council and stated that there Sewer Plant was one..change.which he..had not yet had an...op- p.prtun�'ty to, discuss with Mr. Maxwell, that bet g the insertion.of a provision for pro - ration of rent paid in case the lands are purchased at a date.- 'Pther than the rental due dates. Councilman,C. Smith.reporte.d that he had investi- gated and found the price of $2200.00 per acre ;.tp.be. very. reasonable. Land just south of the area being..purchased by the City had been sold for $3000 to $4000 per acre one year ago. City Manager,Callinan advised the Council that ..he, had contacted the State Water Pollution Con - trol.Board.and was making inquiries into the possibility of the availability of Federal grants fQr this project. City Attorney Maxwell:stated he felt the City should take out a title policy on the lease Arrahgement.and.allow the City Manager and Mr. Maxwell to approve it.for content. Upon motion by Councilman Pezonella, seconded by Councilman V. Smith and unanimously approved, the lease agreement for the purchase of lands around the sewer plant was approved and the::' Mayor authorized t.6 execute same on behalf of the City with the following conditions: 1. To insert a provision in the agreement for the pro- ration of rent., upon .exercising of the Option to purchase. Page -4- November 8, 1965 2. Approval of title policy by City Manager and City Attorney. 3. City Engineer to approve the legal description of the property. Wilfred Grade City Manager Callinan advised the Council that Crossing Baldock- Pacific had filed bankruptcy and that he had contacted the lending institutions in- volved. Mr. Golis has been working with Mr. Backe of Regent Investment Company and has in- dicated that by next Monday's meeting he may have a plan worked out for the installation of the signals. Mayor Rogers requested that this item be put on the agenda for November.15, 1965. Project 1965 -2 City Manager Callinan advised that the executed documents had not been received back from the property owners, therefore, this item will be scheduled for the November 15, 1965 meeting. Project 1965 -3 The City Manager advised the Council that Mr. Hudis, the project engineer, had informed him that all the deeds had been taken to the title Company and that the title company had received verbal approval from Mr. Spivock. Mr. Spivock, who was present in the audience, stated that he was just waiting for the title company to call him at which time he would execute the deeds and /or other necessary papers. Mayor Rogers asked Mr.. Hudis if he had received verification that Mr. Golis was willing to assess the Knutsen Building to pay for the widening of Commerce. Boulevard in front of the building. Mr. Golis concurred that this would be done and Mr. Hudis stated that he was pre- paring the plans and,specifications now for approval and that we should be able to go to bid'in December. Mr. Hudis recommended going to bid the same day on two projects, one for the bridge and one for the road, rather than com-- binin& the two into one project. Personal Appearances Mr. Spivock advised the Council that he had made Norman cE Norma Sn arrangements with Mr. Thiesfeld for planning services on the two projects which Mr. Spivock presently has pending before the Council and that by the November 159 1965 meeting he would have something definite to present to the Council. wage -5- November 8, 1965 Arthur Roberts Mr. Arthur Roberts thanked the Council, on behalf of himself and Lawrence Swenson, for the Council's recommendation of their names to the Petaluma Board of Educationfor consideration for appointment to the current vacancy.
