1967/09/18 City Council MinutesRONNERT PARK CITY COUNCIL MINUTES September 18, 1967 The Council of the City of Rohnert Park met this date in regular session at 7°00 P.M. in the City Offices, 435 Southwest Blvd., Rohnert Park with Mayor Pezonella presiding. Call to Order Mayor Pezonella called the meeting to order and led the pledge of allegiance. Roll Call Presents (3) Councilmen Roberts, Rogers and Mayor Pezonella Late: (1) Councilman V. Approval of Upon motion by Councilman Rogers, seconded by Minutes Councilman Roberts and unanimously approved the minutes of September 5, 1967 were approved.. Communications Communications were brought to the attention of the Council. No action was taken except as specifically noted in these minutes. 1. A letter from Re'vr. Glenn Saul ter.derirl his ID resignation from the Recreation Commission was read. Upon motion by Councilman Roberts, seconded. by Councilman Rogers and unanimously approv- ed, the Council accepted the resignation with regrets. The matter of appointing a new commissioner was deferred until the full Council was pre- sent. 2, A letter from Lesly Meyer, Superintendent of the Petaluma School District, regarding the possible use of Benecia Pool by the Jr. High School was read. Mr. Callinan reported on several discussions he had with Mr. Meyer indicating that the district was war king on a program for use of the pool. Page -2® September 189 1967 Arrival of Councilman V. Upon motion by Councilman Rogers, seconded by Councilman Roberts and unanimously approved, theCouncil authorized an open house to be held at the City Offices on October 9, 1967 and that a committee to handle refershments would be formed. Resolution No. A RESOLUTION COMMENDING CLYDE CHESNEY 67•71 Councilman Rogers read the resolution. Upon motion by Councilman Rogers, seconded by Councilman Roberts and unanimously approved, the Resolution was adopted by the City Counc-il. Expressway West Mayor Pezonella reported on a meeting of the of U.S.101 Sonoma State College Alumni Association. Welcoming of High Mayor Pezonella welcomed the numerous high school School Students students present in the audience. Ordinance No.81 AN ORDINANCE REGULATING THE SUBDIVISION OF LAND WITHIN THE CITY OF ROHNERT PARK AND PROVIDING PENALTIES FOR VIOL9.TION THEREOF. Councilman Rogers moved that Ordinance No. 81 be re- submitted and re- introduced as submitted. Said motion was seconded by Councilman Roberts and unanimously approved. Annexation No.4 RESOLUTION OF PROPOSED ANNEXATION TO THE CITY OF Resolution No. ROHNERT PARK SETTING TIME AND PLACE FORBEARING 67 -70 THEREON IN PROCEEDINGS FOR ANNEXATION TO BE HELD UNDER THE ANNEXATION OF UNINHABITED TERRITORY ACT OF 1939 -- ROHNERT PARK ANNEXATION NO. 4 City Manager Callinan explained the i� soluticn. Councilman Rogers asked if any written protests had been received. Mr. Callinan advised there had been none. Ordinance No.85 Councilman Rogers moved that the Council intro- duce Ordinance No. 85, -rezoning of a portion of AP.No. 143- 340 -02 from "A" to °°RM- 1500 -PD ", by title only. Saaid motion was seconded by Council- man V. Smith and unanimously approved. File NO-0032 City Manager Callinan reviewed his memo dated Gary's Texaco September 14, 1567 to the Council. Mr. Tomilson read his to conduct tow staff report. truck service Changes to Zoning Ordinance Use of Firehouse for Firemen's & Policemen-Is ball. uff-3�1 September 189 1967 Mr. Sterner, the ap-nlicar+_ urnti n,nA ­__ sented a petition from citizens requesting that the City Council renew the use permit. Councilman V. Smith moved that the Council grant a renewal of the permit for a period of three months with the same conditions as attached to the original permit. Said motion was seconded by Councilman Rogers. Mr. Sterner presented several pictures showing the location of the truck in the rear of the station which hampered traffic going through the alley-way. Mr. Sterner requested that he be allowed to park the truck on. the side as shown in one of the pictures. Councilman V. Smith withdrew his motion and. Councilman Rogers withdrew his second. Councilman Rogers moved that Mr. Sterner be allowed to park the tow truck in the location as shown in the picture presented and that his per- mit to conduct the two truck service be - ^enewed for a period of three months subject to all. other conditions listed in the origina7 -perriit. Said motion was seconded by Councilmaii Roberts and unanimously approved. Discussion of the miscellaneous changes proposed to the zoning ordinance was deferred to the next meeting. CD Mr. Callinan requested Council permission for the firemen and policement to use the Firehouse on October 7. 1967 for their �--nmipil rim-nna Upon motion by Councilman Rogers, seconded by Councilman Robe.-ots and unanimously approved, the Council approved the use of' the Firehouse by the firement and policement on October 7, 1967 for their annual dance. Mrs. Shirley Mr. Callinan advised that Mrs. Salomon had Salomon -Animal called earlier and stated she would. not be able Control to attend, but requested the Council consider enacting a strict leash law. A discussion followed between t*.qe Council, Mr. Maxwell and Mrs. G. Sterner a resident. Mr. Callinan was requested to provide a copy of the ordinance to each member of the Council so that they could study it. Mr. Maxwell advised that under the subdivision agreement Mr. Spivock was obligated to install the pump station and that a bond had been posted for its completion. Mr. Maxwell explained the various methods of enforcing the terms of the agreement. Upon motion by Councilman V. Smith, seconded by Councilman Roberts and unanimously approved, the Council turned the matter over to City Attorney Maxwell for follow -up. Project 1966 -2 Project Engineer Hudis gave a verbal status Expressway report. He advised that he had not determined as of this date if the $7,000 claim by Siri, Inc. was valid. Mr. Hudis advised the Council that there was one section of the expressway, approxi- mately 200 feet long, where the roadwork did not meet specifications and .requested authorization to tear this section up and replace it with rock. Upon motion by Councilman Rogers, seconded by Councilman Roberts and. unanimously approved the Council = authorized Project .ingineer Hudis to re- place the approximate 200 feet of unacceptable roadwor't. Mr. Hudis advised that the second progress pay- ment to Arthur B. Siri, Inc. in the amount of 438,422.30 was due and recommended said payment. Upon motion by Councilman Roberts, seconded by Councilman Rogers and unanimously approved, the Council authorized the payment to Arthur B. Siri, Inc. of ;progress Payment No. 2 in the amount of $38,422.30 for Rohnert Park Expressway Project No. 1966 -2. Grades Crossing Mr. Maxwell discussed the railroad crossing for '@xpressway the expressway with the Council and the rehearing granted to the railroad to enable them to present their case. He advised he had talked with the legal staff of the PUC about a temporary permit Page -5- September 18, 1967 External Audit Upon motion by Councilman Roberts, seconded by Report for Councilman Rogers and unanimously approved, the 1966 -67 Council accepted the External Audit Report for the year ending June 30, 1967 as prepared by Fitzpatrick and Poulsen, C.P.A.'s, Santa Rosa. Pump Station- City Manager Callinan reported on the various Sub. 12-B contacts that had been made with Mr. Spivock con- cerning the pump station required for Subdivision 12 -B and advised that at the present time it was his understanding that Mr. Spivock was soliciting bids for the work. A discussion followed, and the Council agreed to pursue the matter of getting a rehearing set for the earliest possible date and solicit any and al",. support available. Project No. 19671 Project Engineer Hudis gave a verbal status Country Club Dr. report. He stated that Superintendent of Public & Snyder Lane Sewer Works, Bill Wiggins, should be commended for his Project handling of this job. Mr. Hudis recommended pay- ment of Progress Payment No. 1 on this project. Upon motion by Councilman Rogers, seconded by Councilman V. Smith and unanimously approved, the Council authorized payment to Donald Schlangden of Progress Payment No. 1 in the amount of $25,318.48 for Country Club Dr. and Snyder bane Sewer Project No. 1967 -1. Project 19672 Project Engineer Hudis stated that the project Southwest Blvd. was complete and operating perfectly. He ad- Water Main vised there would be some additional small amounts of work to do but recommended accepting the project. Upon motion by Councilman Rogers, seconded by Councilman Roberts and unanimously approved, the Council authorized the Project Engineer to file the necessary Notice of Completion. Project 1967 -4 Mr. Callinan advised that the bids were opened on E.CVta ti Ave. rriday, SE-'p tern.be =r' 15, 196 -1 and that 1.1 "ie _Low Water Main bidder was Rice; DeMarti.ni and Smith, Inc., Novato with a bid 73a0ri t , Mr. Callinan gave each councilman an allocation of costs sheet and advised that the project costs and allocation of same had been discussed with Mr. Pollard, the owner of the property which the project will serve first. Mr. Callinan further advised that he had written the City of Cotati requesting an encroachment permit and inquiring whether the residents along East Cotati Avenue wanted to tie into the main to be installed. The City Manager stated that he had not received official word from the City of Cotati but under- stood the encroachment permit would be forthcom- ing. Mr. Callinan advised he felt the Council should noc awe,_Ld the contract until an agreement with Mr. Pollard had beer, entered into whereby he would Page -7-- September 18, 1967 put of the necessary money for the project and the City would give him a per acre assessment credit. Mr. Pollard was present and commented on the amount of funds he was being requested to pay, which he felt were not reasonable. A discussion followed upon the conclusion of whic:. the Council requested the City Manager to follow up on the matter and work out some arrangement with Mr. Pollard. Golf Course City Manager Callinan gave a verbal status 2eport Improvement on the improvement program. He reported the bids Program were opened on the parking lot, Friday, September 15, 1967 and the low bidder was Don Dowd at $18,700.00 Councilman Rogers moved that the Council accept Mr. Callinan's recommendation and request Regent Investment Corporation to award a contract to Don Dowd for the golf course parking lot. Said motion was seconded by Councilman V. Smith and unanimously approved. Mr. Callinan advised that Mr. Hudis had designed. a 24 foot wide road from the railroad to the golf course property and requested some indication from the Council whether to proceed with this minimum width road. Councilman Rogers moved that the Council go on record as accepting this minimum type road and the City Manager be authorized. to work out an agreement for the cost of installation with the land owners. The motion wa3 seconded by Council- man Roberts and unanimously approved Mr. Callinan commented briefly on the renaming of Lakeview Boulevard. Recess The Mayor declared a five minute recess, the time being approximately 9:15 P.Ma Reconvention The Council reconvened at approximately 9:20 P.M. Sewer Plant Mr. Callinan reported on his meeting with the Expansion Rohnert Park Commercial Company and Mr. Golis Program and reviewed hic memo dated September 12, 1967 concerning the assessing of the golf course estates area fir fu -j. needed for the sewer plant expansion. Councilman V. Smith requested that staff provide the Council with a suggested policy in respect to the building of bridges. Mr. Golis advised that his associates had not approved or had an opportunity to go over all the conditions as yet, but requested that the land for the increased widening of Hinebaugh Creek be excluded from the bonding. The City Marager reviewed his cost analysis for the expansion project and the methods of raising the money. Mr. Callinan advised that the next step was to initiate the engineering and that M. C. Yoder & Associates had indicated that $12,000 would provide for enough engineering to permit submission of certain construction plans for certification for a Federal grant. City Manager Callinan solicited approval for the $12,000 engineering cost to be paid to 1VI.C.'Zoder and Associates subject to a proper contract being drawn and entered into between the City and M.C. Yoder. Coun-cilneyL Rogers Councilman Rogers left the meeting at-tis point, .T)eparture the time being approximately 9055 P.M. Upon motion by Councilman IT. Smith, seconded by Councilman Roberts and unanimously approved, the Council authorized staff to have M.C.Yoder & Associates do -the necessary engineering required engineering to obtain certification of the project for a Federal grant for sewer plant expansion. City Manager's Report Meeting with City Manager Callinan reported on a Cotati City Cotati Re. Council meeting which he and Mayor Pezonella had Sewer Service attended. At this meeting the Cotati Council agreed to a meeting with Rohnert Park officials on Wednesday, September 20, 1967 at 7030 P.M. in the Rohnert Park City Offices to discuss the possibility of Rohnert Park serving Cotati with sewer service. Mr. Callinan advised that lie had David Josephs this morning to try any problems before the Wednesday �,allinan advised that Dr_. Mr. Goli:s stated that Cotati did not have the money- to pay for the connec tyon. to Rohnert Park service and Rohnert Park may have to come up with a revenue bond arrangement. Highway Commis -- Mr. Callinan reminded the Council of the City's sion. Meeting appearance -before the Ca'.iifornia Highway Commis- sion on September 20th in Sacramento. Smith, seconded by Councilman Roberts and unanimously approved, the Council authorized the renewal of the City's group insurance program with Crown Life Insurance Company end authorized an increase in the major medical room rate to $45.00. ICMA Conference Mr. Callinan requested authorization to attend the ICMA Conference and advised that funds had been allocated for it in the budget. Mr. Callirim', also requested that Mr. Wiggins be approved as City Manager Pro-Tempore in his absence. Upon motion by Councilman Roberts, seconded by Councilman V. Smith and unanimously approved, the Council authorized the City Manager to attend the International City Managers' Association Conference and approved his appointment of Mr. Wiggins as City Manager Pro-Tempore during his absence. f Abolition of Wage Mr. Callihan discussed a State bill before the Rates in Specifi- legislature to abolish stating wage rates in cations. specifications. In so doing, the ciiies would simply adopt the prevailing 1,•iage scale once and they would not have to be put in each ::;et of specifications® Mr. Maxwell commented that the law as written was cumbersome and the z,-Lil-ating of wage in each set of specifications was a useless requirement. Upon motion by Councilman Roberts, seconded by Councilman V. Smith and unanimously approved, the City Manager was authorized to write a letter of support for the abolition of the requirement. Pedestrian Traffic Mr., callinan advised that -une Police Dept. was at Adr-.an and setting up a traffic patrol at this location in Boaxnie corJunction with the school, Purchase of The Ci,ty Manager advised. that he had received an Old College indication from Rohnert ?ark Realty that there iz; Bldgs. a pcs,­;inle buyer for the old college buildings who is interested in converting them to apartment 'buildings. Page -11- September 18, 1967 Expressway Grade Mr. Maxwell reported that he was trying to get Crossing the rehearing before the PUC set as soon as possible. Copeland Creek Mr. Maxwell asked if the Council still wanted to Improvement proceed with this project and have the necessary Project joint powers agreement with the County finalized. The Council indicated they wanted to proceed and requested Mr. Maxwell to handle the matter. Condemnation suit Mr. Maxwell reported he now had the legal des - for interchange cription and would prepare the necessary answer right -of -way to the suit. Public Annearances Dr. Cord - Dr. Cord asked what had been,done in creating a Cultural Arts Cultural Arts Commission and was advised that Commission the Council had authorized its creation and that Mr. Maxwell would have the necessary ordinance for introduction at the next meeting. Letters from Mexico Mr. Callinan advised that there were several more letters from Mexico thanking the City for their contribution of the sewing machines. Advertising for Mayor Pezonella asked the press to note the re- new Recreation signation of Rev. Saul from the Recreation Commissioner Commission and indicate in the paper that the City was interested in receiving letters from those residents who would like to serve on the Recreation Commission. CATV A discussion was held concerning the status of bringing CATV to Rohnert Park. Councilman V. Smith recommended the Councilmen read the latest issue of Business Week magazine for an up to date view on the subject. The Council set a meeting for Wednesday, Sept. 27th at 8:00 P.M. to discuss CATV.
