October 20, 1967
The Council of the City of Rohnert Park met this date in
regular session commencing at 7 '-00 P.M. in the City Offices
435 Southwest Blvd., Rohnert Park with Mayor Pezonella
presiding. This session was preceded by a work session
which commenced at 6 :45 P.M. to preview the ne7q uniform
for the Department of Public Safety.
Call to Order
Mayor Pezonella called the meeting to order and led the
pledge of allegiance.

Staff Present% City Manager Callinan, City Attorney Maxwell,
and George Tomilson Of Sonoma County Planning Staff.
Approval of Minutes
Upon motion by Councilman Roberts, seconded by Councilman
V. Smith and unanimously approved, the minutes of October
2, 1967 were approved as submitted.
Upon motion by Councilman C. Smith, seconded by Councilman

13, 1967 were approved as submitted.
Bills for Approval
Upon motion by Councilman Roberts, seconded by Councilman
C. Smith and unanimously approved, the bibs presentee!
were approved for payment.
Communications

No action was takon on any communication enoept as specifi-
cally noted.

Mr. Callinan reported that copies of the ordinance had
been sent to the Chamber of Commerce, Mrs. Loebsack and
Dr. Cord. A letter from Dr. Cord regarding the ordinance
was discussed. Mrs. Loebsack was present =d discussed
several points in the ordinance with the Council.
Upon motion by Councilman Roberts, seconded by Councilman.
V. Smith and unanimously approved the reading of Ordinance
No. 86 was waived and said ordinance adopted.

Yx. Callinan explained the resolution.
Upon motion by Councilman V. Smith, seconded by Councilman
Roberts and unanimously approved, Resolution No. 67 -76 -has
adopted.
Planning and Zonin& Matters
File No. 0077 - James City Manager Callinan explained the application displayed

Rubini Apt. Complex on application submitted by Mx. Hudis representing Mr. Rubini.
Beverly Dr. - Variance
request Mr. Tomilson commented on the various variances required
and pointed them out on the plot plan to the Council. A

discussion followed on the previous variances e.Tanted on

City Attorney Mawell advised that the granting of the
variances requested at this time would negate the previously
granted variances.
Upon motion by Councilman V. Smith, seconded by Councilman
Roberts and unanimously approved, the Council made the
necessary findings in accordance with the zoning ordinance
and granted the variances as requested, subject to the rear
uncovered parking spaces be enlarged to conform to the
ordinance.
T.G.. & Y. Sign City Manager Callinan advised that the new sign which T.
G. & Y. Store had installed was quite a bit over the maxi-
mum permitted by the zoning ordinance and that staff had

sign and its appearance was held upon the conclusion of

Off- Street Parking Pin. Tomilson reviewed his staff report and commented on

Project 1966 -2 Engineer Hudis gave a verbal status report. Mr. Haadis
Expressway discussed a V,OOO claim by Siri, Inc. for additional fill
and advised that he did rot think tb.e clain was valid. A
discussion was held and City Attorney N ,cell suggested
that the claim not be denied at this time, but wait until
the project is finished and compromise all claims at the
time of the final payment.
Mr. Hudis advised that Mr. Siri had regtosted a 15 day
extension of time and recommended Council approval of. the
request.
Upon motion by Councilman Roberts, seccnded. by Cclanci "loran

Upon motion by Councilman C. Smith, seconded by Councilman

Expressway Grade Cross - Mr. Maxwell advised that the PUC hearing was set for
ing October 31, 1967 and that County Counsel James Rotz
would represent the City at the hearing.
Project No. 1967 -1 Engineer Hudis gave a verbal status report on Project
Country Club Dr & Sny 1967 ®1. Mr. Callinan presented Progress Payment No. 2.

Upon motion by Councilman C. Smith, seconded by Coy -neilman
V. Smith and unanimously approved, Progress Payment No. 2
in the amount of $10,982.79 payable to D. M. Schlange -n for
Project 1967 -1 was approved for payment.
Claim of Donald L. Davis City Manager Callinan reviewed the claim and the incidents
which caused the claim to be filed.
City Attorney Maxwell advised the Council that under our
insurance we have no alternative but to reject the claim.

Chamber of Commerce Mr. Callinan reported that the Chamber of Commerce had

Sewer Plant Expansion Mr. Callinan stated that a petition is being cire-ala,ted for
an assessment to be placed on the land shorn as Golf Lake
Estates. He advised that he had contacted Bond Coiuisel
Richard Raymond, of Wilson, Jones, Morton and Lynch, who in
turn will advise how he feels the City should proceed. Mr.
Callinan reported that Mr. Raymond felt the City should
provide for the issuance of the revenue bonds to purchase
the lands but that this matter would be discussed with t1e
Council at the appropriate timo. Mr. Callinan further .d
vi,sed that he had just received a revised contract for
sewage treatment From the City of Cotati and after he and
City Attorney Maxwell had an opportunity to review it they
would present it to the Council for comment.
Golf Course Improve- Mr. Callinan reported that bond counsel had received from

interest rate. Mr. Callinan advised that if the Council
accepts the ccmmittmen.t it will enable the issuance of a
contract for the irrigation system.
Upon motion by Couuncilman. C. Smith, seconded by Councilman
Roberts and unanimously approved, the Council indicated
approval of the offer to purchase the golf course bonds by
Robert E. Schweser Co. of Calif. Ltd., sale of the bonds
at the 5.99% rate.
City Attorney's Report
Copeland Creek Project Mr. Maxwell adv -iced that a proposed Joint Powers Agreement
had been sent to Flood Control and the County, neither of
which had commented as yet.
Hardin Lawsuit Mr. Maxwell reported that a hearing was still set for Octo-
ber 309 1967 at which time he felt it would be set for trig)
Mr. lbordell stated he was still tying to settle out of
court.
McGuire & Hester Mr. Maxwell reported that he was having difficulty in gett-
ing McGuire and Hester to pay Axgonaut- Constructors for the
repair to the water line at the Copeland Creek and CommWrce
Blvd. bridge.
