1966/09/06 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES September 6, 1966 The Council of the City of Rohnert Park met this date in regular session at 8 :00 P.M. in the City Offices, 435 Southwest Boulevard, with Mayor C. Smith presiding. This regular meeting was pre- ceded by a work session which commenced at 7 :30 P.M. but at which no formal action was taken. Call to Order Mayor C. Smith called the meeting to order and led the pledge of allegiance. Roll Call Present: (5) Councilmen Pezonella, Roberts, Rogers, V.Smith and Mayor C.Smith. Absent: (0) None Staff present: City Manager Callinan and City Attorney Maxwell Approval of Upon motion by Councilman Pezonella, seconded by Minutes Councilman V. Smith and unanimously approved the- minutes of the regular meetings of August 1st and 15th, 1966 and the adjourned meeting of August 8, 1966 were approved as submitted. Approval of Bills Upon motion by Councilman Pezonella, seconded by Councilman Rogers and unanimously approved the bills, per the attached list, were approved for payment. Communications Communications, per the attached outline, were brought to the attention of the Council. No action was taken on any of the communications except as specifically noted in these minutes. 1. Letter from Hugh B. Codding regarding the alignment of a road west of U.S.101 and the Sonoma State Expressway to Gravenstein Highway was read. City Manager Callinan was requested to ac- knowledge Mr. Codding's letter and express the Council's willingness to work with him on this matter. 2. Letter from the State Regional Water Pollu- tion Quality Control Board regarding the annexation of properties by agencies not able to provide sewer service. Councilman V. Smith commented on this problem and the Local Agency Formation Commission's stand on this issue. Page -2- September 6, 1966 Councilman V. Smith requested the City Manager to request that this item be put on the next Mayors' and Councilmen's Aesocia- tion of Sonoma County's agenda, for discus - sion as a possible topic for one of their meetings. Report by Dr. VIM. Cord Dr. Cord was present and reported on the NDEA Foreign Language trip to Morelia, Mexico, Institute to Mexico Dr. Cord presented the City with a box of letters from the children of the four schools visited in Morelia. Dr. Cord read several of the otters r3iii'1 siiggAs`'r:e that they, be turned over to v v�a. av�.c over G.4. uv the elementary schools and the foreign language teachers with.'the thought that an exchange of letters between the school children would take place.. Mr. Callinan' read several letters from partici- pants in the Institute. .The Council thanked Dr. Cord for his report and expressed their sincere appreciation for his efforts. Mrs. Carole a Mr. Quinn of the Sonoma County Planning staff re- Kenworthy -- Use viewed his staff report with the Council in Permit - Foster which he recommended denial of the use permit. Home at 7481 Boris Ct. Mr. and Mrs. Kenworthy were present and discussed their request with the Council. Mrs. Henderson of the State Mental Hygiene Depart- ment was.present and explained the difference be- tween a certificate for a foster home and a li- censed operator who is conducting a business. Mr. Guinn suggested that perhaps a public hear- ing would be in order, which would permit the neighbors and public to be informed and make any comments or objections prior to further consider - ation: of the use permit. Upon motion by Councilman Rogers, seconded by Councilman Roberts and unanimously approved, the Council requested that this matter be set for a public hearing at the September 19, 1966 regular Council meeting and that the people in the sur- rounding area be notified. Apartment on Boris Mr. Callinan advised the Council that a minor Court -� Finisey change in the plot plan previously approved by the Council had been required by FHA. Page -3- September 6, 1966 1966 -67 Budget City Attorney Maxwell presented.a resolution for the adoption of the 1966 -67 budget as submitted. Resolution No.360 A RESOLUTION APPROVING AND ADOPTING A BUDGET FOR THE CITY OF ROHNERT PARK FOR THE FISCAL YEAR 1966 -67. Councilman V. Smith read Resolution No. 360. Upon motion by Councilman V. Smith, seconded by Councilman Rogers and unanimously approved, said resolution was adopted. Resolution No-354 A RESOLUTION DETERMINING THE AMOUNT OF MONEY NECESSARY TO BE RAISED FROM PROPERTY TAXES TO SUPPORT THE CITY DEPARTMENTS AND PAY THE INDEBT- EDNESS TO THE CITY FOR THE FISCAL YEAR 1966 -67. Upon motion by Councilman V. Smith, seconded by Councilman Rogers and unanimously approved, the Council accepted the external audit report for the City of Rohnert Park for the year ended June 30, 1966. Upon motion by Councilman Pezonella, seconded by Councilman Rogers and unanimously approved the reading of Resolution No. 354 was waived. Upon motion by Councilman Pezonella, seconded by Councilman Rogers and unanimously approved, said resolution was adopted. Resolution No.355 A RESOLUTION FIXING THE RATE OF TAXES FOR THE FISCAL YEAR 1966 -67 FOR THE CITY OF ROHNERT PARK. Upon motion by Councilman Rogers, seconded by Councilman Pezonella and unanimously approved, the reading of Resolution No. 355 was waived and said resolution was adopted. External Audit Mr. Dave Summers of Fitzpatrick & Poulsen was Report for the present and commented on the audit report for City of Rohnert the year ended June 30, 1966 and on the major Park changes in the City's financial record keeping system. He pointed out that the City had been on the accrual basis and had recorded deprecia- tion in the Utility Fund. A brief discussion followed with Mr. Summers, the Council, and the City Manager participating. External Audit A discussion was held between Mr. Summers, the Report for the Council and City Manager concerning the Rohnert Civic Commission Park Civic Commission's audit report. Upon motion by Councilman V. Smith, seconded by Councilman Rogers and unanimously approved, the Council accepted the external audit report for the City of Rohnert Park for the year ended June 30, 1966. Page -4- September 6, 1966 Ordinance No.69 AN ORDINANCE .MENDING O'RDiNANCE NO. 58 OF ThIE CITY OF ROHNERT PARK'(Mechanical Play Devices). Resolution No.356 City Manager Callinan. commented on the feasi- bility of adopting this ordinance in view of the fact that the machines referred to in the ordinance had been removed from the City. City Attorney Maxwell stated that there would be no reason to adopt the ordinance under the present Circumstances. The Council decided not to adopt introduced Ordinance No. 69. City Manager Callin.an commented on and read said resolution. Upon motion by Councilman V. Smith, seconded by Councilman. Roberts and unanimously approved, Resolution No. 356 was adopted, Resolution No.357 A RESOLUTION DECLARING CERTAIN TERRITORY WITH - DRAWN FROM THE COTATI FIRE PROTECTION DISTRICT (Annexation 3-A), Upon motion by Councilman Pezonella, seconded by Councilman V. Smith and unanimously approved, Resolution No. 357 was adopted. Improvement Pro- City Manager Callinan presented to the Council ject 1965 -3 - Progress Payment No. 4 to Argonaut Constructors Commerce Blvd. in the amount of $89743.85 for the extension of Commerce Boulevard and Progress Payment No. 2 to Argonaut Constructors for the widening of Commerce Boulevard between Alison Avenue and Arlen Drive. Mr. Hudis, project engineer, reported that the work on Commerce Boulevard had been completed and that he had filed with the City Clerk his Certificate of Completion. He recommended Council acceptance of the project. Upon motion by Councilman Pezonella, seconded by Councilman Rogers and unanimously approved, the Council approved Progress Payment No. 4 to Argonaut Constructors in the amount of $89743.85 for the extension. of Commerce Boulevard. Mr. Hudis commented that the piece of pipe re- moved from the bridge will have to be replaced by the City. Page -5- September 6, 1966 Upon motion by Councilman V. Smith, seconded by Councilman Roberts and unanimously approved, the Council approved Progress Payment No. 2 to Argonaut Constructors for the widening of Commerce Boulevard between Alison Avenue and Arlen Drive. Resolution NO-358 A RESOLUTION ACCEPTING COMPLETION AND DIRECTING ENGINEER TO FILE NOTICE OF ACCEPTANCE OF COMPLE- TION, COMMERCE BOULEVARD IMPROVEMENT PROJECT 1965.39 STREET IMPROVEMENTS. Upon motion by Councilman Rogers, seconded by Councilman V. Smith and unanimously approved the Council approved the agreement to provide municipal garbage service to Sonoma State College through October 319 1966 for the sum of $81.50 per month. Special Police Mr. Callinan requested Council approval to pro - Service for wide special police service to Sonoma State Sonoma State College when requested by College officials. College Upon motion by Councilman Pezonella, seconded by Councilman V. Smith and unanimously approved, the Council authorized the providing of periodic special police service to Sonoma State College. Upon motion by Councilman V. Smith, seconded by Councilman Pezonella and unanimously approved, the reading of Resolution No. 358 was waived and said resolution was adopted. Street Lighting Mr. Hudis reported to the Council that P.G.& E. for Project had advised him they estimated the cost of 1965 --3 lighting the four curves at $1358.00. Mr. Hudis stated that P.G.& E. had mentioned that the City might consider reflectors rather than spend the money for lights. A discussion was held and the City Manager was requested to check into the cost of reflectors and report back to the Council. Project Well No-5 Mr. Hudis reported on the progress of Project Well No. 5. City Manager's Report Garbage Service City Manager Callinan reported on the college's to the permanent request to the City for interim garbage service, campus of Sonoma Mr. Callinan advised the Council that the City's State College contractor had agreed to provide the service for the period through October 319 1966 for the sum of $82.50 per month. Upon motion by Councilman Rogers, seconded by Councilman V. Smith and unanimously approved the Council approved the agreement to provide municipal garbage service to Sonoma State College through October 319 1966 for the sum of $81.50 per month. Special Police Mr. Callinan requested Council approval to pro - Service for wide special police service to Sonoma State Sonoma State College when requested by College officials. College Upon motion by Councilman Pezonella, seconded by Councilman V. Smith and unanimously approved, the Council authorized the providing of periodic special police service to Sonoma State College. Page m-6° September 6, 1966 Purchase of Dot City Manager Callinan read his memo, dated on Burton Ave. September 2, 1966, to the Council and explained that the lot was being purchased on the basis of the City assuming the unpaid assessment, but otherwise free and clear of all delinquent taxes or other encumbrances. Upon motion by Councilman Rogers, seconded by Councilman Roberts and unanimously approved, the City Manager and City Attorney were authoriz- ed to proceed with the purchase of AP 143224 -24 and its development as a tiny tot play area. lmprcvement of The City Manager reported that the Count had Copeland Creek authorized the advancing to the City of 50,000 to enable the City to construct Copeland Creek. The City Manager advised that the matter now stands in the hands of the City Attorney and County Counsel to work out the details of the agreement. Upon motion by Councilman V. Smith, seconded by Councilman Rogers and unanimously approved, the City Attorney was requested to handle and expe- dite this matter to enable the documents to be prepared for the next Council meeting on September 19, 1966. Opposition to A discussion was held between the Council, City Post Office Manager and City Attorney concerning the Post Dept. Regular Office's regulation relative to curb-side tions delivery of mail. Councilman Rogers suggested that the City Attorney prepare an ordinance setting forth the City of Rohnert Park's requirements in prohib- iting the placing of any mail boxes in the public right -of -ways. Golf Course A discussion was held concerning water service Reduction of to the Rohnert Park Golf Course. Water Rates Upon motion by Councilman Rogers, seconded by Councilman Pezonella and unanimously approved the Council authorized rebelling the golf course at $40.00 per acre foot for the water used during _July and August and then to continue to bill them at $40.00 per acre foot as long as they draw off the water between the hours of midnight and 6000 A.M. The Council stipulated that in order to maintain this special rate the bills must be paid on time. Authorization: for City Manager Callinan Officer Peters to allow Officer Raymond Attend Law Course weeks law enforcement College, stating that for a 50% refund from Standards and Trainin; asked for authorization to Peters to attend the five course at Santa Rosa Jr. the City would qualify the State Peace Officers Commission program. Upon motion by Councilman Pezonella, seconded by Councilman Rogers and unanimously approved, the Council authorized the attendance of Officer Peters at the Santa Rosa Jr. College for the law enforcement course. Part -time Clerk City Manager requested Council authorization to for the Public set the clerk- typist,for the Public Safety Dept., Safety Dept. position at Range 109 Step A, $391.00 per month and to engage an employee at one -half time. Upon motion by Councilman Pezonella, seconded by Councilman V. Smith and unanimously approved the City Manager was authorized to employ a part - time clerk for the Public Safety Department and to position this job at Range 10, Step A of the City's pay scale. Swimming Pool Upon motion by Councilman V. Smith, seconded by Membership for Councilman Pezonella and unanimously-approved, Miss Rohnert Park approval for a free pool membership for Miss Rohnert Park 1966 -67 and her family was granted. City Attorney's Report Hardin Law Suit City Attorney Maxwell reported to the Council that the Hardin case had been dropped from the calendar and stated he would check to see why. He advised the Council that this did not mean that it could not come up again but that Mr. Hardin would have to file again. Page -7- September 6, 1966 Library Service City Manager Callinan reported on the efforts being made to find suitable quarters for branch library. State Chamber of Mr. Callinan advised the Council that Robert Commerce Smith, the regional manager of the State Chamber of Commerce had called and wanted the Council to know that they State Chamber did make a verbal request to the State Highway Commission for the Sonoma State Expressway interchange. Alicia Pool Mr. Callinan advised the Council that Alicia Closing Pool had officially been closed as of September 6, 1966. Page -8- September 6, 1966 Sonoma State The City Attorney reported on his meeting with Expressway Grade Don Head, County Road Commissioner and the City Crossing Manager. He commented briefly on the agreement drawn up by Mr. Mawson of the County Counsel's office. Mr. Maxwell advised that he will follow up on this matter to try and Ret it resolved as soon as possible. Reconvening of The Council reconvened at approximately 10 :45 PM. City Council Recreation The City Manager advised the Council that the Commission Recreation Commission requested the City Council Matters commend, by resolution, the Sting Rays for their recent win in the Redwood Empire League, Section II Championship meet. Resolution N0.359 A RESOLUTION COMMENDING THE ROHNERT PARK STING RAYS. CATV Matters from Councilmen Sofspra Car Wash Tha resolution was read by the City Manager Upon motion by Councilman Roberts, seconded by Councilman Pezonella and unanimously approved, Resolution No. 359 was adopted. A discussion was held, concerning CATV, at the conclusion of which. Councilman V. Smith asked that a letter be directed to Salinas requesting information as to CATV's status at this time. Councilman V. Smith expressed his appreciation to Councilman Roberts for coordinating the Founders Day activities. Councilman V. Smith inquired why Sofspra Car Wash was operating when the landscaping had not been done. City Manager Callinan stated that Mr. Lieb had been on vacation and he had not been able to contact him. A discussion was held, at the conclusion of which the Council requested that the City Manager advise Mr. Lieb that the landscaping Page -9- September 6, 1966 must be done by the next Council meeting on September 19, 1966 or the City would turn the water off. Letter to Mayor C. Smith requested that a letter be sent Chamber of to the Chamber of Commerce Commending them for Commerce their efforts and the activities and success of Founder's Day. Mayor Smith also requested that a letter be sent to Clover Dairy thanking them for bringing the sound truck and operator for the parade and other activities of the weekend. Mayors' and Council- Mayor C. amith reminded the Councilmen of men's Meeting the Mayors' and Councilmen's Meeting on Thursday, September 8, 1966. He suggested that Mr. Azevedo, principal of Rohnert Park Jr. Sr. High School,be invited as the City's guest. Consolidation of Mayor C. Smith inquired of the Council members if Cotati and they would have any objections to him undertak- Rohnert Park ing a study of the feasibility of consolidation on the basis of a private citizen. A discussion followed among the Councilmen, at the conclusion of which Mayor C. Smith.went on record as desiring to conduct this study in the capacity of a private citizen. City Attorney Maxwell suggested that no formal action be taken without all Councilmen being present, to which Mayor Smith agreed. Public Mrs. Keller, a resident, on behalf of the Sting Appearances Ray parents, thanked the Council for their co- operation and help in the Sting Ray activities. Mr. N. Spivock Mr. Norman Spivock, a developer, advised the Council that he was having a great deal of success in renting the buildings formerly used by Sonoma State College but he would like to sell the buildings instead of managing them. He asked for some answer from the Council by the next meeting on the question of the City purchasing these buildings. Mayor C. Smith asked the City Manager to put his recommendations and objections in written form and present it to the Council at the next meet- ing. City Attorney Maxwell pointed out that public funds cannot be used to purchase these build- ings since the City will not be using the major portion of them, and he questioned whether public funds could be used for an appraisal. Page -10- September 6, 1966 Councilman V. Smith requested that the City Attorney research the matter and have a legal opinion for the Council at the next meeting.
