1975/01/20 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES January 20, 1975 The Council of the City of Rohnert Park met this date in regular session commencing at 7:10 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Beary presiding. The regular session was pre- ceded by an executive session which commenced at 7:00 p.m. and at which all Councilmen, City Manager Callinan, and City Attorney Flitner were present, and which was held to discuss personnel and litigation matters Call to Order Mayor Beary called the meeting of the regular session to order at approximately 7:10 p.m. and led the pledge of allegiance. Roll Call `Present: (4) Councilmen Eck, Flores, Hopkins, and Beary Absent: (0) None Late: (1) Councilman Smith: his time of arrival is specifically noted in these minutes. Stff present for all or part of the meeting: City Manager Callinan, City Attorney Flitner, City Engineer Brust, Planning Director Skanchy, and Director of Public Safety Dennett Approval of Mintues Action on the minutes of December 16, January 6 and 16, was deferred to the next regular meeting since they had been received by the Council just prior to the meeting. Approval of Bills Upon motion of Councilman Hopkins, seconded by Councilmar Eck, and unanimously approved, the bills presented per the attached list in the amount of $56,270.40 were approved. Communications Communications per the attached outline were brought to the attention of the Council. No action was taken on any communication except as noted specifically in these minutes. Recycling Center A brief discussion was held concerning the letter and copy of grant proposal submitted by the Santa Rosa Recycling Center to the Sonoma County Board of Supervisors. Upon motion of Councilman'Eck, seconded by Councilman Hopkins, and unanimously approved, staff was directed to send a letter to the Board of Supervisors indicating support for the grant proposal submitted by the Santa Rosa Recycling Center. Page 2. January 20, 1975 Conference on Agri- A brief discussion was held concerning the conference on cultural Use8•of Waste "Agricultural Uses of Waste Water in Sonoma County" Water in Sonoma County to be held at California State College, Sonoma, on February 1. Mayor Beary and Councilman Eck indicated they would attend said conference. County General.Plan A brief discussion was held concerning the County General Preliminary Grant Plan preliminary grant application. Application Upon motion of Councilman Hopkins, seconded by Councilman Eck, and unanimously approved, the Council went on record as endorsing tie County Planning Department's grant application for funds to determine the best organization to implement the County General Plan. Lillian Vaughn re Lillian Vaughn, 369 Bonnie Court, was recognized. She Anti- litter'Week made a presentation concerning litter and efforts to combat same and requested that the city intensify its regular.good efforts at keeping the city clean and that the first week in May be proclaimed as Anti - litter Week. She suggested that a notice be included on the city utility bills concerning anti litter efforts and that city efforts be coordinated with school officials in educating and informing students. about -same. Councilman Smith Councilman Smith arrived during Mrs. Vaughn's presentation, Arrives the time being approximately 7:17 p.m. Upon motion of Councilman.Hopkins, seconded by Councilman Eck, and unanimously approved, Mayor Beary was requested to proclaim the first week in May as Anti - litter Week. General discussion followed concerning ways to reduce and /or eliminate litter in the community. Mrs. Vaughn was assured by the Council that a proclamation will be issued and Anti- litter Week possibly coordinated with a coarnunity clean -up effort. John Lipscomb- General 'Mr. Lipscomb was not present. Mayon Beary indicated if Comments re Urban Mr. Lipscomb should arrive later he would be recognized. Planning Rohnert Park Youth Jeff Roberts, Rohnert Park Youth Panel Chairman, 7300 Panel - Survey Results Burton Avenue, was.,r,ecognized. `He. advised that the Youth Panel had undertaken ,a city -wide survey with 610 beads.of hpusehold contacted; that less than to had refused to answer survey questions ;i.'that 191 man hours had been spent by students from Mr. Don Kite's government classes in conducting the survey during Christmas vacation; and that Mr. Kite and the Youth Panel members had tabulated the results of the survey. He distributed to the Council copies of the questions and tabtlation of responses, a copy of which is attached to and made a part of these minutes. A brief discussion followed during which thanks were expressed to the Youth Panel for doing the survey and being so active in the community. Page 3 January 20, 1975 Ordinance No. 254 Major Beary indicated that consideration of Ordinance No. 254 would be delayed in order to allow those known to be interested to arrive. Ordinance No. 253 AN ORDINANCE OF THE CITY OF ROHNERT PARK PROVIDING FOR THE DEFINITIONS APPLICABLE GENERALLY TO ORDINANCES OF THE CITY OF ROHNERT PARK, AND PROVIDING FOR RULES OF CONSTRUCTION FOR THE ORDINANCES OF THE CITY OF ROHNERT PARK. City Manager Callinan explained Ordinance No. 253. Upon motion of Councilman Hopkins, seconded by Councilman Flores, and unanimously approved, reading of Ordinance No. 253 was waived and said ordinance was adopted. Ordinance No. 255 AN ORDINANCE OF THE CITY OF ROHNERT PARK ADOPTING A GENERAL PENALTY City Manager Callinan explained the ordinance. Upon motion of Councilman Hopkins, seconded by Councilman Flores, and unanimously approved, reading of Ordinance No. 255 was waived and said ordinance was adopted. Ordinance No. 256 AN ORDINANCE OF THE CITY OF ROHNERT PARK REPEALING ORDINANCE NO. 49 (AN ORDINANCE ESTABLISHING AN INDUSTRIAL DEVELOPMENT COMMISSION FOR THE CITY OF ROHNERT PARK, CALIFORNIA) City Manager Callinan explained the ordinance. Upon motion of Councilman Hopkins, seconded by Councilman Flores; and unanimously approved, reading of Ordinance No. 256 was waived and said ordinance was adopted. Ordinance No. 257 AN ORDINANCE OF THE CITY OF ROHNERT PARK REPEALING ORDINANCE NO. 22 (AN ORDINANCE RELATING TO CIVIL DEFENSE AND DISASTERS) City Manager Callinan explained the ordinance. Upon motion of Councilman Hopkins, seconded by Councilman Flores, and unanimously approved, reading of Ordinance No. 257 was waived and said ordinance was adopted. Ordinance No. 258 All ORDINANCE OF THE CITY OF ROHNERT PARK REPEALING ORDINANCE NO. 5 (AN ORDINANCE PROVIDING FOR THE APPLICATION OF THE COUNTY OF SONOMA BUILDING ORDINANCE TO THE CITY OF ROHNERT PARK) City Manager Callinan explained the ordinance. Upon motion of Councilman Hopkins, seconded by Councilman Flores, and unanimously approved, reading of Ordinance No. 25'8 was waived and said ordinance was adopted. Page 4 January 20, 1975 Ordinance No. 259 AN ORDINANCE OF THE CITY OF ROHNERT PARK REPEALING ORDINANCE NO. 37 (AN ORDINANCE AMENDING ORDINANCE NO. 8: REGARDING LIMITATIONS UPON THE ISSUANCE OF BUILDING, ELECTRICAL, AND PLUMBING:PERMITS) City Manager Callinan explained the ordinance. Upon motion of Councilman Hopkins, seconded by Councilman Flores, and unanimously 'approved, reading of Ordinance No. 259 was waived and said ordinance was adopted. Ordinance No. 260 AN ORDINANCE OF THE CITY OF ROHNERT PARK REPEALING ORDINANCE NO. 3 (AN EMERGENCY ORDINANCE APPLYING CERTAIN REGULATIONS TO THE SUBDIVISIONS OF LAND, THE USE OF LAND, BUILDINGS AND STRUCTURES, TO THE ERECTION, CONSTRUCTION AND ALTERATION OF BUILDINGS, STRUCTURES AND IMPROVEMENTS WITHIN THE CITY OF ROHNERT PARK, AND PRESCRIBING THE PENALTY FOR VIOLATION.OF ANY OF.THE PROVISIONS HEREOF) Upon motion of Councilman Hopkins, seconded by Councilman Flores, and unanimously approved, reading of Ordinance No. 260 was waived and said ordinance was adopted. Ordinance No. 261 AN ORDINANCE AMENDING ORDINANCE NO. 190, AS AMENDED BY ORDINANCE NO. 216 (Changing Capital Outlay Fund Fee Schedule) City Manager Callinan briefly reviewed his memo to the Council dated January 17 concerning Ordinance No. 250 and explained the ordinance. Mr. Jacob Lehrer of Condiotti Enterprises was recognized. Ile commented generally about the ordinance and requested that any increase in the Capital Outlay Fund Fees be delayed due to the telescoping effect of increased costs on the sales price of a home. He commented that he does a lot of buying for Condiotti Enterprises and has noticed the prices of materials beginning to come down; and that houses are not-selling now'due to economic conditions. He further requested that the matter be delayed until the next meeting because many builders are out of town at a builders' conference in Dallas and couldn't be present. Discussion followed with Mr. Lehrer participating and during which the Council indicated that since the subject fees were tied to the Construction Cost Index they could be revised downward if said index decreases. Upon motion of Councilman Flores, seconded by Councilman Eck, and unanimously approved, reading of Ordinance No. 261 was waived and said,ordinance was adopted. Page 5 January 20, 1975 Ordinance No. 254 AN ORDINANCE GRANTING A RIGHT OF ENTRY TO AUTHORIZED CITY OFFICIALS FOR THE INSPECTION OF BUILDINGS AND PREMISES FOR THE ENFORCEMENT OF THE PROVISIONS OF THE CITY OF ROHNERT PARK ORDINANCES City Manager Callinan explained the ordinance and briefly reviewed his memo to the Council dated January 17 concern- ing same. City Attorney Flitner further explained the ordinance and read a portion thereof. Mayor Beary declared the scheduled public hearing open on Ordinance No. 254. Mrs. Mary Mori, 1289 Camino Coronade, was recognized. She commented that the Rohnert Park Homeowners Association appreciated being able to speak at the last meeting when the ordinance was introduced and for the amendments made to the ordinance as a result of same. There being no one further desiring to be heard, Mayor Beary declared the public hearing closed. Upon motion of Councilman Hopkins, seconded by Councilman Smith, and unanimously approved, Ordinance No. 254 was adopted., Resolution No. 75-15 RESOLUTION OUTLINING POLICY CONCERNING USE OF FEES DEPOSITED IN CAPITAL OUTLAY FUND City Manager Callinan explained the resolution. Upon motion of Councilman Hopkins, seconded by Councilman Flores, and unanimously approved, reading of Resolution No. 75-15 was waived and said resolution was adopted. Resolution No. 75-16 RESOLUTION OF THE COUNCIL OF THE CITY OF ROHNERT PARK APPROVING THREE YEAR PROJECT LIST FOR THE SAFER ROADS DEMONSTRATION PROGRAM IN SONOMA COUNTY. City L4anager Callinan explained the resolution. Upon motion of Councilman Smith, seconded by Councilman Hopkins, and unanimously approved, reading of Resolution No. 75-16 was waived and said resolution was adopted. Resolution No. 75-17 RESOLUTION AUTHORIZING FILING APPLICATION FOR FEDERAL AND STATE GRANTS FOR PUBLICLY OWNED WASTEWATER TREATMENT WORKS AND PROVIDING CERTAIN ASSURANCES City Manager Callinan explained the resolution. Upon motion of Councilman Hopkins, seconded by Councilman Smith, and unanimously approved, reading of Resolution No. 75-17 was waived and said resolution was adopted. Page 6 January 20, 1975 Resolution No. 75 -18 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK FINDING AND DETERMINING THE PREVAILING WAGE RATE City Manager Callinan explained the resolution. Upon motion of Councilman Flores, seconded by Councilman Hopkins, and unanimously approved, reading of Resolution No. 75 -18 was waived and said resolution was adopted. Parks & Recreation Mayor Beary noted that the time scheduled on the agenda Commission Matters- for both'the Parks and Recreation Commission matters Sonoma County 911 and Sonoma County 911 Planning Study had not been Planning Study reached and therefore Wastewater treatment and disposal matters would be considered next. Wastewater Treatment City Manager Callinan briefly reviewed City Engineer and Disposal Brust`s memo to the Council dated January 20 regarding aerator quotes received. Discussion followed. Upon motion of Councilman Hopkins, seconded by Councilman Smith, and unanimously approved, staff was authorized to purchase four aerator units from L. P. Metesser and Associates at the quoted price of $15,682.40 and directed to arrange for their early installation. General discussion followed concerning the anticipated effectiveness of the aerators and the possibility of added plant capacity.,,_ Mayor Beary made a motion, seconded by Councilman Hopkins, to direct staff to come up with alternate improvements to achieve 2 MGD capacity at the city's wastewater treatment plant without cost to the city. A lengthy discussion followed with City Engineer Brust participating concerning she appropriateness of seeking added plant capacity until effluent quality was improved to satisfy the Water Quality Control Board. Upon motion of Councilman Eck, seconded by Mayor Beary, and unanimously approved, Mayor Beary °s motion was tabled until such time as Mayor Beary thought it appropriate to consider the matter again. City Engineer Brust briefly reviewed his memo to the Council dated January 17 concerning the Regional Water Quality Control Board Hearing scheduled for January 30 to consider issuance of a Cease and Desist Order.. Discussion followed. Page 7 1 January 20, 1975 City Engineer Brust briefly reviewed his memo to the Council dated January 17 concerning the interceptor project. Discussion followed during which City Manager Callinan advised he would like to discuss wastewater treatment and disposal matters again at a work session of the Council. He advised that City Engineer Brust and he had attended a meeting at -the County Public Works Dept. earlier in the day at which buy -in costs for,the Llano plant had been mentioned for the first time and it appeared total Rohnert Park's share of connecting to the Llano Plant would be approximately Two Million Dollars. Discussion followed. Additional Road 11 City Manager Callinan reviewed his memo to the Council Alignment from Commerce dated January 17 concerning an additional road that Blvd. Eastward would extend eastward from Commerce Boulevard into the commercial and residential area and Planning Director Skanchy pointed out the proposed road alignment shown on the map displayed. Discussion followed. Upon motion of Councilman Hopkins, seconded by Councilman Flores, and unanimously approved, the road alignment as outlined by staff and approved by the Planning Commission was approved. Discussion was held concerning the request of Cofego Enterprises, -through Hugh B. Codding, to use assessment district proceedings to construct the new road from Commerce Boulevard to the railroad. Upon motion„of,Councilman Hopkins, seconded by Councilman Smith, and approved by the following voice vote, the use of assessment district proceedings as requested was approved AYES: (4) Councilmen Flores, Hopkins, Smith, and Beary NOES: (1) Councilman Eck Parks & Recreation Parks and Recreation Commission Chairman Beth Hofmann Commission Quarterly appeared discussed with the Council the Commission's Meetings with Request for quarterly meetings with the City Council. Council The Council indicated no objection to quarterly meetings as requested and scheduled the first such meeting for February 10 at 7:00 p.m. with the regular.Parks and Recreation Commission meeting to follow at 8:00 p.m. Councilman Eck Councilman Eck left the Council Chambers during the Leaves and Returns above discussion at approximately 8:25 and returned at approximately 8:27 p.m. Page S January 20, 1975 Gym at Junior High City Manager Callinan reviewed his memo dated January 17 regarding a gym at the junior high school site and the communication from Mrs. Hofmann concerning the Commission's feelings of same. A lengthy discussion followed with Mrs. Hofmann participating concerning the various alternatives for a gymnasium facility. Upon motion of Councilman Flores, seconded by Councilman Hopkins, and unanimously approved, the Council went on record as supporting the conversion of a portion of the metal and woodshop existing facilities at the junior high school as outlined by staff and directed that staff and a Council committee composed of Councilmen Eck and Flores appear before..the Petaluma District School Board to emphasize that athletic activities are a part of the educational program. Further discussion followed concerning a community building that would serve the ultimate population. The Council indicated that a Council committee composed of Mayor Beary and Councilman Smith should meet with two representatives from the Parks and Recreation Commission and two from the Cultural Arts group to pursue a program for a community building. Junior High Baseball .City Manager Callinan briefly reviewed his memo to the Field Priorities Council dated January 17 concerning the junior high baseball field priorities and also Parks and Recreation Director Pekkain's memo reflecting the Commission's recommendations on same.. Discussion followed with Parks and Recreation Commission Chairman Beth Hofmann partici- pating. By consensus of Council improvements to the junior high school baseball field will be generally pursued in accordance With the suggestions of the Commission, with emphasis given to making sure the improve- ments installed, such as backstop fencing, are appropriate for the long run. Boy Scouts Councilman Eck indicated that the Boy Scouts in attendance would like to ask some questions of the °Council. Mart4m DeWitt appeared and asked Mayor Beary what the Mayor's job consists of and Mayor Beary responded, briefly outlining the duties of the Mayor. Jim Schmidt appeared and asked Councilman Eck what the Councilman's job consisted of and Councilman Eck responded briefly outlining the duties of a Councilman. John Williams appeared and asked what is required to become a Councilman and Councilman Hopkins responded, briefly outlining the requirements. Page 9 January 20, 1974 Ray Albert appeared and asked City Manager Callinan what the City Manager's job consisted of and City Manager Callinan: briefly outlined the duties of 'a city manager. A brief discussion followed during which City Manager Callinan brought to the attention of the Council that Scout Day would be February 3 with Boy. Scouts participating in various city functions. Sonoma County 911 Director of Public Safety Dennett briefly reported on and Planning Study discussed with the Council the Sonoma County 911 Planning Prepared by Stanford Study prepared by Stanford Research Institute. In response Research Institute to a question from the Council, Mr. Dennett advised that the northern portion of the city would have to be in a transfer system, probably with Santa Rosa, although at a recent meeting concerning the 911 emergency number a telephone company representative had commented that Rohnert Park should be in a single telephone system within two years. Further discussion followed. Upon motion of Councilman Hopkins, seconded by Mayor Beary, and unanimously approved, the tentative 911 plan for Sonoma County as recommended in the planning study prepared by Stanford Research Institute was approved; i.e., with preference given to Single 911 PSAP and Eight 911 PSAP systems.. Library Site City Manager Callinan briefly reviewed his memo to the Configuration Council dated January 17 concerning the revised library site confi.guration.on Hunter Drive as a result of the additional road approved earlier in the meeting; and Planning Director Skanchy pointed out same on the map displayed. A brief discussion followed. Upon motion of Councilman Hopkins, seconded by Councilman Flores, and unanimously approved, the revised library site configuration was approved as outlined by staff. Sonoma County General City Manager Callinan reminded the Council of the Sonoma Plan Presentation County General Plan presentation scheduled for the January 23 Planning Commission meeting and urged all Councilmen to attend. Rancho Sonoma City Manager Callinan reviewed his memo to the Council Subdivision, Exten- dated January 17 and the letter received from Irving si.on of Tentative Bernstein, Attorney for Martin Stone, concerning the Maps for Units 2 & 3 extension of tentative maps for Rancho Sonoma Subdivision, Units 2 and 3. Discussion-followed.. Upon motion of Councilman Hopkins, seconded by Councilman Flores, and approved by the following roll call vote, a one --year extension was granted on the tentative maps for Rancho Sonoma Subdivision, Units 2 and 3, with the under- standing that sewer service is not guaranteed: AYES: (3) Councilmen Flores, Hopkins, and Beary NOES: (2) Councilmen Eck and Smith Page 10 January 20, 1975 Upon motion,of Councilman Smith, seconded by Councilman Eck, and unanimously approved, Mr. Stone will be requested to review the subdivision layout insofar as open space and parks are concerned.. Recess Mayor Beary declared a recess at this point in the meeting, the time being approximately 9 :15 p.m. Reconvene Mayor Beary reconvened the meeting at approximately 9:27 with all Councilmen present. Spivock Land North City Manager Callinan reviewed his memo to the Council of Golf Course dated January 17 concerning the Spivock land north of the golf course and the proposed resolution regarding preservation of said land as open space. Discussion followed. Resolution No. 75 -19 RESOLUTION PLEDGING ROHNERT PARK'S SUPPORT FOR PRESERVATION OF SPIVOCK LANDS AS OPEN SPACE Upon motion of Councilman Smith, seconded by Councilman Hopkins, and unanimously approved, reading of Resolution No. 75 -19 was waived and said resolution was adopted. Project 1974 -11, City Manager Callinan reviewed his memo to the Council Northwest Improve- dated January 17 concerning Project 1974 -11. ment Project In response to a question from the Council, City,Attorney' Flitner opined there would be no liability on the part of the city if the project were delayed two weeks or even a month since this could not be considered an "unreasonable" delay. Mr.. Norman Spivock, 440 Grand Avenue, Oakland, was recog- nized. He commented he was not opposed to the proposed use of the land for open space and thought it would be very nice, that he was concerned about delay since there are bonds assessed on the land for the Hinebaugh Creek project and taxes and assessments are running to approxi- mately $75,000 annually on,the property; he commented that a two week delay would cost him $8,150 in taxes and assess- ments, construction costs would increase, and this is the best time "of year to go to bid. He urged the Council to authorize a call for bids on the project and fix a date certain for same. Mr. Neil Bloomfield, 11 Madrone Court, Fairfax, was recognized. He advised he was Mr. Spivock's attorney and urged the Council to support the concept of the project. He commented there have been zoning commitments made on the land and that even thoughit was hoped that all parties could work.toward acquisition of the property for open space, it probably would not happen and felt the best way to avoid any conflict was to put the project out to bid. A lengthy discussion followed with Mr. Bloomfield participating. Page 11 January 20, 1975 In response to a question.from the Council, City Attorney Flitner opined that if the project is delayed and Rohnert Park is acting in good faith, the agencies causing the delay should pay the damages for any possible inverse condemnation suit that might be filed by the developers. City Manager Callinan advised he had discussed the matter with Bond Counsel Assaf of Wilson, Jones, Morton & Lynch and had been advised that it would be better to wait and know what the project is for certain before going to bid. He also reminded that the city is not required to use the assessment district procedure for improvement projects. Further discussion followed with Mr. Spivock and Mr. Bloomfield participating. Upon motion of Councilman Smith, seconded by Councilman Flores, and unanimously approved, Project 1974-11 was rescheduled for February 3 in the hope that the Council would have some. indication whether the other -involved public agencies intended to make a commitment for acouisition of the land for Open space. Establishment of City Manager Callinan briefly reviewed his memo to the Commit era re Local Council- dated January 17 concerning establishment of a Cable Television committee to oversee local cable television program Program Origination origination. Discussion followed concerning appropriate groups to assist in establishing such a.committee. Upon motion of Councilman Eck, seconded by Councilman Flores, and unanimously approved, Councilman Smith was appointed to work with the Rohnert Park Chamber of Commerce and the college audio-visual department in establishing a broad based committee to research what was desired by the community for local cable television program origination and report back to the Council with recommendations. Proposition 9, et al ,City Attorney Flitner discussed briefly with the Council and Reporting some of the..provisions of the various campaign disclosure Requirements and conflict of interest provisions and advised that a filing was due by January 31 under the Waxman-Dymally Campaign Disclosure Act. He advised be did not yet have the appropriate forms for reporting under the Political Reform Act:of.1974 (Proposition 9,) but suggested that perhaps a work session could be held to instruct the Council how to complete those forms when received. He advised that the Codding and Cofego's share of said costs had been received. Page 12 January 20, 1975 Landscaping Copeland City Manager Callinan briefly reviewed his memo to the Creek Council dated January 17 concerning the landscaping of Copeland Creek by the Sonoma County Water Agency. Discussion followed. Upon motion of Councilman Flores, seconded by Councilman Smith, and unanimously approved, staff was authorized to pursue obtaining an irrigation system design plan to water the plant material along the creek. Landscaping'Ladybug City Manager Callinan briefly reviewed his memo to the Park Council dated January 17 concerning landscaping of Ladybug Park and advised that only one quote had been received on the landscaping being from Skylark Nursery. A brief discussion followed. Upon motion of Councilman Smith, seconded by Councilman Eck, and unanimously approved, installation of the landscaping in Ladybug Park was approved at a cost of approximately $3,000 - $5,000. The Council indicated it wanted the trees protected by screening as has been done in other parks. New Community Center- City Manager Callinan briefly reviewed his memo to the Auditorium Planning Council dated January 17 concerning planning for a new community center - auditorium. A brief discussion followed during which the Council indicated that the committee discussed earlier in the meeting should consider this project. Library Project City Manager Callinan reviewed his memo to the Council dated January 17 concerning the library project. Discussion followed concerning the present plan to build a 5,000 square foot library facility and the desirability of increasing this to 10,000 square feet now rather than sometime in the future. Councilmen Eck and Flores were appointed to work on the library project in an effort to have the initial library facility 10,000 square feet. CETA /EEA Updating City Manager Callinan reported to the Council on the EEA and CETA federally funded employment programs and briefly reviewed the positions requested, those approved, and the positions filled. Cotati Theatres City Attorney Flitner reported he had discussed the movie problems in Cotati with Cotati City Attorney, Jay Cantor, and would report further on any progress made. Page 13 January 20, 1975 Z._� Legal Review City Attorney Flitner reported briefly on several pending court cases involving 'cities and advised he would report further when decisions are reached. He also briefly reported on a recent court ruling in Santa Clara which held that if the city undertook a bus service which adversely affected a private system, that the private bus system must be bought out. A brief discussion followed. Parking of Commercial Mayor Beary advised that discussion regarding parking of Vehicles in Residential commercial vehicles in residential areas would be Areas deferred. Bicentennial Plans Mayor Beary reported that Cultural Arts Corporation President Alice Wells had been contacted concerning the status of Bicentennial plans for the community and she advised that the group hop Esto incorporate Founders Day into Bicentennial celebrations and perhaps have something on the Rohnert Park sign. A brief discussion followed during which it was decided to invite Cultural Arts Corporation representatives to the February 18th Council- meeting for a more detailed report. Southwest Blvd. Councilman Eck initiated abrie f discussion concerning Speeding Vehicles speeding vehicles on Southwest Boulevard, including school buses. City Manager Callinan:advised he would have the Public Safety Department watch the area closely. Family Information '.Councilman Flores initiated a brief discussion concerning Center the Family Information Centerlocated in the City of Cotati, its funding problems, and advised that the center provided marriage counseling, educational and group counseling, and similar services, and that they currently have 80; cases from the City of Rohnert Park. Upon motion of Councilman Flores, seconded by Councilman Hopkins, and unanimously approved, a $250 contribution was approved for the Family Information Center to help defray its deficit. Landscaping at Cotati Councilman Smith initiated a discussion concerning the Performance Center inadequate landscaping and poor maintenance of same at and Velvet Cork the Cotati Performance Center and Velvet Cork Restaurant, 'Restaurant and suggested that some provision be included in land- scaping plans to insure proper ground preparation prior to installation of landscaping. Planning Director Skanchy advised that one of the use permit conditions for the Velvet Cork required that landscaping plans be submitted for review and approval and to date this had not been done and an occupancy permit had not been issued. Discussion followed. Page 14 January 20, 1975 Upon motion of Councilman Smith, seconded by Councilman Flores, and unanimously approved, staff was directed to follow up on the matter. Golden Gate Transit Councilman Smith brought to the attention of the Council that Golden Gate Transit had adopted rates for senior citizens, children, and handicapped of'10� per zone, e. g. 40t from here to San Francisco. A brief discussion followed. Term of Mayor Mayor Beary initiated a discussion concerning the term of the Mayor being for longer than one year with the Mayor being elected or chosen by the citizens. City Attorney Flitner advised he would check on the code provisions for General Law cities and report back to the Council. Llano Plant Buy -In City Manager Callinan brought to the attention of the Costs Council the buy -in costs for the Llano Plant is what the city'is being asked to pay for existing facilities at the plant and briefly reviewed figures quoted to him earlier in the day which approached $1.7 Million which would not include cost of the local plant modifications and interceptor. He explained that under the present proposal the city would get no credit for abandoning its,pl.ant. Discussion followed. It was decided to discuss the matter further at the scheduled February 10th work session.
