1974/09/16 City Council MinutesCall to Order Roll Call Approval of Bills Approval of Minutes Communications ROHNERT PARK CITY COUNCIL MINUTES September 16, 1874 The Council of the City of Rohnert Park met this date in regular `session commencing at 7:00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Beary presiding. Mayor % Beary called the meeting of the regular session to order at approximately 7:00 p.m. and led the pledge of allegiance. Present:, (5) Councilmen.Eck, Flores, Hopkins, Smith, and Beary Absent: (0) None Staff present for all or part"of the meeting: City Manager Callinan, City Attorney Flitner, Engineer Milt Hudis, and Director of Parks and Recreation Pekkain Upon motion of Councilman Flores, seconded by Councilman Hopkins, and unanimously approved 't bills presented per the attached list in the amount of $50,867.63 were approved. Upon motion of Councilman Hopkins, seconded by Councilman Smith, and unanimously approved, the minutes of September 3 were approved as submitted. City Manager Callinan read a letter from Dorothy Schmidt submitting her resignation from the Cultural Arts Commission. Upon motion of Councilman Flores,,seconded by Councilman Eck, and unanimously, approved', the�'resignation of Dorothy Schmidt from the Cultural Arts Commission was accepted with regret and the Mayor directed to write her a letter thanking her for her services on the commission:. ...Councilman Eck initiated a brief discussion, concerning the communication received from Tom Frenaye regarding the election precincts in' "L" section. City Manager Callinan advised he had contacted the County Election Department concerning the configuration of the precincts and was advised that they were under some time restrictions for the November election, but appreciated the Council's comments on the matter. Councilman Eck initiated a brief discussion concerning the communication received from David Kelso re fare structure on Golden Gate buses, It was suggested that he be informed of the Council's position on the matter and that any further communications should be directed to the County Board of Supervisors. September 16, 1974 Upon motion of Councilman Hopkins, seconded by Councilman Eck, and unanimously approved, comments will be solicited from the City of Cotati concerning conditions of the use permit for the theatres. Chamber of Commerce Chamber of Commerce Manager Don _Jones appeared and Presentation to Chet presented a framed certificate of appreciation to Chet Crowley, Founders Day Crowley, Founder's Day Chairman, commented particularly Chairman on the success of the parade and extended hearty con - gratulations to Mr. Crowley for an outstanding Founderts Day celebration. Resolution.No. 74 -128 CITY COUNCIL RESOLUTION COMMENDING FOUNDERS DAY CHAIRMAN CHET CROWLEY AND OTHERS Mayor Beary read the resolution. Upon motion of Councilman Flores, seconded by Councilman Eck, and unanimously approved, Resolution No. 74 -128 was adopted. Carol Geyer, Rancho Carol Geyer appeared on behalf of the 1973 --74 Championship Cotate High School Rancho Cotate High School Swim Team to express the grati- Swim Team tude of the swim team for the support of the Council in At the request of Councilman Eck City Manager Callinan read the copy of a thank you letter from Lyle Amlin, Founders Day Booth Chairman, to Ann Rasmussen for obtaining the Gayway entertainment for Founders Days. A brief discussion followed. Upon motion of Councilman Eck, seconded by Councilman Flores,.and unanimously approved, a thank you letter from the Council will be directed to all those who contributed to the Founder's Days activities. Peter Eliaser of Santa Councilman Eck advised that Mr. Eliaser was unable to Rosa Recycling Center be present due to a last minute conflict but had advised that when the newspapers had reported that the mobile recycling center at Park Plaza Shopping Center would be closing, the previous Saturday had been the best day ever and perhaps the mobile center would be in operation once a month or on'some`'revised schedule. A brief dis- cussion followed. James Stevens re Mr. James Stevens, resident of Rohnert Park and a teacher Rancho Cotate in Santa Rosa, was recognized. He commented that it had Theatres;l and 2 come to his attention that after a month or.so of business the Rancho Cotate Theatres 1 and 2 were showing "X" and "R" rated films; that the press had reported the owner as saying that it would be a family type theatre when obtaining the necessary permits from the City of Cotati; and expressed concern over the ads displayed outside the, theatre and the coming attractions shown when a general approval type film is playing and their effect on the ,youngsters of the community. Discussion followed with Mr. Stevens participating. Upon motion of Councilman Hopkins, seconded by Councilman Eck, and unanimously approved, comments will be solicited from the City of Cotati concerning conditions of the use permit for the theatres. September 16, 1974 Councilman Flores: advised-he had received a telephone call from Mrs. Shirley Russell of the Waldo Rohnert PTA who expressed concerns :about 4 -way stop signs being installed which would prohibit state funding for crossing guards. City Manager Callinan advised that none of the stop signs being installed would fall into that category. Swim Team Support City Manager Callinan briefly reviewed his memo to the Council dated September 13 concerning the Parks and Recreation:Commission's action concerning requests for support of the swim team. Parks and Recreation Commissioner Ron Fiori appeared to Answer questions of the Council concerning the matter. In' response to a. question from the Council, Director of Parks and Recreation Pekkain responded that the swim team would not take away from public use of the pool. In response to a question from the Council, Sting Ray Coach Gil:Soto responded that.the Sting Rays were dis- banded approximately two years ago simply because there were riot enough swimmers and it was felt they could bene- fit from competition with other swimmers. General dis- cussion followed with Mr. Soto, Mr. Pekkain, and Mr. Fiori participating. Upon motion of Councilman Hopkins, seconded by Councilman Smith, and unanimously approved, support of the swim team as recommended by the Parks and Recreation Commission was approved with the modification that the board of directors 'for the swim team would participate in the hiring and removal of the head coach for the team. Chamber of Commerce Manager Don Jones was recognized. He commented that the chamber had sponsored a golf tourna- ment in the past to support the college athletic program and would now be looking for another recipient of such support. He indicated he would discuss the matter with the chamber board of directors in the hope that the swim team could benefit from the annual golf tournament. Mr. Gil Soto was recognized and expressed appreciation for Mr. Jones' suggestion. He also thanked the Council and Parks and Recreation Commission for support of the swim team. He commented that the swim team would work toward becoming self - sustaining with the knowledge that the city could be counted on if needed. File No, 0327, Proposed City Manager Callinan briefly reviewed his memo to the Amendment to Zoning Council dated September 13 concerning File No. 0327. Ordinance re Side and Rear Yards and Visual Mayor Beary declared the scheduled public hearing open Clearance on File No. 0327. Page 5. September 16, 1974 City Manager Callinan advised that notice of the public hearing had'been published in the local newspaper. There being no one desiring to be heard and no corre- spondenoe received, Mayor Beary declared the public hearing closed. Ordinance No, 247 AN ORDINANCE OF THE'CITY OF ROHNERT PARK AMENDING TEXT OF ORDINANCE NO. 63, ZONING ORDINANCE (Side and Rear Yards: Requirements and'Exceptions) City Manager Callinan explained the ordinance. Upon motion of Councilman Smith, seconded by Councilman Flores, and unanimously approved, the reading of Ordi- nance No. 247 was waived and said ordinance was intro - duced: AYES: (5) Councilmen Eck,'Flores, Hopkins, Smith, and Beary NOES: (0) None Country Club.Estates City Manager Callinan reviewed his memo to the Council Sub. No. 1A, Crocker dated September 13 concerning Crocker Homes, Inc. request Homes, Inc. (Gentry) for an extension of time in which to complete the improve - Request for Extension ments in Country Club Estates Subdivision No. 1A. Dis- of Time cussion followed with`Mr. Woody Pereira of Crocker Homes participating. Upon motion of'Councilman Smith, seconded by Councilman Flores,`and unanitously approved, a one year time extens- ion was granted to Crocker Homes, Inc. in which to com- plete.the improvements in Country Club Estates Subdivision No. 1A. Report on'Feasibility City Manager Callinan noted the written report prepared by of Closed Circuit TV Mille Bianchi - Rossi, student intern, concerning the to Monitor City Parks feasibility of installing a closed circuit television system to monitor city parks and that he was not present to give the report. The Council indicated the written report was self- explanatory and by consensus of Council the matter was dropped from further consideration. Undergrounding City Manager Callinan reviewed his memo to the Council Utility, District dated 'Septen6dr 13 concerhing`an undergrounding utility district "' Discussion followed with Ralph Fitch of P.G.& E and Don Jones participating. Upon motion of Councilman Flores, seconded by Councilman Smith, and unanimously approved, an Undergrounding Utility District will be formed for the area on Southwest Boulevard east of the Public Safety Building to Burton Page 6. September 16, 1974 Avenue with the stipulation..that if additional funds are available an additional project will be undertaken. Mr. Bryce Suderow, 8010 Petaluma Hill Road, Penngrove, was recognized. He inquired how long undergrounding of utilities had been in effect. Mr. Fitch of F.G. & E. responded for approximately 6 or.7 years. Wastewater Treatment City Manager Callinan advised.he had checked with Mr. and Disposal Lindorf of TYA on Councilman Eck's request for clari- fication on the 4.1 MGD referred to in the concept approval letter for the interceptor vs. the 3.2 MGD referred to in the project report for same and had been advised that the 4.1 MGD referred to peaking flows. Mr. Callinan also advised that he had checked with Jesse Diaz of the State Water Resources Control Board who indi- cated,it would be alright to, proceed with the engineering for the interceptor project prior to execution of a joint powers agreement with the City of Santa Rosa. A brief discussion followed.., Resolution No. 74 -131 RESOLUTION APPROVING.AGREEMENT WITH JAMES M. MONTGOMERY CONSULTING ENGINEERS. AND MILTON HUDIS`CONSULTING ENGINEERS RE WASTEWATER TREATMENT FACILITIES City Manager Callinan explained the resolution. Upon motion of Councilman Smith, seconded by Councilman Hopkins, and unanimously approved, the reading of Reso -- lution No. 74 -131 was waived and said resolution was adopted. In response to a question from the Council concerning payment of the engineering fees, City Manager Callinan and.Mr..Gene Rheault of James M. Montgomery, Consulting Engineers, Inc. responded that 87.5% grant funding was hoped for. Councilman Smith requested Mr. Rheault to briefly speak to the Council about the Montgomery Engineering firm. Mr.:Rheault advised that his firm had been in the waste- water-field for 30 years and had volunteered its staff to those agencies which had been using YTO when some of the YTO staff left that firm so as to uphold the integrity of the engineering profession. That his firm had; designed the.Bodega Bay plant which was currently operating, had been engaged. by the blty'of Fairfield to design its sub - regional plant and briefly discussed the scope of that project. In response to a question from the Council, Mr. Rheault advised that Milton Hudis Engineering would be working on the pipeline portion of the project and that his firm.would be looking at the entire facility and Page 7, September 169 1974 would.:provi;de a,report to the.Council of what would actually be built and provide;a cost estimate for same. A -brief discussion followed, A At the request of Councilman Eck discussion was held con- cerning City Manager Calli,nan's letter to Dr. David Joseph dated September 6 concerning the wastewater treatment plant. He inquired of City Attorney Flitner if the city would be incurring liability in approving tentative or final maps since there is a sewer problem. City Attorney Zitner opinioned that liability does not attach at the tentative or final map stage; that courts have been hit- ting cities that have.tried to limit growth on the basis of lack of municipal services without making efforts to provide said services. Councilman "Eck requested City.Attorney.Flitner to deter- Mine what steps could be taken to impose a moratorium on tentative and /or final maps because we have a sewer prob- ;1em. A lengthy'discussion followed. Benches for Bus Stops City Manager Callinan advised that the cost per bench was approximately $100 4130 for bus stops and that in the past, participation had been solicited from service clubs. A brief discussion followed. Colegio Vista Park City Manager Callinan. advised that landscape materials Additional.Irrigation will be planted soon around the perimeter of Colegio System Vista Park and that materials! for an irrigation system for the now non-- sprinklered area of same would cost approximately $6,900 ­$7,000 based on materials quotes solicited. Upon motion of Councilman Eck, seconded by Councilman Flores, and unanimously approved, staff was authorized. to purchase the additional irrigation system and playground equipment for Cole�gia Vista Park and install same. Concession Stand for City Manager Callinan advised that he was successful in Rancho"Cota.te Field getting Condiotti Enterprises to contribute materials for the concession stand at the Rancho Cotate High School field, that the materials would be delivered the foi- lowing day and a concentrated effort would be made to have the concession stand constructed prior to the first home game on Saturday. Page 8 September 16, 1974 Windbreak for,Rancho, City Manager Callinan advised that after studying the Cotate Bleachers' matter closer, installation of plywood on the back of theRancho Cotate bleachers did not appear to be the best method of providing a windbreak and suggested that fast growing plants be installed instead. Mayor Beary noted that the Stadium Com°nittee had met the previous Monday'and had suggested a dirt mound with Sewer Effluent Irri - plantings on top of same. Park Tennis Courts had advised that a maximum of $1,000 would extend power Miss Rohnert Park for lights'to the,Alicia Park tennis courts. Pageant Bracelets Upon motion of Councilman Smith, seconded by Councilman Flores, and unanimously approved, staff was directed to .'return with a project for lighting the Alicia.Park, tennis courts. Gymnasium Report Councilman Smith..advised he had observed several mini- ' being ridden around the tennis courts and dirt clods being thrown on the courts. A brief discussion followed. City Manager Callinan advised that George Castleberry of the Petaluma School District had informed that the draft of agreement for a community gym had been sent to Sacra- mento for review; that the district wanted to make certain the.gym would not be detrimental to the square footage calculations for.the school. Housing and Community ':,City Manager Callinan advised that Rohnert Park.would , funds under the Housing Development Act of 1974 only be-eligible for discretionary Act 1974; that additional and Community Development of information would be,forthcoming from HUD and other agencies; but it appeared quite a lot of material would have to be prepared which,would require some expertise from staff if application is made for funds. Resolution'No. 74-132 RESOLUTION AUT90RIZING THE FILING OF AN APPLICATION UNDER THE COM ,PREHENSIVE EMPLOYMENT AND TRAINING ACT OF 1973 AND DIRECTING AND AUTHORIZING THE CITY MANAGER 'AS'THE OFFICIAL REPRESENTATIVE TO ACT IN CONNECTION WITH THE APPLICATION AND TO PROVIDE SUCH INFORMATION, ASSURANCES AND CERTIFICATIONS AS MAY BE NECESSARY City Manager Callinan explained the resolution. Upon motion of Councilman Hopkins, seconded by Councilman Smith, and unanimously. approved, reading of Resolution No. 74-132'was waived and said resolution was adopted. League of California City Manager Callinan reminded the Council of the League Cities Annual Conference of California Cities Annual Conference being held October 20-23 and advised that the Planning Commission had indi- cated a desire to attend although it seemed only one commissioner would be able to go. Discussion followed during which the Council indicated that since the Planning Commission was authorized to attend the League's Planning Institute they should not be authorized to attend the Annual Conference. Jim Davidson which allayed con - certs about overcrowding. Hillcrest Hospital Advisory Committee "L94 Section Bike Path Mayor Beary advised he had talked with Art Roberts about serving on the Hillcrest Hospital Advisory Committee and that Mt. Roberts had indicated he was willing to serve. Mayor Beary indicated that two_more individuals in the Rohnert Park area were being sought to serve on said committee and solicited Council members assistance. Councilman Flores advised he had received a telephone call from Mrs. Chad�dick, resident.of t9LII section, concern - ing the chain across the bike path in the area and that she had requested a'fence'be installed instead of the chain. He informed that his response to her had been that the Ad Hoc Committee on "L" Neighborhood Mini -Park Development would discuss the request at its next meeting. Street Patching Councilman•Smith initiated a brief discussion concerning the recent street patching in the city and some places that were rougher than before.
