1963/06/03 City Council MinutesROHNERT PARK CITY COUNCIL, June 3s 1963 The Council of the City of Rohnert Park met this date in regular session at 8:00 p-m- at the City Office, 6950 Commerce Blvd., Rohnert Park, with Mayor Smith presiding. Roll Call Present: (4) Mayor Smith, Councilmen Bell, Buchanan, Foust. Absent: (0) Police Chief Upon motion by Counci&man Foust, seconded by Councill'i'lan Bell, Joseph Spinelli was appointed Police Chief by the following (0) vote: AYES: (3) Smith, Bell, Foust ABSTAIN: (1) Buchanan NOM,: Councilman Upon motion by Councilman Buchanan, seconded by Councilman Foust, Jimmie W. Rogers was appointed Councilman to fill the vacancy created by Mr. Callinan's resignation by the following tote: AYES: (3) Smith, Buchanan, Foust ABSTAIN: (1) Bell NOES: (0) Mayor Smith made a statement regarding the reorganization of the City of Rohnert Park. This statement is attached and by reference made a part of these minutes. Oath of Office The City Clerk administered the Oath of Office to Councilman Jimmie W. Rogers, and City Manager Peter M. Callinan. Minutes Upon motion by Councilman Buchanan$ seconded by Councilman Foust, and unanimously approved, the minutes of May 20, 1963 were approved. Bills Upon motion by Councilman Bell, seconded by Councilman Foust, and unanimously approved, bills per attached copy dated June 3, 1963 were approved for payment. Managers Report Mr. Callinan, the City Manager7 made his report which included the following subjects: Report on City insurance; Sewer Inspection Connection; Neighborhood B Park; Report on Police Car; Temporary Fire House; Appointments to Recreation Commission p PG&E rates change at sewer plant; Sewer study by Milt Hudis; Annual Audit of City Books; Sewer Line to College. Sewer Insp. Fees Upon motion by Councilman Buchanan, seconded by Councilman Bell, action was deferred on lowering of Sewer Inspection Fee from W to $5 to conform to the Uniform Building Code, by the following vote: AYES: (4) Bell,, Buchanan, Foust$ Rogers, NOES: (1) Smith ABSENT: (0) Recreation Upon motion by Councilman Bell, seconded by Councilman, Foust, and unanimously approved, Ray Goff was appointed to the Recreation Commission. PG&E rate Change Up§n motion by Councilman Buchanan, seconded by Councilman. Foust, and unanimously approved, the PG&E rate change and schedule for the sewer plant was approved, and Mr. Callinan, City Manager, was authorized to execute the forms. Neighborhood B Proposed lease for Park in Neighborhood B offered by the developers is 6.56 acres. Park includes the following information: size of property bond, 7/i/64-6/30/65; rent for lst year will be T$l plus tax and payment will be $890.16 plus bond and taxes. Action was deferred. June 3, 1963 (cont) Audit Upon motion by Councilman Buchanang seconded by Councilman Foust, and unanimously approved, the yearly audit will be conducted by the firm who has done the audit for the past few year, Mr. Russell Goheen. The City Manager was authorized to negotiate the price for City Council approval. Resolution #70 Resolution No. 70 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK * CIVIL DEFENSE, was read and moved by Councilman Bell, seconded by Councilman Buchanan, and unanimously approved. Post Office Upon motion by Councilman Buchanan, seconded by Councilman Foustt and unanimously approved, the City Post Office Box will be moved from the Cotati Post Office to the Rohnert Park Pharmace facilities effective immediately® The same P.O. Box number will be retained. Sub. 19-B Upon motion by Councilman Buchanan, seconded by Councilman Foustq and unani-ously approved, the following changes are to be made in the final construction plans for roads, water and sewer in Sub- division 19-B: 1. All pipe not manufactured in this country will be required to be tested within 100 miles of Rohnert Nark® 2..Cast iron pipes will be eliminated. 3. Rubber bands will be eliminated from manholes and backfilled with soil instead® These changes will also apply to all, City Specifications in future subdivisions. City Specifica- Upon motion by Councilman Bell, seconded by Councilman Foust, and unanimously approved, Mr. Wiggins, Director of Public Works, was directed to check the city specifications and recommend any necessary changes. June 3, 1963 (cont) Well #4 Upon motion by Councilman Foust, seconded by Councilman Bell, and unanimously approved, plans for the drainage box at Well TY4, as submitted by Milt Hudis, Acting City 4agineer, were approved. Subdivision 9-B 'Upon motion by Councilman Foust, seconded by Councilman Buchanan, and unanimously approved, the map of Subdivision, 9-B was accepted for recording. The map, which was prepared by Mowbrey and Passarino, will note the 4b 00 bond for one year for monuments and pins, and the certifications will be changed to indicate City acceptance rather than County acceptance. Fire Dept. Upon motion. by Councilman Buchanan, seconded by Councilman Foust, and unanL-,,iously approved, the Fire Department election results were approved by the City Council as follows: Chief: Robert J. Ryan; ist Assistant: Silvio Cincera; 2nd Assistant. Delane Patton. Copies of Minutes The City Clerk was authorized to furnish copies of City Council minutes to organizations and business at no charge. Individuals must pay 1..50 per page. Copies will not be mailed, but must be picked up at the City Office. FHA in Sub 4-A The City Council requested that Mr. Spivock, developer; Mr. Hudis, Acting City !hgineer; Mr. Callinang City Manager and Mr. Maxwell City Attorneyq work to resolve the problem of FHA financing in Sub 4-A because S anta Alicia Drive is not completed. Adjournment There being no further business, the meeting was then adjourned at 10:50 p.m. City Clerk APPROTLD: Mayor i CITY COUNCIL STATEMENT ON CITY SEWER SERVICE by Mayor Smith With the authorization for M. Hudis to conduct the sewer study, it is felt that perhaps a rest4tement of the Council's position on sewer services should be made. In Resolution No. 50 adopted February 4th, 1963, the City Council expressed a policy of city services for city areas. Much discussion and comment has been given to one particular city service* namely sewer service. While the city has excellent sewer service facilities and has always expressed an interest in the orderly development of areas immediately adjacent to the city, the following points should be kept in mind: As of this date the City Council feels: 1. That the city has no obligation and certainly has made no committment to provide sewer service to any lands other than the land area presently within the city limits of Rohnert Park. 2. That an indication was made to the State of California of Rohnert Park's willingness to provide the permanent college site of Sonoma State College with sewer service. However, extension of sewer service to the college is dependent on many factors, such as: a* The State and City agreeing on a mutually satisfactory contract for the sewer service, b. An expression by the college on what additional city services the college may require, such as fire protection and pplice protection and from where they intend to obtain theme co An expression by the college on whether or not is would consider becoming a part of the City of Rohnert Park. d. The council feels that unless the college is in the city limits of Rohnert Park that chances of the area immediately around the college site obtaining city services from Rohnert Park are pretty nil. 3. That land owners bordering the City of Rohnert Park should not be so naive as to think that if and when they want sewer service that all they will have to do is ask Rohnert Park. This is an absurdity. 4. That if anyone outside the present city limits has a priority right to expect sewer services it is only the Rohnert Park developers with whom the city has worked very closely in our development. This expr4ssion is made contingent upon these developers bringing their lands into the city as soon as possible so that overall planning authority will be vested in the city* In essence what the council is saying is that the only real committment that our sewer facilities have on them presently is for the City of Rohnert Park with a contingent committment also to the State College and the Rohnert Park development group. Let no one believe to the contrary. CITY COUNCIL S'T'ATEMENT TO CITIZENS OF ROHNERT PARK 3 June 1963 by Mayor Smith With the appointment of Mr. Rogers as Councilman, the City Council has now completed the first major reorganization since Rohnert Park became a city® Much thought on the part of the council went into the decisions to make this reorganization. council. became readily apparent to the council. The reorganization also affects the position of City Treasurer. The city presently employs Mr® O'Neil as City Treasurer at $100 per month® Effective in July, it is planned that most of the duties presently being performed by the City Treasurer will be transferred to the City Manages°® This move will allow the city to reduce substantially the salary paid to the City Treasurer since his duties will be minimized as far as State Laws will allow. In appointing Mr. Rogers to replace Mr. Callinan on the council we feel that wd have chosen a person who on many occasions has shown his interest in civic affairs, He has demonstrated leadership and gained the respect and admination of all those who have had contact with him. While we do not anticipate always agreeing with him, we have no reservations that Mr. Rogers will develop into a representative that all the citizens of Rohnert Park will be proud of. And so these special districts have not been the answer. Demands for service gvew and local governments have passed on more and more of them to the State and Washington; State and Federal governments have met these and moverl in with their own programs. Thus the plight of local government is a serious one. Their powers are scattered even among special districts; they are in a poor position to reassert fiscal responsibility, but if they don't the cities and citizens will have less and less to say about their own affairs. This is the penalty for buck passing. One of the foremost precepts of the natural law is mans right to the possession and use of his property, and having said that each man has an inalienable right to his property, it must also be said that every citizen has an obligation to contribute his fair Mare to the legitimate functions of Government - he has no obligation be that. While we are laying claim to a 50o tax rate, many of our residents tax bills reflect up to M-00. We feel future homeowners should not be sub-ordinated to the petty form of Government Special Districts aretespecially when such exist to permit local Governments to by pass fiscal responsibility.
