1978/07/24 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES July 24, 1978 The Council of the City of Rohnert Park met this date in, regular session commencing at 7 :00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Hopkins presiding. The regular session was preceded by an executive session which commenced at 7:00 p.m. and at which all Councilmen and City Manager Callinan were present and which was held to discuss personnel and litigation matters. Call to Order Mayor Hopkins called the meeting of the regular session to order at approximately 7:23 p.m. and led the pledge of allegiance Roll Call Present: (5) Councilmen Beary, Carbone, Roberts, Stewart and Hopkins Absent: (0) None Staff present for all or part of the meeting: City Manager Callinan, City Attorney Flitner, and Planning Director Skanchy. Approval of Minutes Upon motion of Councilman Carbone, seconded by Councilman Roberts, the minutes of July 10, 1978 were approved on a voice vote, with Mayor Hopkins abstaining. City Manager Callinan noted that on page 9, paragraph 6, he wished to strike the prefix "anti" in anti - tyranny. The Council agreed. Final Map, File No. Approval of Final Map, File No. 0205 - Crocker Homes, Inc., 0205, Crocker Homes Mountain Shadows Subdivision II, (142 single family lots) and authorizing Mayor to execute appropriate subdivision agreement. Final Map, File No. Approval of Final Map, File No. 0578 - Debra Homes, Inc., 0578, Debra Homes Foothills Subdivision, (137 single family lots) and authorizing Mayor to execute appropriate subdivision agreement. Final Map, File No. Approval of Final Map, File No. 0590, Pacific Coast Development 0590, Pacific Coast Corp., Country Club Villa, (33 single family lots) and Development Corp. authorizing the Mayor to execute appropriate subdivision agreement. Page 2 July 24, 1978 Upon motion of Councilman Carbone, seconded by Councilman Stewart, the final maps for File Nos. 0205, 0578 and 0590 were approved, on.a voice vote with Councilman Beary abstain - ing. Resolution No. 78 -99 RESOLUTION ACCEPTING GRANT DEED (From Qantas Development Corporation, Off -Sit.e Sewer and Storm Drain Easement, Colegio Vista Subdivision No. 5) Resolution No. 78 -100 RESOLUTION ESTABLISHING PAY RANGE FOR PUBLIC SAFETY LIEUTENANTS AND.CT�ANGING THEIR STATUS TO MANAGEMENT EMPLOYEES Upon motion of Councilman Carbone, seconded by Councilman Stewart, and unanimously approved, reading of Resolution Nos. 78 -99 and 78 -100 was waived and said resolutions were adopted. Jack Behl re. Mr. Jack Behl, 56 Allan Avenue, was recognized and stated Amphitheatre that he represented the Rohnert Park Cultural Arts Corporation and inquired what the City planned to do regarding a community amphitheatre. City Manager Callinan informed that there is a bowl design being constructed by the Public Works Department. Mayor Hopkins.appointed Councilmen Beary and Stewart to an Amphitheatre Coordinating Committee, which will last for one month and report their findings to City Council on September 11, 1978. Proposed 1978 -79 City Manager Callinan referred Council to his memo dated Budget July 20, 1978 to the City Council regarding the proposed 1978 -79, budget . Mayor Hopkins opened the public hearing on the proposed budget for the fiscal year 1978 -79. Clara Brown, 335 Allison Avenue, was recognized and inquired .Lf the Cultural Lli is budget wa�� b�%.�.-++g cut a City Manager Callinan informed that Cultural Arts is budgeted to receive $5,500. There being no one else desiring to be heard, Mayor Hopkins closed the public hearing. Resolution No. 78 -101 RESOLUTION APPROVING AND ADOPTING A BUDGET FOR THE CITY OF ROHNERT PARK FOR THE FISCAL YEAR 1978 -79 Upon motion of Councilman Roberts, seconded by Councilman Carbone, and unanimously approved, reading of Resolution No. 78-101 was waived and said resolution was adopted: Page 3 July 24, 1978 Resolution No. 78 -102 RESOLUTION OUTLINING POLICY ON CONVERSION OF APARTMENTS TO CONDOMINIUMS Policy on Conversion City Manager Callinan read proposed Resolution No. 78 -102 to Condominiums Outlining Policy on Conversion of Apartments to Condominiums, and informed that this resolution is a combination of proposals made by Councilmen Roberts and Stewart. File No. 0289 Robert Harris, Appeal of Planning Commission Decision re. Condo- minium Conversion Communications Unified School District Matters Councilman Roberts made a motion, seconded by Councilman Stewart, to adopt said resolution as presented. Discussion followed. Councilman Carbone made a motion, seconded by Councilman Roberts, to amend paragraph 1. of said resolution by deleting the word "only ". Councilmen Stewart withdrew her second on the original motion. Councilman Roberts made a motion, seconded by Councilman Carbone, to adopt Resolution No. 78 -102 with the word "only" deleted from the first subparagraph. The motion was approved by the following roll call vote: AYES: (3) Councilmen Carbone, Roberts and Hopkins NOES: (2) Councilmen Beary and Stewart City Attorney Flitner advised Council that they may vote to reconsider this appeal due to the 2 to 2 Council vote cn this matter at the July 10th meeting. Councilman Beary made a motion, seconded by Councilman Carbone, to reconsider Robert'Harris' appeal 'of the Planning Commission decision regarding the conversion of his apartments on Santa Alicia Drive to condominiums. Said motion failed by the following roll call vote: AYES: (2) Councilmen Beary and Carbone NOES: (3) Councilmen Roberts, Stewart and Hopkins Communications per the attached outline were brought to the attention of the Council. No action was taken on any communications except as noted specifically in these minutes. City Manager Callinan informed that the Cotati - Rohnert Park Unified School District will be eliminating bus transportation and advised of the July 20th letter from Schools Superintendent McConnell requesting the City to pay from the Schools Impact Fee Fund to move 5 portables to the Emily Avenue school, and advised the Council to consider the possibility of developing a new portable school at the northern school site in the Coleman Valley area. Discussion followed with Dr. McConnell, Superintendent of the Cotati - Rohnert Park Unified School District, who expressed his thanks to the City for the suggestion of the portable school and that he would bring up this suggestion at the School Board meeting on Wednesday, July 26, 1978. He also expressed his concern for the students living on the west side of U.S. 101 freeway in Page L} July 24, 1978 regards to the elimination of bus transportion and informed that there is a special,nieeting scheduled for Monday, July 31, 1978 to address'th is problem. He also informed that the portable school would be needed by October 16, 1978, if 5.t is authorized to be placed on the northern school site. Mrs. Phyllis Fore, 940 Ellen Street, was recognized and asked what was planned to be done about the children in double sessions at Emily school, and stated that she felt that the ,5 portable school units being discussed for the northern school site would be better utilized at the Emily school site. Dr. McConnell stated that this will be decided at the Board meeting on July '26', 1978. Mrs. Cathy Briscoe, 932 Ellen Street, was recognized and inquired if City Council would reconsider the placement of the portable school if there is any problem with the northern site and could this be done in time to meet the October 16th deadline. Mrs. Alice Wells, Vice - Chairman of the School Board, was recognized and informed her that the school board would hold special meetings if necessary to solve any problem with the placement of the portable school. Mrs. Wells then extended an invitation to Mayor Hopkins, Councilmen and staff to attend the July 26th meeting. Councilman Carbone indicated that he would attend„ Mrs. Helen Lawrence, 942 Ellen Street, was recognized and asked what land was being discussed for the northern site and when would the portable school be ready. RGiiiier� and of the portable school depended on when the manufacturer could have the buildings ready. Mr. John Reichert, 6299 Country Club Drive, was recognized and expressed his concern that there was not enough notice given to parents regarding the elimination of busing and the double sessions at Emily school, and asked why there couldn't be extra portable units set up at Emily to relieve the double sessions. Mayor Hopkins informed him that it was not possible to have the portable units set up before October lst and, therefore, alleviate the double sessions. Upon motion of Councilman Roberts, seconded by Councilman Carbone, and unanimously approved, City Manager Callinan was directed and authorized to get a new "portable" school developed on the school site on Hudis Drive. Pandemoniac PANDEMONIAC VEHICLES FROM THE CITY OF ROHNERT PARK Vehicles City Attorney Fli_tner reviewed Ordinance No. 356. Upon motion of Councilman Roberts, seconded by Councilman Carbone, and unanimously approved, the reading of Ordinance No. 356 was waived and said ordinance introduced. Lawsuit Against PERS City Attorney Flitner informed that this lawsuit has not & Numerous Cities been certified as a "class action" lawsuit and that retaining outside counsel may not be necessary. Ile will keep Council informed regarding this matter. regarding the possible delivery date before the school. board meeting on July 26th. She was informed ,that she could do.so. Sale of Gasoline Upon motion of Councilman Carbone, seconded by Councilman Stewart, and unanimously approved, staff was authorized to sell gasoline from the city's Corporation Yard to the Cotati- Rohnert Park Unified School District for its Driver's Education Course vehicles at the City's cost plus 10%. Councilman Beary inquired about the legislation concerning State aid for the portable schools. Mr. Davidson, Assistant Superintendent of the Unified School District, informed that this legislation was passed and that the school district would be reimbursing the city for approximately $92,000 for the Emily.Avenue portable school when it is received from the State. Recess Mayor Hopkins declared a recess at this point in the meeting, the time being approximately 8:47 p.m. Reconvene Mayor Hopkins reconvened the meeting at approximately 8:58 p.m. with all Councilmen present except Councilman Carbone. City Manager's Report City Manager Callinan referred the Council to his memo dated July 20, 1978 to the City Council for explanation of all matters on the City Manager's Report section of the agenda. Councilman Carbone Councilman Carbone returned to the meeting during City Returns Manager Callinan's report, the time being approximately 9:00 P.M. City Manager Pro Upon motion of Councilman Roberts, seconded by Mayor Hopkins, Tempore and unanimously approved, Assistant to the City Manager Robert Albright was approved as City Manager Pro Tempore during City Manager Callinan's vacation from July 31st to approximately August 21st. Page 6 July 24, 1978 Sonoma County Waste- Councilman Carbone was designated as the city representative water Reclamation to the Citizens Advisory Committee, Sonoma County Wastewater Reclamation Study. Sonoma County Mayors' Mayor. Hopkins informed that Rohnert Park will be hosting & Councilmen's Assn. the September 14, 1978 meeting of the Sonoma County Mayors' Meeting and Councilmen's Association and that he will be coordinating the meeting to be held at the Community Center. Councilman Stewart extended congratulations on behalf of the City Council to Mayor Hopkins on being appointed Vice- Chairman of the Sonoma County Mayors' and Councilmen's Association. State Wastewater Councilman Carbone read a letter from the City of Arcata Reclamation Laws calling for a resolution to support a more flexible State wastewater reclamation law. Councilman Carbone made a motion, seconded by Councilman Peary, to send a letter of support. It was then noted that the letter called for endorsement before July 22nd. Councilman Beary made a motion to table it, which died for lack of a second. Councilman Roberts made a motion, seconded by Councilman Stewart, and unanimously approved, to send a letter of support for Arcata's recommendation. The proposed budget includes all city operations and contains recommendations and proposals for use of all various city funds including those funds received by the city under the Federal General Revenue Sharing Program. Copies of the proposed budget are available in the City Offices, 6750 Commerce Boulevard. All persons desiring to offer comments concerning the proposed budget are invited to do so.
