1978/08/28 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES August 2 8, 1978 The City Council of the City of Rohnert Park met this date in special session commencing at 4:00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Hopkins presiding. Call to Order Mayor Hopkins called the meeting of the special session to order at approximately 4:10 p.m. and led the pledge of allegiance. Roll Call Present: (3)- Councilmen Carbone, Stewart and Hopkins Late: (2) Councilmen .Beary and Roberts (whose time of arrival is specifically noted in these minutes). Approval of Minutes Councilman Stewart noted that page 6 of the minutes should be corrected to reflect that Pete Bailey had commented concern - ing the City Council Chambers' clock. Upon motion of Councilman Carbone, seconded by Councilman Stewart, and unanimously approved, the minutes of August 14th were approved as corrected. Approval of Bills Upon motion of Councilman Carbone, seconded by Councilman Stewart, and unanimously approved, the bills presented per the attached list in the amount of $276,379.64 were approved. C O N S E N T C A L E N D A R City Manager Callinan referred the Council to Asst. -to the City Manager Albright's memo dated August 25, 1978 to the City Council for explanation of all the matters on the Consent Calendar. Resolution No. 78 -111 RESOLUTION ACCEPTING GRANT DEED (from Qantas Development Corp., Parcels A & C, Colegio Vista Subdivision No. 5A) Resolution No. 78 -112 RESOLUTION ACCEPTING COMPLETION AND DIRECTING ENGINEER TO FILE NOTICE OF COMPLETION (Rohnert Park Community and Recreation Center, Phase I Grading, Project No. 1977 -14) Resolution No. 78 -113 RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS AND AUTHORIZING THE RELEASE OF BONDS FOR COUNTRY CLUB ESTATES SUBDIVISION NO. 5, - UNIT A Ordinance, No. 357 AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING THE ROHNERT PARK MUNICIPAL CODE, SECTIONS 17.52.060, 17.52.070, 17.58.080, 17.58.150 and 17.62.024 (Re. AYES: (4) Councilmen Carbone, Roberts, Stewart, Hopkins NOES: (b) None ABSTAIN: (1) Councilman Beary File No. 0605 - City Manager Callinan reviewed Asst. to the City Manager Shapell Industries Albright's August 25th memo to the City Council concerning Elderly Housing the appeal of Mr. Joel Heath requesting the City Council to Project (Appeal by overturn the Planning Commission's approval of Shapell Indus- i. Heath) tries' proposed 150 unit elderly housing project to be developed north of Valley Village Mobile Homes Estates on Country Club Drive. Planning Director Skancby reviewed his planning staff reports and described the development plan which was displayed. City Attorney City Attorney Flitn ' er arrived at this point in the meeting, Arrives the.time being approximately 4:18 p.m. Discussion followed between Council members and staff regard- ing the proposed elderly housing project. Mr. Mark Maltzman, Shapell Industries, was recognized and commented on HUD/city review of the proposed project as well as tenant profile, environmental impact, traffic circula- tion and security fencing. A brief discussion followed between Mr. Maltzman and the City Council. Mr. Joel Heath, Campbell California, was recognized and explained that he had filed an appeal because the fencing and roadway had not been properly addressed during the planning process. He generally expressed concern relating to the prof t f '"mount-inS 10`qti0n rp % Uhe of two story structures, vehicular emissions, with major emphasis on traffic control and fencing for security. Discussion follwed between Mr. Heath and the City Council. Mr. Heath pointed out that he desired two separate roadways, i.e. Walnut Circle separate from the access to the proposed project, and that the existing 6 foot fence remain for security reasons. Mr. Heath presented to the City Clerk a letter (a copy of which is attached to the original set of these minutes) distributed to residents of Vallev Village. Discussion between the Council and Mr. Joel Heath resumed and during which Mr.. Paul Heath was recognized. Page 3 August 28, 1978 Mayor Hopkins inquired if other individuals in the audience desired to speak concerning the proposed project. Mrs. Madeline Dashwood, Valley Village, was recognized and inquired if anyone had suggested that the Heath's purchase that portion of Walnut Circle which did not belong to them inorder to preserve the fence and make a private roadway for Valley Village. Mrs. Irene Michaels, Valley Village, was recognized and generally commented on activities of senior citizens and the Council's consideration of traffic and security problems associated with the proposed development. Mr. George Michaels, Valley Village, was recognized and expressed that, in his opinion, the proposed project was very well. designed even though there could be some changes with reference to the roadway and fencing. Discussion followed between Council members concerning vandalism, fencing, and roadway access to Valley Village and the proposed elderly housing project. Mr. Frank Dashwood, Valley Village, was recognized and inquired if the site plan provided for eltimate width of the Expressway and suggested how Walnut Circle could be partially fenced. Discussion followed between the City Council members, staff, and Mr. Ma It zman . Mr. Cummins, 193 Walnut Circle, was recognized and expressed that in his opinion the fence along Walnut Circle should remain intact for security reasons and commented on rental fees compared to improvements made by the property owner. Discussion followed between Council members. Upon motion of Councilman Roberts, seconded by Councilman Carbone, and approved by the following roll call vote, the City Council upheld the appeal. of Mr. Joel Heath and overturned the Planning Commssion's approval of Shapell Industries' proposed 50 unit elderly housing project to be located north of Valley Village Mobile Homes Estates and directed that the mobile home park owners and representative from Shapell Industries should attempt to resolve concerns expressed by Valley Village mobile home park residents and, in addition, decided to retain jurisdiction at its level concerning the project and would review the matter in one month. Callinan reviewed Asst. to the City Manager Qantas Development, Albright's August 25th memo to the City Council concerning Colegio Vista 5A & 5B Qantas Development Corporation's letter requesting Council reconsideration of its condition requiring concrete tile or shake shingle roofs in Colegio Vista Subdivision Nos. 5A and 5B. Planning Director Skanchy gave a staff report concerning the request. Councilman Roberts Councilman Roberts returned to the Council Chambers at Returns approximately 6:32 p.m. Mr. Jon Joslyn was recognized and commented on the difference in price in constructing a tile or shake roof compared to a composition roof. Discussion followed. Upon motion of Councilman Roberts, seconded by Councilman Stewart and unanimously approved, the city Council amended Itect its previous precise development plan and -I architectural review approval to leave roofing material to the discretion of the developer except on major thoroughfares for Colegio Vista Subdivisions 5A and 5B. Joint Cotati-Rohnert After a brief discussion, the City Council indicated it Park Councils Mt9. 'would prefer that the August 30th joint City Councils meeting with Cotati be postponed because several Council members had other obligations and commitments. Neighborhood "B" Mrs. Gail. DeVauxg 7453 Boris Court, was recognized and informed that during the past week two vehicles had gone completely out of control in her neighborhood and that children could no longer go to the park to play. Mrs DeVaux presented a petition (a copy of which is attached to the original set of these minutes) and explained that individuals were congregating in the park, drinking alcohol, smoking and becoming roudy. Mrs. Carol Lenbares, 500 Santa Barbara Drive, was also recognized and commented on the situation. Adjournment There being no further business, Mayor Hopkins adjourned the meeting at 7:30 p.m. to Thursday, August 31, 1978 at 4:00 p.m. r t `Deputy City Clerk Faus APPROVED: August 20, 1978 Tenants Valley Village Mobile Home Estates 6401 Country Club Drive Rohnert Park, California 94928 Dear Tenants: Thursday, July 27th, the Rohnert Park Planning Commission approved a 50 unit H.U.D. low income government housing project for the elderly to be built on the acreage adjacent to Valley Village Mobile Home Estates. The following is a quote received from Gannon Enterprises Inc. "Gannon Enterprises Inc. and Shappell Government Housing Inc. a joint venture, has received endorsment from H.U.D. and e og to build an apartment house on�the, parcel adjoining your Mobile Home"_ark.- Our units will consist of 5D- units limited to elderly and 16, `2 bedroom` units which are not limited to eTd- 6_fi_rl�y." ` The 50 uni s are Govee ent subsid�seT` -I ow income housing. The government pays 75% of the tenants rent and the tenant pays 25% of their rent. The other units proposed would very likely be for families with children. We went to the meeting and a few residents were present and expressed concern. We expressed concern on behalf of the tenants in that the planning commission was approving a plan that will allow the project to use our existing Walnut Circle Drive and to take down the existing fence between the properties. We did have some reservations about a low income project but we have GREAT CONCERN at sharing streets and taking down the fence. We do not want to become traffic controllers or control children or pets that would now have a short cut through or be able to wander into the park ,just exploring because we no longer have the fence. We are basically concerned on your behalf, but are also concerned because management will be traffic, people, and pet controllers with no authority except to continually call the Rohnert Park Police as tenants relay problems. We have already had complaints from tenants in the past about outside children climbing the fences. I feel by removing the fence the problem may accelerate.
