1978/10/24 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES October 24, 1978 The Council of the City of Rohnert Park met this date in regular session commencing at 7:00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Hopkins presiding. The regular session was preceded by an executive session which commenced at 7:00 p.m. and at which all Councilmen and City Manager Callinan were present and which was held to discuss personnel and litigation matters. Call to Order Mayor Hopkins called the meeting of the regular session to order at approximately 7:07 p.m. and led the pledge of allegiance. Roll Call Present: (5) Councilmen Beary, Carbone, Roberts, Stewart, and Hopkins Absent: (0) None Staff present for all or part of the meeting: City Manager Callinan, City Attorney Flitner, and Planning Director Sk an chy Approval of Minutes Upon motion of Councilman Beary, seconded by Councilman Stewart, and unanimously approved with Councilman Roberts abstaining, the minutes of October 10, 1978 were approved as submitted. Approval of Bills City Manager Callinan requested that a bill from Christensen and Foster, in the amount of $237,225.36, for construction work under Phase II of the community and recreation center development, be added to the bills for approval. Upon motion of Councilman Roberts, seconded by Councilman Stewart, and unanimously approved, the bills presented per the attached list in the amount of $296,320.40, including the bill received from Christensen and Foster in the amount of $237,225.36, were approved. Adding Non- Agendaed City Manager Callinan requested that time be allotted under Items 1) the City Manager's Report to discuss the salary range for the Youth Services Specialist position, 2) a Resolution Accepting Completion and Directing Engineer to File Notice of Completion (Benecia Park Parking Lot, Project No. 1977- 16, and 3) under Matters from Councilmen time to discuss a "vita course" for Benecia Park. Mayor Hopkins requested that time be allotted under, matters from Councilmen to discuss File No. 0146, R. C. Roberts application for additional mobile home pads in Rancho Feliz. Page 2 October 24, 1978 Animal Control Mr. Alfanso Rodrigues, 6830 Country Club Drive, was recognized and requested that the City Council consider placing an add in local newspapers describing animals available for adoption at the city's animal control shelter. Mr. Rodrigues fell: that his suggestion would help find homes for the animals tl,-.Ius preventing needless killing. Discussion followed between the City Council, City Manager and Mr. Rodrigues. City Manager Callinan assured lie would follow-up on the matter. Resolution No. 78-142 RESOLUTION ACCEPTING COMPLETION-AND DIRECTING ENIGNEER TO FILE NOTICE OF COMPLETION (Benecia Park Park Lot, Project No. 1977-16) City Manager Callinan explained the resolution. Upon motion of Councilman Beary, seconded by Councilman Roberts, and unanimously approved, reading of Resolution No. 78-1L►2 was waived and said resolution was adopted. Project No. 1978-16, City Manager. Callinan asked that the resolution awarding Park Club Drainage a contract for the Park Club drainage facility be deferred to the November 13th City Council meeting in order to meet and confer with the City Attorney and developer because bids received were somewhat higher than the engineer's estimate. He noted that Mr. Norm Owen, attorney represent- ing the developer of the Park Club Apartments, was present in the audience. Agreement for City Manager Callinan requested that the resolution approving Collection of Special an agreement with the County of Sonoma for collection Assessments of special assessments be deferred to the November 13th City Council meeting in order to have City Attorney Flitner review same. Resolution No. 78-143 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK APPROVING EASEMENT AGREEIcENT WITH NORTHWESTERN PACIFIC RAILROAD (For Widening of Rohnert Park Expressway at Railroad Crossing) City Manager Callinan explained the resolution noting that when the agreement was executed the city would withdraw its application to the Public Utilities Commission for a grade crossing over, the railroad at Rohnert Park Expressway. Upon motion of Councilman Roberts, seconded by Council-man Stewart, and unanimously approved, reading of Resolution No. 78-143 was waived and said resolution was adopted. Project No. 1978-14, City Manager Callinan explained the assessment district Executive Avenue for improvement of Executive Avenue and pointed out the Assessment Dist. boundary map on display at the meeting. Resolution No. 78-144 RESOLUTION OF PRELIMINARY APPROVAL OF ENGINEER'S REPORT kLixecutive Avenue, R(.,)1-1-17e-T.­'L Park Froject No. 1978-14) Upon motion of Councilman Roberts, seconded by Councilman Beary, and unanimously approved, reading of Resolution No. 78-144 was waived and said resolution was adopted. Page 3 October 24, 1978 Resolution No. 73 -145 RESOLUTION APPOINTING TIME AND PLACE OF HEARING PROTESTS IN RELATION TO PROPOSED ACQUISITIONS AND IMPROVEMENTS, AND DIRECTING NOTICE (Executive Avenue, Rohnert Park Project No. 1978 -14) Upon motion of Councilman Roberts, seconded by Councilman Beary, and unanimously approved, reading of Resolution No. 78 -145 was waived and said resolution was adopted. Resolution No. 78 -146 RESOLUTION DESCRIBING PROPOSED BOUNDARIES OF ASSESSMENT DISTRICT, DIRECTING FILING OF BOUNDARY MAP AND ASSESSMENT DIAGRAM AND THE RECORDATION OF NOTICE OF ASSESSMENT (Executive Avenue, Rohnert Park Project No. 1978a -14) Upon motion of Councilman Roberts, seconded by Councilman Beary, and unanimously approved, reading of Resolution No. 78 -1115 was waived and said resolution was adopted. Growth Management City Manager Callinan suggested -that McKellar and Associates' Program request to transfer residential units from other builders to the Sonoma Racquet Club be deferred to the November 13th meeting because Councilman Stewart had some questions concerning the matter. The Council agreed to so do. Sidewalk on Expressway City Manager Callinan solicited the Council's authorization to have the city install the sidewalk along Rohnert Park Expressway between the railroad tracks and Country Club Drive. He informed that quotes had been received and that property owners in the area had agreed to reimburse the city as and when their property is developed. Upon motion of Councilman Roberts, seconded by Councilman Stewart, and unanimously approved, the City Council authorized staff to proceed with the installation of sidewalk along the south side of Rohnert Park Expressway from the railroad tracks to Country Club Drive. County Paratransit City Manager Callinan informed that copies of the County's Coordinating Council September 26th letter concerning formation of a "Paratransit Coordinating Councils' had been disseminated to each Councilman for review. Discussion followed during which the City Council indicated it desired to have a representative from Rohnert Park serve on the executive committee and, in addition, expressed interest as to what the definition was for such terms as 9 °economically disadvantaged" and "transit dependent ". File No. 0,503 - City Manager Callinan reviewed the final map for Parkside Parkside Apartments, Apartments, condominium conversion. Condominium Conversion, Final Map Upon motion of Councilman Carbone, seconded by Councilman Stewart, and approved by the following voice vote, the Council approved the final map for Parkside Apartments (File No. 0503). AYES: (4) Councilmen Beary, Carbone, Stewart, Hopkins NOES: (1) Councilman Roberts Page 4 October 24, 1978 File No. 0577 City Manager Callinan reviewed the tentative map for Boise Boise Cascade, Cascade's industrial subdivision located east of Commerce Industrial Boulevard, north of Transport Avenue. Subdivision, Final Map Councilman Beary informed that he was doing some sub- contracting work for the applicant and, therefore, would abstain from voting on the matter. Upon motion of Councilman Carbone, seconded by Councilman Roberts, and approved by the following voice vote, the Council approved the final map for Boise Cascade Corp. (File No. 0577), and authorized the Mayor to execute an appropriate subdivision agreement prior -to the map being released for recording. AYES: (4) Councilmen Carbone, Roberts, Stewart, Hopkins NOES: (0) None ABSTAIN: (1) Councilman Beary Transport Avenue, Councilman Carbone initiated a discussion regarding the Street Name Change possibility of re-naming Transport Avenue. Discussion followed between the City Council members and City Manager Callinan. Mr. Jim Redding, Western Business Park Associates, was recognized and informed that his firm considered State Farm Drive an appropriate designation for what is now known as Transport Avenue. He informed that in talking with Messrs. Boggs and Kunst they were also agreeable to the renaming of Transport Avenue. Discussion followed. Upon motion of Councilman Carbone, seconded by Councilman Beary, and unanimously approved, the City Council directed that the Planning Commission conduct a public hearing to consider a street name change for Transport Avenue. File No. 0146, City Manager Callinan initiated discussion regarding Council R. C. Roberts, Appeal approval to re-consider R. C. Roberts' appeal. of the Planning of Planning Commission Commission denial of a use permit for a 24 unit addition Decision to Rancho Feliz Mobile Home Park. Discussion followed. Upon motion of Councilman Stewart, seconded by Councilman Carbone., and approved by the following voice vote, the Council approved reconsideration of R. C. Roberts' appeal of the Planning Commission decision regarding a use permit for an addition to Rancho Feliz Mobile Home Park. AYES: (4) Councilmen Carbone, Roberts, Stewart, Hopkins NOES: (1) Councilman Beary City Manager Callinan advised that the matter would probably be scheduled for a November meeting. Library Request for City Manager Callinan informed that copies of the Sonoma Financial Assistance County Library letter requesting financial support for the local library had been disseminated to each Council member. Discussion followed. Page 5 October 24, 1978 Upon motion of Councilman Roberts, seconded by Councilman Carbone, and unanimously approved, the City Council directed that a letter be forwarded to the Sonoma County Library informing that the City did not feel in good conscience it could make a financial contribution at this time, but that it would be willing to discuss the matter with the other cities and the county. Flood Insurance Study City Manager Callinan informed that the city's flood insurance study /policy would be discussed with the Planning Commission. Communications Communications per the attached outline were brought to the attention of the Council. No action was taken on any communications except as noted specifically in these minutes. National League of Upon motion of Councilman Roberts, seconded by Councilman Cities Congress of Beary, and unanimously approved, the City Council authorized Cities & Expo. any of its merbers desiring to attend the National League of Cities 1978 Congress of Cities & Exposition in St. Louis, Mo., November 26 to 29, to so do and, in addition, act as the city's voting and alternate voting delegate. I-Iudis Street School City Manager Callinan informed that development of the Iludis Street school was moving along and that the contractor would probably meet the November 1st deadline. Maternity Benefits City Manager Callinan requested that his report concerning maternity benefits be deferred to the November 13th meeting. All Night Parking City Manager Callinan informed that he had received informatior. Permits from the City of Arcata concerning issuance of all night parking permits to those individuals who can demonstrate that they are using the designated off-- street parking facilities and have need of additional parking. He explained the matter would be referred to the Council for its consideration in the near future. Youth Services City Manager Callinan solicited the Council's approval Specialist Salary to establish the salary range for the Youth Services Special - Range ist position at 64K, $1261 to $1533. Upon motion of Councilman Roberts, seconded by Councilman Carbone, and unanimously approved, the City Council approved the salary range for the Youth Services Specialist position as followese Range 64K, $1261 to $1533 per month. International Systems City Manager Callinan initiated discussion concerning the Inc. re. Federal Grant possibility of contracting with International Systems Assistance Inc. regarding the preparation of federal_ grants. The City Council requested that a representative of ISI make a presentation to the Council concerning its services. Travel Trailer Park City Attorney Flitner requested that the proposed travel Ordinance trailer park ordinance be deferred to the November 13th meeting. Page 6 October 24, 1978 PERS Class Action City Attorney Flitner informed that consideration of the Lawsuit class action lawsuit against the Public Employee's Retirement System and numerous cities had been deferred for 60 days by the presiding judge. Council Mobile Home After a brief discussion, Councilmen Carbone and Stewart Park Committee were designated by the Mayor to serve on the Council's mobile home park committee. Trail Separation Councilman Stewart informed that she had received a request Disposal from a resident regarding the disposal company instituting a trial separation program. City Manager Callinan informed that the concept had been implemented previously by the disposal company and found unfeasible but that he would discuss it again with company representatives. Marin/Sonoma Mosquito Councilman Roberts gave a report concerning a recent investi- Abatement District ration being conducted by the Board of Trustees of the Marin/Sonoma Mosquito Abatement District. City Manager Callinan informed that a letter had been received from the mosquito abatement district regarding the expiration of Councilman Roberts term on the board of trustees. Councilman Roberts indicated that he was interested in being re-appointed to the position. Upon motion of Councilman Beary, seconded by Councilman Stewart, and unanimously approved, the City Council re-appointe Councilman Roberts as the city's representative on the Marin/Sonoma Mosquito Abatement District Board of Trustees for the term beginning, January 1, 1.979 through December 31, 1981. Benecia Park Vita City Manager Callinan informed that Councilman Carbone Course had contacted him concerning installation of a "vita course" in Benecia Park and that he thought it was -an excellent idea. —on UIJULA J�IVLJ_k..011 U� k.UULi�.L�man Carbone, seconded by Councilman Roberts, and unanimously approved, the City Council authorized installation of a "vita course" in Benecia Park. Traffi Signals Mayor Hopkins initiated a discussion concerning the sequence of signals at the intersection of Commerce Boulevard/Hunter Drive and No Name Street/Southwest Boulevard. City Manager Callinan informed that a part was on order which would remedy the signal on Commerce and Hunter from stopping traffic for for no apparent reason. Councilman Carbone informed that he had observed the signal at Rohnert Park Expressway/Country Club Drive and found that the lights changed too quickly. City Manager Callinan informed that he would follow-up on the matter.
