1979/02/26 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES February 26, 1979 The Council of the City of Rohnert Park met this date in regular session commencing at 7 °00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Hopkins presiding. The regular session was preceded by an executive session which commenced at 7 °00 p.m, and at which all Councilmen and City Manager Callinan were present and which was held to discuss personnel and litigation matters. 'all to Order Mayor Hopkins called the meeting of the regular session to order at approximately 7;20 p.m. and led the pledge of allegiance, ,oll Call Present- (5) Councilmen Beary, Carbone, Roberts, Stewart and Hopkins Absent.- (0) None Mr° Dennis Pelley, 45 Varda, was recognized and inquired how many cats were considered excessive. City Attorney Flitner and City Manager Callinan informed that the law allowed 3 animals per household. Staff present for all or part of the meeting-,-.. Councilman Carbone noted that on page 3 under Amphitheatre in Benecia Park, that he had been the dissenting vote and not Councilman Roberts. Upon motion of Councilman Carbone, seconded by Councilman Beary, and unanimously approved., the minutes of February 13, 1979 were approved as corrected. pproval of Bills Upon motion of Councilman Roberts, seconded by Councilman Carbone, and unanimously approved, the bills presented per the attached list in the amount of $616,564,12 were approved. on- Agendaed Items Councilman Roberts requested that time be alloted under Matters from Councilmen to discuss automobile insurance, nscheduled Public Mr. Donald L. Branscom, 19 Alexis, was recognized and asked if ppearances this was the time to speak on the parking ordinance for Sonoma Grove Mobile Home Park.. Mayor Hopkins advised him that the matter would be taken up later on the agenda. Mr. William Simpson, 31 Alexis, was recognized and inquired if there were any leash law for cats. City Attorney Flitner informed that there is no leash law for cats, only laws for excessive number of cats. Mr° Dennis Pelley, 45 Varda, was recognized and inquired how many cats were considered excessive. Mr. Dennis Pelley, 45 Varda, was recognized and informed that there has been promise of a parking lot for at least 2 years, and that there is a problem with theft and flooding in the back lot that is now being used for parking. Planning; Director'Skanchy directed Council's attention to the layout and elevations for Redwood Park Estates that were on display at the meetinig and reported on the 246 unit condominiu project to be'developed'on a 21+ acre parcel located east of Snyder Lane and north of Rohner; Park Expressway and informed that staff had recommended an additional 17 .guest parking, spaces over that required by the Planning Commission. Mayor Hopkins opened the public hearing on File Noe 0646, McKellar and Associates for a 246 unit condominium project. John Picchi, project architect, was recognized and noted that the design of the project was based on units amassed around an open space with complimentary architecture to the neighboring medical center. There being no one else desiring-to be heard, Mayor Hopkins closed the public hearing. Councilman Stewart made a :notion to approve the precise devel- opment plan with the additional 17 guest parking spaces, making a total of 62 guest parking spaces. The motion died for ,lack of a second, Councilman Carbone made a motion, seconded by Councilman Roberts, to approve the precise development plan and architectural review for Redwood Park Estates, File No. 0646, McKellar and Associates, subject to the conditions recommended by the Planning Commission . but with the addition of 10 guest parking spaces, making a total of 55 _guest parking spaces,'which passed by the following roll call vote- AY ES> (3) Councilmen Carbone, Roberts and Hopkins NOES- (1) Councilman Stewart ABSENT. Upon motion of Councilman Beary, seconded by Councilman Roberts, Councilman Roberts made a motion, seconded by Councilman Beary, to install a stop sign at Camino Colegio and Casa Way. Discussion followed. Mayor Hopkins commented that he would like to see a staff report on this before deciding at the next Council meeting. (4) Councilmen Beary, Roberts, Stewart and Hopkins NOES: (1) Councilman Carbone Classification Study City Manager Callinan informed that the revisions to this study have not yet been received. Golf Course City Manager.Callinan infonTrad that he will be meeting soon with Golf Professional Bill Ross regarding negotiations for a new agreement and then with Mr. and Mrs. Smith regarding the lease agreement for the 19th Hole Restaurant, as both of these parties are operating on a month to month basis. Communications Communications per the attached outline were brought to the attention of the City Council. No action was taken on any communications'unless specifically noted in these minutes. Cultural Arts City Manager Callinan noted that Council has received a copy of Commissioner the let-ter of resignation from Cultural Arts Commissioner and - Resignation member of the Board of Directors, Marion McMullan. Upon motion of Councilman Roberts, seconded by Councilman Stewart, and unanimously approved, the letter of resignation of Marion McMullan was accepted and.staff was directed to prepare a letter of appreciation for the Mayor's signature. Stop Sign on City Manager Callinan informed that a letter from Mr. and Mss. Camino Colegio Bernard Lewis, 7200 Camino Colegio, had been received trans- and Casa 1,,7ay mitting a petition signed by 14 residents requesting installa- tion of stop signs on Camino Colegio at Casa !play. Councilman Roberts made a motion, seconded by Councilman Beary, to install a stop sign at Camino Colegio and Casa Way. Discussion followed. City Manager Callinan advised that staff would then pursue the matter with Storer Cable TV, Cad.le`s Mercy City Manager Callihan informed that Cadle's has commenced Ambulance Service ambulance service to the community under the agreement with the city and that the estimate for paramedic equipment necessai to begin paramedic service on July 1, 1979 is approximately $12,000. Upon motion of Councilman Beary, seconded by Councilman Robert and unanimously approved, authorization was given to order the needed paramedic equipment but with payment for same to take place on July 2, 1979. Contract for Land -- City Manager Callinan referred the Council to his memo dated scape Maintenance February 22, 1979 to the City Council and the Comparison of Service, a copy of which Proposals for Landscape Maintenance for review is attached to the original set of these minutes, of this matter. Discussion followed. Refinance of City Manager Calli.nan. referred. the Council to the inter-office Savin Copier memorandum concerning refinancing the lease purchase agreement for the Savin 770 copy machine at Public Safety Building No. 1 Resolution Noe 79-36 RESOLUTION AUTHORIZING REFINANCE3G OF CGP�' P�AC�7Ir;E BY ^ NEt,I LASE PUR.,7iASE ARRANGU'-1171 (Dept. of Public Safety Photocopy Machine) Upon motion of Councilman Carbone, seconded by Mayor Hopkins, and unanimously approved, reading of Resolution No. 79-36 was waived and said resolution was adopted. New Police Vehicles City Manager Callinan informed the Council that two bids were four new pursuit received on the proposal to purchase police units that are budgeted in fiscal year 1978 -79. He also Page 7 February 26; 1979 informed that since the trade -in value is so low on the three used vehicles that staff recommends auctioning them off or retaining them for other city uses. He also advised that he had no recommendation as yet on which company to purchase the vehicles from because he had not yet discussed the bids with Director of Public Safety Dennett. Upon motion of Councilman Carbone, seconded by Councilman Roberts, and unanimously approved, authorization was given to the City Manager to purchase four new police pursuit vehicles from whichever bidder he deemed most appropriate for the city. Project No. 1976-7, City Attorney Flitner informed that on February 199 1979 an Eagle Park Extra arbitrator decided against the city concerning the $4,000 Grading additional payment requested for the extra grading done on Eagle Park by the contractor. Public Safety City Attorney Flitner informed that while the District Attorney's Personnel Files office advises resistance to subpoena for police officer's personnel files, a recent court decision has ruled that these files can be subpoenaed on affidavit from the complainant charging insifhtment of violent action by the officer. Discussion followed. Upon motion of Councilman Beary; seconded by Councilman Carbone, and unanimously approved, City Attorney Flitner was directed to strongly oppose subpoenas of police officer's personnel files. Paratransit Coordan -- Upon motion of Councilman Roberts, seconded by Councilman Beary, ating, Council and unanimously approved, Councilman Carbone was appointed to the Paratransit Coordinating Council. SB 234 Mayor Hopkins expressed his support for SB 2349 which is a 'bail out' bill for the schools. Upon motion of Councilman Beary, seconded by Councilman Carbone, and unanimously approved, staff was directed to send out a letter of endorsement over the Mayor's signature for SB 234. Automobile Insurance Councilman Roberts reported that certain counties in southern California were attempting to persuade the State Department of Insurance to unify insurance rates for automobiles throughout the state, which would raise the insurance rates in Sonoma County by over 20%. Councilman Roberts then read a resolution urging the Department of Insurance to maintain the present system of allocating; lost costs. Discussion followed. Resolution No. 79-37 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK URGING DEPART4ENT OF INSURANCE TO MAINTAIN SYSTEM OF ALLOCATING LOST COSTS ON THE BASIS OF GEOGRAPHIC AREA Upon motion of Councilman Roberts, seconded by Councilman Carbone., and unanimously approved, Resolution No. 79-37 was adopted and direction was given for copies to be sent to Assemblyman Filante and Senator Keene. Discussion followed between City Manager Callinan9 City Attorney Flitner, and Councilman Beary with direction given to staff to do a cost comparison on this matter for Council's review. Sonoma Grove Parking Councilman Beary made a motion, seconded by Councilman Stewart,. Regulations to abate enforcement of the Y9no all night parking ". on Cristobal Drive until staff reports back with recommendations on this situation. Discussion followed. The motion was approved by unanimous voice vote.
