1979/03/26 City Council Minutes>11 to Order Zoll Call approval of Minutes approval of Bills ROHNERT PARK CITY COUNCIL MINUTES March 26, 1979 The Council of the.City of Rohnert Park met this date in regular session commencing at 7:13 p.m. in the City Offices, 6750 'Commerce Boulevard, Rohnert Park, with Mayor Hopkins presiding. The regular session was preceded by an executive session which commenced At 7.00 p.m. and at which all Council- men and City Manager Callinan were present and which was held to' discuss personnel and litigation matters. Mayor Hopkins called the meeting.: of the regular session to order at approximately 7;13 p.m. and led the pledge of allegiance. Present: (4) Councilmen Beary, Carbone, Roberts and Hopkins Absent: (1) Councilman Stewart Staff present for all 'or part of the meeting: City Manager Callinan, City Attorney Flitner (whose time of arrival is specifically noted in these minutes) and Planning Director Skanchy. Upon motion of Councilman Carbone, seconded by Councilman Roberts and unanimously approved, the minutes of March 12 and 21, 1979 were approved as submitted. Upon motion of Councilman Carbone, seconded by Councilman Roberts and unanimously approved, the bills presented per the attached list in the amount of $1839295.32 were approved. ron- Agendaed Items Mayor Hopkins requested time under Matters from Councilmen to discuss patrol of the high school parking lot for parking violations. golf Course Rates Mr. Dave Lurie, 1023 Santa Cruz Way, was recognized and expressed his frustration at the proposed increase in golf rates. He questioned how much public input was received on 'this proposal as he feels it is unreasonable. Upon motion of Councilman Beary, seconded by Councilman Carbone, and unanimously approved, reading of Resolution No. 79-52 was waived and said resolution was adopted. Resolution No. 79 -54 Project No. 1978 -1, Snyder Lane- Hinebaugh Creek Resolution No. 79-55 Resolution No. 79-56 Upon motion of Councilman Carbone, seconded by Councilman Beaty, and unanimously approved, reading of Resolution No. 79 ®53 was waived and said resolution was adopted. A RESOLUTION ACCEPTING COMPLE'T'ION.AND DIRECTING ENGINEER TO FILE NOTICE OF COMPL,ETION`(Well.No. 14, Project No. 1977 -3) City Manager Callinan reviewed the resolution and his memo to the Council dated March.23, 1979 concerning same. Upon motion of Councilman Carbone, seconded by Councilman. Beaty; and unanimously approved, reading of Resolution No. 79 ®54 was waived and said resolution was adopted. AN ORDINANCE OF THE CI"T"Y OF ROHNERT PARK AMENDING ROHNERT PARK MUNICIPAL CODE, TITLE 17 (Zoning Map Change, A. P, No. 143- •29001', File No. 0662, 20 acres on the east side of Snyder Dane, east of and contiguous to Coleman Valley Sub - division, north of and adjacent to the unincorporated area of the County to ",RM ®2000 PD" ". (multiple family residential planned unit development, 10 dwelling units per acre) dlstric City Manager Callinan reviewed the ordinance and his Memo to the Council dated March 23, 1979 concerning same. Upon motion of Councilman Roberts, seconded by Councilman Carbone, and unanimously approved; with Councilman Beaty abstaining, reading of Ordinance. No. 361 was waived and said ordinance was adopted. City Manager Callinan referred Council to his memo to the Cit Council dated March 23, 1979 for explanation of this matter and noted the revised assessment amount on page 2 of said memo. A RESOLUTION ORDERING REDUCTION OF CERTAIN ASSESSMENTS (Snyder Lane and,Hinebaugh Creek, Project No. 197 81) A RESOLUTION DETERMINING UNPAID ASSESSMENTS AND PROVIDING FOR ISSUANCE OF BONDS (Snyder Lane and Hinebaugh Creek, Project No. 1978 -1) Upon motion of Councilman Roberts, seconded by Councilman C'_;rbone ; and tuna -ni moizsly approved ; reading of Resolution Nos. 7955 and 7956 was waived and said resolutions were adopted. Transport kvenue Extension and Rohnert Park Express- aay Widening Page 3 March 26, 1979 City Manager Callinan referred Council to his memo to the City Council dated March 23, 1979 for explanation of this matter, reviewed the bids received,'and informed that the low bid was somewhat higher than the construction funds provided in the assessment district and that the property owners have agreed in writing to pay the difference upon demand, and certain work could be deleted to bring the bid within the estimate and funding being provided by the County. He also informed that the property owners would like the city to put more funds into the bridge but that staff did not agree to recommend that. He explained certain work items that could be deducted, such as cobblestone medians, without effecting the project and that Don Dowd had agreed to allow the city up to 60 days to decide on extending the Expressway eastward. Discussion followed. Mr. Jim Redding, 7147 Barbi Lane, representing Western Business Park and Fairway Business Park, was recognized and commented on the proposed deletions in the'contract. Discussion followed. Resolution No. 79 -57 A RESOLUTION OF AWARD OF CONTRACT ( Rohnert Park Expressway Widening, Project No. 1978.19 and Transport Avenue Extension, Project Noo'1977 -4) Zesolution No. 79-58 A RESOLUTION ORDERING REDUCTION OF CERTAIN ASSESSMENTS (Transport Avenue Extension, Project No. 1977 -4) 2esolution No. 79 -59 A RESOLUTION DETERMINING UNPAID ASSESSMENTS'AND PROVIDING FOR ISSUANCE OF BONDS (Transport Avenue Extension, Project No. 1977 ®4) Upon motion of Councilman Carbone, seconded by Councilman Roberts, and unanimously approved, reading of Resolution Nos, 79 -57 through 79a -59 was waived and said resolutions were adopted with the provision that the widening of Rohnert Park Expressway to a few hundred feet to the east of the railroad tracks and the deletion of certain work items will be handled by change orders. ;ultural Arts Ms. Shirley Russell, President of the Rohnert Park Cultural Hppenings Month Arts Corporation; was recognized and informed of the many activities, art show and reception'-scheduled for June and feels it would be appropriate to designate June as "Cultural Arts Happenings Month". Upon motion of Councilman Beary, seconded by Councilman Carbone, and unanimously approved,` designation of June as "Cultural Arts Happenings Month9° was approved. ?ile No. 0664, City Manager Callinan referred Council to his memo dated >egam, Inc. March 23, 1979 to the City Council on this matter. Planning Director Skanchy explained this project referring to the layout and elevations on display at the meeting and noted that this application was approved by the Planning Commission subject to certain eonrliti.ons as outlined. Page 4 March 26, 1979 Mayor Hopkins opened the public hearing on the application for precise development plan and architectural review for two 12,500 square foot office buildings to be located on the north side of'Avram Avenue, 200.feet east of City Hall. Mr. Dean Lillis, project architect, was recognized and expressed his effort at having the design blend in with the City Hall building and the apartments that will be on each side:of the project. Discussion followed. There being no one else desiring to -be heard, Mayor Hopkins closed the public hearing.: Upon motion of Councilman Roberts, seconded by Councilman Carbone, and approved by the following voice vote, applicati; for precise development plan and architectural review for tvr 12,500 square foot office buildings to be located on the north :side of Avram Avenue, File No. 0664, Segam, Inc. was approved subject to the conditions recommended by the Planning Commission. Manager Callihan referred Council to his memo dated Codding Enterprises March 23, 1979 to the City Council on this matter. Planning Director Skanchy explained this project referring to the sit( plan and rendering on.display at the meeting and informed that the staff recommends approval. Mayor.Hopkins opened the public hearing on the application fc precise development plan and architectural review for a 69001 square.foot restaurant to be located at the southeast corner of South Santa Rosa Avenue /Redwood Drive and Rohnert Park Expressway. Mr. Doug Craig, Codding Enterprises, was recognized and commented on the design of the building and the set back requirements which he feels are excessive and asked the Council to reduce the set back. There being no one else desiring to be heard, Mayor Hopkins closed the public hearing. Upon motion of Councilman Roberts, seconded by iiayor'Hopkins and unanimously approved with Councilman Beary abstaining, application for precise development plan and architectural review for a 6,000 square foot restaurant to be located at the southeast corner of South Santa Rosa Avenue / Redwood DrivE and Rohnert Park Expressway, File No. 0628, Codding Enterpri: was approved subject to the conditions recommended by the Planning Commission. Communications Communications per the attached outline were brought to the attention of the City Council. No action was taken on any communications unless specifically noted in these minutes. Use of Parks by City Manager Callinan referred Council to his memo dated Area's Youth Groups March 23, 1979 to the City Council for explanation of this matter and informed'of the decision by the Parks and Recreation Commission to allow Rancho Cotati Little League to play on Rohnert Park baseball diamonds. Discussion followed. Mr. Bill Jacobi, Parks and Recreation Commissioner and Rohnert Park Boy's Baseball president, was recognized and informed that said Cotati team had first applied to play in Penngrove and was refused, then they came to Rohnert Park and he feels that they should have given six months notice before being allowed to use Rohnert Park's heavily scheduled baseball diamonds. Mrs. Ronald Fritch, 5691 Stony Point Road, Cotati, was recognized and reported that she was involved in Little League which includes Rohnert Park, Cotati and Penngrove, and therefore felt that all these cities should have access to the parks. Discussion followed. Mrs. JoLynn Hill, 509 Corte Naranja, was recognized and informed that she found the situation regarding, leagues and neighborhoods very confusing. Page 5 March 26, 1979 265 College View City Manager Callinan informed that the removal of debris and Drive rubble from 265 College View Drive is scheduled to start on Wednesday, March 28th and to be done by Redwood Disposal Corporation. Storer Cable TV City Manager Callinan referred this matter to City Attorney _ "Showtime" Rates' Flitner, who informed that lie had reviewed the legal data submitted by Storer and had contacted the League of California Cities for information on FCC regulations with regards to the city's ability to regulate rates for Storer Cable TV, Inc.'s "Showtxme" feature. He advised that the city did not have the right to regulate the' "Showtime" rates since the FCC has preempted regulation of this feature for the time being. Discussion followed with Mr. William Schiller, Storer Cable TV, Inc., participating. Landscaping 8 Light- City Manager Calli.nan'r'eferred Council to his memo dated ing Act of 1972 March 23, 1979 to the'`City Council for explanation of this matter and solicited direction. Discussion followed. Upon motion'of Councilman Carbone, seconded by Councilman Roberts, and approved by the following voice vote, staff was directed to draft a resolution for the next regular meeting of'the City Council. Mayor Hopkins commented on.the, parking problems at the Ranch( Cotate High School lot with the students violating the reser�. parking spaces designated for the staff. City Manager Calli-T and City Attorney Flitner advised that the matter would be researched for possible solutions. Mr. Dave,Li-rie, 1023 Santa Cruz Way, was recognized and suggested posting notice of the golf course rate increase at the course. He also expressed his concern over the matter of street lighting and questioned the availability of state surplus money for the city to cover street lighting. Community Center City Manager Callinan,informed that the installation of landscaping at the new community center was experiencing delays due to the rains but.the building was complete, commented on problems with vandalism and that partial accep- tance of the building was required to gain control of the building, so that furniture could be delivered to it. Resolution No. 79�60 RESOLUTION OF PARTIAL ACCEPTANCE OF COMPLETION AND DIRECTING ARCHITECT TO FILE NOTICE OF COMPLETION (Rohnert Park Communil Recreation Center, Project No. 1977-14) Upon motion of Councilman Roberts, seconded by Councilman Beary, and unanimously approved, reading of Resolution No. was waived and said resolution was adopted. Golf Course Update City Manager Callinan informed that talks were still continui with the golf pro, the concession operators, and others con cerning contracting, out the golf course and that a 'neeting i. scheduled with the Council's Golf Course Committee to review the proposals and make recommendations. PERS Class Action City Attorney Flitner informed that the city apparently has Lawsuit only one or two employees who would be affected by the outcor of this lawsuit and that he would look into removing the city from the case.
