1979/07/09 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES July 9, 1979 The Council of the City of Rohnert Park met this date in regular session commencing at 7:00 p.m. in the City Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor Roberts presiding. The regular session was preceded by an executive session which commenced at 7:00 p.m. and at which all Council - men and City Manager Callinan were present and which was held to discuss personnel and litigation matters. Call to Order Mayor Roberts called the meeting of the regular session to order at approximately 7:30 p.m. and led the pledge of alle- giance. Roll Call Present: (4) Councilmen Carbone, Hopkins, Stewart and Roberts Absent: (1) Councilman Beary Staff present for all or part of the meeting: City Manager Callinan, City Attorney Flitner,`Planning Director Skanchy and Director of Public Works /City Engineer Brust. Approval of Minutes Upon motion of Councilman Hopkins, seconded by Councilman Carbone, and unanimously approved with Councilman Stewart .abstaining from voting on the June 25th and July 2nd minutes, the minutes of June 1:1, 1979 %' June 25, 1979 and July 2, 1979 were approved as'submitted. Approval of Bills Upon motion of Councilman Carbone, seconded by Councilman Hopkins, and unanimously approved, the bills presented per the attached list in the amount of $499,485.68,were approved. John Kline re. John Kline, 8886 Lancaster Drive, was recognized and asked Maintenance of what could be done to have absentee property owners better Rental Units maintain their properties. He explained that in the area of Lancaster Drive and LaCross Court several rental units had become unsightly as the result of poor maintenance. Discussion followed. City Manager Callinan said he would make a tour of P4L" Neigh- borhood in the area of Lancaster Drive and LaCross Court and appropriately follow -up on the matter. Jan Marks re. Jan Marks, 460 Eucalyptus Avenue, was recognized and indicated Qantas EIR that she would like to register concern with reference to the Qantas EIR. Mayor Roberts informed that the matter was scheduled for later in the meeting. _ C O N S E N T C A L E N D A R City Manager Callinan referred the Council to his Council meeting memo dated July 5, 1979 for explanation of all the matters on the Consent Calendar. File No. 0576, Sunrise City Manager Callinan reviewed his July 5, 1979 memo to the Terrace, Final. Map Council concerning the final map for Sunrise Terrace and •/ informed that in talking with Mr. Larry Robins and Olaf Gross,. the project developers, they had indicated that they had no intention of holding onto the condominium units for rentals, although they couldn't prevent someone from buying up the units for use as rentals. Councilman Carbone made a motion, which was seconded by Council- man Hopkins, to approve the final map for Sunrise Terrace (56 condominium units on Camino Colegio) and authorize the Mayor to.execute.an appropriate subdivision agreement prior to the map being released for recording. Discussion followed. The motion to approve the final map for Sunrise Terrace was approved by the following voice vote: AYES. Upon motion of Councilman Hopkins, seconded by Councilman Stewart, and approved by the following voice vote, the City Council approved the following revisions and /or transfers of residential units allocated for 1979, subject to the condi- tion that the units will be offered for sale. Discussion fol- lowed. Petition for Stop City Manager . Callinan reviewed his July 5, 1979 memo to the Sign on Santa Dorotea City Council regarding a petition from residents requesting a stop sign on Santa Dorotea Circle, eastbound and westbound at the westerly intersection with Davis Circle, and informed that Mr. Lyman Moore, 903 Santa Dorotea Circle, had called toexpress opposition to the requested stop sign. Councilman Hopkins made a motion to table the matter. Said motion died forlack of a second. Discussion followed. Resolution No. 79-128 RESOLUTION DESIGNATING, AUTHORIZING AND APPROVING INSTALLA- TION OF STOP SIGN Upon motion of Councilman Carbone, seconded by Councilman Stewart, and approved by the following voice vote, reading of Resolution No. 79-128 was waived and said resolution was ,adopted. - AYES: (3) Councilmen Carbone, Stewart and Roberts NOES: (0) None, ABSTAIN: (1) Councilman Hopkins ABSENT: (1) Councilman Beary Ordinance No. 365 AN ORDINANCE OF THE CITY OF ROHNERT PARK AMENDING CHAPTER 15.16 OF THE ROHNERT PARK MUNICIPAL CODE (Building and Con- struction, Electrical Code) City Manager Callinan explained the ordinance. Mayor Roberts opened the scheduled public hearing on Ordinance No. 365. There being no one desiring to be heard, Mayor Roberts closed the public hearing. Project No. 1979 --10, Laguna Verde Assess- ment District Page 4 July 9, 1979 Upon motion of Councilman Hopkins, seconded by Councilman Carbone, and unanimously approved by a roll call vote, reading of'Ordinance No. 365 was`waived:and said ordinance was adopted. City Manager Callinan reviewed his July 5, 1979 memo to the Council on this project which is for the development of the Laguna 'Verde Industrial,Subdivision including Labath Avenue northerly from Rohnert Park Expressway, as shown on the Assess- rent Diagram which was displayed. Mr. Callinan reviewed the construction bids with-the Council stating that they were lower than the Engineer's estimate. Mr. Callinan informed that bond bids were also solicited and opened.,on July 6, 1979 for both the Laguna Verde Assessment District, Project No. 1979 -10, and Classic Court Assessment District, Project No. 1979 -5. Two bids were received for each of the projects, one from Wulff, Hansen and Company, et al, for 93% of par at 7 1/20 (for a net effective rate of 8,3484%) and Kern Schumacher for 90.66% of par at- 6 11496 (for a net.effective interest rate of 7.3820). Mr. Callinan advised that notice of the public hearing had been published in the local newspaper and mailed to property owners in the area -of the assessment district and that a copy of the Engineers Report prepared by Sandine and Associates was on file in his office. Present.in the Chamber to answer questions for the Council were City Engineer_ Brust, Bond Counsel Phil Assaf of Wilson, Morton, Assaf and McElligott and Dave Sandine, Project Engineer. Mayor Roberts opened the public hearing on the Engineer's Report prepared pursuant to the provision of the Municipal Improvement Act of 1913 on Laguna Verde Assessment District, Project No. 1979 -10. There being no one desiring to be heard and no communications received, I Mayor Roberts closed the public hearing. Resolution No. 79 -129 A RESOLUTION OVERRULING PROTESTS ON RESOLUTION OF INTENTION NO 79 -106 (Laguna Verde Assessment District, Project No. 1979-10) City Manager Callinan explained the resolution. Upon motion of Councilman Hopkins, seconded by Councilman Carbone, and approved by the following roll call vote, reading of Resolution No. 79-129 was waived and said resolution was adopted. AYES.: (3) Councilmen Carbone, Hopkins and Stewart NOES: (1) Mayor Roberts ABSENT: (1) Councilman Beary Discussion followed concerning reducing assessments in both the Laguna Verde and Classic Court Assessment Districts and the validating lawsuits., File No. 0418 - City Manager Callinan reviewed his July 5, 1979 memo to the Qantas Development Council regarding Qantas Development Corporation's EIR for Corp. EIR the area south of East Cotati Avenue. City Attorney Flitner explained that the Council could do one of the following: 1. Approve the EIR of the Council finds it adequate. 2. Approve the EIR subject to mitigative measures. 3. Determine that there should be "no project ". 4. Have the consultant:prepare further comments. Mr. Del Davis of Del Davis Associates, EIR consultants from San Rafael, was recognized and explained that as the result City Manager Callinan Leaves Page, 7 July 9., 1979 of comments received at the April 9, 1979 hearing, additional studies and information was provided in the EIR. He explained that many responses to comments made at the hearing were al- ready contained in the EIR, but in fragmented form, therefore, the EIR's format had been revamped to make it more organized. Repetitive comments were responded to in summary form as allowed by CEQA guidelines. He stated that the extensive peak hour distance and time travel studies for Railroad Avenue, East Cotati Avenue and Snyder Lane, provided very important modifications to the EIR. In particular major differences were found in the morning and evening peak hour traffic patterns. City Manager Callinan left the Council Chambers at approximately 8:30 P.M. Mr. Davis noted that there was insufficient sewer treatment capacity for development of the entire project at this time. He advised that comments regarding the City's growth manage - ment program were included in the EIR and because he found major differences of opinion between police service experts in Cotati and Rohnert Park full statements by each party were included in the EIR. Mr. Davis read a letter received July 9, 1979 from Marthe Osborne Norwick relating her concern that the EIR did not adequately address the long term impact of the project on 1).agricultural land and 2) open space. Mr. Davis cited various sections of the EIR which he felt adequately addressed Mrs Norwick's concerns and recommended that her comments be overridden. Mayor Roberts indicated that he would recognize anyone in the audience who desired to address the Council concerning the EIR although the matter had not been scheduled for a public hearing. City Manager Callinan City Manager Callinan returned to the Council Chambers at Returns approximately 8:36 p.m. Alan Stansbury, member of the Cotati City Council, was rec- ognized and indicated that the entire Cotati City Council was present, except Councilman Jordan and Mayor Davis who were out of town. Councilman Stansbury expressed interest in the amounts of sewer capacity mentioned in the EIR because of the sewer con- tract which had been provided to Rohnert Park in March and which they had not yet received back. He explained that his city hoped,that there would be a guaranteed sewer capacity and informed that Cotati's staff also felt that the revised traffic volumes for East Cotati Avenue were not adequate. In concluding his comments, he requested that the data con - tained in the EIR be updated as each unit of the project is developed in order to make sure that the mitigative measures are watched. Page 8 July 9, 1979 Jan Marks, 460 Eucalyptus Avenue , was recognized and explained that she had many concerns about the proposed development. In particular she felt that police services would suffer, traffic figures would have to be revised and that roadways are not adequate for the type of.development. She was concerned that the Qantas project only had access off East Cotati Avenue and Railroad Avenue and that traffic would become bogged at Old Redwood Highway and Railroad Avenue resulting in additional traffic on Willow and Eucalyptus Avenues, John Formasi, resident of Willow Avenue, was recognized and expressed that lie was concerned about traffic on Railroad Avenue. Mr. Formasi informed that he makes a pick -up and gets back onto the roadway at Railroad Avenue and he noticed a traffic problem at this time. In addition, he hadn't heard any mention about water. He asked if the City planned on using well water, if there would be any guarantee that the homeowners' wells wouldn't dry up and briefly commented on his experience with a well in Petaluma. Mr. John Kline, 8886 Lancaster Drive, was recognized and commented that at the last Council meeting there was talk about drainage under the railroad tracks. He had contacted the engineering department and found that nothing had been approved concerning drainage, therefore, he felt that all the steps hadn't been looked into. He also inquired how the amount of traffic could be determined for the roadway connecting to Railroad Avenue if it hadn't been constructed yet. Mr. Davis was recognized and explained that a master drainage plan had been prepared by the Sonoma County Water Agency and that the Crater Agency had negotiated other drainage crossings with the Northwestern Pacific Railroad and this is what the EIR proposed. Mr. Kline also asked what the project's impact would be on the community of Penngrove. He felt that it may very well generate traffic through that area. Susan Reynolds, 514 Santa Alicia Drive, was recognized and stated that she didn't feel Mr. Davis had addressed her previously expressed concerns about using the project area for housing for Sonoma State University's needs. She pointed out that there was a current housing; crises at the university, one which it was doubtful the campus housing could fulfill. She informed that students were not able to obtain low income housing in this community and thus were forced to live elsewhere. Miss Reynolds felt that the EIR could address the sociological effect of the project and it's impact on Sonoma Grove next door. She 'informed that people are commuting long distances to attend S.S.U. She wanted to see approval held up until it was determined if the development would meet the sociological and housing needs of the community, the people who live and work here and the people who attend S.S.U. She informed that her data showed that there was approximately one child for every two people attending S.S.U. More than any other California campus. Page 9 July 9, 1979 Discussion followed between.Miss Reynolds and City Council members and during which City .Manager Callinan inquired if Miss Reynolds was representing S.S.U. or .herself and how the City could get a'copy of the housing study she had previously mentioned. Miss Reynolds informed that she was speaking on her own behalf although she was a member of the S.S.U. Student Housing Committee. She informed that she had prepared the housing study mentioned and that she didn't feel that the EIR had responded to the needs of the student community. Mr. Del Davis expressed that he felt the speaker had a valid comment, but that it was up to the Council how it wanted to limit its consideration of the project's impact. He thought that it might be appropriate to include these types of comments in the Housing Element of the City's General Plan. Adrian Swenson, 897 West Railroad Avenue, was recognized and reminded that she had made comments at the hearing concern- ing West And East Railroad and Willow Avenues and that it was her opinion that these issues were not adequately answered by the EIR. She noted that the EIR estimated that approximately 50 vehicles would use the West Railroad off ramp, but that there was no indication of how that figure was arrived at and, in addition, the EIR commented that the project would take place over a period of years, but that the law required that it address the cumulative impacts of the project and provide mitigative measures in the EIR document. She said she couldn't find any mitigative measures in the EIR. Mrs. Swenson informed that there had been a considerable down zoning of the land uses in the area of west Railroad Avenue as the result of a recently completed land use study. The people had preferred to maintain a rural atmosphere and were concerned about the impact of traffic. She also noted that there were no pathways for pedestrians, bicyclists or horseback riders and inquired who would pay for these installations. Mr. Tom Elliott, 367 Eucalyptus Avenue, was recognized and cautioned that any project which was started without an adequate foundation may never be completed and that the residents in the area would have to live with the consequences. He informed that the roadway on the west side of Railroad Avenue were deteriorating and that additional traffic would only contribute to this deterioration. He commented that with passage of Proposition 13 many more years may pass before . the roadway would be repaired and there was also the problem of flooding and runoff water and traffic using Fern, Willow and Eucalyptus Avenues for shortcuts thereby endangering children and pedestrians walking along the roadway. Page 10 July 9, 1979 Charles Kitchen, 4457 Hollingsworth Circle, was recognized and expressed his opposition to the project. Ile felt that Rohnert Park was adequately providing for low income housing and that the project was an example of private enterprise gone crazy. He felt that if we continued along the present growth and building trends that we should rename the city, "condo city". Mr. Davis responded to comments made by the various individuals. Resolution No. 79-136 A RESOLUTION OF THE ROHNERT PARK CITY COUNCIL U APPROVING THE ENVIRONMENTAL IMPACT REPORT FOR THE PROPOSED QANTAS DEVELOP- MENT WITH THE MITIGATION MEASURES PROPOSED AND DIRECTING THE ROHNERT PARK CITY MANAGER TO FILE A NOTICE OF DETERMINATION City'Manager Callinan explained the resolution. Upon motion of Councilman Hopkins, seconded by Councilman Carbone, and unanimously approved by the following roll call vote, reading of Resolution No. 79-136 was waived and said resolution was adopted. AYES: (4) Councilmen Carbone, Hopkins, Stewart and Roberts NOES: (0) None ABSENT: (1) Councilman Beary Recess Mayor Roberts declared a recess at approximately 9:30 p.m. Reconvene Mayor Roberts reconvened the meeting at approximately 9:42 p.m. Deannexation Councilman Hopkins made a motion, which was seconded by Councilman Carbone, and which was approved by the following voice vote, directing staff to write a letter, over the Mayor's signature, to the City of Cotati and Cotati residents f they would deannex from along East Cotati Avenue asking i the City of Cotati and annex to Rohnert Park.. (3) Co-unc-1-Imen Carbone., Hopkins and Roberts NOES: (1) Councilman Stewart ABSENT: (1) Councilman Beary Earl Willow, Bus City Manager Callinan reviewed his July 5, 1979 memo to Service Application the Council concerning the application of Mr. Earl Willow for a Certificate of Public Convenience and Necessity to operate a bus service. Mayor Roberts opened the public hearing on the application of Earl Willow for a Certificate of Public Convenience and Necessity. City Manager Callinan read a letter dated July 69 1979 from Mr. Willow and a letter dated July 5. 1979 from Mr. Earl Bailey, operator of the Rohnert Park/Cotati Yellow Cab Co. Page 11 July 9, 1979 Mr. Earl Willow was recognized and informed that he had worked out a rate schedule and plans for providing a comprehensive bus system in Rohnert Park, Cotati. and Penngrove as well as the outlying areas. He explained that his business associates desired to have a Certificate of Public Convenience and Necessity so,that a feasibility study could be undertaken. He estimated that it would take 3--6 months to get the system oft the .ground,. Mr. Earl Bailey, Rohnert Park - Cotati Yellow Cab Co., was recognized and commented that he didn't know of any intra- city bus system.;n the U.S. that wasn't tax subsidized. He informed that he was presently applying for transportation monies so that he,could offer a 50� taxi cab fare in the Rohnert Park area and that the taxi cab company couldn't afford to lose.any customers because it just now is operating on a paying basis. He didn't believe Rohnert Park was ready for the type of service proposed by Mr. Willow. He asked that.the City Council,put off the matter for six months to allow him time to investigate a subsidized taxi cab service. There ,being no one further desiring to be heard and no other communications received, Mayor Roberts closed the public hearing. Discussion followed, Upon motion of Councilman Hopkins, seconded by Councilman Carbone, and unanimously approved, the City Council went on record as approving in concept Mr. Willow's proposed bus service in Rohnert Park and indicated that it would withhold approval of a Certificate of Public Convenience and Necessity pending receipt of additional information .and clarification of certain details. Councilman Stewart Councilman Stewart left the Council Chambers at approximately Leaves 10:16 p.m. Resolution No. 79 -137 RESOLUTION APPROVING AN ADOPTING A BUDGET FOR THE CITY OF ROHNERT PARK FOR THE FISCAL YEAR 1979 -80 City Manager Callinan advised that the public had been made aware of the budget hearing by publication of legal notice, direct mailings and by several fine stories done on the proposed budget by the press. Mayor Roberts opened the public hearing on the City's 1979- 80 Proposed Budget and Federal General Revenue Sharing Funds. There being no one desiring; to be heard and no communications received, Mayor Roberts closed the hearing. City Manager Callinan explained the resolution. Upon motion of Councilman Hopkins, seconded by Councilman Carbone, and unanimously approved, reading of Resolution No. 79 --137 was waived and said resolution was adopted. Resolution No. 79 -138 A RESOLUTION ORDERING REDUCTION Of ASSESSMENTS (Laguna Verde Assessment District, Project No. 1979 -10) City Manager Callinan explained the resolution. Upon motion of Councilman Carbone, seconded by Councilman Hopkins, and approved by the following roll call vote, read- ing of Resolution No. 79 -138 was waived and said resolution was adopted.
