1979/07/23 City Council MinutesROHNERT PARK CITY COUNCIL MINUTES July 23, 1979 The Council of the City of Rohnert Park met this date in regular session commencing at 7:00 p.m. in the -City. Offices, 6750 Commerce Boulevard, Rohnert Park, with Mayor 'Roberts presiding. Call to Order Mayor Roberts called the meeting of the regular session to order at approximately 7:02 p.m. and ,led the pledge of alle- giance, Roll Call'' Present: (4) Councilmen Beary, Carbone, Hopkins and Roberts Absenti' (1) Councilman Stewart Staff.present for all or part of the meeting: City Manager Callinan and City Attorney Flitner (whose time of arrival is specifically noted` these minutes). Councilman Stewart's. City ,Manager Callinan informed that Councilman Stewart had Baby given birth to a 7 lb. 14 oz.,girl. at 11:30 a.m. this morning. Approval of Minutes _ _Upon motion of Councilman Carbone, seconded by Councilman Hopkins, and unanimously approved'with Councilman Beary abstaining, the minutes of July 9, 1979 were approved as submitted. Approval of,Bills City Manager Callinan requested that Progress Payment No. 1, in the amount of $217,068.34, for Project No. 1977 -4, Transport Avenue Extension, and Project No. 1978 -19, Rohnert Park Expressway Widening, for Don Dowd Co. and $26,120.10 for police vehicles purchased from Zumwalt Chrysler Plymouth be added to the bills for approval. Upon a motion duly made and seconded, the bills presented per the attached list in the amount of $663,173.88, including the bill received from Don Dowd Co. in the amount of $217,068.34 and Zumwalt Chrysler Plymouth in the amount of $26,120.10, were approved. C O N S E N T C A L E N D A R City Manager Callinan referred the Council to his Council meet - ing memo dated July 17, 1979 for explanation of all the matters on the Consent Calendar. Mr. Callinari informed that Deer Meadow Village Unit No. 2 and Rancho Sonoma Unit No. 1 should not have been listed for final map approval but rather for resolutions accepting public improvements and releasing security. Upon,motion of Councilman Carbone, seconded by Councilman Hopkins, and unanimously approved, reading of Resolution Nos. 79139 through 79-144 was waived and said resolutions were adopted and the.final maps for Colegio Vista Subdivision No. 5B and Laguna Verde Industrial Subdivision were approved. * * * * * ft * * *'- * * * * * I * * * 11i * * * * * * * * * * * * * Resolution No. 79-145 RESOLUTION CONFIRMING AMENDED ASSESSMENT (Project No. 1956-1, Assessment No., City Manager Callinan reviewed,bis memo dated July 17, 1979. Mayor Roberts opened the scheduled public hearing on Project No. 1956-1, Amended Assessment No. 6.52.1.11.1-1. There being no one I desiring to be beard and no - written communica- tions received, Mayor Roberts I closed the public hearing. Upon motion of Councilman Hopkins, seconded by Councilman Carbone, and unanimously approved, reading of Resolution No. 79-145 was waived and said resolution was adopted. Page 3 July 23, 1979 City Attorney Arrives. City Attorney Flitner arrived at this point in the meeting, the; time being approximatley 7:13 p.m. Project No. 1979 -5, City Manager Callinan reviewed his July 17, 1979 memo to Classic Court Assess- the Council on this project which is for the development ment District of Classic Industrial Subdivision No. 2 north of Executive Avenue, off Transport Avenue (State Farm Drive), as shown on the Assessment Diagram which was displayed. Mr; Callinan reviewed the construction bids with the Council and.explained that the bids were higher than the Engineer's estimate and that a $10,000 contingency could be provided for the project by eliminating two items, namely l) 283 feet of 6" water main and 2) street trees: Discussion. followed. Resolution No. 79 -146 RESOLUTION AWARDING SALE OF-BONDS.(Classic Court Assessment District, Project No. 1979 -5) "'City Manager Callinan explained the resolution. Upon motion of Councilman Hopkins, seconded by Councilman Carbone, and unanimously approved with Councilman Beary abstain - ing, reading of Resolution No. 79 -146 was waived and said resolution was adopted. Resolution No. 79 -147 RESOLUTION.OF AWARD OF CONTRACT (Classic Court Assessment District, Project No. :1979 -5) Resolution No. City Manager Callinan explained the resolution. Upon motion of Councilman Hopkins, seconded by Councilman Carbone, and unanimously approved with Councilman Beary abstaining, reading of Resolution No. 79 -147 was waived and said resolution was adopted subject to the condition that the contractor, Maggiora and Ghilotti, execute a,change order deleting the items described by City Manager Callinan prior to the Mayor executing the contract. 79 -148 RESOLUTION DIRECTING MAILING AND PUBLISHING OF NOTICE TO PAY ASSESSMENTS (Classic Court Assessment District, Project No. 1979 -5) City Manager Callinan explained the resolution. Upon motion of Councilman Hopkins, seconded by Councilman Carbone, and unanimously approved with Councilman . Beary .abstaining, reading of Resolution No. 79 -148 was waived and said resolution was adopted., Resolution No. 79 --149 RESOLUTION DIRECTING MAILING AND PUBLISHING OF NOTICE TO PAY ASSESSMENTS.(Laguna:Verde Assessment District, Project No. 1979-10) City Manager Callinan explained the'resolution. Upon motion of Councilman Carbone, seconded by Councilman Hopkins, and unanimously approved, reading of Resolution No. 79-149 was waived and said resolution was adopted. Page 4 duly 23, 1979 Presentation to Mayor Roberts presented Tina Helgren, former Parks and Recrea= Tina Helgren tion Commissioner., with a framed resolution expressing apprecia- tion. Irene Greer Resignation from Cultural Arts Cori►. Garbage Collection Fees Mrs. Helgren- Riepenhoff thanked the Mayor and Council members. City Manager Callinan'.nformed that copies of a letter from Mrs. Greer resigning from-the Cultural Arts Commission had -been distributed to each < Council . member and asked how the vacancy should be filled. Discussion followed. The Council indicated.-that the matter should be placed on its August 13, 1979 meeting agenda in order to fill the vacancy. City Manager Callinan informed that copies of a letter from Attorney Maxwell representing Rohnert Park Disposal Co., had been distributed to each Council member and requested that Council consideration of this matter be postponed. Discussion followed.. The Council indicated that the matter should be placed on its August 13, 1979 meeting agenda. Communications Communications per the attached outline were brought to the attention of the City Council., No..action was taken on any communication except as specifically noted in these minutes. City Manager's Report City Manager Callinan referred the Council to his Council meeting memo dated July 17, 1979 to the City Council for explanation of all matters on the City Manager's Report sec - Lion of the agenda. Fran Murphey- City Manager Callinan informed that Frances Murphey had Resignation from submitted a letter of resignation from the Parks and Recreation Parks 9 Rec. Com. Commission because she had been hired by the Department of Public. Safety as a Dispatcher -Clerk and asked how the Council desired to fill.the vacancy on the Commission. Discussion followed® The Council directed that a letter be sent to those individuals who had previously expressed an .interest in serving on the Parks and Recreation Commission to determine if they were still interested in an appointment to that body. Laiks Lawsuit City Manager Callinan informed that a summons for a lawsuit had been filed against the City: of Rohnert Park for alleged damages resulting from the false arrest of Michael Laiks. mayors, & Councilmen's City Manager Callinan informed that the September 20, 1979 Assn. Meeting Mayors' and Councilmen's Association of Sonoma County meeting would be hosted by Rohnert Park at the new Community Center. M.T.C. Meeting City Manager Callinan informed that Assemblyman Filante would be making a presentation.to the Metropolitan_ Transportation Commission on July 25, 1979 concerning special districts and financing of proaects`at which time he will also bring up widening of South Santa Rosa Avenue (Redwood Drive). Anyone interested in attending the meeting was welcomed to do so. Page 5 July 23, 1979 Resolution No. 79 -150 RESOLUTION DIRECTING MAKING OF AMENDED ASSESSMENT RE CERTAIN ASSESSMENTS UNDER RESOLUTION OF INTENTION NO. 7 (Project No. 1956 --1, Assessment No. 6.904.1.16) City Manager Callinan explained the resolution and informed that it had been received after the preparation of the agenda. Upon motion of Councilman Hopkins, seconded by Councilman Carbone, and unanimously approved, reading of Resolution No. 79 -150 was waived and said resolution was adopted. Resolution No. 79 -151 RESOLUTION AUTHORIZING ACQUISITION OF PHOTOCOPY MACHINE BY LEASE PURCHASE City Manager Callinan explained the resolution. Upon motion of Councilman Carbone, seconded by,Councilman Hopkins, and unanimously approved, reading of Resolution No. 79 -151 was waived and said resolution was adopted. Resolution No. 79 -152 RESOLUTION OF BEST WISHES TO FRANK "ANDY" ANDERSON City Manager Callinan explained the resolution. Upon motion of Councilman Hopkins, seconded by Councilman Carbone, and unanimously approved, reading of Resolution No. 79 -152 was waived and said resolution was adopted. R.P.Expressway Name Mayor Roberts informed that someone had commented to him that technically Rohnert Park Expressway was not an express- way and, therefore, it might be wise to change the name. He asked the other Council members to reflect on the matter. City Attorney's Report -City Attorney Flitner commented on various lawsuits in which public safety officers' personnel files were subpoenaed to determine if the officer had a history of harassing individuals and his attempts to keep the personnel files out of any criminal action. Redwood Empire Div. Councilman Hopkins informed that the Redwood Empire Division League of CA Cities League of California Cities meeting in April 1980 would be held in Rohnert Park. BAAPCD Mayor Roberts informed that any Council member interested in being appointed to the Bay Area Air Pollution Control District Board should contact either the Mayors' and Council- men's Association or himself. Library Mayor Roberts initiated a discussion concerning the financial status of the County's library system and the possibility of cities having to pay for library services. Newspaper Article Mayor Roberts stated for the record that he had not been involved in any altercation with the Mayor of Cotati at Rohnert Park /Cotati Day at the Sonoma County Fair and in fact, had not even seen Mr. Stansbury, as was reported by newspaper columnist Gaye LeBaron. Mr. Hal Janney re. Golf Course Sonoma Villas Condominiums Resolution No. 79-153 Adjournment Apppovrn! Mayor r4�Roberts Page 6 1 July 23, 1979 Mr. Hal Janney, 4701'Flores Drive, was recognized and commented on a meeting between homeowners and a representative of California Golf-Tennis wherein they were informed of new golf rates and policy for mandatory golf carts. Discussion followed between Mr. Janney and Council members and during which it was noted that a proposal for rate changes and/or policy concerning mandatory golf carts had not yet been presented to the Council for its consideration. rA gentleman representing Carsten Mikkelsen, owner of 101 Avram Avenue, was recognized and informed that he was under the impression that a resolution would be on the Council's agenda accepting the public improvements and releasing security for Sonoma Villas condominiums on Avram Avenue. Discussion followed between staff., Council members and the unidentified gentleman. - RESOLUTION ACCEPTING PUBLIC 'IMPROVEMENTS AND AUTHORIZING RELEASE OF SECURITY FOR SONOMA VILL&TOWNHOUSES City Manager Callinan explained the resolution and said that if this matter had not been listed on the agenda due to an error on staff's part, he would appropriately handle the matter. Upon motion of Councilman Hopkins,, seconded by Councilman Carbone, and approved by the following vote, reading of Resolu- tion No. 79-153 was waived and said resolution was adopted by title.
